Proceedings for 162nd Meeting of SEAC held on 6th April 2016 at 12.00 noon

The Chairman, SEAC, Karnataka welcomed the members of the Committee and others present. The following proposals listed in the agenda were appraised in accordance of the provision of EIA Notification 2006. The observation and decision of the Committee are recorded under each of the agenda items.

Some of the consultants have produced the copy of the stay order in which there is a list of 13 consultants who have obtained stay (W.P. No. 16250-16251/2016) order from Hon’ble High Court of Karnataka to the committee. The committee had discussed regarding the individual stay obtained by Environmental Consultants against the Gazette Notification dated 03.03.2016 issued by MoEF and CC, New Delhi and decided to allow the consultants for making the presentation by the consultants who have obtained stay order from the court and it is hereby brought to the notice of the Authority.

The State Expert Appraisal Committee, Karnataka perused the proceedings of 161st SEAC meeting held on 28th and 29th March 2016 and confirmed the same.

Sand proposals of District Sand Monitoring Committee, Dakshina Kannada District:

162.1 Removal of Sand from Sand Bar - SB - N6 of Nethravathi River Bed, Arkula Village, Mangaluru Taluk, Dakshina Kannada (4 Ha) of District Sand Monitoring Committee, Dakshina Kannada District. (SEIAA 111 MIN 2016)

This is an application submitted by Dakshina Kannada District Sand Monitoring Committee seeking Environmental Clearance for proposed removal of sand from sand bar project at SB-N6, Nethravathi River Bed of Arkula Village, Mangaluru Taluk, Dakshina Kannada District in a area of 4.0 Ha. Representative of the proponent and EIA coordinator from M/s. Metamorphosis Project Consultants Pvt Ltd, Bangalore attended the meeting of SEAC and presented the proposal.

The committee appraised the proposal considering the information provided in the statutory application-Form I, Pre Feasibility Report, report prepared by NITK, Suratkal and clarification/information provided during the meeting. The Committee noted that the said proposal has been considered by the State Coastal Zone Management Authority (KSCZMA) during the meeting held on 05.04.2016, the KSCZMA has recommended the proposal to SEIAA in accordance with the CRZ Notification 2011 for EC consideration with a specific condition that the length of the sand bar to be limited to 60%.

The Committee after discussion decided to recommend the proposal for issue of EC by imposing the following additional conditions:

1. Removal of sand bar shall be permitted only during the non monsoon season which is breeding season for aquatic fauna. 2. The quality of the material/sand removed from the sand bar shall be verified for its suitability to use in the construction activity. 3. All conditions stipulated by NITK and accepted by the proponent is to be strictly followed.

Action: Secretary, SEAC to forward the proposal to SEIAA for further necessary action. 162.2 Removal of Sand from Sand Bar - SB - N2 of Nethravathi River Bed, Jappinamogru Village, Mangaluru Taluk, Dakshina Kannada (19 Ha) of District Sand Monitoring Committee, Dakshina Kannada District. The Committee after discussion decided to recommend the proposal for issue of EC by imposing the following additional conditions:

1. The proposed reduction of length of the sand bar by 50% should be accommodated towards the structure side ie. the bridge. 2. Removal of sand bar shall be permitted only during the non monsoon season which is breeding season for aquatic fauna. 2

3. The quality of the material/sand removed from the sand bar shall be verified for its suitability to use in the construction activity. 4. All conditions stipulated by NITK and accepted by the proponent is to be strictly followed

The proponent has submitted the letter of withdrawal of the above said proposal. The committee accepted the same and decided to recommend the proposal for closure.

This is an application submitted by Udupi District Sand Monitoring Committee seeking Environmental Clearance for proposed removal of sand bar project at SB- SW-17, Swarna River Bed of Haradi Village, Udupi Taluk, Udupi District in a area of 1.011 Ha.

The proponent has submitted the letter of withdrawal of the above said proposal. The committee accepted the same and decided to recommend the proposal for closure.

Total Project cost = Rs. 46 Cr.

1. Land details: - Total Plot area is 17,502.67 Sqm 2. The proposed residential buildings consists of 369 units and the configuration of the building is G+9UF and a club house in a total built up area of 45,788.68 Sqm. Ht of the building is 29.95 m, Right of way is 12.50 m. 3. Land use details: Total plot area -17,502.67 Sqm Green belt area -7,876.20 (45%) Driveway and hardscape ared -2,906.20 Sqm (16.61%) Ground coverage -6,720.27 Sqm (38.39%) Permissible FAR is 1.5 and proposed is 1.499. 4. Water Requirement: Total water requirement is 256 KLD.(105 KLD fresh water + 151 KLD Recycled water) The source of water is Konappana Agrahara village panchayat. NOC from Konappana Agrahara village panchayat submitted. Scientific assessment of the water in the gram panchayat submitted. Fresh water requirement calculated for 55 LPCD. 5. Wastewater Management: - The total quantity of waste water generated is 243 KLD (considering 95% waste generation) and treated is proposed STP of design capacity of 250 KLD with SBR technology. 6. Excavated Earth Management: - The total Earth work generated = 10,080 Cum. for backfilling - 4,032.16 Cum; landscaping – 3,150.48 Cum; roads and

walk ways – 1,162.48 Cum and for site formation (Level difference in the project site is 3m) – 1,734.88 Cum. 7. Sludge generated is 12 Kg/day. 8. Energy Requirement: Total power requirement of 1707 KW is sourced from BESCOM; Backup power proposed is DG sets with a capacity of 1X750 KVA. Other details: 20 Nos of recharge pits have been provided to recharge the ground water within the site. 12. Environmental sensitive area: Konappana agrahara lake is falls within 500 m from the project site as per the google image submitted by the proponent.

The Proponent and Environment Consultant attended the 160th meeting of SEAC held on 1st, 2nd and 3rd March 2016 to provide clarification/additional information.

The committee appraised the proposal considering the information provided in the statutory application-Form I, Form-1A, Conceptual Plan and clarification/additional information provided during the meeting. The committee observed that the konappana agrahara lake is within 500 m from the project site. Therefore the committee directed the proponent to get clarification from competent authority (MI/LDA/BDA/BBMP) that the propolect area is not coming under lake bed or water spread area. Also the source of water shown is from village panchayat & hence it is instructed to conduct scientific assessment for availability of water for quantity & quality and its impact on the competitive users.

The committee after discussion had decided to reconsider the proposal after submission of the following.

1. Clarification from competent authority (MI/LDA/BDA/BBMP) regarding the project site is not coming under lake bed or water spread area. 2. Scientific assessment of availability of water for quality & quantity & its impact on competitive users.

The proponent has submitted the reply vide letter dated 21.03.2016.

The committee perused the replies submitted by the proponent during the 161st meeting of SEAC held on 28th and 29th March 2016. The committee observed that, the letter given by Tahsildar is for kharab land only & is silent about water/lake bed. As per the Google map, the lake appears to be about 100 m away from the project site, but, as per CDP, the lake is abutting the site and accordingly 30 m buffer has been left.

The committee after discussion decided to reconsider the proposal after submission of the clarification regarding distance of lake from the site by the competent authority as sought in the earlier meeting. 31

The proponent has submitted the relevant photographs and documents showing the lake boundary and project site boundary which are certified by BBMP vide letter dated 04.04.2016. It is also noted the as per the RMP 2015 submitted by the proponent the project site is not falling in the sensitive Zone.

The committee perused the reply submitted by the proponent and decided to recommend the proposal to SEIAA for issue of Environmental Clearance with a condition that no construction activity undertaken within the 30 m of buffer zone.

M/s Bruhat Bangalore Mahanagara Palike has submitted a proposal for development of Scientific Landfill for Inerts at Bagalur Quarry pits in BBMP West Zone, Bangalore (SEIAA 10 IND 2016) under section 7(i) Common Municipal Solid Waste Management Facility (CMSWMF), of EIA Notification 2006. The proposed project is comes under category B1.

The proposed project consists of filling the existing quarry site in phase manner, with phase – 1 for 5 acres designed for 250 TPD/ Ha with design period for 3 years.

The committee appraised the proposal based on the information submitted by the proponent. The committee after discussion decided to recommend the proposal to SEIAA for issue of standard ToR along with the following additional ToR’s. The EIA report should be prepared by NABET/QCI Accredited consultants only.

1. Scheme and design of land fill site construction/scheme of development which should comply to MSW Rules 2000. 2. Third party evaluation scheme both at development phase and at operation phase of the site may be provided. 3. Details of the surroundings of the site, proposed measures taken to avoid the accidents during unloading of the material, provision made to avoid dust emission and noise may be given. 4. Details of approach road, mode of transportation to avoid accidents and spillages of the material to be given. 5. Protocols/methods to avoid organic or degradable or toxic/industrial waste entering in to land fill site. 6. Scheme/procedure followed for the operation of the land fill site may be explained. 7.
