The Texas Department of Criminal Justice (TDCJ) policy, Administrative Directive (AD)-03.50, "Administrative Segregation" directs the TDCJ to develop an Administrative Segregation Plan which establishes uniform mles and regulations to guide staff in both the conditions and procedures relating to offenders housed in administrative segregation. The TDCJ is fully committed to abide by and enforce the provisions outlined herein, and all employees are expected to comply with its requirements. A SELF-GUIDED TOUR OF OLD MONTANA PRISON 2 WELCOME Bands of outlaws and Vigilantes roamed early Montana Territory leaving a path of destruction and death. In an attempt to tame the Wild West, a prison was established in Deer Lodge in 1871. Constructed primarily with convict labor, Old Montana Prison was an active prison until 1979, when it was moved to a new site four miles west of town. The Old Montana Prison Is preserved and presented to you by Powell County Museum and Arts Foundation and is listed on the National Register of Historic Places. • This tour will take 45 to 60 minutes to complete. • This site is over 130 years old and some of the grounds are uneven, so please watch your step. • Please stay on the tour route. • Do not mark or remove any property under penalty of law. You are standing next to the entrance just inside the prison yard. Turn right and follow the sidewalk along the Wall. Numbered markers will indicate the attraction that is described in this booklet. 3 1896 Cell House 1. Location of 1896 Cell House An enormous red brick cell house with rounded towers loomed over the city of Deer Lodge until 1959 when it was damaged by an earthquake and torn down. In 1960, this slab was poured as a foundation for a gymnasium and classroom buildings. Both buildings were moved to the new prison. The 1896 Cell House was divided into two sections by a two-foot thick wall, which ran from the roof to the floor. -

Interview with Hugo Pinell Hugo Pinell and Kiilu Nyasha The following is an edited transcript of an interview for Prison Focus radio show, KPOO, 89.5 FM, on June 15, 2006 with political prisoner, Hugo Antonio Lyons Pinell (aka Yogi Bear) Luis Bato Talamantez: We have comrade Nedzada [Handukic] and Kiilu Nyasha and we have Gordon Kaupp, an attorney here in San Francisco who is representing the subject of our show, Hugo Antonio Pinell. And on- line shortly, we will have Kiilu, all of whom traveled to Pelican Bay State Prison, which is, I think, 10 miles away from the Oregon state border, a very remote prison, super-maximum prison, to visit Hugo. We claim that he is probably the longest held Nicaraguan citizen in the world, 42 years. And in the past he was also a co-defendant with myself [sic] during the 1970s in the so-called San Quentin Six case. We want to ask Gordon here, for somebody here in America who has been in prison for 42 years, I mean, how do you square that with justice? Can you tell us more about his case, Gordon? Gordon Kaupp: I have the honor of representing Mr. Pinell, and I had the honor of meeting him several weeks ago up at Pelican Bay State Prison which is an extremely cold, dark, foreboding institution in which many lives are thrown away. There are legal reasons and social-political reasons why Yogi is up there. In the board hearing, we’re dealing with the legal reasons which serve as the mechanism for the social and political reasons that keep him locked up; namely, the way that they keep somebody held for such a long and inhumane period of time is by focusing on the suitability factors in his parole board hearing. -

The Court is now asked to allow intervention by twenty-six inmates at the Hutchins State Jail, three inmates at the C.T. Terrell Unit, and one inmate at the Richard P. LeBlanc Unit. All units are facilities under the direction of Defendant Texas Department of Criminal Justice (“TDCJ”). All parties in this case are opposed to the proposed interventions. Moreover, it is the opinion of the Court that the proposed interventions will unduly delay the adjudication of the original parties’ rights. All pending Motions to Intervene are therefore DENIED. The related Motions filed by Proposed Intervenor Charles C. Taylor, Jr. and non-party Richard Jaxson are also DENED. I. Dear Human Rights Defender
Dear Human Rights Defender, I’m writing to you because I think you understand that securing basic human rights has always hinged on the success of daily battles for civil liberties and human dignity. I think you would also agree that human rights and civil liberties are only truly present when they are available to all people, especially the most vulnerable among us. I founded the Human Rights Defense Center and our monthly magazine, Prison Legal News, on these principles, and as a result the organization has focused its efforts on responding to the constant flow of injustices stemming from America’s jails and prisons. As the Russian novelist Fyodor Dostoevsky said, “The degree of civilization in a society can be judged by entering its prisons.” That doesn’t bode well for this country, where we have 5% of the world’s population and 25% of the world’s prisoners. With more than 2.4 million people in U.S. prisons, jails and other detention facilities, and approximately another 5 million on probation or parole, this country has been faced with an unprecedented rate of mass incarceration, the likes of which the world has never seen. It is what some have called a Fill out the attached slip to receive a sample issue of PLN! “Nation Inside”— others have called it “The New Jim Crow.” More than 60 percent of prisoners in the Nation Inside identify as African American or Latino men, despite those demographics making up only 15 percent of the male population in the U.S. It is difficult to overstate the impact of institutional racism and classism in the criminal justice system. -
