The Council is required under the Licensing Act 2003 to review its Statement of Licensing Act Policy at least every 5 years.

The current policy sets out Cornwall Council’s general approach to making licensing decisions in relation to the following licensable activities:-

• The sale by retail of alcohol • The supply of alcohol at members’ clubs • The provision of regulated entertainment (including live/recorded music, films, indoor sporting, boxing & wrestling) • The provision of late night refreshment (supply of hot food/hot drink between 11pm and 5am)

The review takes into account changes that have occurred to the legislation and statutory guidance since the last publication of the policy, as well as recommendations from the Licensing Act Committee.

For ease of reference, you will see the proposed deletions, amendments and additions in shaded text in the attached document.

As part of the policy consultation, the Licensing Authority are also reviewing all towns in Cornwall in relation to the cumulative impact of licensed premises.

Cumulative impact means the potential impact on the promotion of the licensing objectives of a significant number of licensed premises concentrated in one area.

The licensing objectives are:

✓ Prevention of crime and disorder ✓ Prevention of public nuisance ✓ Public safety

✓ Protection of children from harm

You will see from the existing policy, there are currently 4 cumulative impact policies in place, within , Falmouth, and , in relation to late night alcohol and late night refreshment premises. Maps showing the cumulative impact boundaries for each of those towns are included in the attached policy at Appendix B, C, D & E on pages 43-46.

The current cumulative impact policies were implemented by the Licensing Authority as a result of evidence being provided by the Police and Public Health. The Authority considers that the number of premises licences in these areas is such that it is likely that granting further licences would be inconsistent with their duty to promote the licensing objectives.

In addition to the wider policy review, perhaps you can let me any comments in relation to the cumulative impact of licensed premises in your area. In particular if your town/parish are within a current cumulative impact area, please let me have your comments in relation to this and in particular, review the boundary of the current cumulative impact policy.

We will of course also be consulting with all responsible authorities designated under the Licensing Act, Cornwall Councillors and other partners/stakeholders such as the licensed trade, businesses, residents and representatives of businesses, trade and residents.

It is also proposed for a comparison to made of all towns in Cornwall in relation to cumulative impact; the Police and Public Health will be providing evidence for the Licensing Authority to consider in due course.

The full public consultation in relation to the revised policy, including the cumulative impact policies, will run until 5 December 2018.

All consultation responses will be referred to the Licensing Act Committee at its meeting on 18 December 2018 for them to consider, make any amendments as necessary and recommend the policy to Council for adoption.

8. Parade Tree - to consider Land & Heritage’s report following their inspection of T1101 and to authorise the clerk to request Conservation area consent from Cornwall Council.

Site Inspection – Lostwithiel Town Council – 21st September 2018

T1101 – Beech (Fagus sylvatica) – The Parade

I made a visit to this tree following a request by the councillors, due to the appearance of a fungal growth at the base. The decaying remains of Meripilus giganteus were present on two buttresses to the south and to the west. The fungal stage did not appear too advanced, and was present in 15% of the base/root plate circumference. Probing the immediate surface roots did not show decay, but there was cambium death to the surface of the south root buttress. Slight crown thinning and leaf yellowing on the south and west side of the tree reflects the issues seen at the base, and probably below ground within the root system.

The tree is weighted to the north, and is more likely to fall in line with or into the river. The affected buttresses increase this being the likelihood. There is no doubt that the presence of the fungus increases the risk of collapse, although it is often seen in a far more

advanced stage in other mature specimens. Given that the initial report recommends the removal of this tree within the next five years ‘’unless safety issues require it sooner’’, then I would follow the outcomes highlighted within the report. I suggest that Beech T1101 is scheduled for removal as soon as possible, and certainly within a 6-month timeframe.

9. World War I Commemorations – to consider the following: - a) The request to fly the Union flag at the Parade War Memorial from the morning of 9 November to the morning of 12 November. b) To note the drafted timetable of the Lostwithiel Centenary Commemorations.

Friday afternoon junior festival in St Bartholomew’s Church at 1400hr. Friday evening full festival of Remembrance in St. Bartholomew’s Church at 1845hrs. Sunday morning Armistice Day (Change to usual events) Meet at the Drill Hall for 1030hrs for parade to march to the War Memorial at 1045hrs. Commemoration and wreath laying, followed by National Anthem, parade reforms and marches to St Bartholomew’s Church for a memorial service. After service – dispersal. Sunday evening Final Centenary Commemoration at the War Memorial. Committee gather at site for 1830hrs to place bollard and barrier tape, locate the fire basket between the fixed barbecue stands place the fire extinguisher to hand and position the first aider nearby. 1844hrs light the fire At 1845hrs read Tribute to Millions

1850hrs poem (Rupert Brook-The Soldier) followed by the Elegy. They shall not… 1858hrs Bugler plays The Last Post. 1900hrs Two minutes silence. 1902hrs Kohima Epitaph. 1903hrs Piper plays a Lament. 1905hrs Church bells ring a special peal. 1907hrs dismantle, douse the fire and dispersal. Put up Union flag Friday afternoon and take down Sunday evening.

10. Edgcumbe House roof – to consider the price received via Scott & Co for a firm of steeplejacks to undertake a repair to the chimney at a cost of £500 plus Vat per day. (currently anticipated works will be completed within 1 working day).

We are pleased to quote as follows: With the use of rope access/Steeplejack technicians install access ladders to gain access to chimney at the above property for repair works to be carried.

• To install flash banding to lead flashings on chimney to stop the ingress of water into property below. • Whilst carrying out these works if anything else is found that we feel could be adding to the problem we will fix and report our findings once completed. • Due to the unknown condition of the chimney we cannot offer any guarantees that this will stop any water from getting in.

In this price we have allowed for one working day, any extra days if required will be charged at £500 per day.

The cost of the electrical installation for the external defibrillator cabinet at Lostwithiel Community Centre will be very close to 13

£300.00 incl. VAT that importantly includes electrical completion certificate.

External 24/7 defibrillator cabinets are crucial in Lostwithiel to give the essential cover required. It is understood that the opening times at the community centre are variable - Sudden cardiac arrest survival is totally dependent on 'drop to shock time' that according to the European Resuscitation Council (ERC) a shock delivered in the first minute the chances of survival up to 90% depreciating by 10% to 12% without one. This corresponds with our best in UK stats three lives saved in a week including an eight-year-old girl all shocked in a little over a minute with all making a full recovery.

It has also come to our attention the serious lack of awareness and CPR & AED training in Lostwithiel that includes none at the public access defibrillator (PAD) sites. A pattern has formed. Locations with closely linked PADs ant trained all being saved and those without training not surviving.

The RRMC provides onsite accredited CPR & AED training to the highest standards - Please see attachment example appraisals RRMC Principal Trainer Leon Hosking. The RRMC are a non-profit organisation comprised of dedicated unpaid volunteers. We do have training expenses to cover...Cost of expensive training equipment, insurances, replacement consumables, travel expenses, etc. The following concession offered:

• If we can arrange for PAD site training at Lostwithiel Community Centre, Earl of Chatham and Royal Oak Inn in one day - Total £100.00. • Community training - £100.00 per session - Maximum 16 at a time.

King George V playing field to consider the following: - a) To consider instructing the clerk to start the six-month trial of use of the river bank area by dog walkers from mid-October. b) To consider instructing the clerk to apply to Cornwall Council for King George V playing field excluding the river bank area to be included in the next Public Space Protection Order.

This storage item will cover a small amount of floor space and will fit in the court yard of Taprell House behind the old outdoor toilet with very little visual impact.

The front of this storage unit opens up completely and the lid can be lifted allowing for easy access to the signs. This storage unit should hold approximately 15 signs.

A typical shed would cover move floor space as we would have to have additional room to manoeuvre the signs within the shed.
