Amazon's Antitrust Paradox
LINA M. KHAN Amazon’s Antitrust Paradox abstract. Amazon is the titan of twenty-first century commerce. In addition to being a re- tailer, it is now a marketing platform, a delivery and logistics network, a payment service, a credit lender, an auction house, a major book publisher, a producer of television and films, a fashion designer, a hardware manufacturer, and a leading host of cloud server space. Although Amazon has clocked staggering growth, it generates meager profits, choosing to price below-cost and ex- pand widely instead. Through this strategy, the company has positioned itself at the center of e- commerce and now serves as essential infrastructure for a host of other businesses that depend upon it. Elements of the firm’s structure and conduct pose anticompetitive concerns—yet it has escaped antitrust scrutiny. This Note argues that the current framework in antitrust—specifically its pegging competi- tion to “consumer welfare,” defined as short-term price effects—is unequipped to capture the ar- chitecture of market power in the modern economy. We cannot cognize the potential harms to competition posed by Amazon’s dominance if we measure competition primarily through price and output. Specifically, current doctrine underappreciates the risk of predatory pricing and how integration across distinct business lines may prove anticompetitive. These concerns are height- ened in the context of online platforms for two reasons. First, the economics of platform markets create incentives for a company to pursue growth over profits, a strategy that investors have re- warded. Under these conditions, predatory pricing becomes highly rational—even as existing doctrine treats it as irrational and therefore implausible. -

Sleepy Hollow Homeowners Association May 3, 2013 Board of Supervisors of Marin County 3501 Civil Center Drive San Rafael, CA 94903-4157 Re: Stream Conservation Area (SCA) Proposed Amendments to the Development Code Honorable Members of the Board of Supervisors: INTRODUCTION The Sleepy Hollow Homes Association (SHHA) objects to the proposed changes to Chapters 22.33 (Stream Protection) and 22.63 (Stream Conservation Area Permit) as they would apply to the residents of the unincorporated portion of San Anselmo known as Sleepy Hollow. We ask that the County exempt and/or delay implementation of any changes to Chapters 22.33 and 22.63 as to the city-centered corridor streams, including Sleepy Hollow. The SHHA supports implementation of the proposed amendments to the San Geronimo Valley, to protect wildlife habitat in streams where Coho Salmon currently exist. The SHHA supports regulations to ensure the health and survival of the species in these areas. The SHHA recognizes the urgency of this matter to the San Geronimo Valley, both for the survival of the endangered and declining Coho population and for the property rights of the affected residents who are currently subject to a building moratorium. -

Sisters who Served as Principals/Presidents at Magnificat Sister Carol Anne Smith by Mary Cay Doherty Please click here for the digital poster This month we return to our exploration of Sisters of the Humility of Mary who served as Principal / President of Magnificat High School. Of the eight Sisters, we have peered into the lives of Sister Mary of Lourdes (Bernadette) Vetter, Sister Honora McAndrew, Sister Claire (Mary Pius) Young, Sister Ann (Mary Patrick) McManamon, and Sister Rose (Mary Aquinas) Schaffer. Our discussion today features Sister Carol Anne Smith. In the coming months, we will look at the lives of Sister Carolyn Marshall and Sister Mary Pat Cook. Sister Carol Anne was called to lead Magnificat as principal from 1981-1988 and again as president from 2007-2013. As we consider her life and service to Magnificat in this article, we will see that, under her leadership, Magnificat flourished. Sister Carol Anne requested specifically that whatever is described as accomplishments during her terms in leadership at Magnificat be credited was well to those who made the accomplishments possible. These include the faculty and staff, colleagues in administration, Fathers’ and Mother’s Club leaders and members, Advisory Board members and Board of Trustees members, benefactors, alumnae, Sisters of the Humility of Mary and, with love, our school’s always and beautiful students. The holiday season is behind us, but the activities and accolades of 2018 still give us to plenty to celebrate. That is why this edition of GCU Magazine is packed with examples of good news worth sharing—with you and with those you know. First, the Georgian Court–Hackensack Meridian Health School of Nursing is celebrating its 10-year anniversary. Our first decade has produced successful health care professionals serving patients from coast to coast, and the program is among the fastest growing at GCU. In this issue of the magazine, I’d like you to meet two unforgettable alumni. Florence “Riccie” Riccobono Johnson ’45 (pp. 28–29) has worked at CBS for more than six decades and reflects on her time at 60 Minutes, where she’s been employed since 1968. Gemma Brennan ’84, ’93 (pp. 6–9), a longtime teacher, principal, and part-time GCU professor, is sharing her passion in unique ways. Likewise, our newest honorary degree recipient, His Royal Highness The Prince Edward, Earl of Wessex, shared his passion for court tennis during a September visit to GCU (p. 13). Georgian Court was at its absolute finest as the prince met students, faculty, staff, and coaches, and played several matches in the Casino. Not only did the company present more than 200 exiting performances, but we also welcomed Yannick Nézet-Séguin as the Met’s new Jeanette Lerman- Neubauer Music Director. Maestro Nézet-Séguin is only the third conductor to hold the title of Music Director since the company’s founding in 1883. I am also happy to report that the 2018–19 season marked the fifth year running in which the company’s finances were balanced or very nearly so, as we recorded a very small deficit of less than 1% of expenses. The season opened with the premiere of a new staging of Saint-Saëns’s epic Samson et Dalila and also included three other new productions, as well as three exhilarating full cycles of Wagner’s Ring and a full slate of 18 revivals. The Live in HD series of cinema transmissions brought opera to audiences around the world for the 13th season, with ten broadcasts reaching more than two million people. Combined earned revenue for the Met (box office, media, and presentations) totaled $121 million. As in past seasons, total paid attendance for the season in the opera house was 75%. The new productions in the 2018–19 season were the work of three distinguished directors, two having had previous successes at the Met and one making his company debut. -

Carrie Dyer, Catherine Adams and Stephanie Korupp were unable to attend. Mike McGovern was present as our staff rep. 1. Minutes The minutes were approved with two corrections: Mike isn’t a member and should be listed as the staff representative. Also Tiley Kelley’s name was misspelled. It should be Tillie. 2. Updates: •Letterhead (Catherine) Catherine was going to have a mock up available; will need to wait until August to see what she’s able to offer. •Banners/new portable banner (Catherine/Carol Anne) Carol Ann has arranged to display the banner at the Wet Paint Auction on Sunday, July 13. We will get it from Catherine’s house to her in a timely way. (NOTE: Done!) •Portland Symphony, Ft. Williams Foundation and 250 Committee Partnership News (Barbara and Catherine) This subcommittee met again. The goal is to take a proposal to the Fort Williams Advisory Board and the Town Council in September. Corporate sponsors are currently being approached. Mike suggested that it would be best if all sponsor and host contributions were able to go through the FWFoundation. He also suggested that Barbara get in touch with Bob Malley in order to get on the agenda for the FWAdvisory Commission in September. Mike gave Barbara a copy of the Fort Williams Park Group Use Policy. A 5000 maximum number of guests was noted. He suggested that there should be a dialogue on the needs and expectations of the event with joint decisions of the parties involved the goal. -
