COMMENCEMENT OF BIOSAFETY ACT, 2006 AND BIOSAFETY REGULATIONS

Under section 53 of the Biosafety Act, 2006 (Act No. 7 of 2006), read with section 49 of that Act, I determine that -

(a) that Act; and

(b) the Biosafety Regulations published under Government Notice No. 210 of 1 September 2016, come into operation on 1 November 2016.

(a) In terms of subsection (2)(b) of section 7 of the Higher Education Act, 2003 (Act No. 26 of 2003) read with section 8 of that Act, I invite -

(i) higher education institutions other than the University of Namibia and the Namibia University of Science and Technology, and

(ii) organisations representing -

(aa) students;

(bb) academic employees;

DECLARATION OF NKURENKURU EXTENSION 3 TO BE AN APPROVED TOWNSHIP: TOWNSHIPS AND DIVISION OF LAND ORDINANCE, 1963

In terms of Section 13 of the Townships and Division of Land Ordinance, 1963 (Ordinance No. 11 of 1963), I -

(a) declare the area situated on Portion 5 of the farm Nkurenkuru Townlands No. 1346, Registration Division “B” and represented by General Plan B 236 to be an approved township.

(b) Set forth in the Schedule the conditions subject to which the application for permission to establish the township concerned has been granted.

2. Composition of township:

- for Cemetery purposes: Erf 1332

- for Public Open Space purposes: 1386 to 1407

4. Conditions of title:

The following conditions shall be registered in favour of the Local Authority against the title deeds of all erven, except the erven referred to in paragraph 3:

The erf must be used or occupied for purposes which are in accordance with, and the use or occupation of the erf shall at all times be subject to, the provisions of the Nkurenkuru Town Planning Scheme prepared and approved in terms of the Town Planning Ordinance, 1954 (Ordinance 18 of 1954). 6135 Government Gazette 30 September 2016 5

AMENDMENT OF REGULATIONS RELATING TO INVESTIGATION OF ALLEGED UNPROFESSIONAL CONDUCT BY REGISTERRED PERSON, AND INSTITUTING AND CONDUCTING OF PROFESSIONAL CONDUCT INQUIRY: PHARMACY ACT, 2004

Under section 66 of the Pharmacy Act, 2004 (Act No. 9 of 2004), on the recommendation of the Pharmacy Council of Namibia, I have amended the regulations set out in the Schedule.

Definitions

1. In these regulations “the Regulations” means the Regulations Relating to Investigation of Alleged Unprofessional Conduct by Registered Person, and Instituting and Conducting of Professional Conduct Inquiry, published under Government Notice No. 289 of 7 December 2015.

Substitution of enabling formula of Regulations

2. The Regulations are amended by the substitution for the enabling formula of the following enabling formula:

“Under section 66(1)(s) of the Pharmacy Act, 2004 (Act No. 9 of 2004), on the recommendation of the Pharmacy Council of Namibia, I have made the regulations set out in the Schedule.”. ______

CALLING FOR REPRESENTATIONS IN OPPOSITION TO APPLICATIONS MADE TO THE MINERALS ANCILLARY RIGHTS COMMISSION

In terms of subsection (3) of section 109 of the Minerals (Prospecting and Mining) Act, 1992 (Act No. 33 of 1992), it is hereby made known that -

(a) the person, whose name is set out in the first column of the Table below and who is a holder of the licence specified opposite that name in the second column, has in terms of subsection (1) of that section applied to the Minerals Ancillary Rights Commission (hereinafter “MARC”) for the granting of the rights mentioned in the fourth column of that Table;

In terms of section 16(3) of the Roads Ordinance, 1972 (Ordinance 17 of 1972), it is hereby made known that application has been made to the Chairperson of the Roads Board of Hardap West that the road described in the Schedule and shown on sketch-map P2364 by the symbols A-B-CD, be declared a proclaimed farm road (number 1242).

A copy of this notice and the said sketch-map of the area concerned on which the road to which the application refers and other proclaimed, minor and private roads in that area are shown, shall for the full period of thirty days, mentioned below, lie open to inspection at the offices of the Roads Authority, Windhoek and the Chief Engineering Technician of the Roads Authority, Rehoboth, during normal office hours.
