The Holy See and the United Nations Briefing paper The Vatican’s latest five-year silence on sexual abuse of children in the Catholic church In 2014 the United Nations scrutinised the children’s rights record of the Holy See, the sovereign State headed by the Pope, and issued a raft of recommendations to improve the State’s compliance with international human rights law. Five years on, research shows that Vatican authorities have not only failed to bring into effect the UN’s recommendations, but in some cases actively undermined progress for children’s rights. Back in 2014, the UN had primarily questioned the Holy See on the global scale of sexual abuse against children and its cover-up by individuals working under the authority of the Catholic church. The Committee on the Rights of the Child (CRC)1 and the Committee against Torture (CAT)2 each issued a series of recommendations addressing access to justice for the countless victims around the world, as well as calling for reform in the church’s internal procedures, which govern abuse prevention and child safeguarding, transparency in reporting, and accountability for abusers. States have to report back every five years with an update on how they have sought to improve their human rights record, but the Holy See did not submit the required information ahead of time, therefore its five-year review will not take place this year. While being tardy in reporting to the UN is not uncommon, this is not the Holy See’s first time, as for its 2014 review the State submitted the relevant documentation 14 years late. -

Indeed, Our Predecessors already provided for the sanctity of the sacraments, especially penance, through appropriate Apostolic Constitutions such as the Constitution Sacramentum Poenitentiae, of Pope Benedict XIV, issued June 1, 1741;[1] the same goal was likewise pursued by a number of canons of the Codex Iuris Canonici, promulgated in 1917 with their fontes by which canonical sanctions had been established against delicts of this kind.[2] In more recent times, in order to avert these and connected delicts, the Supreme Sacred Congregation of the Holy Office, through the Instruction Crimen sollicitationis, addressed to all Patriarchs, Archbishops, Bishops, and other local Ordinaries “even of an Oriental Rite” on March 16, 1962, established a manner of proceeding in such cases, inasmuch as judicial competence had been attributed exclusively to it, which competence could be exercised either administratively or through a judicial process. CANON LAW ON CHILD SEXUAL ABUSE THROUGH THE AGES Kieran Tapsell1 In 2014 two senior members of the Marist and Christian Brothers in Australia told Justice McLellan, the Chair of the Child Sexual Abuse Royal Commission that in the 1980s the brothers would not have regarded touching a student’s genitals as a crime but only a “moral failure”.2 McLellan asked Br Shanahan. Q. Can you explain how the Orders would have brought themselves intellectually to that position, describing it only as a moral failure and not a criminal offence? How would they have arrived at that position? 3 A. No, I can't explain it. This paper is an attempt to explain it: how bishops, priests and religious all over the world came to regard the sexual abuse of children, not as crimes punishable by the State, but as moral failures that should be dealt with by treatment, and by dismissal from the priesthood or religious life only as a last resort.4 The explanation lies in a gradual but radical change of culture within the Catholic Church that took place in the latter part of the 19th century that can be traced through changes in canon law. The Concepts of “Canon Law” and “Child Sexual Abuse” The title of this paper, Canon Law on Sexual Abuse through the Ages, is in some senses anachronistic. Alternative Report To the United Nations Committee on the Rights of the Child Regarding the Periodic Reports of the Holy See Due on 1 September 2017 5 September 2017 I. Introduction and Overview The Survivors Network of those Abused by Priests (“SNAP”) and the Center for Constitutional Rights, collectively the “Reporting Organizations,” submit the information herein for the Committee’s consideration of the Holy See’s third through sixth periodic reports that were due on 1 September 2017.1 As the Holy See did not submit its reports,2 the Reporting Organizations take this opportunity to call the Committee’s attention to several developments since its last review of the Holy See in 2014, in particular with respect to its Concluding Observations Nos. 8, 13-14, 19-20, 29-30, 43-44, and 60-61.3 Following the review of the Holy See in January 2014, the Committee issued a number of observations and recommendations about the Holy See’s handling of pervasive and systemic sexual violence against children within the Roman Catholic Church. In particular, this Committee observed that “in dealing with allegations of child sexual abuse, the Holy See has consistently placed the preservation of the reputation of the Church and the protection of the perpetrators above the child’s best interests…”4 The Reporting Organizations are deeply concerned that the Holy See has not implemented any of the Committee’s recommendations over the past three years, and does not appear to have genuinely attempted to do so. In fact, in a number of respects, the Holy See has continued to do the exact opposite of what the Committee recommended. -

The Catholic Church and Child Sexual Abuse: It’s Time to Come Clean Kieran Tapsell Historically, the Church’s canon law for 1500 years reflected a serious and consistent attitude to child sexual abuse. It was always a sin, but by the 4th century the Church started to regard it as a crime punishable in this life. The first Church law against the sexual abuse of boys was passed at the Council of Elvira in 306CE. 1 St. Basil of Caesarea, the fourth century Church Father, (330-379CE) and the main author of the monastic rule of the Eastern Church, instructed that a cleric or monk who sexually molests youths or boys is to be publically whipped, his head shaved, spat upon, kept in prison for six months in chains on a diet of bread and water, and after release is to be always subject to supervision and kept out of contact with young people. 2 Leaving out such antiquated punishments as whipping, spitting and head shaving, St. Basil seems remarkably modern in his demand for imprisonment, and for his understanding that sex abusers are often recidivists, and some form of restriction and supervision is needed. For the next seven or eight centuries, there was little separation between Church and State, but the Church still regarded the sex abuse of children as deserving more punishment than simply dismissing priests from the priesthood. In the 12th century Church and State started drifting apart, and that is when we see a series of papal and Council decrees requiring clergy guilty of serious crimes to be stripped of their status as priests and handed over to the civil authority for punishment. -

The Catholic Church and Child Sexual Abuse: It’s Time to Come Clean Kieran Tapsell Introduction This is a speech given by Kieran Tapsell, the author of Potiphar’s Wife: The Vatican Secret and Child Sexual Abuse (ATF Press 2014) to a meeting at the Pumphouse Hotel, Melbourne, Australia, organised by Catholics for Renewal and Catalyst for Renewal on 29 October 2014. The organisers invited the Rev. Professor Ian Waters, an Australian canon lawyer to respond. Kieran is a former seminarian from the 1960s who became an Australian attorney. On his retirement in 2004, he became intrigued by the case of one of his seminary professors who had become a bishop and who refused to give to the police a report by a canon lawyer into child sexual abuse by a group of priests in his diocese. The police issued a search warrant and his presbytery was searched. The priests were duly convicted and imprisoned. Kieran suspected that the reason this bishop – a good and honourable man – would have refused to hand over this report was because he felt restrained from doing so. This led to Kieran’s returning to the study of canon law and the eventual publication of his book, Potiphar’s Wife: The Vatican Secret and Child Sexual Abuse (ATF Press 2014). At the time of the publication of the book, the Australian Government had established a major investigation into child sexual abuse in institutions in Australia through a Royal Commission headed by Justice Peter McLellan. The Australian Church has made detailed submissions to the Royal Commission, but not once has it referred to the effect of the pontifical secret imposed by canon law since 1922 on allegations of child sexual abuse by clergy.
