EUGEN SEGAL Membru al ACADEMIEI ROMÂNE Ziua de 09 Octombie 2013 a devenit un reper trist pentru comunitatea academică şi şcoala de chimie românească. În aceea dimineaţă, în Bucureşti, la numai câteva luni de la împlinirea vârste de 80 de ani, ne părăsea ilustrul Profesor Eugen Segal, Membru al Academiei Române. Născut în Iaşi, la 23 mai 1933, Profesorul Segal parcurge studiile generale şi liceale, alături de cele muzicale, în oraşul natal. Este un elev care se remarcă timpuriu, atât prin talent ştiinţific şi muzical, cât şi printr-o deosebită sete de cunoaştere. Se perfecţionează în limbile engleză, franceză şi rusă. După absolvirea liceului ar fi dorit să urmeze cursurile Conservatorului din Moscova, dar din motive de dosar este respins. Astfel că, în 1951 dă admitere la Universitatea Bucureşti, Facultatea de Chimie, unde este admis printre primii la secţia Chimie Fizică. Cu entuziasm şi pasiune se dedică studiului fiind remarcat încă din primii ani ai studenţiei de către renumiţii Profesori Gheorghe Spacu şi Ilie Murgulescu. Imediat după absolvirea facultăţii, în 1955, devine angajat al Universităţii din Bucureşti iar Profesorul Ilie Murgulescu, creatorul Şcolii de Chimie Fizică din România, îl alege drept colaborator. Sub îndrumarea reputatului magistru se înscrie la doctorat, iar în 1963 susţine teza cu titlul "Contribuţii la studiul cinetic al unor descompuneri endoterme în sisteme solid-gaz". În anii următori, chimistul Eugen Segal şi-a perfecţionat pregătirea profesională la Institutul de Chimie-fizică al Academiei de Ştiinţe din Moscova şi la Institutul de cataliză al Secţiei Siberiene a Academiei de Ştiinţe a URSS din Novosibirsk. Încă de la începutul carierei universitare se afirmă prin publicarea a numeroase articole şi studii în domeniile sale de interes: cinetică chimică heterogenă izotermă şi neizotermă; chemosorbţie şi cinetica reacţiilor catalitice; cinetica formală. In memoriam 5 Foarte riguros în activitatea ştiinţifică şi didactică, exigent cu sine, dar prietenos şi cald cu cei din jur, tânărul Eugen Segal se remarcă timpuriu, fiind unanim apreciat atât de către studenţii săi, cât şi de colectivul academic. În anul 1960 primeşte premiul I iar în 1964 premiul II al Ministerului Învăţământului pentru activitatea ştiinţifică. După obţinerea titlului ştiinţific de doctor, în perioada 1964-1968, în paralel cu activitatea de la catedră, i se încredinţează de către mentorul său, Academicianul Ilie Murgulescu, conducerea unui important colectiv, ca Şef al Sectorului de Chemosorbţie din Centrul de Chimie Fizică al Academiei Române. În anul 1969, la doar 36 de ani, Doctorul Eugen Segal obţine titlul de Profesor universitar, iar un an mai târziu pe cel de Doctor Docent în chimie şi conducător de doctorat. Numeroasele publicaţii în reviste de specialitate din străinătate, precum şi frecventele participări la manifestări de profil îl fac cunoscut pe Profesorul Segal în comunitatea ştiinţifică naţională şi internaţională, ceea ce îi aduce în 1973 o ofertă de Bursă Fulbright la Universitatea Standford din California, SUA. Reîntors în ţară în 1974, Profesorul Segal îşi continuă activitatea ştiinţifică şi publicistică cu şi mai mult elan, scrie cărţi şi manuale, îndrumă doctoranzi şi ingineri diplomaţi. Era prezent aproape continuu în laboratorul de cercetare, inducând o atmosferă specială de lucru, în care studenţii, doctoranzii şi colaboratorii săi formau o adevărată echipă închegată prin pasiunea Profesorului Segal. Mereu cu o glumă pe buze şi cu o idee nouă în minte, Profesorul Segal punea energiile în mişcare, aparent fără nici un efort, găsindu-şi timp să discute cu fiecare şi să îndrume tinerii adunaţi în jurul său. Cu mare profesionalism dublat de o modestie exemplară a condus paşii multor generaţii de studenţi şi doctoranzi pe tărâmul cercetării şi cunoaşterii. Ca un exemplu tipic pentru modestia Profesorului Segal, ordinea autorilor pe un articol era întotdeauna cu profesorul pe locul II şi studentul sau doctorandul pe locul I. În perioada 1976-1986, Academicianul Ilie Murgulescu a scris împreună cu cei mai importanţi discipoli, cartea vieţii sale, intitulată modest „Introducere în Chimie Fizică” în 7 volume, cuprinzând aprox. 5000 de pagini. Dintre acestea, volumele: II.1. „Teoria molecular cinetică a materiei” de 1033 de pagini şi apărută în 1979 şi II.2. „Cinetică chimică şi cataliză” de 1023 de pagini, apărută în 1981, au drept coautor pe Profesorul Eugen Segal, care a scris timp de câţiva ani la acest material, răspunzând cu multă dăruire şi căldură exigenţei deosebite a mentorului său. Printr-o muncă tenace, zi de zi, şi întreţinând mereu o atmosferă tânără, entuziastă şi critică, Profesorul Eugen Segal a construit ceea ce a devenit cunoscut în toată lumea drept „Şcoala de Analiză Termică Românească”. Produsele acestei şcoli, răspândite în întreaga lume, sunt astăzi nume întâlnite în toate jurnalele de specialitate, în colectivele editoriale ale revistelor internaţionale de analiză termică şi în conducerea celor mai prestigioase societăţi ştiinţifice de profil (ICTAC şi ESTAC). Chintesenţa muncii de cercetare ştiinţifică a Profesorului Eugen Segal s-a concretizat în: 534 articole publicate din care 215 în reviste din ţară şi 319 în reviste din străinătate; 10 cărţi şi manuale în calitate de autor şi coautor; 12 brevete de invenţie; 50 contracte de cercetare; 6 granturi; 2407 citări; Factor de Impact Individual Cumulativ total (ISI) 100,080; factorul HIRSH 19; 22 teze de doctorat coordonate. Pentru meritele sale ştiinţifice, în anul 1991 Profesorul Eugen Segal este ales Membru Corespondent al Academiei Române, iar în anul 2009 devine Membru titular al prestigioasei instituţii naţionale. În anul 2010, şi-a susţinut discursul de recepţie dedicat Academicianului Ilie Murgulescu, "Dascăl de excepţie şi creator de ştiinţă". 6 Buletinul S. Ch. R. Nr. The main aim of this dissertation is to assess the liability of officials of transnational corporations in Burma and transnational corporations in Burma for crimes against humanity such as slave labour and for war crimes such as plunder under International Criminal Law. However at present transnational corporations cannot be prosecuted under International Criminal Law as the International Criminal Court only has jurisdiction to try natural persons and not legal persons. In doing this analysis the theory of complicity, actus reus of aiding and abetting and the mens rea of aiding and abetting in relation to officials of transnational corporations will be explored and analysed to assess the liability of these officials in Burma. In doing this analysis the jurisprudence of inter alia the Nuremberg cases, the cases decided by the International Criminal Tribunal for the Former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR) will be used. This dissertation also examines the problems associated with suing or prosecuting transnational corporations due to the legal personality of transnational corporations and the structure of transnational corporations. At the end of the dissertation some recommendations are made so as to enable transnational corporations to be more transparent and accountable under the law.

    Master Plan of the Nazi/Cartel Coalition – Blueprint for the ‘Brussels EU’ Chapter 2 WALTER HALLSTEIN: Prominent Nazi Lawyer – And Key Architect of the ‘Brussels EU’ Chapter 2 Walter Hallstein (1901-1982) Walter Hallstein was a prominent lawyer involved in the legal and ad- ministrative planning for a post-WWII Europe under the control of the Nazis and their corporate allies, the Oil and Drug Cartel IG Far- ben. Hallstein represented the new breed of members of the Nazi/Cartel Coalition. He was trained by legal teachers whose primary goal was to sabotage the ‘Versailles Treaty’ defining the reparation payments imposed on Germany after it lost WWI. Early on in his career Hall- stein received a special training at the ‘Kaiser Wilhelm Institute in Berlin.’ This private institute was largely financed by the IG•Farben Cartel to raise its scientific and legal cadres for the Cartel’s next at- tempts at the conquest and control of Europe and the world. While the rule of the Nazis ended in 1945, the rule of their accom- plices, the IG Farben Cartel and its successors BAYER, BASF, and HOECHST had just begun. As a strategic part of their plan to launch the third attempt at the conquest of Europe, they placed – a mere decade after their previous attempt had failed – one of their own at the helm of the new cartel ‘politburo’ in Brussels: Walter Hallstein. This chapter documents that the fundamentally undemocratic con- struct of today’s ‘Brussels EU’ is no coincidence. Hallstein, a promi- nent Nazi lawyer – and expert on the IG•Farben concern – was chosen by these corporate interests to become the first EU Commission pres- ident with a specific assignment: to model the ‘Brussels EU’ after the original plans of the Nazi/IG Farben coalition to rule Europe through a ‘Central Cartel Office’.

Farbenindustrie to Locate a Plant in Auschwitz The Buna/Monowitz concentration camp, which was erected by the SS in October 1942, was the first German concentration camp that was located on the plant grounds of a major private corporation.1 Its most important function was the fur- nishing of concentration camp prisoners as slave laborers for building the I.G. Auschwitz plant, I.G. Farben‘s largest construction site. Instead of estab- lishing an industrial production location on the grounds of an existing concentra- tion camp, a company-owned branch camp of a concentration camp was put up here, for the first time, on a site belonging to an arms manufacturer. This new procedure for construction of the I.G. Auschwitz plant served as a model and in- fluenced the subsequent collaboration between the arms industry and the SS in the process of expanding the concentration camp system in Nazi territory throughout Europe, particularly toward the end of the war, when numerous sub- camps were established in the course of shifting industrial war production to un- derground sites.2 The Buna/Monowitz concentration camp was located in East Upper Silesia within the western provinces of Poland, which had been annexed by the German Reich.
