Feeley, Chair Since the Islamic resurgence of the 1970s, many Muslim postcolonial countries have established and empowered constitutional courts to declare laws conflicting with shariʿa as unconstitutional. The central question explored in this dissertation is whether and to what extent constitutional doctrine developed in shariʿa review is contingent on the ruling regime or represents lasting trends in interpretations of shariʿa. Using the case of Pakistan, this dissertation contends that the long-term discursive trends in shariʿa are determined in the religio-political space and only reflected in state law through the interaction of shariʿa politics, regime politics, and judicial politics. The research is based on materials gathered during fieldwork in Pakistan and datasets of Federal Shariat Court and Supreme Court cases and judges. In particular, the dissertation offers a political-institutional framework to study shariʿa review in a British postcolonial court system through exploring the role of professional and scholar judges, the discretion of the chief justice, the system of judicial appointments and tenure, and the political structure of appeal that combine to make courts agents of the political regime.

Khan I. INTRODUCTION Judicial activism in South Asia, as well as the unique form of pro-poor litigation known as ―public interest litigation‖ (PIL) on which much of it rests, has received considerable attention in recent years from both South Asian and foreign scholars. The concept of public interest law or PIL is not novel and is often instinctively traced back to the PIL phenomenon of the 1960s in the United States. In recent decades, the American practice has been a notional counterpart of public interest in courts in other constitutional systems. However, the South Asian incarnation of PIL is, in many ways, distinguishable from the Anglo-American experience. Upendra Baxi‘s early critique of the Indian Supreme Court‘s activism in the mid-1980s is the classic statement of the distinctiveness of the Indian genre of PIL. Baxi uses the term ―social action litigation‖ (SAL) to emphasize the very different historical triggers, institutional settings, and conceptual groundings of PIL in the Indian context. The * Oscar R. The Hur movement and movement of the separation of Sindh from Bombay Presidency for the restoration of separate provincial status were the evidence’s of Sindhi nationalist thinking. After the restoration of the provincial status of Sindh the politics of province dominated by the nationalist or provincial parties. The result of 1937 elections showed that country level parties such as All India Muslim League and Indian National Congress could not success to win the elections in Sindh. Even Muslim League did not achieve a single seat. After the guarantees of the provincial autonomy and sovereign status to the units in Lahore Resolution 1940, the politician of Sindh supported Pakistan with the hope that after the independence their identification as well as their legitimate rights would be protected. But unfortunately their hopes could not fulfill the requisites requirements of federalism such as grant of provincial autonomy to federating units, supremacy of constitution, democratic and participatory political system and independent judiciary. Unfortunately the parameters of the federation had been undermined by the civil and military bureaucracy of Pakistan since the day of its independence.
