The Road Management Plan identifies the roads for which Council is responsible and documents the management system in place to ensure that the road assets continue to be effectively maintained to provide a safe road network for the community. o Exceptional Circumstances Council will make every effort to meet its commitments under its Road Management Plan. While Council will make every endeavour to meet all aspects of its Road Management Plan in the event of natural disasters and other events including, but not limited to, fires, floods, droughts or storms; or, a prolonged labour or resource shortage due to a need to commit or redeploy council staff and/or equipment elsewhere, together with human factors, such as lack of Council staff or suitably qualified Contractors, Council reserves the right, pursuant to Section 83 of the Victorian Wrongs Act 1958, to suspend compliance with its Road Management Plan. In this event, where the Chief Executive Officer (CEO) of Council has considered the impact of such an event on the limited financial resources of Council and its conflicting priorities, and determined that the Road Management Plan cannot be met, then pursuant to Section 83 of the Wrongs Act, the CEO will write to Council’s officer in charge of its plan and inform them that some, or all, of the timeframes and responses in Council’s Road Management Plan are to be suspended. Once the scope of the event/s have been determined, and the resources committed to the event response have been identified, then there will be an ongoing consultation between Council’s CEO and Council’s Officer responsible for the RMP, to determine which parts of Council’s plan are to be reactivated and when. Council statements to residents about the suspension or reduction of the services under the Road Management Plan will include reference to how the work that will be done has been prioritised, and the period for which it is likely to be affected. It sets out the rights and responsibilities of road users and the responsibilities of Road Authorities for the management of roads. o Road Authority Responsibilities The Act includes provisions for: o The making of road management plans as part of the management system to be implemented by a road authority, o The keeping of a register of public roads in respect of which the road authority is the coordinating road authority , o The construction, inspection, maintenance and repair of public roads, RM Plan ADOPTED OCT 2017.docx Page 7 of 79 12/22/2017 Towong Shire Council Road Management Plan o Issues relating to civil liability arising out of road management. o Duty of Road Users Road users have a duty in respect of the use of a public highway. The Road Management Act, Section 106, refers to the obligations of road users as set out in Section 17A(1) of the Road Safety Act as follows: o A person who drives a motor vehicle on a public highway must drive in a safe manner having regard to all relevant factors including (without limiting the generality) the- o Physical characteristics of the road, o Prevailing weather conditions, o Level of visibility, o Condition of the motor vehicle, o Prevailing traffic conditions, o Relevant road laws and advisory signs, o Physical and mental condition of the driver. o Relationship to Corporate Plan The Council Plan 2013-2017 defines Asset Management as one of its Key Result Areas with the strategic goal “to maintain and improve the Shire’s infrastructure to meet agreed levels of service.” The asset management strategy includes: o Implementing actions identified in the Asset Management Strategy o Maintaining and implementing Asset Management Plans for each class of asset o Conducting condition assessments for each class of assets every 3 years o Periodically reviewing levels of service by community consultation to ensure sustainability o Preparing Financial Plans to fund identified renewal targets A copy of the Council Plan is available for inspection at the Council Offices.
