    TRUST, BUT VERIFY: WHY THE BLOCKCHAIN NEEDS THE LAW Kevin Werbach† ABSTRACT The blockchain could be the most consequential development in information technology since the Internet. Created to support the Bitcoin digital currency, the blockchain is actually something deeper: a novel solution to the age-old human problem of trust. Its potential is extraordinary. Yet, this approach may not promote trust at all without effective governance. Wholly divorced from legal enforcement, blockchain-based systems may be counterproductive or even dangerous. And they are less insulated from the law’s reach than it seems. The central question is not how to regulate blockchains but how blockchains regulate. They may supplement, complement, or substitute for legal enforcement. Excessive or premature application of rigid legal obligations will stymie innovation and forego opportunities to leverage technology to achieve public policy objectives. Blockchain developers and legal institutions can work together. Each must recognize the unique affordances of the other system.     III MEMETIC REFRAMING Christian Patterson’s Redheaded Peckerwood In December 1957, Charles Starkweather and his girlfriend Caril Ann Fugate embarked on a murder spree that shocked the US population. And even today, more than sixty years later, the so-called ‘Starkweather case’ keeps haunting the North American people as part of the country’s collective imagination. This situation is testified to by Christian Patterson’s evolving photobook Redheaded Peckerwood (2011, 2012, 2013),404 which contains a visually diverse selection of photographs, each of which points suggestively to the Starkweather case.405 The historical murder spree is undoubtedly Redheaded Peckerwood’s narrative centre. However, I argue that the criminal case merely serves a reflection on how ‘frames’, which are sets of conventions that govern the representation of historical events, are disseminated in culture.406 That argument, I claim, is conditioned by a memetic principle of rereading that allows the frame to appear multiple times according to the meme’s emergent logic of imitation through variation. ‘Memes’, according to Richard Dawkins’s initial definition of the phenomenon, are units of cultural transmission that propagate themselves in ever-changing form by leaping from brain to brain, often via magazines, computers, movies, and other technological platforms.407 Humans cannot entirely control these processes,408 and I argue that the same might be said of the process of rereading Redheaded Peckerwood, since it is partially governed by algorithms. The smartphone revolution around 2010 introduces the so-called ‘post-digital’ era, that is, the situation wherein humans no longer control the digital realm, since portable digital devices allow for a permanent extension of subjectivity across the Internet.409 Within this contemporary context, I contend that humans are habituated to meeting ambiguity and elusiveness with immediate online searches.

The Canadian independent media and investment research company Corporate Knights put the Belgian business at the top of their latest Global 100 ranking, nabbing the gold from Brazilian cosmetics company Natura and the Norwegian oil company Statoil. Umicore specialises in recycling technology and manufactures catalysts for cars which reduce pollution. It also recycles materials like gold, copper, nickel and rare metals such as palladium from used car batteries and printing plates. Ecological efficiency is high on the agenda of the company, which plans on-site wind turbines and aims to reduce its level of CO2 emissions by 20% in 2015 compared to 2006. The fact that the corporation has a one-to-five ratio of female representatives on their board of directors and a CEO (Marc Grynberg) who earns ‘only’ 34 times as much as the average employee, ensured Umicore’s exceptional score as far as the social component of the index is concerned. In 1989, Umicore was set up after the merger of mining giant Union Minière and the lead- processing plant Metallurgie. The company became one of the most spectacular and successful industrial reconversions in Belgium and has gradually managed to position itself as a global player among major recycling businesses.
