In exercise of th,e power con• erred by clause (xxxv) of sub-section (2) of sectidh 30 of the Mizoram Educa• tion Act, 2e03 (Act No. 5 of .2003), the Governor of Mizoram" is pleased to make the [allowing rules, namely :- . 1. SnORT TITLE? EXTENT AND COMMENCEMENT : (1) These Rules may be called the Mizoram Education (Transfer and . Posting of School Teachers) Rules, 2006, (2) It shall extend to the whole of Mizoram in respect of Elementary ,Educdtion and Secondary£ducation, except Chakllla Autonomous District, Lai Autonomou3 District and Mara Autohomous Dis• trict in respect of Elementary Education 'only. (3) These rul es shall com::: into force from til~ date of notificati on in the Mizoram Gazette. 2. IN THESE RULES, UNLESS THE CONTEXT OTHERWISE REQUIRES : ;- (1')' "Act" means MizoramEducati~n Act, 2003 (Act No. 5 of 2003) (2) ""Appropriate AuthoJity" shall mean the authority.as specified in Rule 9; (3) "District" means the jurisdiction area prescribed by tb.e Government of District Education Officer; (4) "Elementary School" means Primary Schools and Middle Schools~ (5) "Government" means the Government of Mizoram. (9) ··Sub-Division" meanS the jurisdiction area prescribed by the Government [uf Sub-Divi~ioua I Education Officer. (10) ·'Teacher" me:lns aU categories of teachers employed by Government :n Schools on time scale basis. 3. POSTING OF TEACHERS: (I) No teachers shall be deployed in a schod in excess of the s'lllctioo.ed strength. (2) The sanctioned strength of teachers in a school may vary from time to time al decided by the Government. 4. TENURE OF POSTING : There may be a fixed minimum tenure in a post, after the completion of which a teacher may be liable to be transferred. 5. GRADING OF POSTING: (l) A different minirnu m tenure may be fixed amongst the urban and the rural habitations and graded according to degrees of difficulty of pos• ting ('s follows: (a) All schouls within the limit of Aizawl and Lunglei may be graded as 'A Category' WIth a minimum tenure of six years. (b) Schools in the District Headquarters other than Aizawl and Lung• lei, towns and villages along NH 54 may be graded as 'B CategJry' with a minimum tenure of 5 yc:ars. (c) School in villages connected by all weather truckable roads may be graded as 'C Category' with a minimum tenure of 4 years. (d) Schools in villages not mentioned above in clause (a), (b) ad (c) of Sub-Rule (l) may be graded as '0 Category' with a minimun of tenure of ~ years. (2) The list of villages and towns in each category may be as listed in Schedules I to IV. (3) In the event of omission of a particular villa ge in the grading as per the schedule, the Government shall have the power to categories that particular village as one of the categories as may be conside• red appropriate by the Government. 6. CONSIDERATION OF TRANSFR : (1) A teacher posted in a sChool of 'D Category' may b-e considered for transfer to a school of A or B or C Category, after completion ot' minimum tenure and subject to availability of a vacant post. 3 Ex --10 j /2006 (2 ) A teacher posted in a school of C Category may be consider-:d for transfor to a 8c11001of A or B Category on his own application Or to a school of D Category according to the necessity as decided by the appropriate authority, after the teacher has completed his minimum tenure in a school of C Category. 3) A teacher postod in a scho()l of B Category mlY be considered for transfer to a school of A Category on his own application or to a sC~~)ll of 0 and C C:1tegory acco'ding to the necessity as decidod by the appropriate authority. after tb.~ teacher has cOinpleted his min• imuIn tenure in a school of B Category. (4) A teacher posted in a school of 'A' Category may be considered for tran'ifcr to a school of n or C or B Category, as th~ case may be. l1ccording to the necessity as decided by the appropriate authority, after completion of mini:num lenure in a school of A Category; Provided that a marri=d lady teacher having family may be con• sidered for exemption from such transfer even after completion of t 'H~ minimum tenure: except on h~r own volition. 7. MINIMUrvl TENURE: On the commencement of these Rules, the minimum tenure or otherwise shall be made from the date of p~st1ng of a teacher ill his/her existing category of school. 8. COMPULSORY POSTING: In a cycle of 18 years from the date of commencement of these Rules. a teacher may be required to serve at least o~)e spell of minimum tenure at a school located in D Category. 9. APPROPRTA TE AUTHORITY For the purpose of Rule 6, 7 and 8, the following Ojicers shall be the ap• propriate authority for consideration of transfer and posting of teachers, namely: - (l) In transfer and posting of teachers, which require!l inter-district deploy• ment the Director of Schoo 1 Education shall be the appropriate a utho• rity for both Elementary School Teachers and Seconda.ry School Teachers. (2) .In tran::fer and posting of teachers, which requires inter-sub-division derloyment of Elementary School Teachers, the District Education Officer shall be the appropriate authority within his own district. ' (4) In transfer and posting of teachers, which requir~s intra sub diviskn• , depJoymeLlt cf Elementary Sehool Teachers, the Sub Divisional Educa~ , tion, Othcer ~hall be'the appropriate authority, within his own Sub• Division. 10. PROCESSING OF APPLICATION (1) Any application for transfer must be submitted by a teacher hims~lf/ herself through proper chanfiel only. The concerned officer shall scru- "tinizethe application with reference to the teacher's service particulars and category under which the transfer application has been made. Any application fQr transfer from other persons on his/her behalf shall sumnlarily' be'r.ejected (2) Any application for transfer received by an authority through proper channel must be considered or forwarded, as the ca~e maY be, to ap• propriate authority within three weeks with intimation to the applicant. 1L -BUE" PREFERENCE : (I) Due preference may be given to teachers who have completed their tenure at schools of D or C or B Category. (in the order) for trans~ fer and posting to schools of A or B or C Category (in the order). (2) In the Annual Confidential Reports' of Teachers, the fact that they have completed their minimum tenure in schools located at D and C Categories sha 11 be specia lly ~en tion~d. 12. SPEClAL PROVISION: . '. Notwithstanding anything contained in Rules 3 (1), 6,7 and 8, the Director of School Education may, in consultathn with the Government, deploy a .;teacher in any school, if" according to his ()r her opinion, the exigencies of .circumstances so demand.
