E.O. 13770 created an ethics pledge for executive branch appointees, provided for the administration and enforcement of the pledge, and revoked President Barack Obama’s executive order ethics pledge that covered his Administration (E.O. 13490). President Trump’s executive order shares some features with President Obama’s executive order and a previous executive order issued by President Bill Clinton. Executive order ethics pledges are one of several tools, along with laws and administrative guidance, available to influence the interactions and relationships between the public and the executive branch. The ability of private citizens to contact government officials is protected by the Constitution. As such, the restrictions placed by executive order ethics pledges, laws, and administrative guidance are designed to provide transparency and address enforcement of existing “revolving door” (when federal employees leave government for employment in the private sector) and lobbying laws. ACTION: Comment on Notice of Proposed Rulemaking. We understand that “The Board and FinCEN (collectively, the “Agencies”) are issuing this proposed rule to modify the threshold in the rule implementing the Bank Secrecy Act (“BSA”) requiring financial institutions to collect and retain information on certain funds transfers and transmittals of funds. The proposed modification would reduce this threshold from $3,000 to $250 for funds transfers and transmittals of funds that begin or end outside the United States. FinCEN is likewise proposing to reduce from $3,000 to $250 the threshold in the rule requiring financial institutions to transmit to other financial institutions in the payment chain information on funds transfers and transmittals of funds that begin or end outside the United States.” Significant Concern While we provide comments below, we note that some question the legitimacy of this regulatory effort. Currently, only 12 percent of operators have reported flared gas from oil well production. The Rule is codified in 43 CFR subparts 3178 and 3179 and became effective on January 17, 2017. Statutory Authority and Regulatory History: The Mineral Leasing Act of 1920 (MLA) (30 U.S.C. §§ 188–287) subjects federal oil and gas leases to the condition that lessees will “use all reasonable precautions to prevent waste of oil and gas developed in the land . .” 30 U.S.C. § 225. Further, the MLA requires lessees to exercise “reasonable diligence, skill, and care” in their operations and requires lessees to observe “such rules for the health and safety of the miners and for the prevention of undue waste as may be prescribed by [the] Secretary [of the Interior].” 30 U.S.C. § 187. The Federal Oil and Gas Royalty Management Act (FOGRMA) makes lessees liable for royalty payments on oil or gas lost or wasted from a lease site when such loss or waste is due to negligence or the failure to comply with applicable rules or regulations.

    Ethics Pledges and Other Executive Branch Appointee Restrictions Since 1993: Historical Perspective, Current Practices, and Options for Change Updated February 23, 2021 Congressional Research Service https://crsreports.congress.gov R44974 Ethics Pledges and Other Executive Branch Employee Restrictions Summary On January 20, 2021, President Joe Biden issued Executive Order (E.O.) 13989 on ethics. E.O. 13989 created an ethics pledge for executive branch appointees and provided for the administration and enforcement of the pledge. President Biden’s executive order shares some features with previous executive order ethics pledges issued by Presidents Donald Trump, Barack Obama, and Bill Clinton. Executive order ethics pledges are one of several tools, along with laws and administrative guidance, available to influence the interactions and relationships between the public and the executive branch. The ability of private citizens to contact government officials is protected by the Constitution. As such, the restrictions placed by executive order ethics pledges, laws, and administrative guidance are designed to provide transparency and address enforcement of existing “revolving door” (when federal employees leave government for employment in the private sector, or vice versa) and lobbying laws. This report begins with an overview of the relationship between the public and the executive branch, including the use of laws, executive orders, and other guidance and Administration policy to regulate interactions. A brief summary of recent executive orders is then provided, including a side-by-side analysis of ethics pledges from the Clinton, Obama, Trump, and Biden Administrations (see Appendix). This analysis is followed by observations about the similarities and differences among the four pledges.
