Rice Memorial | AFSCME Local 105 2956732.vl 1 1/1/19 through 12/31/21 AGREEMENT BETWEEN CARRIS HEALTH-RICE MEMORIAL HOSPITAL And AFSCME COUNCIL 65, LOCAL 105 JANUARY 1, 2019 - DECEMBER 31, 2021 This Agreement is made and entered into the day and year hereinafter written by and between the undersigned Hospital hereinafter referred to as the “Hospital” and AFSCME Council 65, Local 105, hereinafter referred to as the “Union.” ARTICLE 1. SCOPE AND DEFINITIONS 1.1 This contract shall apply and be limited to the Licensed Practical Nurses employed by the Hospital. The Hospital recognizes the Union as the exclusive collective bargaining representative of all Licensed Practical Nurses employed by the Hospital. 1.2 The term “nurse” as used herein shall mean “Licensed Practical Nurse.” The term “Licensed Practical Nurse” shall mean a person currently holding a license or permit from, recognized by and in good standing with the Minnesota State Board of Examiners of Nurses as a Licensed Practical Nurse. The Hospital and Union agree that only persons so licensed shall be recognized as Licensed Practical Nurses. 1.3 A full-time nurse is employed by the Hospital to work eighty (80) hours in a two-week payroll period. 1.4 A part-time nurse is employed by the Hospital to work a usual specified number of scheduled hours, but less than eighty (80) hours in a two-week payroll period. 1.5 A temporary nurse is employed by the Hospital to work a usual specified number of hours each two-week payroll period, not to exceed six (6) consecutive months. A temporary nurse may be full-time or part-time, depending on the circumstances of the temporary need. Temporary nurses can be utilized for a number of reasons, including but not limited to replacing a nurse on a leave of absence, a medical leave, or jury duty. During this period of time the temporary nurse shall accrue no length of service benefits. A temporary nurse working past the six (6) month period shall accrue length of service benefits Irom the last date of hire. 1.6 Casual part-time or on-call nurse is employed by the Hospital to supplement its full-time and part-time staff as needed. Casual nurses are not committed to a specified number of hours Rice Memorial | AFSCME Local 105 2956732.V1 1/1/19 through 12/31/21 each two-week payroll period; rather, they are assigned to work on an “as needed” basis. Depending on circumstances and need, a casual nurse may work anywhere from 0-80 hours in a two-week payroll period. 1.7 Temporary positions and employees who are high school students are excluded from the bargaining unit. ARTICLE 2. HOURS OF DUTY 2.1 The normal hours of work shall be eight (8) hours per day and eighty (80) hours in a torn teen (14) day period or forty (40) hours per week in the seven (7) day work period at the discretion of the Hospital. If a nurse is required to work in excess of eighty (80) hours during a two (2) week period or in excess of eight (8) hours in any work day or in excess of eight (8) consecutive hours unless agreed to by the LPN affected for personal scheduling purposes, he/she will be paid at one and one-half (1 'A) times her regular rate of pay for all time so worked. Overtime payments shall not be duplicated. In the alternative to an eight/eighty (8/80) work schedule, for overtime purposes, schedules may be established so as to provide eligibility for overtime only after the completion of forty (40) hours of work in the seven (7) day period. A nurse shall have the opportunity to review the alternative work schedule oi schedules being considered. 2.2 The general pattern of scheduling work will be as follows: (a) Nurses will not be scheduled to work more than seven (7) consecutive days. Nurses will have two (2) consecutive days off and alternate weekends (Saturday and Sunday) off. If necessary to allow for flexibility in scheduling, non-consecutive days off during week days (Monday through Friday) may be utilized. The scheduled work week need not correspond to the calendar week and the pattern of scheduling may be such that more or fewer than five (5) days of work are scheduled in one (1) week provided that not more than ten (10) days of work are normally scheduled in any two (2) work weeks. (b) Nurses normally shall not be required to work more than two (2) of three (3) shifts (days, relief, and nights) during a fourteen (14) day work period. (c) Normally there shall be at least twelve (12) hours between assigned shifts (days, relief, and nights) except on days prior to scheduled days off. (d) Nurses shall be allowed a fifteen (15) minute break during each four (4) hour period worked and an unpaid thirty (30) minute lunch period per eight (8) hour shift. Rice Memorial | AFSCME Local 105 2956732. v I t/1/19 through 12/31/21 (e) Exceptions to the general pattern of scheduling may be made by agreement between the Hospital and the nurse concerned or in cases of emergency or unavoidable situations where the application of the general patterns would have the effect of depriving patients of needed nursing service. (t) Completed work schedules will be posted covering a four (4) week period, at least two (2) weeks in advance of the time covered by such schedule. 2.3 Nurses required to work more than their regularly scheduled eight (8) hour shift shall be paid double time for each additional weekend shift or portion of shift worked. For purposes of this section, additional weekend shift or portion of shift shall include hours worked that accrue between 11:00 p.m. Friday and 7:00 a.m. Monday. Incidental overtime that occuis in conjunction with the regularly scheduled weekend shift shall not be construed to be eligible for this section. 2.4 There will be no split shifts unless it is mutually agreeable to both the nurse and the Hospital. 2.5 With the approval of the Director of Nurses, nurses may occasionally receive three (3) or more days off at one time. 2.6 All clock hours shall be considered as hours worked for the purpose of benefit accrual and seniority. Clock hours shall include sick leave, vacation, and holiday hours. Effective the first day of the first pay period following the Hospital approval of this Agreement, paid sick leave shall not be considered as hours worked for the purpose of overtime.
