Name, Last name: Devrim Burcu Eğilmez Signature : iii ABSTRACT JUSTICE AS THE REQUIREMENT OF TOLERATION: CONTEMPTUOUS TOLERANCE AND PUNITIVE INTOLERANCE IN THE SIXTEENTH CENTURY OTTOMAN EMPIRE Eğilmez, Devrim Burcu Ph.D., Department of Political Science and Public Administration Supervisor: Assist.Prof. Kürşad Ertuğrul September 2011, 223 pages This dissertation investigates the historical knowledge of the idea/practice of Ottoman toleration/intolerance, in terms of a conceptual-theoretical framework and methodology derived from philosophical theories of toleration, theories of religious toleration of Western historiography and critical theories of toleration, which are in turn revised and reformulated according to “way of reasoning” of the Ottomans. The objective of deriving a conceptual-theoretical framework is related with the attempt to clarify different linguistic uses of the toleration, the semantics of the concept and presenting circumstances, requirements, levels, degrees and forms of the category. Methodologically, the objective is to abolish the hierarchy between kâfir (infidel) and zındîk/ilhâd (heretic) in terms of identification of subjects of toleration/intolerance in the Ottoman Empire. In order to apply this conceptual-theoretical framework and methodology concerning the idea/practice of toleration, this study focuses on the sixteenth-century Ottoman Empire, particularly its laws (firmans, fetvâ, Ottoman criminal law) and its conception of justice, which is conceptualized as the most important requirement of toleration. The objective is to argue how justice primarily regulated society in order to sustain public order and to iv prevent political and economic instability. The idea/practice of toleration/intolerance, in this sense, is discussed as the policy that was incorporated into the discourse of the Ottoman Empire to the extent that it contributed to the regulation objective of justice as the art of government, which was pragmatic and prudent in essence. In accordance with this framework, the idea/practice of tolerance in the sixteenth-century Ottoman Empire is conceptualized as contemptuous tolerance, followed by the analysis of its laws. Intolerance, on the other hand, is named as punitive intolerance which aims for either the reform or the incapacitation of the heretics and infidels in the Ottoman lands. Pek tabii, bu analiz yapılırken, ortaya koyulan teorik çerçeve ve metodoloji, Osmanlı düşünme biçimi dikkate alınarak tekrar formüle edilecektir. Kavramsal-teorik bir çerçevenin sunulmasının amacı, hoşgörü/hoşgörüsüzlük kavramlarının farklı dilsel kullanımlarını, semantiğini, koşullarını, gereklerini, seviyelerini, derecelerini ve formlarını aydınlatmaktır. Metodolojik katkı ise, genellikle Osmanlı hoşgörüsünün/hoşgörüsüzlüğünün özneleri olarak tartışılan gayri-müslimlerin yanı sıra, Osmanlı hoşgörüsü/hoşgörüsüzlüğü söz konusu olduğunda heretiklerin (Şiiler ve Şii eğilimli heterodoks tarikatlar) ve Sûfîlerin de en az gayri-Müslimler kadar önemli özneler olduğuna vi dikkat çekmek olacaktır. Diğer bir deyişle, Osmanlı hoşgörüsü/hoşgörüsüzlüğü deneyimi, söz konusu kavramsal-teorik çerçeve aracılığıyla analiz edilecek ve dinsel “Öteki”nin sınırları Şii ve Şii eğilimli heterodoks tarikatlar ile Sûfîleri da içine alacak şekilde genişletilecektir. Bu kavramsal-teorik çerçeveyi uygulamak ve metodolojinin geçerliliğini tartışmak için onaltıncı yüzyıl Osmanlı İmparatorluğu seçilmiştir. Introduction The Ottomans and the Caliphate With the fall of Baghdad in 1258, the historical caliphate, embodied by the Ab- basid Empire, formally ended with traumatic consequences that, in response, facilitated the rise of a new wave of self-r eflection, exploration, and experi- mentation in all segments of Islamicate societies.1 In the absence of the impe- rial caliphate, along with the rise of independent regional Muslim dynasties from the fourteenth century onwards, the idea of the caliphate, reinterpreted in response to profound changes taking place in the broader Muslim com- munity, regained its prominence in Islamic political discourse, and, with the rise of the Ottoman Empire, became the linchpin of imperial ideology in the sixteenth century. Modern studies on the question of Muslim rulership re- peatedly assume that the historical caliphate, as conceived by Muslim jurists during the Abbasid period (c. 750– 1258), continued to define both the concept and the institution in subsequent political thought and praxis. This assump- tion confines the theoretical construction of the caliphate to jurisprudence, overlooks the impact of later historical experiences, and disregards the forma- tive influence of broader intellectual traditions in framing the caliphate as both an institution and an ideal. The post-Abbasid caliphate, or the making of the non- Arab caliph in the Ottoman case, was reconstructed in the language of Sufism infused with indigenous traditions of rulership and shaped by defin- ing historical experiences, rather than through the juristic canon of medieval universalism.

K Harvard University Why Ruled by Them? “Why and how,” asks Norbert Elias, introducing his study on the 18th-century French court, “does the right to exercise broad powers, to make decisions about the lives of millions of people, come to reside for years in the hands of one person, and why do those same people persist in their willingness to abide by the decisions made on their behalf?” Given that it is possible to get rid of monarchs by assassination and, in extreme cases, by a change of dynasty, he goes on to wonder why it never occurred to anyone that it might be possible to abandon the existing form of government, namely the monarchy, entirely.1 The answers to Elias’s questions, which pertain to an era when the state’s absolutism was at its peak, can only be found by exposing the relationship between the ruling authority and its subjects. How the subjects came to accept this situation, and why they continued to accede to its existence, are, in essence, the basic questions to be addressed here with respect to the Ottoman state. One could argue that until the 19th century political consciousness had not yet gone through the necessary secularization process in many parts of the world. This is certainly true, but regarding the Ottoman population there is something else to ponder. As an attempt to break away from a strictly territorial understanding of sovereignty as a fixed legal construct, it explores shifting definitions of sovereignty within and across the boundaries of the Ottoman Empire as well as its semi-autonomous provinces. It argues that Ottoman sovereignty was constantly re-defined by inter-imperial rivalries, jurisdictional politics and the formation of modern subjecthood and citizenship in the emerging arena of international law during the period in question. Exploring what it meant to be an Ottoman and a foreigner in the Ottoman Empire during this period, I argue that subjecthood; nationality and citizenship often appear as instrumental categories incidentally utilized by ordinary individuals when deemed necessary. A careful examination of the Ottoman passport regime, on the other hand, proves that there already existed a prolonged process of experimentation on individual documentation and movement controls during the second half of the nineteenth history. Studying a collection of identity cards and passports, I argue that individual documentation was more important for some subjects than others, who needed to maintain and negotiate their identities under overlapping structures of multiple sovereignties.

Such an approach to Bosnian history can be misleading, due to the categories on which it is based (“tradition” versus “modernity”) and the role it attributes to internal and external actors. As far as the inter-war period (1918-1941) is concerned, it plays a secondary part in this approach, and is mainly dealt with by historians interested in the inter-ethnic tensions which contributed to the collapse of the first Yugoslav state in 1941.1 Bosnian society, however, experienced deep transformations within the Kingdom of Serbs, Croats and Slovenes, renamed the Kingdom of Yugoslavia in 1929.

News: Saudi Arabia’s Ministry of Education has made a series of modifications to its history textbooks altering the legacy of the Ottoman Empire and its former rule over parts of the Arabian Peninsula. While the former curriculum taught the topic referencing the Ottoman Caliphate, the new curriculum will now cover the Empire’s “occupation”, crimes and subsequent collapse to pupils in the lower years of high school. (MiddleEastMonitor) Comment: Do the sons deny their father, Abdul Aziz ibn Saud!! Some speculate whether or not Al Saud family are defectors of the Caliphate (Uthmani Khilafah). Some of the maps produced (and available online) carefully exclude the section of Nejd and indicate authority of Ottoman Caliphate on the boundaries of the peninsula and excluding Nejd. Such debates bring about some sort of legitimacy to the rule of Al Saud in the sense that a territory hitherto not governed under the Caliphate was brought under the governance of Al Saud. This is far from the truth! In brief, the presence of Al Saud in the Arabian Peninsula first came about in the mid-18th century which is the time of Muhammad ibn Saud and Muhammad ibn Al Wahab when they rebelled against the Ottoman rule and brought a small area in Nejd under their control. In the early 19th century, the Ottoman Caliphate fully removed their presence. In early 20th century, Abdul Aziz ibn Saud returned from exile from Kuwait, fought and defeated the Ottoman authority under Ibn Rashid and lay claim to Nejd. The aftermath of these events came about as the founding of Kingdom of Saudi Arabia.

    Some aspects of Tu rco-African Relations with special reference to the Sudan Yusuf Fadl Hasan Introduction Turkey’s relation with Africa is old, it goes back to the sixteenth century. It had developed political, cultural and economic relations with the Arab North African countries, the Nilotic Sudan and some strategic parts in East Africa. There was no significant presence or relation with Sub-Saharan Africa. However, the religious bond linked nearly all-African Muslims especially those of Bilad al-Sudan and North-East Africa with the Ottoman Caliphate – the Servitor of the Two Holy Places – Mecca and Medina is of great signifi- cance. Although the Sudan is an Afro-Arab country, much influenced by the Ottoman Empire, like other Arab countries, I am considering it in this paper as a Sub-Saharan African country. Africa with its vast resources now represents the world new Economic Frontier and hence it is laid open to tough competition among the highly developed nations. Mighty in civilization, well armed as a regional power and equipped with the characteristic of a modern state. Turkey aims at developing its relations with the African continent. In 1998, an Action Plan of the Turkish Foreign Policy of Opening Up to Africa was initiated. On 21st, September 2005. H. E. Mr. Abdullah Gül, the Deputy Prime Minister and Minister of Foreign Affairs, of the Republic of Turkey, in his speech to the 60th session of United Nations General Assembly states: “We attach great importance to fur- thering our relations and cooperation with the African Continent.
