ATHLETICS AUSTRALIA SELECTION POLICY 17th IAAF WORLD CHAMPIONSHIPS , , 27th SEPTEMBER to 6th OCTOBER 2019

This document sets out the basis on which will select athletes for the IAAF World Championships in Doha, Qatar, 27 September – 6 October 2019.

For the avoidance of doubt, the “Selectors” referred to throughout this Policy is the Athletics Australia National Selection Panel appointed by the Board of Athletics Australia from time to time. Also, the reference to “Head of High Performance Systems” means the person in that role or their nominee from time to time and reference to “Head of Performance and Coaching” means the person in that role or their nominee from time to time.

1 Aims of Policy and overview of Selection process

The aim of Athletics Australia’s Selection Policy (“Policy”) for the World Championships is to nominate the most competitive possible team to represent Australia. The policy is aligned with the High Performance Strategy and the Athletics Australia Strategic Plan to achieve medals, supported by additional top eight places, at the and IAAF Championships. Specifically, the policy aims to facilitate the following outcomes (“Aims”):

• Nominate the most competitive possible team to represent Australia;

• Selecting athletes and relay teams with the realistic potential to win a medal or finish in the top 8 in Doha; and

• Providing major Championships experience to likely 2020 Olympic Games medallists and top 8 finishers.

The process for selection under this Policy is that the Selectors will consider selecting (i) athletes that have qualified according to the criteria set out in this Policy and then (ii) any athletes offered a “Roll Down” invitation.

In those cases where the selectors will have a choice of qualified athletes they will be guided by this policy and will prioritise those athletes who are likely to be the most competitive in Doha.

Athletics Australia will consider selecting athletes offered a Roll Down invitation by virtue of their position on the IAAF Top Lists where the athlete is likely to achieve a top 8 result in Doha or the 2020 Olympic Games.

In all cases, the selectors will consider each athlete’s competitive record and demonstrated ability to plan the peak of their season at a major championship event.

It is the expectation of Athletics Australia that Athletes will compete at the National Championships for their event and support the Australian Athletics Summer Series of events. The strength of the 2019 Australian Season will be assessed by the IAAF when determining categorisation for the new World Ranking System. It is important that our best athletes compete to enable the maximisation of points in Australia when attempting to qualify for the 2020 Tokyo Olympics.

2 Standards, criteria and athlete numbers

2.1 Athletes can only compete at the World Championships if invited by the IAAF and if Athletics Australia accepts the invitation. Athletics Australia is under no obligation to accept the invitation of any particular athlete. Further, and for the avoidance of doubt, if the IAAF amends its qualification rules in any way, that may impact this Policy. If that occurs, Athletics Australia reserves the right to amend this Policy in accordance with clause 11 and it will provide as much notice as practical to affected people.

2.2 Individual athletes can qualify by:

2.2.1 Achieving the relevant IAAF Standard (listed in Appendix 1) or

2.2.2 By Wild Card through meeting a relevant IAAF Status Qualification (as listed in Appendix 1); or

2.2.3 Receiving a “Roll Down” position to complete the overall field size set by the IAAF. The IAAF will offer Roll Down positions based on world ranking within the IAAF qualification period. (See Appendix 3 for guideline athlete numbers per event.)

2.3 Normally the IAAF will invite up to a maximum of three athletes per event from any one country.

2.3.1 A fourth athlete can be added where they are the reigning World Champion from 2017, Champion from 2019 or leader (at the closing date of the qualification period) of the IAAF Challenge, IAAF Race Walk Challenge or Combined Events Challenge.

2.3.2 If both the reigning World Champion from 2017 and Diamond League Champion from 2019 in any one event or leader in the IAAF Hammer Throw, Race Walk or Combined Events Challenge are different athletes from the same nation, that nation can only choose one of those athletes.

2.4 Relay teams can qualify by:

2.4.1 Having placed in the top ten (twelve in the mixed 4x400m) at the 2019 World Relay Championships or

2.4.2 By receiving a “Roll Down” position to complete the overall field size (16 teams) set by the IAAF. The IAAF will offer Roll Down positions based on world ranking

within the IAAF qualification period.

2.4.3 Athletes do not need to have achieved any specific time to be named in a relay squad, although all individual entries in the 100m must be included in the relevant 4x100m squad and all individual entries in the 400m must be included in the relevant 4x400m squad. This does not apply to the mixed 4x400m. Being named in a relay squad does not guarantee competing in the relay at the World Championships. Any team member initially selected for any event can be selected to compete in the relays at the World Championships.

3 Selection and Selection Priority

3.1 AA will not accept IAAF invitations for (and therefore will not select) athletes who:

3.1.1 Do not meet the Athlete Eligibility Criteria (see Section 4); and

3.1.2 Only qualify by a performance or performances that were set outside the Qualification Period (see Section 5) or were not an Eligible Performance (see Section 6).

Further to the points above, AA may not accept IAAF invitations for (and therefore may not select) athletes if, in the opinion of the Selectors, those athletes are unable to achieve the aims of the Policy set out in clause 1.

3.2 Selection for all events except the relays and .

3.2.1 In this Policy:

a) “Priority Status” will be given to any eligible athletes who achieves a Wildcard Category A or IAAF Standard (as set out, and subject to the comments in, Appendix 1) within the Qualification Period for each event set out in the table in Section 5.2.

b) “National Champion” status will be given to the first eligible Australian athlete in the National Championship for each event set out in the table in Section 5.2.

c) “ Champion” status will be given to any Australian athlete that wins a relevant event at the 2019 Oceania Championships and therefore qualifies for consideration as a Wildcard Category B athlete (as set out, and subject to the comments in, Appendix 1).

3.2.2 At the initial selection meeting for each event (as per the table in Section 5.2) athletes will be selected as follows:

a) If the National Champion also has Priority Status, then, subject to meeting all requirements in section 4, he or she will be selected provided they have nominated for selection.

b) Additional athletes holding Priority Status can be selected at this stage, provided space is left for the National Champion (if they are not selected at this stage).

c) For the avoidance of doubt, the selectors are not obliged to select any qualified athlete, other than the National Champion if the National Champion also holds Priority Status.

d) At each stage the selectors will be guided by the notes in Section 7.

3.2.3 After the 2019 Oceania Championships (25-28 June 2019), the Selectors may hold an interim selection meeting and consider any athletes that have qualified as a Wildcard Category B athlete. The Selectors may select an athlete at this interim athlete provided that the athlete otherwise meets all the requirements of this Policy, in particular the guidance notes in Appendix 1. However, the Selectors:

a) will not, at this interim selection meeting, select an athlete in an event where four or more athletes have already qualified for consideration by Selectors (eg as Oceania Champion, National Champion and/or achievement of Priority Status) or if the Selectors, Head Coach, Head of High Performance Systems or Head of Performance and Coaching consider it is likely that four or more athletes will be qualify for consideration under any of the available methods by the conclusion of the qualification period;

b) are not obliged to select any qualified athlete at this stage.

3.2.4 At the final selection meeting for each event (as per the table in Section 5.2) the selectors may select additional athletes. The order of adding additional athletes will be:

a) The National Champion if he or she has not already been selected and if they now hold Priority Status;

b) Any other athletes holding Priority Status;

c) Oceania Champions (again, having regard to the matters set out in Appendix 1).

For the avoidance of doubt the selectors must consider athletes in the order above but they are not obliged to select an athlete, other than the National Champion (providing they hold Priority Status), at any stage. Except as set out, the Selectors will be guided by the notes in Section 7.

3.3 Selection for the Marathon

3.3.1 There is no trial event for the Marathon.

3.3.2 Subject to section 4, at the Marathon selection meeting the selectors will select between qualified athletes following the prioritisation process outlined in Section 7.

3.3.3 There will be no selections made based on performances achieved after the Athletics Australia qualification period for the marathon has closed (see Section 5).

3.4 Selection for Relays

3.4.1 AA will accept all relay team invitations received from the IAAF to compete at the Doha World Championships (Women 4x100m, Women 4x400m, Men 4x100m,

Men 4x400m and Mixed 4x400m). This means that each team must:

a) Have placed in the top ten (twelve for mixed 4x400m) at the 2019 World Relay Championships; or

b) Have received a “Roll Down” invitation to complete the overall field size set by the IAAF. The IAAF will offer Roll Down invitations based on world ranking within the IAAF qualification period.

3.4.2 Athletes entered in the individual 100m and 400m will be automatically included in the relevant Relay Squad. This does not apply to the mixed 4x400m.

3.4.3 Relay Squad members not picked automatically under section 3.4.2 may be added to the team by the Selectors and do not need to achieve any other IAAF performance standard. The decision to nominate any additional travelling Relay Squad members is at the absolute discretion of the Selectors.

3.4.4 For the avoidance of doubt, the World Championships Relay Teams will consist of up to six athletes per relay discipline, comprised of any automatic Relay Squad members (Section 3.4.2) and any other selections made at the absolute discretion of the Selectors (section 3.4.3).

3.4.5 The World Championships Relay Squad members will be nominated to create the most competitive possible team based on applicable relay skills, team cohesiveness and compliance with the AA relay program. Results in individual events (e.g. 100m, 200m or 400m), while important, will not be the sole criteria for nomination to the relay teams.

3.4.6 The World Championships Relay Squad members will be confirmed at the relevant relay selection meeting.

3.4.7 For the avoidance of doubt, at the Championships any athlete on the Team may be chosen to compete in the relays. Being a member of the travelling Relay Squad does not guarantee competing in the relay at the Championships. The choice of athletes and their order will be made by the Head Coach in consultation with the Head of High Performance Systems, Head of Performance and Coaching and the relevant team relay coach(es).

3.5 “Roll-down” invitations

At the end of the IAAF selection period, the IAAF will apply a “Roll Down” invitation process inviting additional athletes to complete the overall field size for each event (except the 10,000m, relays, walks and ) at the World Championships. The IAAF will offer Roll Down invitations based on world ranking on the “IAAF Top Lists” within the IAAF qualification period. (See Appendix 3 for guideline athlete numbers per event).

3.5.1 The Selection Panel will consult with the Head Coach, Head of High Performance Systems and Head of Performance and Coaching when using their discretion considering the Aims in Section 1 and Discretion Framework in Section 8 to decide if they will accept Roll Down invitations for any particular athlete. The athlete must meet the Athlete Eligibility Criteria of this policy (see Section 4) and the “IAAF Top List” performance by the athlete must meet the Eligible Performance Criteria of this policy (see Section 6). For the avoidance of doubt:

a) Selectors do not have to leave any team places open to account for this possibility.

b) If circumstances mean that the Selection Panel must choose between one or more athletes at this stage, then they must select the National Champion if applicable otherwise they will be guided by the notes in Section 8.

c) No Roll Down invitations can be accepted for the 100m or 400m unless the athlete has already been selected in the relevant relay squad or a place remains open in the relay squad.

d) For the avoidance of doubt, the selectors are not obliged to select any invited athlete through this process. Any selection decision will be made at the discretion of the Selectors.

3.5.2 Due to the IAAF Roll Down invitation process, athletes who were eligible to be selected by AA at the final selection meeting (3.2.3) and who were not selected at that time, will not be considered by the IAAF for invitation through the Roll Down. In other words, no athlete that has achieved Priority Status will be eligible for a Roll Down invitation.

3.5.3 There will be no Roll Down invitations issued by IAAF for the following events: 10,000m, relays, 20km Walk, 50km Walk and Marathon.

4 Athlete Eligibility Criteria

Only those athletes who qualify according to this Section will be eligible for selection in the Team:

4.1 Satisfy all IAAF eligibility, nationality and World Championship Participation Rules.

4.2 Be a citizen of Australia.

4.3 Be a registered member of Athletics Australia through their Member Association.

4.4 Complete and submit the online Application for Consideration for Selection form (which can be found at www.athletics.com.au) for each event in which the athlete is seeking selection. The form must be submitted by the “Nomination Date” shown in Section 5.

The date for submission of the Application for Consideration for Selection may be extended for any or all athletes at the discretion of the Chairman of Selectors on the recommendation of the Head of High Performance Systems or Head of Performance and Coaching.

4.5 Commit to signing the Athletics Australia Code of Conduct.

4.6 Be and remain in ‘good standing’ with Athletics Australia and at all times comply with Athletics Australia’s Code of Conduct and conduct themselves in a way that does not bring themselves, their sport or the National Team into disrepute. Athletics Australia may consider past and present behavioural conduct in determining whether an athlete is in ‘good standing’. If Athletics Australia determines that an athlete is not in ‘good standing’ with Athletics Australia, in its absolute discretion Athletics Australia may choose not to select that athlete.

4.7 Agree to comply with a pre-Championships preparation policy that will be published by Athletics Australia’s Head of High Performance Systems and Head of Performance and Coaching. This policy may include the requirement to prove form and fitness to

compete in the 2019 World Championships prior to the final Athletics Australia selection date of 9 September 2019. Failure by a previously selected athlete to comply with the pre-Championships preparation policy may, at the discretion of the Head of High Performance Systems, Head of Performance and Coaching and Head Coach, result in an athlete who has been named by Athletics Australia at an earlier date not being selected in the final team for the World Championships.

4.8 Agree to undertake all reasonably expected education courses, including but not limited to ASADA e-learning modules level 1 & 2 and Keep Sport Honest Anti Match Fixing e-learning program.

5 Qualification Periods, Nomination and Selection Dates

5.1 All qualification performances must be achieved between the dates shown below.

5.2 Selection meetings will be held in the week commencing the date shown (marked w/c) or on the day shown.

6 Eligible Performance Criteria

6.1 Performances must be achieved during competitions organised or authorised by IAAF, its Area Associations or its National Member Federations. Results achieved at university or school competitions must be certified by Athletics Australia or the National Federation of the country in which the competition was organised.

6.2 Performances must be achieved during an official competition organised in conformity with IAAF Rules.

6.3 To be recognised for the purposes of this Policy, performances achieved in Australia must be achieved in a competition sanctioned by Athletics Australia as an Athletics Australia “National Permit Meeting”. Athletics Australia operates a sanctioning process across all meets that involves the issuing of a permit – “National Permit” or “Recreational (State) Permit”. A current list of all “National Permit” meetings will be available on the Athletics Australia website.

6.4 Performances achieved in mixed events, on the track and completely in the Stadium, shall not normally be accepted. If athletes and/or coaches are in doubt as to the interpretation of the IAAF and Athletics Australia Rules in relation to qualifying performances in Mixed Events they should contact the Competitions Manager of Athletics Australia.

6.5 Wind-assisted performances, beyond legal readings recognised by the IAAF, or performances for which a wind reading is not available will not be accepted.

6.6 Hand-timed performances in 100m, 200m, 400m, 800m 110m/100m Hurdles, 400m Hurdles and 4x100m relay will not be accepted.

6.7 Per IAAF rules, under 20 athletes (any athlete aged 18 or 19 years on 31 December 2019 i.e. born in 2001 or 2000) may compete in any event except the Marathon and 50km Race Walk.

6.8 Per IAAF rules, under 18 athletes (any athlete aged 16 or 17 years on 31 December 2019 i.e. born in 2003 or 2002) may compete in any event except the throwing events, the Combined Events, 10,000m, the Race Walks and Marathon.

6.9 Per IAAF rules, athletes younger than 16 years on 31 December 2019 (i.e. born in 2004 or later) CANNOT be entered in any event.

6.10 Performances must be achieved in a competition where a minimum of three athletes are competing.

6.10.1 For throwing events, all three athletes must be competing with the same implement specifications.

6.10.2 For hurdle events, all three athletes must be competing with the same hurdle heights.

7 Prioritising athletes at the final selection meetings

7.1 Except for Roll Down invitations (which are dealt with in section 8), the Selectors will only consider Eligible Athletes holding an IAAF Status Qualification or IAAF Standard set within the relevant Qualification Period.

7.2 Where the selectors have a choice between two or more athletes for selection for a particular event then they will prioritise in the following order:

7.2.1 First, see Section 3 for the prioritisation of National Champions;

7.2.2 Then, if prioritisation is still required, the Selectors will exercise their expert judgment and prioritise other athletes by their likely finishing position at the 2019

World Championship. To do so, they will have regard to the following criteria in any order that they consider appropriate:

• World ranking lists • Previous Benchmark event results • An athlete’s: o Repeat performances at or near the IAAF Standard o Finishing position at the relevant Australian Championships o Head-to-head record within the Qualification Period o Other relevant Head-to-head performances o Previous Championships record with special reference given to results at the: ▪ 2017 World Championships; ▪ 2018 World Race Walking Team Championships; ▪ 2016 Olympic Games; ▪ 2019 World Cross Country Championships o Current form and fitness • Any other relevant information

The Selectors may consult with the Head Coach, Head of High Performance Systems and Head of Performance and Coaching when making their decisions. For the avoidance of doubt only athletes who have met the Eligibility Requirements may be nominated subject to the application of Sections 2 and 4. Furthermore, the nomination of any athlete is at the absolute discretion of Athletics Australia.

8 Discretion framework for athletes offered Roll Down invitation

8.1 When considering whether to accept an invitation offered to an athlete under the Roll Down process in line with the aims of this policy, the Selectors will first consult with the Head Coach, Head of High Performance Systems and Head of Performance and Coaching and consider athletes and their prospects of being competitive against the following Discretion Framework:

• Likelihood of achieving a Top 8 in Doha • Likelihood of achieving a Top 8 in Tokyo • Current form and fitness, with particular reference to when the performance that earned the Roll Down invitation was achieved • The likelihood of the athlete achieving a Top 8 at future benchmark event • Past championships performances

For absolute clarity, it is the Selectors discretion, through the application of Section 8.1 to decide if they will accept each individual invitation under the Roll Down process. The acceptance of any one individual invitation has no bearing on the acceptance of any other individual invitation.

9. Further Obligations after Selection

Athletes selected in the Team for the IAAF World Championships in Doha according to the process and criteria set out in this Policy may be required to prove their fitness to compete in the World Championships by the achievement of a performance standard to be set by the Head Coach. The process and standards will be published separately.

Failure by a selected athlete to meet the performance standard will, at the discretion of the Head of High Performance Systems and Head of Performance and Coaching, in consultation with the Head Coach, result in an athlete who has been selected in the Team being withdrawn from the World Championships Team.

Furthermore, without limiting anything in the Athletics Australia Code of Conduct or any other applicable agreement or policy, athletes selected in the Team will be required to undertake any medical assessments and testing requested by the Athletics Australia Chief Medical Officer, or their delegate, and disclose to the Athletics Australia Chief Medical Officer, or their delegate, any relevant medical history and known medical condition or issue that may be or become relevant to participation in the World Championships Team.

If it is the opinion of the Athletics Australia Chief Medical Officer, or their delegate, that from a medical or welfare perspective it is not in the best interests of an athlete to be a member of the Team and compete at the World Championships, Athletics Australia reserves the right to withdraw that athlete from the Team.

There is no appeal regarding any decision made under this section 9.

10. Appeal Process

The appeal process is attached hereto as Appendix 4.

11. Athlete Replacement Policy

11.1 If an athlete selected in the team withdraws or is withdrawn prior to the 16th September, the Selectors may select a replacement athlete in that event. However, the decision to select or not select a replacement athlete is at Athletics Australia’s discretion, meaning that the Selectors may choose not to select a replacement athlete.

11.2 If an athlete selected in the team withdraws or is withdrawn after 16th September 2019, there will be no replacement selected as the IAAF entries will be closed.

11.3 There will be no appeal from a decision of the Selectors under this section 11.

12. Amendment to Policy

This Policy can be amended at any time by Athletics Australia if it is of the opinion that such an amendment is necessary as a result of any change to the Participation Rules, to give effect to the Policy following discovery of a drafting error or oversight, or for any other reason determined to be in the best interests of Athletics Australia. Athletics Australia shall not be responsible or liable in any way to any one as a result of any such amendment.

Appendix 1 – Wild Card Status Qualification and IAAF Standards

Wild Card Category A

1. The selectors will accept IAAF invitations for athletes or teams qualified via the following Status Qualification routes:

• 2019 Diamond League Champion, or • Defending (2017) World Athletics Championships Champion, or • Leader (at the closing date of the qualification period) of the 2019 IAAF Hammer Throw Challenge, 2019 IAAF Race Walk Challenge or 2019 IAAF Combined Events Challenge, or • Placing in the Top 15 of the 2019 World Cross Country Championships (for the 10,000m)

Wild Card Category B

2. The Selectors may, at their discretion, accept IAAF invitations for athletes qualified only by the following Status Qualification routes:

• Winning the 2019 Oceania Championships

In exercising their discretion under this clause, the Selectors will have regard to the Aims of this Policy set out in clause 1 and only select athletes that they consider are capable of achieving those Aims.

Appendix 4 – Appeal Process

ATHLETICS AUSTRALIA 2019 WORLD CHAMPIONSHIPS IN ATHLETICS SELECTION APPEALS PROCEDURE REGULATION

1.0 Event Selections finalised prior to 09 September 2019

In the case of any event where either the final selection date has occurred on or prior to 09 September 2019 (marathon and race walks), or where all possible places in an event have been filled by the Selectors, or in respect of the selection of any athlete in any other event which has been finalised prior to 09 September 2019, the normal appeal process according to AA By Law 8 will apply.

2.0 Relay Selections

There will be no appeal process available in respect of selection or non-selection as a travelling Relay Squad member, except that a selected athlete does not meet the Athlete Eligibility Criteria.

In any such case, the Appeal (detailing the specific nature of the non-compliance) shall be made in writing to the Chief Executive Officer within 24 hours of the posting of the final team selections on the Athletics Australia website (which unless otherwise advised shall be 12 noon on Monday 09 September 2019), or if the non-compliance is not known at that time, within 24 hours of such non-compliance being made generally known.

The CEO shall investigate the matters raised (including providing the adversely affected athlete of the right to be heard). The CEO will, solely in his absolute discretion, determine such an appeal as soon as practical after receiving the notice of appeal and shall where necessary request, or direct, the Selectors to make any applicable change to the athletes selected. If an athlete is ruled ineligible following such an appeal, then the Selectors will convene to consider whether or not a replacement athlete will be selected.

3.0 Remaining Selections

As the IAAF closing date is 16 September 2019 and there are only limited options for changing athletes within the IAAF entry system after that date, the default Athletics Australia Selection Appeal provisions (By Law 8) will not be appropriate in the circumstances.

In lieu thereof, the following ‘Fast Track” procedure will apply in accordance with these Regulations.

3.1 The Selection Appeals Tribunal will consist of one person only – who shall preferably be knowledgeable both of the and the law, but at least one of those areas;

3.2 An athlete not selected in the 2019 World Championships, other than under the circumstances set out in Regulations 1.0 or 2.0 above, may appeal his/her non- selection to the Selection Appeals Tribunal in accordance with this Regulation 3.0.

3.3 The appeal must be made in writing and reach the CEO of Athletics Australia by hand delivery, facsimile or electronic transmission by no later than 24 hours after the notification to athletes of the Selection decisions by any means (including, but not limited to, emails to athletes, telephone calls to athletes, or posting of the final team

selections on the Athletics Australia website or distribution through social media channels), which unless otherwise determined by Athletics Australia shall be 12 noon on Monday 09 September 2019.

3.4 An athlete may not appeal unless he/she has achieved the relevant IAAF entry standard or roll down position for the event in respect of which the appeal is made.

3.5 The appeal must be accompanied by a cash or electronic funds transfer payment of $AUD500. If the fee is not paid, the athlete will be deemed to have withdrawn the appeal.

3.6 The sole grounds of appeal are that:

(a) a selected athlete whom the Appellant seeks to replace does not meet the Athlete Eligibility Criteria;

(b) the Appellant’s omission from the Team was otherwise a result of a failure by the Selectors to properly apply the Selection Criteria set out in the Policy;

(c) there were no grounds on which the selection decision could reasonably be based.

3.7 The Appellant can withdraw an appeal at any time.

3.8 The Tribunal will hear the appeal either in person or by telephone as soon as practicable after its lodgement and always bearing in mind the advice of the CEO as to the practicalities of being able to make any necessary changes within the IAAF entry system.

3.9 If the appeal has no impact on any other athlete (ie there is a vacancy available under the IAAF entry rules), the Tribunal will consider submissions, either orally or in writing, from or on behalf of the Appellant and the Selectors only. The Tribunal may consult any officer of Athletics Australia or other person it deems necessary to reach a fair and correct decision

3.10 If the appeal impacts one or more athletes already selected (ie the appeal if successful may involve the substitution of that athlete with the Appellant), the Tribunal will also consider submissions by or on behalf of that athlete(s).

3.11 If more than one appeal affects selection in the same event, the appeals will be held concurrently and submissions considered from all relevant parties according to regulations 3.9 and 3.10.

3.12 The Tribunal has no power of selection or re-selection. The Tribunal may review the matter(s) set out in the appeal and may (if required) refer the matter back to The Selectors for consideration.

3.13 The decision of the Tribunal will be binding on the parties and no further appeal, including to CAS, shall be allowed.

3.14 Hearing of the Appeal

(a) The Tribunal may, after receiving the appeal documents, investigate and consider the matter and determine whether the matter should be dismissed because, in the opinion of the Tribunal, there is no credible evidence, submission

or argument upon which the Tribunal could be satisfied that a ground of the appeal can be made out.

(b) If the Tribunal determines the matter should be dismissed under Regulation 3.14(a)(1) above that decision is final and the appeal has failed. If the Tribunal determines that the appeal should be dismissed without a hearing, the Appellant's appeal fee of $500 is forfeited to Athletics Australia as the costs of the appeal. (c) If the Tribunal does not consider the question posed under 3.14(a)(1) or otherwise determines the matter warrants a hearing, the Tribunal will advise the Appellant and set the date for such a hearing as soon as practicable and necessary having regard to the timing of selection and the proximity of relevant events, in accordance with Regulation 3.8.

(d) The Tribunal must conduct any appeal hearing as follows:

(1) it must observe the principles of natural justice; (2) it is not bound by the rules of evidence and may inform itself as to any matter in such manner as it thinks fit; (3) it will conduct its hearings with as little formality and technicality and with as much expedition as the proper consideration of the matter permits; (4) hearings may occur in such manner as the Tribunal decides; (5) the Appellant must establish one or more grounds of appeal to the reasonable satisfaction of the Tribunal with full regard to the importance and gravity of the issue; (6) all persons appearing before the Tribunal have the right, at his, her or its expense, to legal representation;

(e) Following consideration of all information that the Tribunal considers relevant the Tribunal shall arrive at a finding;

(1) the Tribunal shall notify the CEO of its findings as soon as practicable; (2) if the Tribunal considers the ground(s) alleged by the Appellant to be made out, it shall recommend that The Selectors reconsider the relevant selection or nomination decision; (3) where the Tribunal considers that a ground of appeal has been made out, it may stipulate that all or part of the appeal fee be refunded to the Appellant; (4) The Selectors shall comply with any direction of the Tribunal to reconsider the relevant selection or nomination decision; (5) any further nomination or selection decision of The Selectors under the direction of the Tribunal shall be final and binding, and no further appeal shall be available to the Appellant in respect of that selection.
