Re: Request for urgent review of Adani Ports and Special Economic Zone’s inclusion in the Dow Jones Sustainability Index 17 March 2021 Dear Dow Jones Sustainability Index and Media Stakeholder Assessment Committees, We are writing to you to request an urgent review of the inclusion of Adani Group subsidiary Adani Ports and Special Economic Zone (Adani Ports) in the Dow Jones Sustainability Index (DJSI) and to apply these considerations across the entire Adani Group. In this letter we present evidence of the public controversy surrounding the Adani Group’s activities expanding the unsustainable thermal coal sector, its destruction of the environment and the livelihoods that depend on it and its work with partners which have committed human rights abuses. While this letter concentrates on the actions of Adani Ports specifically, the Adani Group’s history of transferring capital and ownership of subsidiaries between its complex web of companies means the entire group must be held responsible for unsustainable and antisocial practices while it continues to undertake them. Adani Ports should not be permitted to absolve itself of responsibility for its roles and activities as described in this document by simply divesting itself of controversial entities, while those entities’ destructive practises continue within the Adani Group. We are grateful for the opportunity to provide information for consideration by the MSA and Index Committees regarding Adani Ports. We hope the information in this letter will be considered in an urgent review and determination of Adani Ports’ status by the Committee. In summary, Adani Ports’ critical sustainability considerations are; 1. its business relationship with Myanmar’s military, which is credibly accused of crimes against humanity and gross human rights abuses, including war crimes and genocide against ethnic and religious minorities, including the Rohingya people, despite Adani Ports being a signatory to the UN Global Compact, 2. -

The Adani Brief: What governments and financiers need to know about the Adani Group’s record overseas An Overview of The Adani Brief by authors Environmental Justice Australia and legal research contributors Earthjustice The Adani Group’s proposed Carmichael Coal Mine and Rail Project in the Galilee Basin in Queensland would, if developed, be among the largest new coal mines in the world. In addition to destroying the traditional lands and sacred sites of the Indigenous Wangan and Jagalingou people, and unique and important species and ecosystems, burning the 60 million tons of coal the mine is projected to produce each year would measurably exacerbate climate change and ocean warming and acidification that are causing human and environmental devastation worldwide. The associated rail infrastructure and expansion of the coal export terminal at Abbot Point Port adjacent to the Great Barrier Reef World Heritage Area would facilitate the shipping of coal through the Reef’s water from both the Carmichael Mine and other mines proposed for the Galilee Basin, increasing the risk of shipping oil spills and groundings that would further damage the Reef’s already endangered ecosystem. In addition to these threats, the Adani Brief presents evidence that raises serious concerns about the global legal compliance record of some corporate entities within the Indian‐based Adani Group. This evidence includes investigations by an Indian government intelligence agency of illegal business dealings, active involvement in large‐scale illegal mineral exports, and numerous violations of Indian environmental laws that have harmed the environment and local communities. This evidence in the Adani Brief suggests that governments and private stakeholders should give serious consideration to the possibility that if this track record continues in Australia, then supporting the Adani Group’s Carmichael Mine and the Abbot Point Port may expose governments and private stakeholders to reputational and financial risks. -

Key Findings ● In 2011, a ship carrying Adani coal sank off the coast of Mumbai, devastating beaches, tourism and marine life. Adani did nothing to clean up the mess for fi ve years. Adani can’t be trusted to operate in the Great Barrier Reef. ● Adani’s Australian CEO was Director of Operations at another mining company when it poisoned a river in Zambia that people relied on to survive. Adani hid this from the Australian government. Adani can’t be trusted with Queensland’s water. ● There have been deaths, illness and injuries at Adani workplaces. Reports show Adani have exploited and underpaid their workforce, including using child labour. Adani can’t be trusted to follow the rules and look after workers in Australia. ● Adani uses dodgy tax havens in the Cayman Islands to hide assets and revenue. 13 of the 26 Adani subsidiaries registered in Australia are ultimately owned in the Cayman Islands. -

Located in the Galilee Basin, five of these projects would each be larger than any coal mine currently operating in the country. 1. Introduction 1.1 Project Proponent Adani Mining Pty Ltd (Adani) is the Proponent of the Carmichael Coal Mine and Rail Project (the Project). Adani is an Australian subsidiary of Adani Enterprises Limited, a company based in Ahmedabad, India. Adani Enterprises Limited has diverse interests in global trading, development and operation of ports, inland container terminals, establishment of special economic zones, oil refining, logistics, gas distribution, power generation, transmission and trading. Adani established in Australia in mid-2010 with the intent of engaging in exploring for, mining, and exporting coal resources. Accordingly, Adani initially purchased the right to seek a mining lease application (being MLA70441) over exploration permit for coal (EPC) 1690 and then secured similar rights to the eastern and northern parts of EPC1080 in December 2011. This was the initiation of development of the Carmichael Coal Mine and Rail Project (the Project). Adani Abbot Point Terminal Pty Ltd (Adani APT), also an Australian subsidiary of Adani Enterprises Limited, has purchased the lease of Abbot Point Coal Terminal 1 and is seeking to develop Abbot Point Coal Terminal 0 as part of their overall programme for exportation of coal. Adani has not been subject to any proceedings under a Commonwealth, State or Territory law for the protection of the environment or the conservation and sustainable use of natural resources. Adani’s Environment and Sustainability Policy is included in Volume 4 Appendix A Adani Environment and Sustainability Policy. Since establishing in Australia, Adani has sought to deliver community benefit from its business involvement. This commitment to delivering community benefit is further detailed through the commitments identified in the Social Impact Management Plan (SIMP) included in Volume 4 Appendix G Social Impact Management Plan. -

Initial production capacity is projected to be 10 million tonnes of coal per year, though Adani has obtained the approval to produce 60 million tonnes of coal per year. The plan also involves hundreds of kilometres of new railway tracks and new coal port terminals that threaten the Great Barrier Reef. It is estimated to cost AUD 16.5 billion. The extent and intensity of the impacts associated with this project would be profound. And yet, the Environmental Impact Statement (EIS) is riddled with holes and errors. This raises serious questions about whether the current approvals system is adequately equipped to protect people and the environment from developments that are just too damaging. 8. Cumulative Impacts
8. Cumulative Impacts This section describes the potential cumulative and consequential assessment of the Project and proposed projects currently under investigation or expected to commence investigations in the next 5 years within the Galilee Basin. This assessment has been undertaken in accordance with Section 7 of the Project Terms of Reference (ToR) and a table cross-referencing these requirements is provided in Volume 4 Appendix C ToR Cross Reference Table. Baseline studies undertaken as part of the Project EIS and contained within Volume 2 and Volume 3 and other publicly available information on proposed projects in the region have been used to identify potential cumulative and consequential impacts. 8.1 Introduction 8.1.1 Overview Cumulative impacts can be defined as successive and combined impacts of one or more projects upon the society, economy and the environment (Franks, DM, Brereton, D, CJ, Sarker, T and T, Cohen, 2010). Such impacts may occur due to the accumulation and synergistic interactions arising from other developments, being developed within the same area or over a similar time frame of operation to the project being assessed. Developments may impact upon environmental values as a result of geographic overlap of project areas, scheduling overlap or utilisation of the same infrastructure, services and resources. The majority of the cumulative impacts associated with the Project are derived on the basis of a broader scale from transport, economic and social interactions between the Project and other existing/proposed projects in near vicinity to the Project. Impacts related to air quality, particularly dust generation and dispersion, groundwater, surface water and noise are usually derived on the basis of the regional or catchment scale around the Project Area.
