Signature of Supervisor /"t�\(� 2-v1 \ Date ABSTRACT Attempts to engage Aboriginal peoples in resource and environmental management decision-making process, fo r the most part, have been characterized as tokenism (Bowie 2007). This has left Aboriginal peoples frustrated and disillusioned. This thesis uses a theory of civil engagement, Arnstein's (1969) ladder of citizen participation, as a framework to interpret the level of Aboriginal consultation conducted during the Ontario Mining Act Modernization (MAM) process. This case study gauged the current state of public participation practices by examining Aboriginal peoples' participation and influence in decision making. In August 2008 the Ontario Ministry of Northern Development Mines and Forests (MNDMF) initiated a consultation process to modernizethe Mining Act. The MAM sought to find a balance between the wants of the mining industry, Aboriginal peoples, environmental organizations and private landowners. My case study fo cused solely on the consultation processes conducted with Aboriginal communities and organizations between August 2008 and December 2010. To gain insight into this process I did a documentation review and I conducted 26 interviews with Ontario political leaders, Aboriginal leaders, lawyers, elders, economic developmental officers and MNDMF staff. My analysis fo und the MAM Aboriginal consultation was flawed and I positioned the level of participation in decision making ranging fromIn forming to Partnership rungs on Arnstein's ladder. Arnstein's framework was not entirely compatible to judge Aboriginal consultation in Ontario. I added detail to the ladder to make it more pertinent for Aboriginal case studies in resource management. I provide recommendations to improve consultation processes, such as, setting realistic timeframes, addressingcapacity issues and including Aboriginal peoples in designingthe consultation process. Unfortunately, I am doubtful they will be instituted because of the different interpretations of treaties and a governmental lack of interest in power sharing. I believe until such time as the provincial government is prepared to make major systemic changes to how they interact with Aboriginal peoples, consultation processes will remain unsatisfactory from an Aboriginal and citizen engagement perspective. Consequently, civil activism and legal action will be options for Aboriginal groups in the push to change specificlegis lation. The land was once a burial ground for the local Métis community. As the present church decided to merge with another, the diocese decided, in the spirit of reconciliation, that the land and buildings should be returned to its original inhabitants. As the transfer is recent, the Métis Nation of Ontario’s Historic Sault Ste Marie Métis Council is currently envisioning how this space can be useful for the Métis, and create dialogue and relationship between Métis and non-Métis people. This thesis explores the historical colonial logics which allowed for the initial dispossession of the Métis from their home territory, focussing on the themes of gender, race, and land. It will then discern how the land return challenges colonial rationales and offers reconciliatory and decolonial potential. Final Report for the Ipperwash Inquiry—March 31, 2005 - by Jean Teillet The Role of the Natural Resources Regulatory Regime in Aboriginal Rights Disputes in Ontario EXECUTIVE SUMMARY1 The quest was to look at the role of the natural resources regulatory regime in Aboriginal rights disputes in Ontario. The fact that there are Aboriginal disputes is, to put it quite simply, indisputable. The fact that such disputes have been a feature of the history of Ontario from its inception is also indisputable. The reason for these Aboriginal rights disputes is simple to identify. Aboriginal peoples resist dispossession of their lands and resources. This paper sets out several examples of these Aboriginal rights disputes. The examples cover almost two hundred and fifty years, from the late 1700s to the events of this past year. The examples cover the entire geography of Ontario and they represent all of the Aboriginal peoples who live in Ontario. The examples show how and where the disputes are fought—in courts, on blockades, in parks, on roads, and in the political back rooms of the province. The natural resources regulatory regime plays a significant role in Aboriginal rights disputes because it functions as the many-armed mechanism by which Ontario, at the expense of Aboriginal peoples, originally settled the province and now implements its development. The norm is that the natural resources regulatory regime is applied with full force and vigour to Aboriginal peoples without accommodation of their Aboriginal rights.

    SEEING WITH TWO EYES: COLONIAL POLICY, THE HURON TRACT TREATY AND CHANGES IN THE LAND IN LAMBTON COUNTY, 1780-1867 KAREN JEAN TRAVERS A DISSERTATION SUBMITTED TO THE FACULTY OF GRADUATE STUDIES IN PARTIAL FULFILMENT OF THE REQUIREMENTS FOR THE DEGREE OF DOCTOR OF PHILOSOPHY GRADUATE PROGRAM IN HISTORY YORK UNIVERSITY TORONTO, CANADA JUNE 2015 © KAREN TRAVERS, 2015 ABSTRACT This dissertation explores the histories of Walpole Island (Bkejwanong), Sarnia (Aamjiwnaang), and Kettle and Stoney Point (Wiiwkwedong and Aazhoodena) between 1790 and 1867 in what became Lambton County, Ontario. Anishinabe peoples faced tremendous challenges during this crucial period in their histories stemming from the loss of the Ohio Valley, non-native settlement, and intense pressure to surrender the land and settle permanently on reserves. With few exceptions, literature on the subject of Upper Canadian history and Indian policy largely accepts the decline of Anishinabe communities as an inevitable consequence of demilitarization after the War of 1812. The fact that Anishinabe peoples continue to live in these same communities as they have for hundreds of years, complicates such analyses. Through the lens of ‘two-eyed seeing’ I interrogate this contradiction and explore the many ways that the Anishinabeg sought to combine Indigenous knowledge and worldviews with the tools to survive in Eurocanadian economies between 1790 and 1867. While this story is not one of swift decline, I argue that Indigenous leaders sought a future for themselves that differed fundamentally from the one that unfolded in the years before Confederation. This study uses petitions, Indian Affairs and municipal documents to explore the confluence of local processes that undermined Anishinabe attempts to co-exist with Eurocanadians.
