Neither the individual's right to privacy5 nor the pub­ lic's right to know6 is explicitly protected by the Constitution, but both do have constitutional overtones, and both are protected by various statutory provisions. Academic Freedom and the Public’s Right to Know: How to Counter the Chilling Effect of FOIA Requests on Scholarship Rachel Levinson-Waldman Every state has a mechanism that entitles citizens to request and obtain records produced in the course of official acts.1 The state statutes enabling this access to public documents – often referred to as state Freedom of Information Act (FOIA) statutes – are intended to make the actions of public employees and representatives transparent, and to foster accountability and debate.2 The statutes generally do not ask for the requester’s reason for wanting the documents; rather, they assume that the government’s operations should be open to the public, and proceed upon that presumption in favor of transparency. Recently, several groups have used state FOIA statutes to demand materials developed by faculty members as well as emails exchanged among scholars. By potentially squelching debate rather than encouraging it, however, these requests threaten to undermine the purpose of freedom of information laws. Indeed, they pose a significant risk of chilling academic freedom by making scholars reluctant to discuss and explore controversial issues or to collaborate with each other, thereby constraining one of the primary services offered by publicly funded colleges and universities. Moreover, not only does judicial treatment of FOIA requests vary significantly from state to state, but the analysis of requests for documents under these state statutory schemes can diverge substantially from the treatment of requests for the same documents as part of litigation or pursuant to other statutory regimes.

INTRODUCTION Attempts to inspect the records of the State of Alaska can be frus- trating for the public, the press, and government officials because of the uncertainty in Alaska as to what records are available for inspec- tion. This frustration arises because Alaska, unlike most states and the federal government,' does not have a comprehensive public records act that clearly identifies what records are exempt from disclo- sure. Instead, Alaska Statutes sections 09.25.110 and 09.25.1202 spec- ify that all public writings and records, with a few noted exceptions, are available for inspection. In contrast, evidentiary privileges in Alaska are relatively straightforward. There is, however, one constitutional privilege that has just been recognized in Alaska and is deserving of close scrutiny. August, 2004 I OVERVIEW Legislation enacting the California Public Records Act (hereinafter, “CPRA”) was signed in 1968, culminating a 15-year-long effort to create a general records law for California. Previously, one was required to look at the law governing the specific type of record in question in order to determine its disclosability. When the CPRA was enacted, an attempt was made to remove a number of these specific laws from the books. However, preexisting privileges such as the attorney-client privilege have been incorporated by reference into the provisions of the CPRA. The fundamental precept of the CPRA is that governmental records shall be disclosed to the public, upon request, unless there is a specific reason not to do so. Most of the reasons for withholding disclosure of a record are set forth in specific exemptions contained in the CPRA. However, some confidentiality provisions are incorporated by reference to other laws. Also, the CPRA provides for a general balancing test by which an agency may withhold records from disclosure, if it can establish that the public interest in nondisclosure clearly outweighs the public interest in disclosure. There are two recurring interests that justify most of the exemptions from disclosure. First, several CPRA exemptions are based on a recognition of the individual’s right to privacy (e.g., privacy in certain personnel, medical or similar records). Second, a number of disclosure exemptions are based on the government’s need to perform its assigned functions in a reasonably efficient manner (e.g., maintaining confidentiality of investigative records, official information, records related to pending litigation, and preliminary notes or memoranda).
