In February, Francis alluded to raising the age limit for minors, saying in his closing speech for a Feb. 21-24 summit on child protection, “We now consider that this age limit should be raised in order to expand the protection of minors and to bring out the gravity of these deeds.” Already in July 2013, Francis promulgated a law in Vatican City on child pornography with the language, “[E]very human being below the age of eighteen years.” During that February summit, the so-called “pontifical secret” also took a beating, with several heavyweights in the Francis papacy criticizing it, including Cardinal Reinhard Marx of Germany, a member of the pope’s “C9” council of cardinal advisers, and Cardinal Blase Cupich of Chicago, essentially the pope’s go-to man in the United States, as well as other prelates. Jan 1, 2020 Canon lawyers and other experts, however, have often argued that there are legitimate reasons in abuse cases to maintain a degree of “secrecy,” or confidentiality, allowing witnesses to speak freely and priests to protect their good name until guilt is proven. However, under Francis’s new changes, dated Dec. 4, the pontifical secret has all but been eliminated in certain instances, effectively taking away an excuse not to cooperate with civil justice. The new norms also address so-called “office secrets,” meaning ordinary confidentiality. https://cruxnow.com/vatican/2019/12/pope-abolishes-pontifical-secret-in-abuse-cases-raises-age-for-child-porn/ 3/6 1/1/2020 Pope abolishes 'pontifical secret' in abuse cases, raises age for child porn “Office confidentiality shall not prevent the fulfilment of the obligations laid down in all places by civil laws, including any reporting obligations, and the execution of enforceable requests of civil judicial authorities,” they say. All parties involved, including the person who files the report, the person who alleges to have been harmed and the witnesses, it adds, “shall not be bound by any obligation of silence with regard to matters involving the case.” In a statement, Bishop Juan Ignacio Arrieta, secretary for the Pontifical Council for Legislative Texts, insisted that while pontifical secrecy has been loosened, confidentiality has not been thrown out the window. “The fact that awareness of these criminal actions is no longer bound by the ‘pontifical secret’ doesn’t mean they’re cleared for publicity at will on the part of those possessing such awareness, which, in addition to being immoral, would injure the right to one’s good name,” he said, adding that those who are informed of the situation or involved in the investigation in some way “are obligated ‘to guarantee security, integrity and reserve,’ and to share information with third parties not involved in the case.” Dalla Torre said “the reasons which in the past led to including the gravest offenses against morals … among the materials subject to the pontifical secret are giving way to goods which, today, are perceived as higher and worthy of particular care … above all, the primacy of the human person offended in his or her dignity, all the more so in cases of weakness, [young] age or a natural incapacity.” “When civil law establishes an obligation to report on the part of someone informed about the facts,” he said, “the reduction of the pontifical secret and the detail on the limits of the ‘office secret’ permit a ready fulfillment of the requirements of the law, thereby favoring full collaboration with civil authorities and preventing illegitimate incursions of the civil authority into the canonical sphere.” Veteran Italian journalist Andrea Tornielli, the Vatican’s editorial director, called Tuesday’s changes “a sign of openness, availability, transparency and cooperation with civil authorities.” Tornielli summed up the spirit of Francis’s changes this way: “The good of children and young people must always trump any consideration of secrecy, even that which is ‘pontifical.’” Maltese Archbishop Charles Scicluna, an expert canon lawyer and Francis’s go-to figure on the abuse scandals, called Tuesday’s moves “epochal.” “I remember that in the discussion at the summit in February, the pontifical secret was repeatedly spoken of almost as an impediment to the right information given to the victim and the communities,” Scicluna said. “In my opinion, this decision is epochal in the context of the juridical institution of the pontifical secret and it arrives at the right moment.” Follow Elise Harris on Twitter: @eharris_it https://cruxnow.com/vatican/2019/12/pope-abolishes-pontifical-secret-in-abuse-cases-raises-age-for-child-porn/ 4/6 1/1/2020 Pope abolishes 'pontifical secret' in abuse cases, raises age for child porn Crux is dedicated to smart, wired and independent reporting on the Vatican and worldwide Catholic Church. The Catholic Church in the Czech Republic Dear Readers, The publication on the Ro- man Catholic Church which you are holding in your hands may strike you as history that belongs in a museum. How- ever, if you leaf through it and look around our beauti- ful country, you may discover that it belongs to the present as well. Many changes have taken place. The history of the Church in this country is also the history of this nation. And the history of the nation, of the country’s inhabitants, always has been and still is the history of the Church. The Church’s mission is to serve mankind, and we want to fulfil Jesus’s call: “I did not come to be served but to serve.” The beautiful and unique pastoral constitution of Vatican Coun- cil II, the document “Joy and Hope” begins with the words: “The joys and the hopes, the grief and the anxieties of the men of this age, especially those who are poor or in any way afflicted, these are the joys and hopes, the grief and anxieties of the followers of Christ.” This is the task that hundreds of thousands of men and women in this country strive to carry out. According to expert statistical estimates, approximately three million Roman Catholics live in our country along with almost twenty thousand of our Eastern broth- ers and sisters in the Greek Catholic Church, with whom we are in full communion. There are an additional million Christians who belong to a variety of other Churches. Ecumenical cooperation, which was strengthened by decades of persecution and bullying of the Church, is flourishing remarkably in this country.

  • The Holy See and the United Nations Briefing Paper the Vatican’S Latest Five-Year Silence on Sexual Abuse of Children in the Catholic Church
The Holy See and the United Nations Briefing paper The Vatican’s latest five-year silence on sexual abuse of children in the Catholic church In 2014 the United Nations scrutinised the children’s rights record of the Holy See, the sovereign State headed by the Pope, and issued a raft of recommendations to improve the State’s compliance with international human rights law. Five years on, research shows that Vatican authorities have not only failed to bring into effect the UN’s recommendations, but in some cases actively undermined progress for children’s rights. Back in 2014, the UN had primarily questioned the Holy See on the global scale of sexual abuse against children and its cover-up by individuals working under the authority of the Catholic church. The Committee on the Rights of the Child (CRC)1 and the Committee against Torture (CAT)2 each issued a series of recommendations addressing access to justice for the countless victims around the world, as well as calling for reform in the church’s internal procedures, which govern abuse prevention and child safeguarding, transparency in reporting, and accountability for abusers. States have to report back every five years with an update on how they have sought to improve their human rights record, but the Holy See did not submit the required information ahead of time, therefore its five-year review will not take place this year. While being tardy in reporting to the UN is not uncommon, this is not the Holy See’s first time, as for its 2014 review the State submitted the relevant documentation 14 years late.

This set-aside time for prayer and reflection—after all the Church has been through in recent months—could provide both a healing balm and a needed boost forward, some say. Ash Wednesday, the start of Lent, is typically a big Catholic draw, filling churches with nearly Easter- or Christmas-size Mass crowds even though it is not a holy day of obligation. Conventual Franciscan Father Jude DeAngelo, director of campus ministry at The Catholic University of America in Washington, hopes this year is no exception. “We in the American Catholic Church have been through a year of tremendous suffering and tremendous upheaval and frustration,” he told Catholic News Service (CNS), referring to the past months of allegations of sexual misconduct and cover-up by Church leaders. Pope condemns ‘blind violence,’ offers prayers after Brussels attacks By Junno Arocho Esteves Catholic News Service VATICAN CITY – Assuring his prayers for the victims and families of the terrorist attack in Brussels, Pope Francis condemned the “cruel abominations” and prayed for the conversion of those who adhere to violent fundamentalism. “To all, I ask that you persevere in prayer and in asking the Lord in this Holy Week to comfort the hearts of the afflicted and to convert the hearts of those people taken in by cruel fundamentalism,” the pope said at the end of his weekly general audience in St. Peter’s Square March 23. Saying he followed the tragic news of the bombings with a “sorrowful heart,” the pope expressed his closeness to “the dear people of Belgium, to all the families of the victims and to all the wounded.” “I renew an appeal to all people of good will to unite in the unanimous condemnation of these cruel abominations that have caused only death, terror and horror,” he said. After his appeal, the pope led the people in the square in praying a “Hail Mary” for those affected by the terrorism, followed by a moment of silence for “the dead, the wounded, the families and for all the Belgian people.” Three nearly simultaneous attacks – two at the Brussels airport and one on the Brussels area of Maalbeek, near where much of the European Union is based – left at least 34 dead and more than 200 people injured.

25/09/2018 PRESS RELEASE 150a eng GERMAN BISHOPS‘ CONFERENCE Check against delivery! Statement of Cardinal Reinhard Marx, President of the German Bishops’ Conference, Press conference on the presentation of the Study “Sexual abuse of minors by Catholic priests, deacons and male members of orders in the domain of the German Bishops’ Conference” (MHG Study) on 25 September 2018 in Fulda The study on “Sexual abuse of minors by Catholic priests, deacons and male members of orders in the domain of the German Bishops’ Conference” makes it clear to us that the Catholic Church has by no means overcome the issue of dealing with the sexual abuse of minors. The study takes a deep look into the past. I say quite clearly: sexual abuse is a crime. Those who are guilty must be punished. For too long abuse has been denied and hushed up in the church. One simply looked away. I apologize for all failure and for all pain and suffering. I am ashamed because of the trust that has been destroyed; because of the crimes that have been committed by officials of the Church; and I feel shame, because many people have looked the other way and did not want to see what had happened and who did not care about the victims. This also applies to me. We have not listened to the victims. All this must not remain without consequences! Those affected are entitled to justice. Since 2010, we have committed ourselves in the German Bishops’ Conference Kaiserstraße 161 53113 Bonn and taken appropriate measures to make an unconditional orientation towards Postal address the victims our first priority and to prevent that more people become victims.
