Chapter 17 Leaving Islam for Christianity: Asylum Seeker Converts Nora Stene 1 Introduction This chapter presents a case study from Norway, and explores why and how some asylum seekers leave one religion for another: more specifically Islam for Christianity. The context of their conversion is migration and the difficult situ- ation of asylum seekers. The chapter also highlights perspectives and method- ologies especially relevant to this field of study. There are no available official statistics on the number of asylum seeker converts in Norway. However, the Norwegian Immigration Appeals Board (une) estimates that between 2001 and 2015 approximately 950 individuals converted from Islam to Christianity – listing fear of religious persecution as support for their asylum appeals. The great majority of them were from Iran or Afghanistan, but une data has registered smaller numbers of converts from a total of 23 different countries (details in Stene 2016, personal communication une 2017). It should be noted that in order to be considered a convert by the une there must be an announcement of faith, baptism, and attachment to a local Christian congregation (une 2016). The actual number of converts may also be higher than the figure given above, as asylum seekers may not mention conversion in their applications –or appeals. The une has observed that conversions/baptisms usually take place during the appeal-process, after an initial asylum application has been rejected. In this period a number of asylum seekers have contact with Christian congregations (une 2016). Clearly critical to certain kinds of active proselytisation among asylum seekers, the une, human rights- and church umbrella-organisations have issued guidelines to protect asylum seekers from what has been termed “unwanted attention” from missionaries (details in Stene 2016:207). -

Yaqeen Institute for Islamic Research 3 | The Issue of Apostasy in Islam The Shari’ah consists of some laws that remain the same regardless of changing circumstances and others that change with them. Most of the Shari’ah is up to individual Muslims to follow in their own lives. Some are for judges to implement in courts. Finally, the third set of laws is for the ruler or political authority to implement based on the best interests of society. The Shari’ah ruling on Muslims who decide to leave Islam belongs to this third group. Implemented in the past to protect the integrity of the Muslim community, today this important goal can best be reached by Muslim governments using their right to set punishments for apostasy aside. One of the most common accusations leveled against Islam involves the freedom of religion. The problem, according to critics: Islam doesn’t have any. This criticism might strike some as odd since it has been well established that both the religion of Islam and Islamic civilization have shown a level of religious tolerance that would make modern Americans blush. -

Political Islam includes the establishment of Sharia (the body of Islamic religious law), which contains harsh restrictions on freedom of expression, as well as harsh punishments for apostasy and blasphemy and standards at odds with modern Western norms of gender equality. Political Islamists are actively attempting to extend the reach of Sharia over Western cultures and legal systems. This report addresses how, through means of actual physical violence, threats and intimidation, legal action, and political pressure, the emancipation of Muslim women is stunted if not ground to a halt. -

A prefatory comment: Too often, in my experience, Muslim-Christian dialogue, motivated by a praiseworthy and entirely understandable desire to minimize violence and destructive prejudice, tends to emphasize whatever the two religions share in common. Interfaith gatherings motivated by such concerns sometimes neglect points of substantive difference between the faiths, especially with regard to Islamic and Christian understandings of Jesus. This is regrettable, and certainly not the approach I propose to attempt as you and I undertake this course. Instead, while acknowledging certain similarities between Islam and Christianity, and giving attention to the highly important commonalities they share with Judaism (all three faiths, it should be noted, are given a special shared status in Islamic theology as al-adyan al- samawiyah, “the heavenly religions”), I nonetheless will emphasize the radical differences between Islam and Christianity in their understandings of Jesus. I do this for a specific reason. I believe that highlighting only the similarities between these traditions does a disservice to both, whereas a critical yet sympathetic comparison of Islamic and Christian Christologies allows us to appreciate the distinctive spiritual treasures available in each religion. -

Marsda Adisucipto Yogyakarta Email: [email protected] Abstract: This paper starts from the contradiction between the concept of religious freedom in the Qur'an and the concept of apostasy ( riddah ) in classical Islamic jurisprudence. Some jurists believe that the concept of religious freedom has been reduced to a sectarian and discriminative concept, while riddah itself has undergone a shift in its meaning because of the hasty and out-of-context interpretation. Many jurists have established death penalties for every apostasy regardless some limitations on the concept of riddah . This paper presents some Islamic jurist views on riddah , especially in the classical jurisprudence, and also traces back the historical context of riddah in the past in order to understand the reasons for the rise of the death penalty for apostasy. Abstrak : Tulisan ini berangkat dari persoalan kontradiksi antara konsep kebebasan beragama dalam Al-Qur'an dan konsep murtad ( riddah ) dalam khasanah fikih klasik. Beberapa ahli fikih percaya bahwa konsep kebebasan beragama telah direduksi menjadi sebuah konsep yang sektarian dan diskriminatif, sementara riddah itu sendiri telah mengalami pergeseran makna karena interpretasi yang tergesa-gesa dan keluar dari konteksnya. Banyak ahli fikih telah menetapkan hukuman mati bagi setiap murtad tanpa ada pembatasan pada konsep riddah.Makalah ini menyajikan beberapa pandangan ahli fikih tentang riddah , terutama masa klasik klasik, dan juga mencoba menelusuri konteks historis riddah di masa lalu untuk memahami mengapa munculnya hukuman mati bagi murtad. MARBURG JOURNAL OF RELIGION, Vol. 18, No. 1 (2016) 1 “Coming Out” or “Staying in the Closet”– Deconversion Narratives of Muslim Apostates in Jordan Katarzyna Sidło Abstract This article describes a pilot study conducted between 22.03.2013 and 22.05.2013 among deconverts from Islam in Jordan. Due to the religious and cultural taboo surrounding apostasy, those who left Islam are notoriously difficult to access in a systematic way and constitute what is known in social research as a ‘hidden’ or ‘hard-to-reach’ population. Consequently, the non-probability sampling methods, namely an online survey, were used to recruit participants to the study. The objective of this research was threefold: (a) exploring the community of apostates from Islam in Jordan, (b) understanding the rationale behind decision to disaffiliate from Islam, and (c) analysing their narratives of deconversion. In addition, this paper examines the changes that occurred in respondents’ lives as a result of their apostasy and the degree of secrecy about their decision. Background The problem of apostasy from Islam is a complex and controversial one. The Quran itself does not explicitly name death as a prescribed penalty for abandoning Islam. The commonly agreed interpretation of the few verses (Arabic – ayats) that mention apostasy is to the effect that Allah will inflict punishment on apostates in the afterlife (Quran, 2:17, 3:87, 9:74, 18:291; usually invoked in this context is ayat from surah Al-Baqara (2:256) “There is no compulsion in religion”2). Chapter 7 Leaving Islam Christine Schirrmacher 1 Introduction Looked at from a global perspective, possibly more people than ever are chang- ing or leaving their religion. At the same time, while it is legally impossible to leave Islam in all Middle Eastern countries, it is considered to be a punishable crime under Sharia law, and the death penalty can be applied in a handful of countries like Saudi-Arabia or Iran. Interestingly enough, the Koran does not seem to have a clear verdict on apostasy. Muslim theologians hold different views as to whether Islam favors complete religious freedom or whether the culprit is unpunishable as long as he does not rock the boat of the community. Many Muslim theologians still hold to the death penalty. 2 Key Terms The term for “unbelief” or “non-belief” (Arabic: kufr) is used 482 times in the Koran. In at least 19 verses it is used in the sense of turning away or falling away from Islam (Hallaq 2001: 119–122). There is no mention in the Koran of the Ara- bic term for “apostasy,” which is ridda and irtidād in Arabic. However, one finds neither in the Koran nor in tradition an unambiguous definition for when apostasy from Islam (Arabic: al-ruǧūʿ ʿan dīn al-islām or qaṭʿ al-islām) is unquestionably present, how it can be determined, and whether saying the creed is sufficient in order to avert the charge of apostasy (Griffel 1998: 356). Indeed, there is widespread consensus that apostasy undoubtedly exists where the truth of the Koran is denied, where blasphemy is committed against God, Islam, or Muhammad, and where breaking away from the Islamic faith in word or deed occurs. -

Title: Assessing Apostasy, Blasphemy and Excommunication (takfir) in Islam and Their Modern Application by States and Non-State Actors A Thesis Submitted for the Degree of Doctor of Philosophy by Masaki Nagata Supervised by Dr. Mohamed Elewa Badar Brunel Law School Brunel University June 2016 Abstract In certain contemporary Muslim majority states apostasy and blasphemy are not merely religious sins; they are acts which potentially have legal, or extra-legal, consequences. Although apostasy has not been criminalised in many such states, extrajudicial killings of apostates are carried out by some extremist groups and individuals. Such groups always justify these murders of fellow Muslims and non-Muslims on the grounds of apostasy and blasphemy. The concept and use of takfir (excommunication) is also a serious issue in Muslim majority states. Groups such as Daesh (also known as Islamic State of Iraq and Syria) rely on takfir to attack fellow Muslims, despite there being no legal basis in Shari’a for the use of takfir or for criminalising apostasy. Although the concept was developed by people, not God, takfir are now being used to bypass rational human judgement. Their use plays a major role in many of the religious issues confronting Muslim majority states, such as the criminalisation of apostasy and blasphemy. This thesis analyses the central issues of apostasy, blasphemy and takfir collectively, as their history and their contemporary use and misuse by extremist groups are inextricably entwined. The key finding is that the right to punish apostasy and blasphemy and to issue declarations of excommunication (takfir), all originally reserved in Islam for God only, have been appropriated by man.
