  • Ethics Pledges and Other Executive Branch Appointee Restrictions Since 1993: Historical Perspective, Current Practices, and Options for Change
Ethics Pledges and Other Executive Branch Appointee Restrictions Since 1993: Historical Perspective, Current Practices, and Options for Change ,name redacted, Specialist on the Congress September 29, 2017 Congressional Research Service 7-.... www.crs.gov R44974 Ethics Pledges and Other Executive Branch Employee Restrictions Summary On January 28, 2017, President Donald Trump issued Executive Order (E.O.) 13770 on ethics and lobbying. E.O. 13770 created an ethics pledge for executive branch appointees, provided for the administration and enforcement of the pledge, and revoked President Barack Obama’s executive order ethics pledge that covered his Administration (E.O. 13490). President Trump’s executive order shares some features with President Obama’s executive order and a previous executive order issued by President Bill Clinton. Executive order ethics pledges are one of several tools, along with laws and administrative guidance, available to influence the interactions and relationships between the public and the executive branch. The ability of private citizens to contact government officials is protected by the Constitution. As such, the restrictions placed by executive order ethics pledges, laws, and administrative guidance are designed to provide transparency and address enforcement of existing “revolving door” (when federal employees leave government for employment in the private sector) and lobbying laws. The report begins with an overview of the relationship between the public and the executive branch, including the use of laws, executive orders, and other guidance and Administration policy to regulate interactions. A brief summary of recent executive orders is then provided, including a side-by-side analysis of ethics pledges from the Clinton, Obama, and Trump Administrations.

  • We Understand That the U.S. Department of Labor Announced a Proposed Rule That Would “Update and Clarify” the Department of Labor’S Investment Duties Regulation
July 26, 2020 Office of Regulations and Interpretations Employee Benefits Security Administration, Room N-5655, U.S. Department of Labor 200 Constitution Avenue NW Washington, DC 20210 Attention: Financial Factors in Selecting Plan Investments Proposed Regulation. Document Citation: 85 FR 39113 Page: 39113-39128 (16 pages) CFR: 29 CFR 2550 RIN: 1210-AB95 Document Number: 2020-13705 Dear Sir/Madam: We understand that the U.S. Department of Labor announced a proposed rule that would “update and clarify” the Department of Labor’s investment duties regulation. According to the news release issued announcing this proposed rule, “Private employer-sponsored retirement plans are not vehicles for furthering social goals or policy objectives that are not in the financial interest of the plan,” said Secretary of Labor Eugene Scalia. “Rather, ERISA plans should be managed with unwavering focus on a single, very important social goal: providing for the retirement security of American workers.” We are writing to provide comments on this proposed rule. Background The core idea behind the work of William Michael Cunningham at Creative Investment Research is the recognition that mainstream market-based solutions do not maximize social return. This leads to an underappreciation for the value of human life. We develop market-based innovations to counter this. The elevation of “Chicago-school” economic theories has led to a focus on celebrity and money worship. These magnify and worsen the misallocation of economic resources identified above. Our development of social return investment technologies and the subsequent rise of social entrepreneurs are the methods we have used in this effort. We have radically augmented the development of new investment theories that are the key, we believe, to a higher level of human development.

  • Threshold for the Requirement to Collect, Retain, and Transmit Information on Funds Transfers and Transmittals of Funds That
Washington, DC December 23, 2020 DEPARTMENT OF THE TREASURY Docket No. R-1726; RIN 7100-AF97 Docket No. FINCEN-2020-0002 ; RIN 1506-AB41 SUBJECT: Threshold for the Requirement to Collect, Retain, and Transmit Information on Funds Transfers and Transmittals of Funds That Begin or End Outside the United States, and Clarification of the Requirement to Collect, Retain, and Transmit Information on Transactions Involving Convertible Virtual Currencies and Digital Assets with Legal Tender Status AGENCIES: Board of Governors of the Federal Reserve System (“Board”); Financial Crimes Enforcement Network (“FinCEN”), Treasury. ACTION: Comment on Notice of Proposed Rulemaking. We understand that “The Board and FinCEN (collectively, the “Agencies”) are issuing this proposed rule to modify the threshold in the rule implementing the Bank Secrecy Act (“BSA”) requiring financial institutions to collect and retain information on certain funds transfers and transmittals of funds. The proposed modification would reduce this threshold from $3,000 to $250 for funds transfers and transmittals of funds that begin or end outside the United States. FinCEN is likewise proposing to reduce from $3,000 to $250 the threshold in the rule requiring financial institutions to transmit to other financial institutions in the payment chain information on funds transfers and transmittals of funds that begin or end outside the United States.” Significant Concern While we provide comments below, we note that some question the legitimacy of this regulatory effort. As an agency headed by a person appointed by an impeached president who may have conspired with foreign interests, some believe any regulatory proposals put forward are invalid. Further, some claim that this administration is directly responsible, via incompetence, misdirection, and simple falsification (lying)1, for the deaths (eventually) of over 500,000 of its citizens.

From: Chambers, Micah To: Ryan Ullman Subject: BLM V/F Memo Date: Wednesday, April 12, 2017 12:02:34 PM Attachments: 4-6-17 VF CRA Briefing.pdf -- Micah Chambers Special Assistant / Acting Director Office of Congressional & Legislative Affairs Office of the Secretary of the Interior BLM Venting & Flaring Rule Summary of the Final Rule: The “Venting & Flaring Rule” (the Rule) is formally the Waste Prevention, Production Subject to Royalties, and Resource Conservation rulemaking that replaced the requirements related to venting, flaring, and royalty-free use of gas contained in the 1979 Notice to Lessees and Operators of Onshore Federal and Indian Oil and Gas Leases, Royalty or Compensation for Oil and Gas Lost (NTL-4A). Currently, only 12 percent of operators have reported flared gas from oil well production. The Rule is codified in 43 CFR subparts 3178 and 3179 and became effective on January 17, 2017. Statutory Authority and Regulatory History: The Mineral Leasing Act of 1920 (MLA) (30 U.S.C. §§ 188–287) subjects federal oil and gas leases to the condition that lessees will “use all reasonable precautions to prevent waste of oil and gas developed in the land . .” 30 U.S.C. § 225. Further, the MLA requires lessees to exercise “reasonable diligence, skill, and care” in their operations and requires lessees to observe “such rules for the health and safety of the miners and for the prevention of undue waste as may be prescribed by [the] Secretary [of the Interior].” 30 U.S.C. § 187. The Federal Oil and Gas Royalty Management Act (FOGRMA) makes lessees liable for royalty payments on oil or gas lost or wasted from a lease site when such loss or waste is due to negligence or the failure to comply with applicable rules or regulations.

Ethics Pledges and Other Executive Branch Appointee Restrictions Since 1993: Historical Perspective, Current Practices, and Options for Change Updated February 23, 2021 Congressional Research Service https://crsreports.congress.gov R44974 Ethics Pledges and Other Executive Branch Employee Restrictions Summary On January 20, 2021, President Joe Biden issued Executive Order (E.O.) 13989 on ethics. E.O. 13989 created an ethics pledge for executive branch appointees and provided for the administration and enforcement of the pledge. President Biden’s executive order shares some features with previous executive order ethics pledges issued by Presidents Donald Trump, Barack Obama, and Bill Clinton. Executive order ethics pledges are one of several tools, along with laws and administrative guidance, available to influence the interactions and relationships between the public and the executive branch. The ability of private citizens to contact government officials is protected by the Constitution. As such, the restrictions placed by executive order ethics pledges, laws, and administrative guidance are designed to provide transparency and address enforcement of existing “revolving door” (when federal employees leave government for employment in the private sector, or vice versa) and lobbying laws. This report begins with an overview of the relationship between the public and the executive branch, including the use of laws, executive orders, and other guidance and Administration policy to regulate interactions. A brief summary of recent executive orders is then provided, including a side-by-side analysis of ethics pledges from the Clinton, Obama, Trump, and Biden Administrations (see Appendix). This analysis is followed by observations about the similarities and differences among the four pledges.
