Destination NSW is seeking an itemised quotation for the provision of Precinct Lighting Overlay Services for Vivid Sydney 2021.

Vivid Sydney (the ‘Event’), the largest festival of light, music and ideas in the Southern Hemisphere and the largest event in Australia, is owned, managed and produced by Destination NSW. Vivid Sydney has been integral in cementing Sydney’s position as the creative capital of the Asia-Pacific and, instrumental in driving visitation to Sydney and stimulating the city’s visitor economy.

Vivid Sydney features the world’s best creative industry forums, a mesmerising free public exhibition of outdoor lighting sculptures and projections, a cutting-edge contemporary music program and the spectacular lighting of Sydney’s iconic buildings and other Sydney precincts.

ANNEXURE A

Specifications of service required: Destination NSW is seeking an itemised quotation for the provision of Precinct Lighting Overlay services (including delivery, maintenance and removal) for Vivid Sydney 2021.

The Contractor will work under the direction of the Production Manager, Vivid Light, and collaboratively with the Technical Manager, Vivid Light and Event Operations Manager to plan, implement and deliver Precinct Lighting Overlay services. For the avoidance of doubt, the creative lighting design has been undertaken by the Curator, Vivid Light. The Contractor will be responsible for delivery, installation, maintenance and removal of the precinct lighting overlay services only.

The Contractor will be responsible for ensuring that all items are safely installed, operated and maintained during bump in, the Event period and bump out to deliver the services across multiple precincts.

The anticipated Precincts for these services include: • • The Rocks • .

Key Accountabilities:

● Liaise with Vivid Sydney Production and Operations staff to deliver the Precinct Lighting Overlay packages in keeping with relevant Australian Standards and legislation ● Provision of an experienced Lighting Programmer to be available for pre-production meetings, programming and site visits as required ● Provision of suitably qualified and experienced staff required to successfully install, operate and maintain the Precinct Lighting Overlay across all Precincts for the duration of the Event.

Specific tasks are as follows: • Provide lighting and programming plans with power requirements, following consultation with the Vivid Sydney team • Provide the required equipment to successfully execute the activation program, including but not limited to: o IP rated lighting package o Cabling o Power Supply o Control systems and servers o Weatherproof enclosures & LED safety lighting o Compliance Certificates and insurances o Sufficient backup stock of relevant lighting infrastructure should damage, or breakage occur during the Event • Provide accredited personnel over an agreed range of dates for the compliant fit out/install and removal of any equipment • Provide all equipment and licensed/certified persons, and undertake any inductions or preparation of any documentation as required to complete the installations • Provide safe, tested and tagged electrical connections to provided electricity supply including all necessary rigging, cable tray and power distribution equipment • Develop and deliver upon a valid risk assessment and a detailed risk management plan

• Contribute to and comply with Vivid Sydney Risk Assessments and other plans as required • Coordinate transport and loading/unloading of equipment • Be responsible for any storage (including sourcing storage and coordination of storage) • Work openly and collaboratively with Destination NSW to determine the final program, including the overall design, equipment and schedule • Provide specialist technical staff / plant operators / riggers (if required) for the bump in, Event and bump out period • Work to strict deadlines and ensure resourcing is available to work to this • Comply with all relevant laws and Work Health and Safety standards • Provide a COVID-19 plan.

Event requirements: • All maintenance during the Event • Lighting to be operational from 6pm – 11pm each night during the Event • Supply of two (2) onsite representatives each night of operation 4pm – 12am • Issue daily report back to the Event Control Centre during the Event period. • Provide 24/7 contact details for representative on a on call basis if required

Event Dates:

• Bump In: 26 July – 5 August 2021 • Event: 6 – 28 August 2021 • Bump Out: 28 August – 3 September

General items: • The Contractor must provide appropriate public liability insurance noting Destination NSW as an Interested Party. Minimum $20 million • The Contractor must provide appropriate professional liability insurance. Minimum $10 million • The Contractor must provide appropriate workers compensation insurance – as required by law • Services and equipment must be of the highest quality, guaranteed and fit for purpose • The Contractor must provide an Australian Business Number or Australian Company Number • The Contractor must ensure they adhere to all relevant laws and regulations applicable to the services, including Australian Modern Slavery legislation.

Key Considerations: The successful Contractor will be required to enter into a Contract of Engagement with Destination NSW which includes, but is not limited to the following terms:

• Ownership of all intellectual property (including copyright) in any project material will vest in and/or be assigned to Destination NSW on a royalty free, for use worldwide, free of charge in perpetuity basis. The Contractor will agree to execute all documents and do all things required for the purposes of giving effect to this. The project material once assigned will be used by Destination NSW, tourism trade stakeholders, media and the NSW Government • Abiding by a supplier's code of conduct as issued by the NSW Government • Termination Clause, Destination NSW may at any time terminate the contract without cause and for any reason by giving 30 days’ notice in writing to the Contractor, such termination being effective upon expiration of the 30-day period. Destination NSW is not liable for any payments to the Contractor beyond the 30-day notice period, and such amount will be received by the Contractor in full satisfaction and discharge of any claims of any nature whatsoever in connection with this contract. Destination NSW would not be liable for any further/pro-rata payments • If the Contractor does not perform the services required, the service provider is not entitled to receive any further payments and must if so required by notice in writing to the Contractor by Destination NSW, repay to Destination NSW all payments made under this contract or such part of the payments as so demanded by Destination NSW with respect to expenses already incurred and services rendered to date and must make such repayment within seven (7) days of the date of such demand by Destination NSW or within such longer period as specified by Destination NSW. • The use of sub-contractors to deliver parts of this work must include an outline of the proposed contracting structure in response to this Request for Quotation • The successful Contractor will be required to provide all relevant accreditation, licenses and qualifications. • Any case studies are to be approved by Destination NSW prior to use.

Destination NSW will provide the following:

• Creative lighting design and concept

• A limited number of Event radios and accessories as agreed by Destination NSW • Footprint/grid map of the Vivid Sydney Precincts • Any plant required to deliver the Event • All Power supply in nominated locations by Destination NSW • All relevant Engineering certificates • Access to any mandatory online inductions and training systems • A Site shed to store relevant spares and control equipment during the Event period.
