TENDER NOTICE

Sealed Tender with samples are invited from bonafide Dealers / Manufacturers/ Traders/ Regd. SSI Units/ Industrial Undertakings/ Organisations Owned / Managed by the State Govt./ State Based Medium Scale/ Large Scale Units Tender for Supply of Clothing, Uniform and Stitching items of Annual Tender(part- 1) for the Kolkata Police for the year 2013-14.

Tender and samples will be received upto 16.30 hours 18.04.2013.

Printed Tender Book for the above tender containing schedules of stores required and other terms and conditions can be obtained from the Tender Section, Lalbazar, 18, Lalbazar Street, Kolkata-1 on cash payment of Rs.500.00 (Rupees Five hundred) only (Non refundable) per copy.

Tenderers are requested to read the Tender Instructions contained in the Tender Book very carefully as defective tenders are liable to be rejected at the outset..

Sealed Tender should be addressed to the Governor of the State of West Bengal (through the Commissioner of Police, Kolkata) in a sealed cover, superscribed “Tender for Supply of Clothing, Uniform and Stitching Items of Annual Tender for Kolkata Police for the year 2013-2014” and to be dropped in the Tender Box, specifically marked, to be kept in Tender Section ( Administrative Branch),Ground floor of Main Building Kolkata Police Hqrs (Ground floor) 18, Lalbazar Street, Kolkata-700001.

The Tender Committee will open sealed tenders at 13.00 hours on 19.04.2012 in the Briefing Room, Lalbazar, Kolkata. Tenderers, if they desire so, may be present or send their authorised representative (not more than one) at the time of opening of tenders.

INSTRUCTIONS FOR GUIDANCE OF TENDERERS

1. The tender must be addressed to The Governor of the State of West Bengal (through the Commissioner of Police, Kolkata). It should be submitted in a sealed cover addressed to the Administrative Officer , Kolkata Police, 18, Lalbazar Street, Kolkata, or should be posted so as to reach that officer before 16.30 hours, on the 18.04.2013 . It should be superscribed “ Tender for Supply of Clothing, Uniform and Stitching Items of Annual Tender(part-1) for Kolkata Police for the year 2013-2014” The tender may be handed in personally by the tenderer or his representative on the date mentioned above. Any tender or samples reaching after the date & time mentioned will not be considered. Sealed Tenders should be dropped in the Sealed Tender Box to be kept in the office of the Administrative Officer, Kolkata Police. The Detailed Tender Document can be downloaded ( after Newspaper Publication ) from Kolkata Police Website kolkatapolice.gov.in .

2. Samples of all the articles tendered for should be dispatched or deposited to - THE INSPECTOR, CLOTHING DEPARTMENT Headquarters, 18, Lalbazar Street, KOLKATA-700 001. and must reach him by the same date. Samples should not be offered for more than three qualities for a particular item . a) If the samples are sent to the wrong officer or if they reach the Inspector, Clothing Department, after the date mentioned, they will not be accepted and the tender will not be considered. b) All samples must be carefully labelled with the name of the tenderer, the name of the articles and reference to item of tender. Tag labels should be used and cords of tags sealed, Paper labels should not be pasted on the samples. A sample of every item tendered for (strictly according to the “standard” sample), must be sent, not one sample for several items, if this is not done, samples will not be considered. Reference to previous year’s samples will not be considered. c) The samples should also be accompanied with lists. The administration accepts no responsibility as regards change, damage or loss of samples submitted but will endeavor to return them correctly as far as possible. d) Unaccepted samples will be returned to tenderers after receipt of letter addressed to the Commissioner of Police, KOLKATA from the unsuccessful tenderer. e) It should be distinctly understood that under no circumstances will such samples be purchased nor will they be returned by post nor will freight be prepaid. f) In the case of sample delivered personally by the Contractors residing at KOLKATA, 3 day’s notice will be given to remove unaccepted samples after expiry of which time, they will lie at the risk of the Contractors, for which the Kolkata Police will accept no responsibility whatsoever. g) Please put the item number on the of each sample-ticket as large as possible. If more than one sample is sent for one item, please mark them A,B,C, etc. A sample must accompany each item. h) Intending tenderers can see the “standard” samples in the Central Clothing Stores, Lalbazar on weekdays (except holidays) between 10.00 hours to 16.00 hours.

3. The amount of earnest money should be in favour of The Commissioner of Police, Kolkata in . Bank drafts /FDR/NSC/Bank Guarantee Bond .Reference to the previously deposited earnest money will

not be entertained. 4. Rates must be quoted both in words and figures. No erasers or alterations whatsoever should be made in the tender. Interpolation or overwriting in the rates are liable to be cancelled. 5. Tenderers are requested to enter their rates in words and in figures in column 5 of the list distinctly. The rates should be F.O.R. destination and include all charges, such as freight, packing, coolie hire, etc. but exclusive of Excise Duties/Sales Taxes as admissible. Omission to enter the rates in words and in figures in columns will be sufficient cause to reject the tender. a) Tenderers are requested to mention specifically as to whether CE/ST/VAT etc. will be charged by them and if so , the same should specifically be indicated against each of the items.

4 6. If any tenderer disregards these instructions, their tender will be rejected. The department accepts no responsibility for loss of Currency of Promissory Notes enclosed in tenders.

7. In the event of this tender being submitted by a firm, it must be signed separately by each member thereof, or in the event of the absence of any partner, it must be signed on his behalf by a person holding a Power-of-Attorney authorising him to do so.

8. (a) The amount of Earnest Money to be deposited :- Rs. If the amount of the tender does not exceed Rs.10,000 200.00 If exceeding Rs.10,000 and not exceeding Rs.50,000 1000.00 If exceeding Rs.50,000 and not exceeding Rs.100,000 2000.00 and for each additional Rs.10,000 or portion of Rs.10,000 a further sum of 200.00

(b) The earnest money will be liable to be forfeited if the tenderer fails to fulfil and observe any of the terms and conditions. (c) Firms registered as a Small Scale Industry with the C & S.S.I. Department and Firms on rate contract with D.G.S. & D may, however, be exempted from depositing earnest money on production of satisfactory documents of their being so registered against the items tendered for. (d) Maximum amount of earnest money is Rs.50,000/-

9. For items on which earnest money cannot be calculated,owing to quantities not being specified, the amounts will be noted against the items. 10. The Commissioner of Police does not bind himself to accept the lowest or any tender, not to assign any reason for non-acceptance, he also reserves the right to divide the contract amongst any number of tenderers, and to let contracts for less than the quantities mentioned in the form of tender.

11. The stores must be supplied in every respect in accordance with the standard pattern, terms and conditions of the contract. 12. Any attempt at canvassing on the part of a tenderer will render his tender liable to rejection summarily. 13. Tenderers whose tender are accepted will be required to execute at their own cost a duly stamped Agreement Form within a Stipulated period after they are notified about the acceptance of the tenders and security deposit at prescribed rate of 5% in the form of Bank fixed Deposit/FDR, National Savings Certificate,Bank Guarantee Bond,G.P.Notes duly pledged in favour of the Commissioner of Police, Kolkata, should be deposited.

14. All tenderers shall submit alongwith their tender copy of the valid Trade Licence, Income Tax Clearance Certificate/PAN No for contract value above Rs.50,000/-, Sales Tax Clearance Certificate/VAT Registration No and valid document of Professional Tax. Tenders received without such certificates will not be considered. Testimonials as to previous contracts held by the tenderers with any other department of Government should be enclosed as well.

15. Manufacturing Units should have to submit authentic documents to be a manufacturer.

16. Those tendering for fabrication of officers’ uniform should preferably be Civil or Military tailors of at least 3 years’ standing/ experience.

17. Authorised Dealer of a manufacturing firm should have to submit the certificates of dealership duly certified by the manufacturing firm.

18. The products of (1) Regd. SSI Unit of the State (2) Industrial Undertakings/ Organisations owned/ managed by the State Govt. and (3) State based Medium Scale/ Large Scale Units may be given preference, if quality is found satisfactory, in terms of the relevant rules of WBFR Vol-I (Since amended). 19. Conditional Tender with time limit imposed thereof will not be considered.

20. The words” KOLKATA POLICE” will have to be imprinted onthe articles specified in the items in the list.

21. Tender will be cancelled if it is found that samples do not accompany the rates for 10 items.

22. The tenderers shall enclose with the tender evidence in support of their experience in this line. 5

23. Exemptions and preferences will be extended to the Govt. Undertakings as per provisions laid down in F.R. Rule 47B (since amended) read with 9600-F, dated 04.10.91 , 10500-F dt. 19 th Nov.,2004 & 5400-F(Y), dated 25.06.2012. 24. In the items relating to fabrication of , tenderers must specify the address within the City of KOLKATA where their place of business is situated. 25. Tenderers should submit samples for all the items of fabrication (bulk/made to measure). 26. Actual requirement of any item may increase or decrease by 50% over the forecast requirement, if required & orders for supply would be made through out the year as per requirement.

27. This tender will remain valid for 1(one) year from the date of issue of letter of acceptance. However the tender may be extended further if situation so warrants. 28. No request for enhancement of rate after the submission/selection of tender will be entertained. 29. Pre Bid Criteria: Last 3 years paper of other unit distribution or Annual Turn over of three times of the tender value. 30. No record of Black listing by any govt offices earlier. 31. Rate quoted for IS-Marked product where desired will be given preference. 32. Supporting documents to adduce the IS-Marked genuinity must be produced along with the tender document. To, THE GOVERNOR OF THE STATE OF WEST BENGAL , (Through the Commissioner of Police, KOLKATA, 18, Lalbazar Street, KOLKATA-700001).

Tender for Supply of Clothing, Uniform and Stitching Items under Annual Tender(Part-1) for Kolkata Police for the year 2013-2014” The items earmarked for “supply to be made by the Govt.” will be procured from the Govt. Undertakings directly as per Govt. Order.

I/We ______of ______hereby tender for the supply of TEXTILE MATERIALS and other article of K.P. uniforms, equipments and miscellaneous stores/ Govt. items in the quantities and at the rates set forth in the Schedule hereof. I/We agree to observe and be bound by the conditions following :-

C O N D I T I O N S

1. In the event of the Contractor failing to make a security deposit in manner hereinafter mentioned, the Commissioner of Police may, at his discretion, forfeit the earnest money lodged with this tender and cancel the acceptance of the tender.

2. The Contractor shall have to deposit (in a Savings Bank Pass Book pledged to the Commissioner of Police, KOLKATA or in Government Securities endorsed to the Commissioner of Police, KOLKATA or produce bank guarantee and FDR of Nationalised Bank) as Security Deposit equivalent to a sum equal to 5 percent of the total value of the aproximate quantities mentioned in the Schedule for which the tender has been accepted, and execute an Agreement within 10 days from the date of issue of the Acceptance Letters failing which the Acceptance Letter will be treated as cancelled. 3. Commissioner of Police may accept the tender in respect of all the goods tendered for, or any of them, or any part of all or any of them, by notifying the Contractor accordingly in the acceptance and the tender shall thereupon be considered as a tender for the quantity so accepted.

The Contractor shall supply (in accordance with the details set forth in the Schedule) such of the goods contracted for as may be ordered from time to time by the Commissioner of Police within the time specified in each stores order. Orders marked “URGENT” shall have to be complied with by the Contractor even within 36 hours after receipt thereof. 5. If the Contractor by any cause, other than his own neglect or default, be prevented or delayed from supplying goods as last aforesaid, the periods provided in clause may be extended by the Commissioner of Police on his being satisfied that reasonable grounds exist for such extension. 6. If the Contractor shall fail to comply with any order as in clause 4 mentioned or in any extended period under clause 5 or if any goods supplied shall not be up to the standard hereinafter provided for the Commissioner of Police may, without any notice to the Contractor, purchase elsewhere the goods required and in the case of defective goods the Contractor shall, at his own expense, remove such defective goods. Any goods so purchased shall be considered part of the minimum quantity which the Commissioner of Police is bound to take as hereinafter mentioned. Any loss incurred by reason of the price paid for such goods above the schedule price or any other loss or expense incurred by reason of such default on the part of the Contractor, may be deducted from any bills or any money payable to the Contractor or from the said Security Deposit. 7. If the Contractor shall cause any goods to be supplied direct from his factory or mill, such goods shall be consigned to the Commissioner of Police or as he may direct and shall be delivered free of cost to the Police Headquarters.

8. Delivery of goods shall not be considered as complete until such goods have been inspected and passed by the Committee appointed for the purpose.

9. All quantities shall be subject to reweighment and count at destination and weighments and count shall be considered final only when certified by the Commissioner of Police.

10. That the Contractor hereby agrees and convenants with the Governor that the , uniform , other items & stores manufactured and supplied by the contractor under these presents shall be manufactured with the best materials available and shall be of best workmanship and the clothings and / or uniforms or other items supplied shall be strictly in accordance with the approved sample and that the said clothing and/or uniform and/or miscellaneous stores would conform to the description and specification mentioned in the schedule of the clothings or if uniforms supplied be not strictly in accordance with the terms of these presents the Governor shall be at liberty and be entitled to reject such goods as may not conform strictly to the sample herein before mentioned in clause (1) or be not in accordance with the description and specification mentioned in the schedule or be not in accordance with guarantee hereby given. The contractor shall if so called upon to do so replace the clothings and uniforms or such of them as may be rejected by the Governor or otherwise the Contractor shall pay to the Governor such damages as may arise by reason of breach of the conditions contained herein : Provided , however, that nothing herein contained shall prejudice any other right of the Governor in that behalf under this presents or otherwise. 11. If the goods supplied do not conform to the accepted sample in all material particulars and description, the Committee mentioned in paragraph 8 may accept the same on condition that a sum not exceeding 10 percent of the accepted rate shall be deducted if the material supplied is required urgently and is considered otherwise acceptable. In case of any dispute over such reduction, the decision of Commissioner of Police, KOLKATA, shall be final and binding on the Contractors.

12. If any rejected goods be not removed as herein before mentioned within 15 days after rejection, the Commissioner of Police, on consignee may sell such goods and deduct from the proceeds any sums recoverable from the contractor as aforesaid and any expense of sale or otherwise and pay the balance to the contractor. 13. The Contractor shall provide, at his own expense, all tools , plant, implements, packing, coolie hire and the like as may be necessary for the due performance of the contract.

14. No goods shall be deliverable to the clothing department on Sundays or Gazetted holidays without the written permission of the Commissioner of Police, KOLKATA. 15. This contract shall not be sublet either wholly or in part without the written permission of the Commissioner of Police and on breach of this provision the Commissioner of Police may determine the contract and forfeit the Security Deposit and the Contractor shall have no claim for loss thereby resulting to him on any account whatsoever. 16. The quantities set out in column 3 of the schedule herein included are the estimated approximate requirements of the KOLKATA Police. The demand for supply will, however, be according to the requirements of the force out of the limit fixed for the supply of different items of requirements. If need be , the demand for supply may go to the whole quantity fixed for supply and may even exceed by 50 percent of the quantity forecast. But it would not be obligatory on the part of the KOLKATA Police to indent the entire quantity are more.

7 17. On any breach by the Contractor of any of the terms of the contract the Commissioner of Police may, in addition to recovering any loss sustain, terminate the contract on seven days notice to the contractor. The decision of the Commissioner of Police shall be final on all questions as to the extent, meaning or construction of the said schedule or any descriptions, prices or other matters therein mentioned.

18. Where this contract is made with a firm, the act of any partner in the firm whether in breach or performance of the contract, shall be binding on the firm.

19. In the event of failure to supply the articles according to approved samples as agreed upon by the contractor, such articles will be purchased elsewhere without notice to the contractor on the account and at the risk of the contractor.

Contractor shall be liable for any loss which the Government may sustain on that account but the contractor shall not be entitled to any gain on purchased made against default.

20. Contractor drawing cloth from the KOLKATA Police for the fabrication of uniforms must have the cloth shrunk prior to making up of the garments.

*21. Intending tenderers must submit their rates alongwith tender book failing which tender may liable to be cancelled. Submission of tender with a portion /part of the tender book may not be taken into consideration.

22. For fabrication of bulk uniforms (item Nos. 9(a)(b),11(a)(b),14(a)(b),30(a)(b),34(a),38(a)(b) cloth to be given to the selected contractors as per scale stipulated in the enclosed specification.

23. Reputed Brands of the items to be quoted.

24. All woollen articles to be supplied in polythene bags.

25. Two numbers prototypes samples of the accepted articles in respect of item nos. 1, 2(a) & (b), 3, 5, 6, 7, 9(a) & (b), 11,14(a)&(b),20,21,23,24,27,29(a)&(b),30(a)&(b),31,33,35,36, 37,39(a)&(b) and 40 must be submitted to the Central Clothings Stores, Lalbazar for approval of the Deputy Commissioner of Police, Headquarters, KOLKATA within fifteen days from the date of receipt of the acceptance letter. For these items cloths & pocketing cloth must be mentioned.

26. Authentic documents regarding genuineness of the articles to be produced in respect of supplies of “Branded” articles in each supply.

N.B. With regard to Cotton Textile Materials the tenderers are to quote only for the making charges of the kits and also to state the meterage required (except bulk uniform) for each item with the exception of Pugree Cloth, Finge Cloth, Waterproof Cloth. The cloth will be supplied by KOLKATA Police against cloth security (in Fixed Deposit Receipt of Nationalised Bank duly pledged to the Commissioner of Police,KOLKATA) to be deposited by the selected contractor for fabrication of uniforms.
