REQUEST

The applicant, KIMCO Realty, has submitted Sketch Plan application SK-7837-2018, to establish a new sketch plan for the Market Square shopping center, in accordance with § 24- 160D.9(a) “Application for the MXD Zone and sketch plan approval” of the City Code. The Application proposes up to 1,200,000 square feet of commercial / non-residential uses and up to 1,614 residential units on approximately 21 acres.

Location

GENERAL INFORMATION

LOCATION:

The subject area of the application (“Site” or “Property”) is currently improved as the Market Square shopping center with approximately 251,207 square feet (SF) of gross floor area on ±21 acres. Existing improvements on the Property include nine (9) one and two-story buildings and surface parking lots. The Property is bisected by Market Street and Center Point Way, and has frontage along Kentlands Boulevard. The shopping center is adjacent to the Kentlands and Lakelands Neighborhoods as well as the Kentlands Square shopping center. Access to the property is obtained along Kentlands Boulevard to the north, from Main Street to the south, and Chevy Chase Street to the east.

ADEQUATE PUBLIC FACILITIES ORDINANCE (APFO):

Water and Sewer Services and Public Utilities

The Property is currently developed with both water and sewer service and has WSSC categories of S-1 and W-1.

Fire and Emergency Services

The City’s Adequate Public Facilities Ordinance (APFO) requires that any development project be served by at least two fire stations within a ten-minute response time. The Site is located within a ten-minute response time of four fire stations:

• Station 8 (Gaithersburg/Washington Grove) (Montgomery Village Avenue) • Station 31 (Rockville) • Station 32 (Travilah)

Therefore, adequate fire and emergency services are provided.

Schools

The proposed development is located within the Quince Orchard cluster of the Montgomery County Public School (MCPS) system. Within this cluster, the schools that currently serve the proposed development are Rachel Carson Elementary School, Lakelands Park Middle School, and Quince Orchard High School. Under current code, the schools test of adequacy will be performed at the time of any schematic development plan submittal involving residential uses. Sketch plans only provide a range of possible unit counts whereas schematic development plans define specific unit counts.

Traffic Impacts

The City’s Traffic Impact Study regulations do not require the submission of a Traffic Impact Study at the time of Sketch Plan; however, a study will be submitted and reflect development phasing established during the schematic development plan process. Sketch plans only provide a range of possible residential and commercial densities whereas schematic development plans define specific counts on which to conduct an analysis.

EXISTING LAND USE/PHYSICAL CHARACTERISTICS:

The Property, as discussed, is a fully developed strip commercial shopping center with surface parking lots. The Property currently has 251,207 SF of commercial uses. There is no forest identified on or adjacent to the site with all vegetation being related to planted landscaping. There are no specimen trees identified. The property contains no intermittent or perennial streams on or within 200 feet of the property. A Natural Resources Inventory/Forest Stand Delineation (NRI/FSD) reflecting current conditions, was approved March 27, 20171.

NEIGHBORHOOD LAND USE AND ZONING:

The subject property is irregular in shape and is located within the Kentlands subdivision. The property is bounded by Kentlands Boulevard to the north and a variety of residential and commercial uses to the east, south, and west. The property is zoned Mixed Use Development (MXD) and is currently developed as a retail/commercial center. The surrounding properties are all zoned MXD.

ZONING AND SITE PLAN HISTORY:

Annexation:

The Property was annexed by the Mayor and Town Council into the City of Gaithersburg as part of a greater area that contained approximately 928 acres of land in 1967 as Annexation X- 088 by resolution R-22-66. This annexation included what are now Kentlands, Lakelands, Timberbrook, and portions of Washingtonian Woods. The subject Property was zoned R-A (Low Density Residential) as a holding zone at the time of annexation.

Zoning and Site Plans:

The City, on February 6, 1989, approved Zoning Map Amendment Application Z-262, Ordinance O-3-89, which rezoned all of the “Kentlands” property (352 acres) from the R-A (Low Density Residential) Zone to the MXD (Mixed Use Development) Zone. As part of this rezoning, the City approved an accompanying sketch plan. This original Zoning Map Amendment was followed by Z-280, known as "The Lakelands", that rezoned and established a sketch plan for 343.22 acres of land from the I-3 (Industrial Office Park), E-1 (Urban Employment), R-A (Low Density Residential), C-B (Commercial Buffer), and C-1 (Local Commercial) Zones to the MXD (Mixed Use Development) Zone on February 3, 1997 by Ordinance O-6-97.

The existing development of Market Square was constructed in accordance with Resolution R-86-97, that approved Schematic Development Plan SDP-7-1 (Midtown Phase 2, Section 3 & 4, Market Square, and Phase One of Lakelands) on July 7, 1997. Shortly thereafter, the City granted final site plan K-1084 on October 14, 1997. Since the time of these approvals, numerous amendments to the Site Plan have been processed and approved to allow for modifications and alterations to the existing retail center.

Master Plan:

The Kentlands Boulevard Commercial District (KBCD) is an 80 acre commercial area divided by the four lane Kentlands Boulevard. The district was identified in the City’s 2003 Master Plan Update as one of ten Special Study Areas. The City, in June 2007, undertook developing the Kentlands Boulevard Commercial District Special Study Area Master Plan (Master Plan), which culminated in its adoption on May 5, 20082.

The KBCD

The Master Plan established the following overall goals for the KBCD:

Land Use & Intensity • Promote the future appropriate growth of Kentlands downtown with a healthy mix of uses to support the needs of the neighborhood, region and the use of the transit system. • Promote an increase in intensity of Downtown Kentlands as market demand grows and as infrastructure can support it. Downtown Kentlands should serve as a model of succession planning and excellent transit-oriented development. Transportation & Streets • Promote the improvement of the existing infrastructure network, while preparing for the inclusion of the Corridor Cities Transitway.

• Promote the alignment of the Corridor Cities Transitway on the Kentlands side of Great Seneca Highway, continuing to promote the strategy of locating Transit Stations in Town Centers throughout the City of Gaithersburg. Public Spaces & Streetscapes • Provide appropriately scaled civic space in the northern section of the District. • Replace “drive aisles” in current parking lots with properly detailed streets, as new development warrants. • Improve the Public Realm of Kentlands Boulevard to establish a better pedestrian environment. • Improve pedestrian crossing experience at Kentlands Boulevard at key locations. Form & Character • Gradually replace the Shopping Centers in the KBCD with a more urban model (Downtown Kentlands), through the conversion of surface parking lots to transit-oriented development sites. Do not permit redevelopment of sites that in any way preclude future Transit-Oriented Development. • Encourage sustainable development strategies at every level – from site work to building technology to energy efficiency. • Buildings should shape the public realm through proper placement close to the sidewalk.

The Master Plan further divides the KBCD into blocks with individual recommendations.

REQUIRED ACTIONS

Sketch Plan SK-7837-2018

As stated, the Applicant is requesting a new sketch plan for the Property. This sketch plan would supersede the existing sketch plan of record established for the entire Kentlands development and discussed previously. Sketch plans must be amended in accordance with Section 24-198(c) “Amendments to concept plans, sketch plans, and schematic development plans” which states:

(1) The concept plan, sketch plan or schematic development plan must be amended when: (i) Change in use involved. (ii) Changes other than to use: a. Increases the height of building or signage by the (10) feet or more, or b. Materially changes the orientation or siting of buildings, parking accessory uses, or c. Increases nonresidential building floor area by more than ten (10) percent or five thousand (5,000) square feet whichever is greater, or d. Increases by more than ten (10) percent or five (5) units the number of residential dwelling units whichever is greater, or e. Removes more than five (5) percent of area designated for conservation or other environmental preservation purposes.

How, procedurally, a sketch plan gets amended is directed by Section 24-198(c)(2) “For amendments involving change in use or changes other than to use”, plans may be amended at any time as follows:

(iii) Subsequent to council action to approve as follows: a. Filing of a new application in accordance with section 24-160D.9. b. Resubmission of the previous application to the mayor and city council for a courtesy review of the application, presented by the city planning staff, prior to action by the planning commission.

As this will be a multi-year, multi-phased project implementing a specific facet of an adopted Master Plan, a new application was filed.

Section 24-160D.10(a) states that the City Council may approve a sketch plan when they find the following:

(1) The application meets or accomplishes the purposes, objectives, and minimum standards and requirements of the zone; and (2) The application is in accord with recommendations in the applicable master plan for the area and is consistent with any special conditions or requirements contained in said master plan; and (3) The application and sketch plan will be internally and externally compatible and harmonious with existing and planned land uses in the MXD zoned areas and adjacent areas.

SK-7837-2018 SKETCH PLAN ELEMENTS:

The Applicant, as stated, has submitted an application seeking to establish a new sketch plan in accordance with § 24-160.D.9(a) “Application for the MXD Zone and sketch plan approval.” The Applicant, as part of the application, has submitted a justification/ statement of support outlining the purpose of the current request, including findings per § 24-160D.103.

The statement presents that the proposed sketch plan outlines Kimco’s long-term vision and creates the framework to transform the Property into a vibrant mix of uses. The intent of the proposed plan begins with the Master Plan’s call to create a quality public realm, accessible and connected places, a rich mix of uses, and a plan for incremental change, but improves upon this framework through key place-based interventions, through the introduction of appropriately scaled and located proposed open spaces, a street network based on existing circulation patterns, properly-scaled building heights, and a viable mix of residential and commercial uses driven by market conditions. The sketch plan provides a street grid that promotes and enhances connectivity to the surrounding area for vehicles, pedestrians, and bicycles. Moreover, the sketch plan outlines how the Property will be thoughtfully integrated within the context of the community and compatible with the future of the greater Kentlands Commercial District. In keeping with the spirit of the Master Plan, Kimco proposes to redevelop and reposition the Property in phases with mixed-use development.

The proposed SK-7503-2017 sketch plan4 provides a mixed-use community including residential, commercial, and retail uses. The sketch plan divides the Property into nine “Blocks”. The sketch plan includes up to 1,614 residential units which may be either rental or condominium and up to 1.2 million square feet of commercial uses, or a 1.28 floor area ratio (FAR) over the 21 acres. The following chart breaks down the densities and heights by block5:

The proposed uses are more expansive than what the Master Plan considered, accounting for a changing retail climate and market demands. The non-residential uses for the Property include office, restaurant, retail, personal service businesses, banks, hotels, integrated light manufacturing, private education, and amusement center. The following chart defines allowable uses by block:

The Applicant, in addition to modifying the Blocks, has expanded the Master Plan framework in several respects. First, the street network is more detailed to improve functionality, connectivity and accessibility. Second, the sketch plan adds proposed open spaces in areas that the Master Plan did not envision. The proposed street network hierarchy includes the following:

• Primary Site Circulation: These streets include active ground floor uses that encourage walkability through the Property including Market Street, Market Street East, Market Street West, and Center Point Way. • Secondary Site Circulation: These streets have retail and other non-residential uses at the ground floor, but begin to feel more residential in character and are expected to have less traffic making them excellent alternative routes for pedestrians and bicyclists. • Tertiary Service/Access Alley: These streets are intended to provide access within blocks to multiple garages and loading areas and sometimes serve as buffers between the Property and adjacent properties. • Service/Garage Access: Each Block will include thoughtfully located internal access to provide parking, service access, and loading areas.

The sketch plan includes locations and strategies that can create “A quality public realm by creating and maintaining a network of walkable streets; safe street crossings; attractive, accessible public spaces; and buildings whose form and design contribute to an attractive street environment” (Master Plan p. 4.4). The Plan defines which blocks may use various strategies and notes the locations for open spaces. These types of spaces include:

• Urban Plaza: An example of an urban plaza is the existing City-owned plaza that is at the southern terminus of Market Street. This type of area includes specialty paving or ground treatments, in-ground and above ground planter areas, seating areas, and lighting. These spaces serve as daily gathering places and can accommodate special events for larger groups such as outdoor concerts.

• Paseo / Pass-through: An example of what this space can be is shown in the near-term AFP approval. It includes reconfiguring sketch plan Block E to create an approximately 36’ wide paseo which serves as an amenity area for restaurants to have outside dining and a vibrant pedestrian experience and place to gather. • Open Green: In the context of the Property, this type of space would include smaller- scale pocket parks and green areas which serve as a place for people to gather and socialize. • Expanded Sidewalk: The sketch plan is founded on the Master Plan’s principle of activated and vibrant street levels. One way to achieve this is with generous width sidewalks that allow ample space for outside dining, planters, trees, lighting, bicycle racks, benches and other amenities that enhance the pedestrian experience.

SK-7837-2018 SKETCH PLAN PROPOSAL:

Blocks A & D: Block A allows up to 310 residential units and up to 520,000 square feet of commercial (either single use or a mix of uses), with a maximum height of 8 stories that steps down to 5 stories on the west side of the block. The line on the block is illustrative and not intended to denote the exact place where the height transition occurs. Block D allows up to 144 residential units, up to 175,000 square feet of commercial, or a mix of the uses with a maximum height of 6 stories.

Given the adjacency to a major artery, Kentlands Boulevard, Kimco proposes height in Block A that would allow up to 8 stories along Kentlands Boulevard to accommodate retail, parking, and residential. But, this height should step down to 5 stories as the building transitions to the existing live-work units along Main Street. On Block D, Kimco proposes up to 6 stories as a transition to the existing live-work units along Main Street which will maintain a good relationship of distance to height ratio with the neighboring properties.

Block B: This Block proposes up to 275 residential units and up to 450,000 square feet of commercial (either single use or a mix of uses), and a maximum height of 8 stories. Ground floor commercial is envisioned, thus reinforcing and promoting the pedestrian scaled retail environment along Market Street and Center Point Way. The eastern portion of Block B (coupled with Block E on the opposite side of Market Street) is further identified to continue to remain an important Commercial Core node of the Property. While there will be commercial uses throughout the street level, the intent of calling out this specific area is to ensure that it remains an important node of commercial activity as it connects Kentlands Boulevard with Main Street. Heights up to 8 stories are proposed on this block being an appropriate scale fronting Kentlands Boulevard which is a major artery through the community and at the center of the site where there is no direct adjacency to existing lower-density residences.

Block C: This Block proposes up to 150 residential units and up to 200,000 square feet of commercial (either single use or a mix of uses), and a maximum of 6 stories

Block E: This Block proposes up to 190 residential units and up to 310,000 square feet of commercial (either single use or a mix of uses), with a maximum height of 8 stories. The mixed-use on this block with street level retail reinforces Market Street and Center Point Way as shopping streets and work in concert with the development on either side of Market Street. The western portion of Block E (coupled with Block B on the opposite side of Market Street as noted above) is further identified to continue to remain an important Commercial Core node of the Property. While there will be commercial uses throughout the street level uses of the Property, the intent of calling out this specific area is to ensure that it remains an important node of commercial activity as it connects Kentlands Boulevard with Main Street.

Block F: This Block proposes up to 310 residential units and up to 150,000 square feet of commercial (either single use or a mix of uses), with a maximum height of 6 stories. The plan precludes townhouse, hotel, and single-purpose parking uses for this Block. Up to 6 stories are shown which would include a buffer area to the adjacent existing residential buildings and would be consistent with placing density along Kentlands Boulevard.

Blocks G & H: Block G allows up to 150 residential units and up to 170,000 square feet of commercial (either single use or a mix of uses). Block H allows up to 55 residential units and up to 170,000 square feet of commercial (either single use or a mix of uses). Both Blocks allow a maximum height of 6 stories that step down to 4 stories. The lines on the block are illustrative and not intended to denote the exact place where the height transition occurs.

Block J: This Block proposes up to 30 multi-family or senior living residential units and up to 20,000 square feet of commercial (either single use or a mix of uses), and limits the height to 2 stories. The intent is to continue a strong retail presence in this block and provide meaningful open areas in this important location that terminates the view down Market Street from Kentlands Boulevard.

SUMMARY:

The Applicant has submitted for consideration sketch plan application SK-7837-2018. This application reflects implementing the Kentlands Boulevard Commercial District Special Study Area Master Plan. The application has been submitted in accordance with § 24-160.D.9(a) of the City Code. A joint public hearing before the Mayor & City Council and the Planning Commission has been scheduled for April 16, 2018. Staff will continue to work with the Applicant on refining aspects and obligations of the plan following the public hearing and in response to any comments received into the record.

My wife and I moved to The Lakelands about 3 1/2 years ago. We love this place in all its aspects. We ‘downsized’ from a 3 acre country side wooded lot and a rather large house to a townhouse here (we have been ‘country folk’ for most of our 70+ years). We felt it time to be in a little more urban, diverse environment where we could walk to stores, restaurants, theaters, etc. That is all here.

If I have any concern for the future of this wonderful place, it would be the somewhat anemic main-street business area. While there are a few thriving businesses, many seem to be just making it or calling it quits. The missing ingredients are, I believe, customers. We just do not have the population to support a thriving down town. That is why I really think another 1000 or so dwelling units (apartments and condos, I assume) in taller buildings is a good idea (with a parking garage I assume). Much more retail and commercial space frightens me, though. We do not really seem to be able to support what we have.

1. CALL TO ORDER The Regular Session of the Mayor and City Council was called to order at 7:30 PM with Mayor Jud Ashman presiding.

3. REFLECTION Mayor Ashman called for a moment of silence and expressed condolences to Delegate David Fraser Hidalgo after the sudden passing of his wife.

8. JOINT PUBLIC HEARINGS A. Sketch Plan: SK-7837-2018 to Establish a New Sketch Plan for the Market Square Shopping Center

Long Range Planning Manager Robinson presented the above for joint public hearing. Notice of the hearing was advertised in the March 29 and April 5, 2018 issues of The Washington Post, property posted, notifications mailed, and placed on the City’s website. There are currently 16 exhibits in the record. Kimco Realty submitted the Sketch Plan application SK-7837-2018, proposing to establish a new sketch plan for the Market Square Shopping Center, in accordance with § 24-160D.9(a) “Application for the MXD Zone and sketch plan approval” of the City Code. The application proposes caps up to 1,200,000 square feet of commercial / non-residential uses and up to 1,614 residential units on approximately 21 acres.

For the public, staff explained what is addressed during sketch plan review once an application is received and its intent. Stated it is the first step in the mixed use development zone process. The sketch plan provides the overarching framework for all subsequent plans. It reflects the general compliance with any master plan recommendations for the property as it relates to land uses, heights, etc. It lays out the broad design pattern and connectivity network, and establishes the range of allowable heights, the commercial and residential densities and the collection of uses allowed. It affords the greatest flexibility as it may be in place for years, if not decades. Details such as architecture and design guidelines, parking, school and traffic tests and adequate public facilities ordinance facets, engineer, road design and streetscape are all addressed through the subsequent schematic development plans and final site plans. Mr. Robinson reiterated that the presented plan layouts the broadest framework of the sketch plan.

Karen Garfield, Kimco Realty, Director of Development, reported that meetings were held with various groups, stakeholders and members of the community to better understand and gain insight to the Kentlands and issues to address. The applicant went before the Planning Commission to review long term plans for the property. Stated that the Master Plan outlines the mix of uses, accessible and connected places, quality public realm and plan for incremental change that would encourage sustainable develop and a framework to build out the property over the years. Circulation, open space strategies, and expanded sidewalks created at the site are good business practices. In addition, the types of uses, number of units, parking, building heights and compatibility with surrounding uses located on Blocks A through J of the property were reviewed.

The proposed plan provides a mixed-use community divided into nine “Blocks” including residential, commercial, and retail uses. The sketch plan further envisions appropriately scaled and located proposed open spaces and a street grid that promotes and enhances connectivity to the surrounding area for vehicles, pedestrians, and bicycles. The plan is

designed based upon the goals and vision of the Kentlands Boulevard Commercial District Special Study Area Master Plan. The proposed four phasing for development is driven by existing tenants and market demands over a period of time, 5 to 30 year vision.

Speakers from the public:

1. Marilyn Balcombe, Gaithersburg-Germantown Chamber of Commerce (GGCC) President, expressed support for the sketch plan on behalf of the Chamber, but would like to see some of the proposed ideas. Asked for integration between the proposed Kimco Realty and Saul development projects. Concerns were expressed with parking for retailers and the impact on schools and traffic. 2. John Ingrassia, 705 Kent Oaks Way and Kentlands Downtown Working Group Chair, mentioned the groups charge. Added that Market Square is viewed as the town square and requested assurance that it will be protected as part of the development.

There were no other speakers from the public.

Members of the City Council and Planning Commission expressed concerns and had questions with what was proposed regarding: building heights, visibility impact on small businesses, live/work units and the compatibility with proposed building structures, minimum and maximum number of units, parking concentration, pedestrian safety, integration of more green and open space, preserving pedestrian thoroughfare and connectivity in Block J, sight of parking structures, and the importance of wayfinding and signage. The suggestion was made to provide some design guidelines, photographs, and diagrams which would be useful to know the intent and give a glimpse of the proposed facades, streetscapes, vehicular circulations, open space, and walkability of the project. It was further requested to possibly know the intentions and timing of short term plans. Clarification for the public was given that any specific plan for development for each of the above mentioned blocks would be required to go through the City’s public hearing process. In addition, a vote by the Mayor and City Council would be required approving a site development plan.

Motion was made that the Planning Commission hold their record open until 5 p.m. on Friday, May 25, 2018 (39 days) with anticipated recommendation June 6, 2018.
