A Native Title Information Talk Delivered at Fernvale Futures on 22 February 2014. Tim Wishart Slide 1 I acknowledge and offer my respect to the country on which we meet and to the Traditional Owners of this country and to their Old People and Elders. The organisation for which I work, Queensland South Native Title Services is a native title service provider recognised and funded by the Federal Government under the Native Title Act (1993). Slide 2 The area for which QSNTS has statutory recognition under the Native Title Act covers an area spanning Queensland, along the New South Wales border from the Coral Sea to the South Australian border, north to about 250 kilometres north of Mt Isa and running diagonally south eastwards to the coast, marginally south of Sarina. Slide 3 I ought to say that views and opinions expressed are mine and are not necessarily reflective of corporate views or policy of QSNTS. In this conversation I will refer to the Native Title Act as ‘the Act’. But in the consciousness of Queensland Aboriginal and Torres Strait Islander society, the expression “the Act” is often a reference to The Aboriginal Protection and Restrictions of the Sale of Opium Act 1897. That legislation was an Act of the Queensland Parliament. As a result of dispersal, malnutrition, use of opium and diseases, all a consequence of European incursion into traditional lands coupled with the attempted genocide that came with that incursion, it was widely believed in Queensland that Aborigines were members of a 'dying race'. In 1894 pressure from some quarters of the community saw the Queensland Government commission Archibald Meston to look at what had conveniently, for the colonising power, become the plight of Aboriginal people. -

Legal Compliance Education and Awareness Native Title Act 1993 (Commonwealth) Native Title Act 1993 (Cth) How does the Act apply to the University? • On occasion, the University assists with Native Title claims, by undertaking research & producing reports • Work is undertaken in conjunction with ARI, Native Title representative bodies & claims groups • Representative bodies define the University’s obligations & responsibilities with respect to Intellectual Property, ethics, confidentiality & cultural respect • While these obligations are contractual, as opposed to legislative, the University would be prudent to have an understanding of the Native Title Act, how a determination of Native Title is made & the role that the Federal Court has in the management of all applications made under the Act University of Adelaide 2 Native Title Act 1993 (Cth) A brief history of Native Title: Pre -colonisation • Aboriginal people & Torres Strait Islanders occupied Australia for at least 40,000 to 60,000 years before the first British colony was established in Australia • Traditional laws & customs were characterised by a strong spiritual connection to 'country' & covered things like: – caring for the natural environment and for places of significance – performing ceremonies & rituals – collecting food by hunting, fishing & gathering – providing education & passing on law & custom through stories, art, song & dance • In 1788 the British claimed sovereignty over part of Australia & established a colony University of Adelaide 3 Native Title Act 1993 (Cth) A brief history of Native Title: Post-colonisation • In 1889, the British courts applied the doctrine of terra nullius to Australia, finding that as a territory that was “practically unoccupied” • In 1979, the High Court of Australia determined that Australia was indeed a territory which, “by European standards, had no civilised inhabitants or settled law” 1992 – The Mabo decision • The Mabo v Queensland (No. -

Introduction Language, land and song are closely entwined for most pre-industrial societies, whether the fishing and farming economies of Homeric Greece, or the raiding, mercenary and farming economies of the Norse, or the hunter- gatherer economies of Australia. Documenting a language is now seen as incomplete unless documenting place, story and song forms part of it. This book presents language documentation in its broadest sense in the Australian context, also giving a view of the documentation of Australian Aboriginal languages over time.1 In doing so, we celebrate the achievements of a pioneer in this field, Luise Hercus, who has documented languages, land, song and story in Australia over more than fifty years. -

Institutionalisation of Aborigines, under the guise of assimilation and protection policies, was only abandoned in.the lg7Os. It is therefore important to understand the implications of these policies for Aborigines and Australian society in general. I investigate the affect of institutionalisation on Aborigines, questioning the assumption tl.at they were passive victims forced onto missions and government stations and kept there as virtual prisoners.
