As you know, the Government of Canada and the CRTC have mandated that over- the-air televisíon transmission must switch from analogue to digital in many parts of Canad,a:startihg August 31, 2ß11 . [n light of this, ÇBC/Radio-Canada is installing a digital tr:ansntitter for every one of its tetevis,íonistations, for a,.total of 27 transmitters ac!'oss the country. All will'b,e operational'by August 31,2011. Without a CBC/Radio-Canada television station, London does not fit the críteria we have used to implement the Government's directive.

We understand that our choice not to install a digitaltransmitter in London where residents are facing the prospect of no longer having access to over-the-air.- is concerning to local area residents. That's why we are working with the CRTC to- find solutions to the problem.

One.s.elution that we are pro.pclsing is to re<¡uest perrrìission from the CRTC to continue broadcasting in analogue. Since we are going to continue operating over 600 transmitters after August 31 ,2011, the transition date, it makes sense for us to attempt to make the transmitter in London one of them.

It's also important to recogníze that CBC/Radio-Canada is commítted to the regions. lndeed, our corporate five-year strategic plan, Everyone, Every way, places regions as a top priority and we will be using our resources to back that commitment. Rather than investing in transrnitters that serve fewer people as the over-the-air usage continues to decline, our strategy consists of enhancing our regional prograrnming offer on multiple platforms. lt also rneans finding ways of providing local radio and web services to the seven million Canadians who aren't currently served by a local station. ,!0) tttat /:)

Appended is an application by CBC/Radio-Canada to amend the licence of television programming undertaking CBLT in order to change the technical parameters of its transmitter CBLN-TV at London, Ontario. This technical amendment is being submitted subsequent to the Corporation’s request filed on July 14, 2011, for authority to maintain certain analogue transmitters in mandatory markets.

The application reflects a change of channel from 40 to 23 and a decrease in average effective radiated power from 1,000,000 watts to 16000 watts (maximum effective radiated power from 1,678,000 watts to 24,000 watts). The EHAAT of 262.9 metres remains unchanged.

CBLN-TV is currently operating on channel 40 in NTSC. On August 31st, this channel can no longer be used in London because it has been assigned to a new DTV station in Toronto. Given the technical limitation of our CBLN-TV equipment, the best alternative is to operate on channel 23. The proposed operating parameters have been developed taking into account surplus equipment resulting from the transition to DTV. Thus a 1kW transmitter will be re-used for CBLN-TV in the existing antenna system.

The technical documents in support of this application together with a copy of the CRTC application form and this letter are being sent under separate cover to Industry Canada today.

1 CBC/Radio-Canada is pleased to respond to the intervention received from Inc. (Bell Media) in connection with the above-noted Applications to amend the licence of its over-the-air (OTA) television station CBLT-TV in order to change the technical parameters of the re-transmitters CBLN-TV London and CBLN-TV-1 Kitchener and to amend the licence of its OTA television station CBLFT-TV Toronto in order to change the technical parameters of the re-transmitter CBEFT Windsor. If approved, from a technical perspective, the Corporation could maintain analogue transmitters in these markets without causing interference after the August 31, 2011 digital transition deadline.

2 CBC/Radio-Canada respectfully submits that Bell Media has not raised any valid issues in its intervention and that the Applications should be approved as filed.

The Applications Meet the Procedural Requirements

3 Bell Media has asked the Commission to return these applications on procedural grounds alleging they should have been served with the application as a potential

respondent. Bell Media has erroneously interpreted the guidelines on the CRTC Rules of Practice and Procedure (Broadcasting and Telecom Information Bulletin CRTC 2010- 959; or the Guidelines) and its request should be declined.

4 Determining who is a respondent to a particular application depends on the specific facts of the application. In the case of applications for technical amendments such as the ones filed in this instance, the Corporation is required to identify all television stations whose originating or rebroadcasted signal would suffer interference or that would be required to vacate their frequency. Bell Media has not raised this as an issue in the current proceeding.

5 Indeed, Bell Media has not provided any reason whatsoever to demonstrate that it has a direct interest in these proceedings and make them a potential respondent to these proceedings. Given that approval of these Applications would result in maintaining the status quo – i.e. maintaining existing analog OTA coverage in these markets, CBC/Radio-Canada submits that there are no potential respondents in this matter and consequently, there is no requirement to serve parties with copies of these applications.

6 The precedent CKVR-TV cited by Bell Media is not comparable to CBC/Radio- Canada’s current applications for technical amendments. The Commission required Bell Media to re-file its applications to establish two digital rebroadcasting transmitters for CKVR-TV and serve potential affected respondents because the application, if approved, would extend the reach of the service and result in revenue impacts to both the applicant and other broadcasters.

7 The Commission has determined that these applications are complete and has set out expedited timelines for their consideration. The Corporation notes that Bell Media has filed an intervention in respect of these applications within the deadlines established by the Commission. In the circumstances, its procedural request should be dismissed.

Timing of the Applications

8 The second reason cited by Bell Media is that the Corporation has chosen to file these applications shortly before the deadline to shutdown analog in mandatory markets, the Corporation should have been adequately prepared to transition to digital long ago and private broadcasters have already made significant investments to meet this deadline. The Corporation respectfully submits that none of these are valid grounds for denial of these technical amendments.

9 The Corporation has been very public about its financial constraints and its digital transition plan. On 30 November 2010 CBC/Radio-Canada notified the Commission that the Corporation would be installing digital transmitters for all of its originating television stations – 27 in total – but that it would not be transitioning from analog to digital in any other markets, i.e. those markets where the Corporation maintains re- broadcasting transmitters.

10 The Corporation has also publicly stated its intention to maintain OTA service in all markets, should the CRTC permit. In the Corporation’s 28 February 2011 reply to interventions concerning its application to amend the broadcasting licence of CBAT-TV Fredericton in order to add a post-transition digital transmitter to serve Fredericton, CBC/Radio-Canada stated at paragraph 9:

Nonetheless, in order to ensure that those Canadians currently using over-the-air technology are able to transition to alternative means in a gradual manner in the coming years without hardship, the Corporation is committing to continue to operate virtually all of its analogue transmitters in the post-August 31, 2011 period for as long as the analog continues to operate and be available. This commitment will apply to those markets identified as non-mandatory by the Commission. In the future, the Company may also be prepared to examine the feasibility of maintaining analog transmission in mandatory markets, should the Commission’s rules so permit.

11 Should the Commission so permit, approval of these technical amendments will enable Canadians in London, Kitchener and Windsor to maintain access to CBC/Radio- Canada’s OTA signals permitting those Canadians currently using OTA technology to

transition to alternative means in a more gradual manner without hardship. Otherwise, these residents located in mandatory markets where the Corporation will not transition to digital will lose access to CBC/Radio-Canada's OTA television signals far sooner than Canadians in other locations as the Corporation will be maintaining all of its analog transmitters in these markets. In the Corporation's view, disadvantaging these Canadians in this manner would be directly contrary to section 3(1)(m)(vii) of the Broadcasting Act which states that the Corporation's programming "should be made available throughout Canada by the most appropriate and efficient means ...".

12 These applications are consistent with CRTC procedure and approval of the proposed technical amendments will benefit the Canadian broadcasting system.

Dear Mr. Morin,

1. Bell Media Inc. (Bell Media) is pleased to submit the following intervention in response to the Part 1 applications noted above filed by CBC/Radio Canada (CBC). As outlined in their applications, CBC has applied to amend the licence of their over-the-air (OTA) television station CBLT-TV Toronto in order to change the technical parameters of their transmitters CBLN-TV London and CBLN-TV-1 Kitchener. They have also submitted a similar application on behalf of their French-language service CBLFT Toronto for their Windsor transmitter. CBC states these amendments are being submitted subsequent to a request filed with the Commission on 14 July 2011 for authority to maintain certain analogue transmitters in mandatory markets.

2. At the outset, Bell Media respectfully submits that these applications should be returned to CBC for procedural reasons. In Section 8 of CRTC Application Form 302, Application for a technical amendment to a broadcasting licence for an analog or digital television programming undertaking (including rebroadcasting transmitters), applicants are asked to indicate whether their application affects “a person who is adverse in interest to the applicant called respondent” as defined in the guidelines on the CRTC Rules of Practice and Procedure (Broadcasting and Telecom Information Bulletin CRTC 2010-959; or the Guidelines).

3. The Guidelines define a respondent as follows:

A respondent is a person with an interest in the outcome of the proceeding. This interest must be specific to that person and not only an interest as a general member of the public. This interest must also be direct. It is not enough that a decision could set a precedent that might be applied in a future decision concerning the person, nor is it enough that the person could hypothetically be affected by the decision.1

The Guidelines further state that “since the resulting Commission decision could directly and negatively affect respondents, they must be served with the application (section 22(1)(b)).”2 These applications, in which CBC is asking to what amounts to preferential treatment with respect to the digital transition as set out in several Commission policies dating back to 2007, would negatively affect not only Bell Media but other licensees of OTA television stations in the affected markets. Therefore, it is Bell Media’s opinion that CBC should have indicated in their applications that there are respondents who would be affected by their applications and that copies of the applications should have been served on Bell Media and other potential respondents. Moreover, we would like to note that in June 2011 Bell Media filed two applications for new rebroadcasting transmitters associated with our OTA television station CKVR-TV Barrie. In that filing, Bell Media did not indicate that any respondents would be affected and the Commission subsequently returned the applications. (These applications have since been re-filed and are now before the Commission for consideration).

5. However, should the Commission determine that these applications meet the all the appropriate procedural criteria, Bell Media submits that these applications should still be denied as the CBC has chosen to file an application at the eleventh hour for an exception to a long- established Commission policy.

Digital Transition

6. As first noted in Broadcasting Public Notice CRTC 2007-53, Determinations regarding certain aspects of the regulatory framework for over-the-air television, the Commission established 31 August 2011 as the date for the transition from analog to digital conversion television in Canada. Subsequently, in Broadcasting Regulatory Policy CRTC 2009-406, Policy determinations resulting from the 27 April 2009 public hearing, the Commission identified the major markets where it expected conventional broadcasters (including CBC stations) to convert their full-power, OTA analog transmitters to digital. This list of markets was updated in Broadcasting Regulatory Policy CRTC 2010-167, A group-based approach to the licensing of television services.

7. The conversion to digital has been a process several years in the making yet CBC has chosen to file their present applications a mere six weeks prior to the deadline to the transition to digital. Furthermore, due to the limited time frame available until the deadline, the Commission has been forced to shorten the period for interventions to only one week. Bell Media submits that CBC, like all other OTA broadcasters in Canada, has had ample time to prepare for the transition to digital. We are at a loss therefore to understand why the applicant waited until the eleventh hour to file these applications with such little time for either other industry stakeholders or the general public to adequately respond. The Commission cannot treat one group differently from the others, especially due to the fact that all other licensees have been forced to invest tens of millions of dollars in the digital transition.

Conclusion

8. The applicant has erroneously determined that it was not necessary to provide any potential respondents with copies of their applications. Furthermore, CBC should have been adequately prepared for the transition to digital long ago as this policy has been in place for four years, and an application filed at the eleventh hour seeking preferential treatment from a long- established Commission policy should not be granted in light of the significant investments other OTA broadcasters have made in order to meet the 31 August 2011 deadline. Therefore, Bell Media believes there are sufficient grounds for these applications to be denied.
