Main results of the Council

The Council adopted a decision on the full application of the provisions of the Schengen acquis in the Czech Republic, Estonia, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia.

In the margins of the Council, Justice and Home Affairs Ministers and Employment Ministers met for a policy debate on migration, employment and the Lisbon Strategy.

In addition, the Council proceeded to a broad stocktaking on the state of the EU Counter-Terrorism Strategy implementation. It adopted strategic orientations and priority actions on the security of explosives and gave a new impetus to several strands of relevant work such as on critical infrastructure protection and the prevention of radicalization. It did also set guidelines for future work in new areas such as on addressing CBRN Risks and, specifically on Bio-Preparedness.

Furthermore, it adopted a joint declaration with the Council of Europe establishing a European Day against the Death Penalty.

Finally, the Council reached a general approach on a draft Framework Decision on the recognition and supervision of suspended sentences, alternative sanctions and conditional sentences.

MIGRATION, EMPLOYMENT AND LISBON STRATEGY

InthemarginsoftheCouncil,JusticeandHomeAffairsMinistersmetEmploymentMinistersfora policydebateonmigration,employmentandtheLisbonStrategy.

Thedebatefocusedontwomainsubjects:

– Labourmigration,integrationintothelabourmarketandthelinktotheLisbonStrategyfor GrowthandJobs,and

– Undeclaredworkandillegalemploymentasapullfactorforillegalimmigration.

Inthelightofthedebate,thePresidencyconcludedthat:

– thereisacloselinkbetweenmigration,employmentandtheLisbonStrategyforGrowthand Jobs.WellmanagedlegalmigrationcancontinuetocontributetotherealisationoftheLisbon Goalsandshouldbealignedwithskillsshortagesandlabourmarketrequirements;

– workshouldnowbetakenforwardontheproposedDirectivesontheadmissionofthirdcountry nationalsforthepurposeofhighlyqualifiedemploymentandonthesingleapplicationprocedure andacommonsetofrightsforlegallyresidingthirdcountryworkers;

– measurestopromoteintegrationareimportant,includingintheareaofskillsandeducationand employmentandsocialpolicies,asaretheeffortsofmigrantsthemselvestointegrate;

– combatingillegalemploymentofthirdcountrynationalsandundeclaredworkisequally importantanddissuasivesanctionsandeffectiveenforcementcancontributetothis.Workshould thereforealsobetakenforwardontheDirectiveonsanctionsagainstemployersofillegally stayingthirdcountrynationalsandonthefollowuptotheCommission'sCommunicationon undeclaredwork.

Background

Sincethe1990s,positivenetmigrationhasbecomethelargestcomponentofpopulationchangein mostMemberStates,reaching–overthelast5years–atotalofcloseto2millionnetmigrantsper annumacrosstheEU.

ImmigrationflowstowardsEuropearenotlikelytodiminishintheforeseeablefuture.Theoverall socioeconomiccontextoftheEUisincreasinglycharacterisedbyskillandlabourshortages (alreadynoticeableinanumberofsectors),competitionforthehighlyskilledinanevermore globalisingeconomyandacceleratingdemographicageingoftheEuropeanpopulation,resultingin justafewyearsintheshrinkingoftheEUworkforce.

Asafollowuptothe2005PolicyPlanonLegalMigration,theCommissionsubmittedtwo legislativeproposalson23October2007:aDirectiveontheconditionsofadmissiontotheEUfor highlyskilledworkersandaDirectiveontherightsoflegalimmigrantsinemployment.These proposalsareaimedrespectivelyatmakingtheEUattractiveforanincreasinglyneededcategoryof workersandatensuringthatallthirdcountryworkersenjoyacomparablelevelofrightsthroughout theEU.Thelatterproposalalsoprovidesforasingleapplicationprocedurewithaviewtoobtaining asinglepermitencompassingbotharesidenceandworkpermit.Threefurtherproposalswillbe submittedinautumn2008andwillcovertheadmissionofseasonalworkers,intracorporate transfereesandpaidtrainees.

TheCommissionalsosubmittedaproposalforaDirectiveprovidingforsanctionsagainst employersofillegallyresidentthirdcountynationalsinMay2007.Theaimistoensurethatall MemberStatesintroducesimilarpenaltiesforemployersofsuchthirdcountrynationalsand enforcethemeffectively.Itisproposedtorequireemployerstoundertakechecksbeforerecruitinga thirdcountrynationalandtorequireMemberStatestoconductaminimumnumberofinspections ofcompaniesestablishedineachMemberState.

MOBILITY PARTNERSHIPS AND CIRCULAR MIGRATION - Council conclusions

TheCounciladoptedthefollowingconclusions:

1. Initsconclusionsof1415December2006,theEuropeanCouncilagreedonstrengthening anddeepeninginternationalcooperationanddialoguewiththirdcountriesoforiginand transitinacomprehensiveandbalancedmanner.Inparticular,itstatedthatwhile respectingthecompetencesofMemberStatesinthisarea,considerationhadtobegivento howlegalmigrationopportunitiescanbeincorporatedintotheUnion'sexternalpolicies,in ordertodevelopabalancedpartnershipwiththirdcountriesadaptedtospecificEU MemberStates'labourmarketneeds.Inthiscontext,waysandmeanstofacilitatecircular andtemporarymigrationhadtobeexplored.

2. TheEuropeanCouncil,inthelightoftheCommissionCommunicationof16May2007 "OnCircularMigrationandMobilityPartnershipsbetweentheEuropeanUnionandthird countries"underlinedon2122June2007theimportanceofclosercooperationwiththird countriesinmanagingmigrationflows.

Itstatedthatspecificpartnershipsonmigrationwiththirdcountriescouldcontributetoa coherentmigrationpolicywhichcombinesmeasuresaimedatfacilitatingwellmanaged legalmigrationopportunitiesandtheirbenefitswhilerespectingMemberStates' competencesandthespecificneedsoftheirlabourmarketswiththosefightingillegal migration,protectingrefugeesandtacklingtherootcausesofmigrationwhileatthesame timeimpactingpositivelyondevelopmentincountriesoforigin.

3. Inthiscontext,theEuropeanCouncilendorsedtheCouncilconclusionsof18June2007in whichtheCouncilstatedthattheconceptofmobilitypartnershipsbetweentheEuropean Union,MemberStatesandthirdcountriescouldbetestedbywayofalimitednumberof pilotpartnerships.TheCouncilthereforeinvitedtheCommissiontoconsultMemberStates onthefurtherdevelopmentofthisconcept,including,inparticular,onthetermsof reference,andwithaviewtoexploratorytalkswithinterestedthirdcountriesonpilot partnershipsinclosecooperationwiththePresidencyandinterestedMemberStates.The CommissionwasinvitedtoreportbacktotheCouncilontheoutcomeofthese consultationsinordertoenabletheCounciltodecidebytheendof2007whethertoinvite theCommissiontolaunchpilotpartnerships.

4. TheCouncilalsoagreedthatlegalmigrationopportunities,includingwellmanaged circularmigrationcanpotentiallybenefitallpartnersinvolved.Allpossibilitiesforawell managedcircularmigrationshouldthereforebeexploredinclosecooperationwithall relevantstakeholderswithaviewtotheadoptionofCouncilConclusionsnotlaterthanthe endof2007.

5. TheCouncilrecallstheConclusionsoftheCouncilandtheRepresentativesofthe GovernmentsoftheMemberStatesmeetingwithintheCouncilonCoherencebetweenEU MigrationandDevelopmentPoliciesof2021November2007.

6. TheCouncilunderlinesthatmobilitypartnershipsshouldbebroad,tailormadeand balancedandshouldincludeelementsofmutualinterest,forexample,legalmigration,the fightagainstillegalmigration,migrationanddevelopmentincludingcircularmigration. TheCouncilalsorecallsthatmigrationtotheEUshouldbebasedontherespectforthe basicvaluesoftheEUanditsMemberStates.

7. Inviewoftheabove,theCouncilapprovesthefollowingconclusions:

A. Mobility Partnerships

8. TheCouncilunderlinestheimportanceofclosecooperationandpoliticaldialoguewith thirdcountriesinmanagingmigration,building,whereappropriate,onexisting frameworksandpossibilitiesforthepurposeoftakingforwardacomprehensiveapproach tomigration.TheCouncilconsidersthatmobilitypartnershipscouldrepresentanovel approachcapableofbringingaddedvalueinimplementingdifferentaspectsoftheGlobal ApproachtoMigration.TheCouncilrecallsthatthepurposeandparametersofsuch mobilitypartnershipsweresetoutinparagraph10oftheCouncilConclusionsof 18June2007"OnextendingandenhancingtheGlobalApproachtoMigration".The Councilstresses,however,thatthecontentsofindividualmobilitypartnershipsmayvary considerablyfromonecountrytoanother,reflectingthespecificcharacteristicsofeach situationandtherespectiveobjectives,prioritiesandsecurityconcernsofboththeEU,its MemberStatesandindividualthirdcountries.

9. TheCouncilnotesthatthepartiestoamobilitypartnershipwould,ontheEUside,include boththeEuropeanCommunityandMemberStateswillingtoparticipateinandcontribute toit.Mobilitypartnershipswouldthereforerepresentanoverallpoliticalframework,which takeintoaccountexistingobligationsandagreements,combining,asacounterparttothe commitmentstakenbythethirdcountry,inparticularinrelationtothefightagainstillegal immigration,elementswithinCommunitycompetenceandelementsfallingwithinthe competencesoftheMemberStates,asprovidedbytheTreaty.TheCouncilstressesthe factthatmobilitypartnershipswillneedtostrictlyrespectthedivisionofcompetences betweentheEUandtheMemberStates.

10. TheCouncilwelcomestheresultsofthepreliminarydiscussionsheldbetweenthe CommissionandMemberStatesontheaddedvalue,possiblecontentandstructuresof mobilitypartnerships.Onthebasisofthesediscussions,theCouncilinvitesthe Commission,incloseliaisonwithMemberStatesand/orthePresidency,inordertoensure acloseinvolvementoftheCouncil,toopendialoguewithCapeVerdeandMoldova,with aviewtolaunchingpilotmobilitypartnerships.

11. Exploratorydiscussionswillbetakenforwardwithanumberofotherinterestedthird countrieswithaviewtothepossibilityoflaunchingadditionalpilotmobilitypartnerships, inaccordancewithparagraph11oftheCouncilConclusionsof18June2007.Inthis respect,specialconsiderationwillbegiventothosethirdcountriesthathaveindicatedtheir willingnesstoopensuchdialogueandarewillingtoworkwiththeEUanditsMember Statesoneffectivemigrationmanagement.

12. TheCommissionisinvitedtoreportbacktotheCouncilonprogressnotlaterthanJune 2008.Thedevelopmentoffuturemobilitypartnershipsshouldtakeaccountofthe experiencegainedfromthepilotprojects.Onthebasisofthesefurtherexploratory discussions,theCouncilmayrequestthatdialoguebeopenedwithaviewtolaunching pilotmobilitypartnerships.

B. Circular Migration

13. TheCouncilwelcomestheworkundertakenbytheCommissiontoexplorepossibilitiesfor wellmanagedcircularmigrationinclosecooperationwithallrelevantstakeholders.

14. Circularmigrationcanbeusefulinpromotingthedevelopmentofcountriesoforiginor mitigatingtheadverseeffectofbraindrain.Infurtherdevelopingpoliciesandlaunching initiativestothisend,circularmigrationcouldbeunderstoodasthetemporary,legal movementofpeoplebetweenoneormoreMemberStatesandparticularthirdcountries, wherebythirdcountrynationalstakeuplegalemploymentopportunitiesintheEUor personslegallyresidingintheEUgototheircountryoforigin.Wherethismeetsthe identifiedlabourneedsofcountriesoforiginanddestination,thiscanbebeneficialtoall involvedandcancontributetocodevelopment.Thismayinclude,forexample,voluntary service,periodsofstudyortrainingintheEU,andexchangesofdifferentkinds.Well managed,incentivebasedmovementsbetweencountriesoforiginanddestinationcan fosterthepositiveeffectsofthecontributiontodevelopmentprovidedbymigrantsand membersofsettleddiasporawhentheyvisitorreturntotheircountryoforigin,ona temporarybasis.Safeguardswhichpreventoverstayingandensurereturnarekeyelements inorder,asarule,topreventtemporarystayfrombecomingpermanent.Circularmigration canbefacilitatedbyalegalframeworkthatpromotesmobilityandvoluntaryreturn.

15. Wherecircularmigrationisfacilitatedinordertomeetlabourmarketdemands,thisshould fullyrespecttheCommunityacquis,MemberStatescompetencesandtheprincipleof CommunitypreferenceforEUcitizens.HavingregardtotheconclusionsoftheCouncil andtheRepresentativesoftheGovernmentsoftheMemberStatesmeetingwithinthe CouncilonCoherencebetweenEUMigrationandDevelopmentPoliciesof20 21November2007,MemberStatesshould,inmanagingcircularmigration,havedue regardtothepossibleconsequencesoftheirpoliciesonthedevelopmentobjectivesof countriesoforiginandstrivetomaximisethedevelopmentimpactofsuchpolicies, particularlywithaviewtomitigatingbraindrain.

16. TheCouncil,onthebasisofthefirstdiscussionsontheconceptofcircularmigrationand itspossiblecontent,takesnoteofthefollowingpossibleelementswhichcouldbe addressedwhenfacilitatingcircularmigration:

(a) predepartureinformationonlabourmarketopportunities,languageandskills trainingandotherintegrationandaccompanyingmeasuresavailabletomigrants priortotheirarrivalintheEU;

(b) partnershipsbetweenlabourmarketagenciesofpartnercountriesandMemberStates tobettermatchsupplyanddemand;

(c) improvedmutualrecognitionofqualifications;

(d) studentexchangeprogrammes,includingcontinuationofscholarshipsforanumber ofyearsfollowingreturn;

(e) measurestoensureethicalrecruitmentandalsotoensurethat'braindrain'is mitigatedinsectorssufferingfromalackofhumanresources;

(f) adviceandassistanceonmanagingremittancesforenhanceddevelopmentbenefitsas wellasenhancingtheimpactofmigrantssavings/investmentsinthecountriesof origin;

(g) supporttoreturningresearcherstocontinuearesearchprojectintheirhomecountry;

(h) reintegrationsupporttothose,legallyresidingintheEU,wishingtoreturntotheir countriesoforiginwhichisaccessibleinthosecountries;

(i) measurestoensurereturnandreadmission,includingcommitmentsbyindividual migrantstoreturnandassistedvoluntaryreturn;

(j) anadequatelegalframeworktopromotecircularmigration.

TheCouncilunderlinesthattheseandfurtherelementsmustbediscussedbythecompetent Councilbodies.

17. TheCouncilrecallsthatbilateralprogrammesregardingcircularmigrationcouldalsoform partofthebroaderconceptofmobilitypartnershipsbetweentheEUandthirdcountries concerned.

18. TheCouncilinvitestheCommissiontotakethenecessarystepstofacilitatefinancial supportforthesettingupofcircularmigrationprojectsandprogrammeswithinthe existingfinancialframework.

19. TheCouncil,underliningtheneedtoestablishmechanismstomeetthechallengesofan increasinglyglobalisedlabourmarket,invitestheCommissionandMemberStatesto ensurethatCommunitylegislationonlegalmigrationdoesnotimpedecircularmigration.

20. TheCouncilinvitestheCommissiontoregularlyreportbacktoCouncil,withdueregardto MemberStatesandthirdcountriescompetences,aboutprojectsandnationallegislation thatfacilitatecircularmigration,withaviewtoidentifyinggoodpracticesandfurther developingpolicies."

IMPLEMENTATION OF THE EU COUNTER-TERRORISM STRATEGY

TheCouncilproceededtoabroadstocktakingonthestateoftheEUCounterTerrorismStrategy implementation.

Itadoptedstrategicorientationsandpriorityactionsonthesecurityofexplosives(15618/07 )and gaveanewimpetustoseveralstrandsofrelevantworksuchasoncriticalinfrastructureprotection (15522/07 )andthepreventionofradicalization( 15443/07 ).Itdidalsosetguidelinesforfuture workinnewareassuchasonaddressingCBRNRisksand,specificallyonBioPreparedness (15902/07 and 15127/07 ).

ThenewEUCounterTerrorismCoordinator,Mr.GillesdeKerchove,presentedhisfirstsetof reports

– ontheimplementationoftheEUCounterTerrorismstrategyandActionplantocombat terrorism( 15411/1/07 + ADD 1 REV 1 ),

– ontheEUstrategyforcombatingradicalisationandrecruitment( 15443/07 ),and

– onthemediacommunicationstrategy.

Inparticular,hedrewtheCouncil'sattentiontofivesubjects:

– informationsharingandspecialinvestigativemethods;

– radicalisationandrecruitment;

– financingoftechnicalassistancetothirdcountries;

– organisationofworkwithintheCouncil;and

– implementationofEUinstruments.

Background

TheEUCounterTerrorismStrategy,adoptedinDecember2005,groupsallEUactionsinthefield ofcounterterrorism,underfourheadingsPREVENT,PROTECT,PURSUE,RESPOND,withthe objectiveofsettingoutclearlywhattheEUistryingtoachieveandthemeansbywhichitintends todoso.

ThefirstobjectiveoftheCounterterrorismStrategyistopreventpeoplefromturningtoterrorism bytacklingthefactorsorrootcauseswhichcanleadtoradicalisationandrecruitment,inEurope andinternationally.Toattainthisobjective,inDecember2005theCounciladoptedaStrategyand anActionPlantocounterradicalisationandrecruitment(seeimplementationreportin 15443/07 ).

ThesecondobjectiveoftheCounterterrorismStrategyistoprotectcitizensandinfrastructureand reducevulnerabilitytoattacks,interaliathroughimprovedsecurityofborders,transportandcritical infrastructure.

ThethirdobjectiveoftheEuropeanstrategyagainstterrorismistopursueandinvestigateterrorists acrossEUbordersaswellasglobally;toimpedeplanning,travelandcommunications;todisrupt supportnetworks;tocutofffundingandaccesstoattackmaterialsandtobringterroriststojustice. TheCounterterrorismCoordinatorreportedseparatelyontheimplementationofthestrategy againstterroristfinancinginOctober2007( 11948/2/07 ).

ThefourthpriorityoftheEU'sCounterterrorismstrategyistopreparetheEU,inaspiritof solidarity,tomanageandminimizetheconsequencesofaterroristattack,byimprovingcapabilities todealwiththeaftermath,thecoordinationoftheresponse,andtheneedsofvictims.

EUROPOL

TheCouncil,pendingtheoverallissueofdecisionsproceduresandtheliftingofsome parliamentaryreservations,reachedageneralapproachonChaptersVI("Organisation"),VII ("ConfidentialityIssues")andIX("MiscellaneousProvisions")ofadraftCouncilDecision establishingtheEuropeanPoliceOffice.

On22December2006theCommissionsubmittedaproposaltotheCouncilforaCouncilDecision establishingtheEuropeanPoliceOffice(EUROPOL).ThisCouncilDecisionwillreplacethe EuropolConventionandwillconstitutearealimprovementoftheoperationalandadministrative functioningofEuropol.TheCouncilDecisionisexpectedtobefinalisedatthelatestbyJune2008.

TheCouncilalreadyreachedageneralapproachonChapterI("EstablishmentandTasks")atits meetinginJune2007,aswellasonChapterII(InformationProgressingSystems")andChapterIII ("CommonProvisionsonInformationProcessing")atitsmeetinginNovember2007.

Recallingthatsince1997therehasbeennoinstanceofcapitalexecutioninanypartofthe geographicalareamadeupbythe47MemberStatesoftheCouncilofEurope,includingthe27 EuropeanUnionMemberStates;

EmphasizingthatabolitionofthedeathpenaltyisaconditionwhichStatesarerequiredtomeetin ordertobecomemembersoftheCouncilofEuropeortheEuropeanUnion;

InvitingMemberStatesoftheCouncilofEuropeandtheEuropeanUniontocontinuetoexplainthe importanceofabolishingthedeathpenaltyinEuropefortherespectofhumandignity;

RecallingthecentralplaceheldintheEuropeansystemofhumanrightsbyProtocolsNos6and13 totheEuropeanConventiononHumanRightsandFundamentalFreedoms,whichrespectively abolishthedeathpenaltyinpeacetimeandinallcircumstances,andstressingtheimportanceof theirratificationbyalltheMemberStatesoftheCouncilofEurope;

RecallingtheimportanceoftheratificationandpromotionbytheMemberStatesoftheCouncilof EuropeandtheEuropeanUnionoftheSecondOptionalProtocoltotheInternationalCovenanton CivilandPoliticalRights,whichistheprincipaluniversalinstrumentaimedatabolishingthedeath penalty;

InvitingEuropeancitizenstosupporttheabolitionofthedeathpenaltyintheworldandthereby contributetothedevelopmentoffundamentalrightsandhumandignity;

Recognizingtheimportanceofthe "World Day against the Death Penalty" ,whichhastakenplace on10Octobereveryyearsince2003,andtostrengthenthisinitiativeofnongovernmental organizationsbytheinvolvementoftheEuropeanInstitutions:

TheEuropeanUnionandtheCouncilofEurope, approvetheestablishmentofthe"EuropeanDayagainsttheDeathPenalty"on10Octobereach year."

FRAMEWORK DECISION ON COMBATING TERRORISM

TheCouncilhadaninitialexchangeofviewsconcerningaproposalamendingtheFramework Decisiononcombatingterrorism.

TheobjectiveofthisproposalistoupdatetheexistingFrameworkDecisionwithaviewto includingpublicprovocationtocommitterroristoffences,recruitmentforterrorismandtrainingfor terrorism,e.g.throughtheintentionaldistributionofinformationonthemanufactureofexplosives andotherterroristweapons.

Itisimportanttoincludetheseoffences,alreadyaddressede.g.intheCouncilofEurope ConventiononthePreventionofTerrorism,intheFrameworkDecisionbecauseitprovidesthe advantagesofthemoreintegratedinstitutionalframeworkoftheEUandalsobecausethelegal regimeoftheFrameworkDecisioninrespectofthetypeandlevelofcriminalpenaltiesand compulsoryrulesonjurisdictionwillbeapplicabletotheseoffences.

Theproposalispartofabroad"terrorismpackage"whichincludesanActionplanonexplosives,a FrameworkDecisiononaEuropeanPNRandanevaluationreportontheFrameworkDecision.

ThePresidencyindicatedthat

– thetextstrucktherightbalancewithfundamentalrightsandfreedomssuchasfreedomof expression,assemblyorofassociationandtherighttorespectforfamilylife,

– thetextoftheFrameworkDecisionshouldbeagreedasregardsthecharges(Article3of theCommissionproposal)withtheobjectiveofavoidinganycontradictionwiththe CouncilofEuropeConvention,andwithoutjeopardisingtheprocessofratificationofthe CouncilofEuropeConvention,

– itshouldbemadeabsolutelyclearthattheprincipleofproportionalityappliedinthe implementationoftheFrameworkDecision;aparagraphshouldbeaddedtothepreamble similarincontenttoArticle12(2)oftheConvention,andthat

– inordertoenhancecooperation,especiallywithothercountries,memberstatesshouldseek toaccelerateproceduresforratificationoftheCouncilofEuropeConvention.

Inthelightofthedebate,thePresidencyconcludedthatdelegationsbroadlywelcomedthis Commissionproposal.

E-JUSTICE

TheCouncilhadanexchangeofviewsregarding"eJustice".

TheCouncilagreedinJune2007thatworkshouldbecarriedoutinthefieldofejusticewitha viewtocreatingadecentralisedEUejusticesystemgivingaccesstoexistingorfutureelectronic systemsatnationalorCommunitylevel.TheCouncildefinedcertainprioritiesforsuchwork.

TheCouncilstatedinitsconclusionsinJune2007thatworkshouldbecontinuedintheareaofe justicewithaviewtocreatingatEuropeanlevelatechnicalplatformgivingaccess,inthesphereof justice,toexistingorfutureelectronicsystemsatnational,Communityand,whereappropriate, internationallevelinsomeareas.

TheejusticeportalshouldprovideasinglepointofaccesstoEuropeanUnionandnationallaw.By integratingMemberStates'andEUinternetresources,theportalshouldofferaccesstolegal information,judicialandadministrativeauthorities,registers,databases,andotheravailableservices withtheaimoffacilitatingthedailytasksofcitizensandlegalprofessionalsinthecontextofthe Europeanjudicialarea.

TheCouncil: a) tooknoteoftheworkachievedduringthePortuguesePresidencyinthelightofthe conclusionsoftheCouncilinJune2007; b) notedthatworkonlistingmostoftheexistingprojectswasunderwayandwastobe completedbytheendofthefirsthalfof2008;

(ii) continuingthediscussionsonthecontentoftheportal;

(iii) creatingconditionsforcrossbordervideoconferencing;and

(iv) continuingtechnicalworkinaccordancewithparagraph8oftheCouncilconclusions ofJune2007.

TheWorkingPartyonLegalDataProcessing(ejustice)willsubmitareporttotheCouncilinJune 2008onprogressmadeintheareaofejustice.

CONTRACTUAL OBLIGATIONS (ROME I)

TheCouncilwelcomedafirstreadingagreementreachedwiththeEuropeanParliamentona proposalforaRegulationonthelawapplicabletocontractualobligations.

Thetextwillbeadoptedonceithasbeenrevisedbythelegal/linguisticexpertsofbothinstitutions.

ThepurposeofthisproposalistoreplacetheRomeConventiononthelawapplicabletocontractual obligationswithaRegulationandatthesametimetomodernise,whereappropriate.TheRegulation willapplyitsrulestocontractualobligationsincivilandcommercialmattersinsituationsinvolving aconflictof.

Theaimistoharmonisetheconflictoflawsrulesconcerningcontractualobligationswithinthe Community.Thisharmonisationshouldmakesurethateventhoughthesubstantivelawofthe MemberStatesisdifferent,allcourtsofaMemberStatewouldalwaysapplythesamelawbeit theirownorthatofanothercountrytothecontractinquestion.

Theproposalisbasedontheprincipleofpartyautonomy,i.e.inmostcasesthepartiesarefreeto choosethelawtogoverntheircontract.However,intheabsenceofchoice,theproposalsetsforth clearandpredictablerulestodeterminethelawapplicabletoacontract.Apartfromthegeneral regime,theproposalcontainsspecificconflictoflawrulesforparticularcasessuchasconsumer contracts,contractsofcarriage,individualemploymentcontracts.

Theproposalisanimportantstepforwardinordertocompletetheareaofjusticeandtoenhancethe principleofmutualrecognitionofjudgments.Numerousinformalmeetingshavebeenheldwiththe EuropeanParliamentwithaviewtoreachingafirstreadingagreementintheframeworkoftheco decisionprocedure.TheEuropeanParliamentadopteditsreporton29November2007.

EUROPEAN SUPERVISION ORDER IN PRE-TRIAL PROCEDURES BETWEEN MEMBER STATES

TheCounciltooknoteofinformationbythePresidencyontheworkontheproposalregardingthe EuropeansupervisionorderinpretrialproceduresbetweenmemberstatesoftheEU.

OnthebasisofthemandateprovidedbytheJusticeandHomeAffairsCouncilinSeptember,the PortuguesePresidency,afterconsultingtheCommissionandtheincomingSlovenianandFrench Presidencies,preparedarevisedtextoftheproposal.Thistextwillsoonbediscussedforafirsttime bytheCouncilpreparatorybodies.

TheEuropeansupervisionorderwillallowthesuspecttobenefitfromanoncustodialpretrial supervisionmeasureinanothermemberstatethanthatwherethecriminalproceedingsaretaking place.

RECOGNITION OF SUSPENDED SENTENCES, ALTERNATIVE SANCTIONS AND CONDITIONAL SENTENCES

TheCouncilreachedageneralapproachonadraftFrameworkDecisionontherecognitionand supervisionofsuspendedsentences,alternativesanctionsandconditionalsentences.

ThisGermanandFrenchinitiativeaimsatsettingrulesunderwhichaMemberState,otherthanthe MemberStateinwhichthepersonconcernedhasbeensentenced,supervisesprobationmeasures imposedonthebasisofajudgment,oralternativesanctionscontainedinsuchajudgment,andtakes unlessotherwiseprovidedallotherdecisionsrelatingtothatjudgmentand,whereapplicable,a probationdecision.

Basedontheprincipleofmutualrecognition,thedraftFrameworkDecisionaimsatfacilitatingthe socialreintegrationofsentencedpersons,improvingtheprotectionofvictimsandofthegeneral public,andfosteringtheapplicationofsuitableprobationmeasuresandalternativesanctionsinthe caseofoffenderswhodonotliveintheStateofconviction.

PortugalhaddesignatedtheworkonthedraftFrameworkDecisionasoneofthemainobjectivesof itsPresidencyinthefieldofjudicialcooperationincriminalmatters.

BuildingonthepreparatoryworkcarriedoutbytheGermanPresidency,thePortuguesePresidency, makingconsiderableefforts,wasabletoachieveageneralapproachontheFrameworkDecision withinonly11monthsfromthestartofnegotiations.

AttheCouncilsomeMemberStatesandtheCommissionregrettedtheconcessionsthathadtobe madeoncertainissues,suchasontheissueofdualcriminality,inordertoreachagreement.Itwas howevergenerallyacknowledgedthatthecurrentpackageconstitutedabalancedtextwhichwas carefullydraftedsoastoenableallMemberStatestoagreetothetext.

TheCouncilbodieswillbeinvitedtoexamineandfinalisetherecitals,aswellasthecertificateand theform.

Enlargement of the Schengen area to nine Member States

TheMixedCommitteewelcomedtheCouncil'sdecisiononthefullapplicationoftheprovisionsof theSchengenacquisintheCzechRepublic,Estonia,Latvia,Lithuania,Hungary,Malta,Poland, SloveniaandSlovakia.

Theprocessofevaluationofthesecountriesregardingtheliftingofcontrolsatinternalbordershas beenaccomplishedandtheEuropeanParliamentdelivereditsopinionon15November2007.

Itshouldbenotedthat,pendingtheopinionoftheEuropeanParliament,theCouncilhadalready concludedon8November2007thattheMemberStatesconcernedhadfulfilledallthenecessary conditionsfortheapplicationoftheSchengenacquis(dataprotection,air,landandseaborders, policecooperation,theSchengenInformationSystemandvisasissuance).

Theentryintoforceofthedecisionwillallowfortheliftingofchecksonpersonsattheinternal borderson21December2007atlandandseabordersbetweenandwiththenineMemberStates concernedandon30March2008atairborders.

Peoplewillbeabletomovefreely,withoutchecks,withinanareaexpandedto3.6millionkm 2,the "Schengenarea".

Returningofillegallystayingthirdcountrynationals

ThePresidencyupdatedthemembersoftheMixedCommitteeonthelatestdevelopments concerningaproposalforaDirectiveoncommonstandardsandproceduresinMemberStatesfor returningillegallystayingthirdcountrynationals,andinparticularontheoutcomeoftherecent discussionwiththeEuropeanParliament.

ThisproposalwassubmittedbytheCommissionin2005andhasbeenexaminedatlengthunder successivePresidencies.ItsetsoutcommonstandardsandprocedurestobeappliedinMember Statesforreturningillegallystayingthirdcountrynationals,inaccordancewithfundamentalrights asgeneralprinciplesofCommunitylawaswellasinternationallaw,includingrefugeeprotection andhumanrightsobligations.

ThedraftDirectivedealswithkeyissuesinthepolicyofreturnsuchasthevoluntarydepartureof thereturnees,theexecutionofareturndecisionthrougharemovalprocedure,thepostponementof removal,theimpositionofentrybansasaccompanyingmeasuretoareturndecision,theformofthe returndecision,theremediesagainstareturndecisionandthesafeguardsforareturneepending return,thepossibilityofacceleratedprocedureofreturnincertaincasesandthedetentionof returneesanditsconditions.

TheCouncilhadcommitteditselftopursuingworkinclosecontactwiththeEuropeanParliament withaviewtoreachingagreementforthedraftDirective.ThePortuguesePresidencyhastherefore prioritisedworkontheproposalattheleveloftheCouncilandcontinuestomaintainclosecontact withtheParliamentwithaviewtoachievingagreementontheproposal.

Control of the acquisition and possession of weapons

TheMixedCommitteewelcomedthefirstreadingagreementreachedbytheCouncilwiththe EuropeanParliamentconcerningaProposalforaDirectiveoncontroloftheacquisitionand possessionofweapons.

OnMarch2006theCommissionpresentedtheabovementionedProposal,whichseekstoadaptan existingfrom1991DirectiveonthemattertotheprovisionsoftheUNProtocolontheillicit manufacturingofandtraffickinginfirearms,theirparts,componentsandammunitiontotheUN ConventionagainstTransnationalOrganisedCrimeofMay2001.

TheParliamentvotedonatexton29November2007.TheCouncilwillproceedtothefinal adoptionofthisagreedtextwiththeEP,oncethetexthasbeenrevisedbythelegallinguists.

ThenewDirectivewilltacklethecriminaluseoffirearmswithoutinconveniencinglegalusersof weapons.

Thenewdirectivewillcoverthepossessionandtheacquisitionoffirearmsbutalsooftheirparts andammunition,includingtheseimportedfromthirdcountries.TheDirectivewillaswellapplyto illicitmanufacturingandtraffickingofweaponsandtheiressentialcomponents.Additionally, convertibleweaponsarebroughtwithinthenewdefinitionof'firearm'.Suchweaponshavebeen identifiedbythepoliceinmanyMemberStatesasagrowingsourceoffirearmsforcriminals.The textalsosaysthatthedirectiveshouldcover"sellingbymeansofdistancecommunications"(e.g. viatheinternet),whichshouldbe"strictlycontrolled"bythoseMemberStateswhoallowitatall.

Inordertomakeweaponstraceabilitymoreefficient,thetextrequirestheuseofalphanumeric symbols.Themarking,affixedtoan"essentialcomponentofthefirearm",mustincludethenameof manufacturer,theplaceandtheyearoffabricationandtheserialnumber.

MemberStates,accordingwiththesubsidiarityprinciple,cangofurtherthanthedirectiveandkeep theirstricterclassificationsystemsinthenationalgunlaw.Inaddition,thetextalsocallson MemberStatestosimplifyadministrativeprocedureofauthorisationtoacquireandpossess firearms.

TheCounciltooknoteofadraftprogressreportonworkonaEuropeanProgrammeforCritical InfrastructureProtection.Thereporttakesstockoftheprogressachievedandgivesindicationson thewayahead.

FollowingtheMadridterroristattack,theEuropeanCouncilofJune2004askedforthepreparation ofanoverallstrategytoenhancetheprotectionofcriticalinfrastructures( 10679/2/04, point 19 ).In December2005,theCouncilcalledontheCommissiontosubmitaproposalinthisareawhile layingdownsomegeneralprinciplestobetakenintoaccountinfuturework( 14689/05 ). InDecember2006,theCommissionsubmittedaCommunicationonaEuropeanProgrammefor CriticalInfrastructureProtection(EPCIP)( 16932/06 )whichsetoutanoverallpolicyapproachand frameworkforEPCIP,aswellasaproposalforaDirectiveontheidentificationanddesignationof EuropeanCriticalInfrastructureandtheassessmentoftheneedtoimprovetheirprotection (16933/06 ).Inaddition,inFebruary2007,theCommissionissuedaCommunicationonProtecting Europe'sCriticalEnergyandTransportInfrastructure.

Itshouldbenotedthatthemainmotiveforcrossborderorganisedcrimeisfinancialgain.This financialgainisastimulusforcommittingfurthercrimetoachieveevenmoreprofit.Accordingly lawenforcementservicesshouldhavethenecessaryskillstoinvestigateandanalysefinancialtrails ofcriminalactivity.Inordertocombatorganisedcrimeeffectively,informationthatcanleadtothe tracingandseizureofproceedsfromcrimeandotherpropertybelongingtocriminalshastobe exchangedrapidlybetweentheMemberStatesoftheEU.

Itisthereforenecessarythatclosecooperationtakesplacebetweentherelevantauthoritiesofthe MemberStatesinvolvedinthetracingofillicitproceedsandotherpropertythatmaybecomeliable toconfiscationandthatprovisionbemadefordirectcommunicationbetweenthoseauthorities.

Tothatend,thisdecisionwillallowMemberStatestoputinplacenationalassetrecoveryoffices withcompetencesinthesefieldsandwillensurethattheseofficescanrapidlyexchange information.
