GEORGIA 2016 HUMAN RIGHTS REPORT Note: Except where otherwise noted, figures and other data do not include the occupied regions of South Ossetia and Abkhazia. EXECUTIVE SUMMARY The constitution provides for an executive branch that reports to the prime minister, a unicameral parliament, and a separate judiciary. The government is accountable to parliament. The president is the head of state and commander in chief. The Organization for Security and Cooperation in Europe (OSCE) Office for Democratic Institutions and Human Rights (ODIHR) termed the October parliamentary elections competitive and administered in a manner that respected the rights of candidates and voters, but it stated that the open campaign atmosphere was affected by allegations of unlawful campaigning and incidents of violence. According to the ODIHR, election commissions and courts often did not respect the principle of transparency and the right to effective redress between the first and second rounds, which weakened confidence in the election administration. In the 2013 presidential election, the OSCE/ODIHR concluded the vote “was efficiently administered, transparent and took place in an amicable and constructive environment.” While the election results reflected the will of the people, observers noted several problems, including allegations of political pressure at the local level, inconsistent application of the election code, and limited oversight of alleged campaign finance violations. Georgia Transport Sector Assessment, Strategy, and Road Map The Asian Development Bank (ADB) is preparing sector assessments and road maps to help align future ADB support with the needs and strategies of developing member countries and other development partners. The transport sector assessment of Georgia is a working document that helps inform the development of country partnership strategy. It highlights the development issues, needs and strategic assistance priorities of the transport sector in Georgia. The knowledge product serves as a basis for further dialogue on how ADB and the government can work together to tackle the challenges of managing transport sector development in Georgia in the coming years. LAW OF GEORGIA TAX CODE OF GEORGIA SECTION I GENERAL PROVISIONS Chapter I - Georgian Tax System Article 1 - Scope of regulation In accordance with the Constitution of Georgia, this Code sets forth the general principles of formation and operation of the tax system of Georgia, governs the legal relations involved in the movement of passengers, goods and vehicles across the customs border of Georgia, determines the legal status of persons, tax payers and competent authorities involved in legal relations, determines the types of tax offences, the liability for violating the tax legislation of Georgia, the terms and conditions for appealing wrongful acts of competent authorities and of their officials, lays down procedures for settling tax disputes, and governs the legal relations connected with the fulfilment of tax liabilities. Law of Georgia No 5942 of 27 March 2012 - website, 12.4.2012 Article 2 - Tax legislation of Georgia 1. The tax legislation of Georgia comprises the Constitution of Georgia, international treaties and agreements, this Code and subordinate normative acts adopted in compliance with them. 2. The tax legislation of Georgia in effect at the moment when tax liability arises shall be used for taxation. 3. The Government of Georgia or the Minister for Finance of Georgia shall adopt/issue subordinate normative acts for enforcing this Code. 4. (Deleted - No 1886, 26.12.2013) 5. To enforce the tax legislation of Georgia, the head of the Legal Entity under Public Law (LEPL) within the Ministry for Finance of Georgia - the Revenue Service (‘the Revenue Service’) shall issue orders, internal instructions and guidelines on application of the tax legislation of Georgia by tax authorities. -

Unknown Suburbs: Azerbaijani Settlements of the Gardabani Municipality 2020 POLICY STUDY Unknown Suburbs: Azerbaijani Settlements of the Gardabani Municipality Aleksandre Kvakhadze POLICY STUDY 2020 Introduction Since declaring its independence, the Georgian state has been struggling with the integration of its ethnic minorities. The regions densely populated by ethnic Azerbaijanis and Armenians have been passively involved in the social and political processes in Georgia. The combination of the legacy of Soviet ‘national policy,’ an ineffective educational system and socio-economic problems hinder the integration of these regions. This paper will be devoted to the Gardabani municipality, an administrative entity with a significant Azerbaijani population. Several factors have determined the choice of this region for this study. Firstly, geographically speaking, the region represents a suburban area of the cities of Tbilisi and Rustavi. It can be considered as a part of ‘greater Tbilisi/Rustavi’ or a ‘Tbilisi-Rustavi agglomeration.’ Secondly, despite its proximity to Georgia’s political and economic center, the Azerbaijani community in this region has been leading a parallel life and is disconnected from the country’s social and political dynamics. Simultaneously, very little is known about this region and very little research has been carried out on its multi-ethnic population. Unlike the neighboring Marneuli municipality, which has been receiving increasing attention from academia, the media and the non-governmental sector, the Azerbaijani population in Garbadani remains neglected by academic and non-governmental bodies. For instance, there is no comprehensive academic research on the linguistic, historical, ethnologic, social and religious parameters of Azerbaijanis in Gardabani. The absence of reliable works leads to myths and uncertainties regarding Georgia’s Azerbaijanis. -
