In this dissertation I argue that religious minorities are expanding the scope of the liberal democratic public sphere through a series of contestations. I draw on three case studies in Canada and the United States to argue that the framework of the liberal public sphere is decidedly Christian in orientation, and that religious minorities are making this evident through their interventions in public arenas. I develop a critical analytic based on Habermas’s concept of the public sphere, drawing on Habermas’s critics as well as the work of Foucault. I retain the notion of the public vii sphere but emphasize the role of dissensus, rather than consensus, in achieving the liberal goal of equality. I argue that the public sphere is not a neutral arena for public deliberation, because it has historically privileged Christian forms of expression. I then use my critical analytic of the public sphere in order to perform a close reading of three case studies in which religious minorities intervene in the public sphere. I look at cases of Mormons in the American spheres of politics and popular culture; changing notions of reasonable accommodation in the Canadian province of Québec, and legislative challenges by Muslims and Sikhs to uphold the right of religious expression; and atheists in the U.S., Canada, and the U.K. who argue that their brand of atheism is either a church or a creed requiring accommodations from the state. Rather than dismissing religion as a matter of private concern, scholars seeking to understand the contemporary role of religion in the state ought to take seriously the public expressions of religious minorities. These interventions reverify the citizenship rights of religious minorities, on the one hand, and lay bare the Christian Liberalism of the public sphere on the other. viii Introduction We do not have a good way of talking about religion in the contemporary public sphere. Religion emerges in various forms in public debates, in popular culture, in court cases and legislation. When it does, however, the state, its residents, and the media alike seem to be at a loss for how to address it. A laundry list of recent public cases involving religion illustrates this problematic: • The 2014 Hobby Lobby decision, in which the U.S. Supreme Court declared that a corporation has the right to deny certain forms of health care insurance coverage based on religious grounds. A corporate entity can therefore be said to have religious beliefs. • Islamophobic reactions from Europeans and Americans towards Syrian refugees fleeing the horrors of the so-called Islamic State in late 2015, and the concomitant support of the refugees from various conservative evangelical and Mormon groups fearful that banning Islam might lead to other retractions of religious freedom. • The early 2016 standoff between federal authorities and armed occupiers led by Ammon Bundy at the Malheur National Wildlife Refuge in Harney County, Oregon. The occupiers were motivated at least in part by Mormonism, and a number of them identified only as “Captain Moroni” (a significant military and theological figure in Mormon history). • Uproar over the attempt to erect an Islamic cultural center due to its proximity to the site of the former World Trade Center. When Park51 became redefined in 1 2 many media outlets as the ‘Ground Zero Mosque,’ it ultimately resulted in a much more modest design proposal at the site. Cases like these present an interesting challenge for both politicians and academics: how can we account for public expressions of religious claims when they come up against other forms of liberal discourse? I argue that when we see evidence of religion made public, which comes to us via media representations, we are forced to confront an underlying contradiction at the heart of liberalism: that someone else’s freedom to religion can contradict our freedom from religion (or vice versa). Put another way, liberalism’s attempt to maintain a neutral public arena for rights claims cannot fully account for the public expression of religiosity. When these claims are put into public

This article examines the naturalization process in Canada, a country that derives almost two thirds of its population growth from immigration, and where citizenship uptake is currently in decline. Drawing on interviews with recently naturalized Canadians, I argue that the current naturalization regime fails to deliver on the promise to put “Canadians by choice” at par with “Canadians by birth”. Specifically, the naturalization process constructs social and cultural boundaries at two levels: the new citizens interviewed for this study felt that the nat- uralization process differentiated them along the lines of class and education more than it discriminated on ethnocultural or racial grounds. A first boundary is thus created between those who have the skills to easily “pass the test” and those who do not. This finding speaks to the strength and appeal of Canada’s multicultural middle-class nation-building project. Nevertheless, the interviewees also highlighted that the naturalization process artificially constructed (some) immigrants as culturally different and inferior. A second boundary is thus constructed to differentiate between “real Canadians” and others.

Penner Abstract Oral historians have long claimed that oral history enables people to present their experiences in an authentic way, lauding the potential of oral history to ‘democratize history’ and assist interviewees, particularly those who are marginalized, to ‘find their voices’. However, stories not only look backward at the past but also locate the individual in the present. As first demonstrated by Edward Said in Orientalism, Western societies have a long history of Othering non-Western cultures and people. While significant scholarly attention has been paid to this Othering, the responses of orientalised individuals (particularly those living in the West) have received substantially less attention. This thesis focuses on the multi-sessional life story oral history interviews that I conducted with five Afghan-Canadians between 2012 and 2015, most of whom came to Canada as refugees. These interviews were conducted during the Harper era, when celebrated Canadian notions of multiculturalism, freedom, and equality existed alongside Orientalist discourses about immigrants, refugees, Muslims, and Afghans. News stories and government policies and legislation highlighted the dangers that these groups posed to the Canadian public, ‘Canadian’ values, and women. Drawing on the theoretical work of notable oral historians including Mary Chamberlain and Alessandro Portelli, I consider the ways in which the narrators talked about themselves and their lives in light of these discourses.

Due to this inconsistency, we should therefore expect multiculturalism to retreat following an ideological shift to the right in national level politics. However, this study shows that this does not always happen: sometimes multiculturalism survives an ideological shift to the right. This study argues that the likelihood of multiculturalism surviving an ideological shift to the right in national level politics is affected by electoral outcomes, by policy design and by the actions of critical veto players. More precisely, it argues that multiculturalism is more likely to survive an ideological shift to the right in national level politics when (1) parties of the political right secure enough votes in national level elections to govern but not to decide unilaterally (i.e. when they fail to form a minimum winning coalition), (2) failing that, when multiculturalism policies have been written into formal rules, have multiple stakeholders, or are ‘locked-in’ and therefore immune to the vagaries of electoral competition and (3) if multiculturalism policies are either de-institutionalized, have a single stakeholder, or are ‘open’ to re-examination, when critical veto players intercede to maintain the status quo despite strong partisan opposition to ii multiculturalism.

  • The Future of Muslims in Canada
    A Delicate Mosaic: The Future of Muslims in Canada Sahar Khelifa* Abstract Islam has had a long and, recently, very contested history in Canada. Studies after 9/11 show an increasingly negative view towards Islam and Muslims in Canada. The presence of Canadian Muslim diaspora, supposed clashes between Islam and the West, and the rise of Islamophobia and counter anti-Islamophobia movements have strained Muslim integration efforts and challenged Islam’s place in Canadian society, testing long-standing Canadian values and beliefs about multiculturalism, democracy and pluralism. This paper addresses the question of Canadian-Muslim integration, looking briefly at the history of Muslims in Canada, the issues they face today, and current events regarding Islam’s place in Canadian society, including Bill 94 and the niqab debate during the 2015 Canadian election. The paper also proposes a process where Muslim communities, the Canadian government and the public can work together to build understanding and resolve differences in order to move forward as a country. This is done in the context of the party’s evolution from its Reform Party and Canadian Alliance predecessors on the terrain of a Canadian settler colonial state with significant racialized and ethnicized (im)migrant and refugee populations from whom some electoral support is required to achieve and exercise power. The main argument of this dissertation is that the Canadian Alliance Party’s absorption of the former Progressive Conservative Party of Canada saw the birth of a new Conservative Party that at its core remained an exclusionary political force whose authoritarian populist approach to politics and policy reinforced and further intensified existing social hierarchies between settler colonial and (im)migrant Canadians, particularly with their treatment of Muslims, refugees, migrant workers and prospective citizens. Their policies and policy-making approach also greatly accelerated the further decline of permanent in favour of temporary or “two-step” immigration, family class immigration, and the public and parliament’s role in making immigration policy. To achieve and maintain power, however, the Conservative Party project had to be connected to an attempted hegemonic political project that could obtain enough support to win elections and govern.

    6 Constituting Citizens Oaths, Gender, Religious Attire ayelet shachar The issue which consumed the final few weeks of the 2015 Canadian Federal Election began innocuously enough. Zunera Ishaq, a permanent resident in Canada and citizen of Pakistan, had completed all of the other prerequisites for naturalization and been scheduled to attend a citizenship ceremony on 1 January 2014. There was only one hitch – she intended to recite the oath 2 while wearing her niqab. The government banned such a practice. Alas, only after taking the oath do the participants become full-fledged members of the 3 new home country to which they have sworn allegiance. Without it, the 4 naturalization process remains incomplete. Citizenship is not conferred. Ishaq’s religious practice thus appeared to bar her from acquiring full and equal membership in her new home country. An earlier version was presented at Yale Law School. Canada (Minister of Citizenship and Immigration) Federal Court of Appeal Trudel, J.A. October 5, 2015. Summary: Ishaq was a Pakistani national who had been granted Canadian citizenship. Her religious beliefs required her to wear a niqab (a veil that covered most of her face). A 2011 change in government policy required her to remove the niqab during the oath of citizenship. Ishaq challenged the policy on a number of grounds, including freedom of religion and equality rights under the Charter. The Federal Court, in a decision reported at [2015] F.T.R. TBEd. FE.057, allowed Ishaq's application, finding that, to the extent that the policy interfered with a citizenship judge's duty to allow candidates for citizenship the greatest possible freedom in the religious solemnization or the solemn affirmation of the oath, it was unlawful. The portions of the policy and manual that required citizenship candidates to remove face coverings or be observed taking the oath were unlawful. The Minister of Citizenship and Immigration appealed. A number of parties brought motions to intervene in the appeal. The Federal Court of Appeal, per Stratas, J.A., in a decision reported at [2015] F.T.R. TBEd. JL.004, denied the motions. The Federal Court of Appeal, in a decision reported at [2015] N.R. TBEd. JL.004, dismissed the appeal. The Minister filed a notice of application for leave to appeal to the Supreme Court of Canada and sought a stay of the Federal Court of Appeal and Federal Court judgments, pending the determination of the application or, if granted, of the appeal.
