Condominiums and Shared Sovereignty | 1 Condominiums And Shared Sovereignty Abstract As the United Kingdom (UK) voted to leave the European Union (EU), the future of Gibraltar, appears to be in peril. Like Northern Ireland, Gibraltar borders with EU territory and strongly relies on its ties with Spain for its economic stability, transports and energy supplies. Although the Gibraltarian government is struggling to preserve both its autonomy with British sovereignty and accession to the European Union, the Spanish government states that only a form of joint- sovereignty would save Gibraltar from the same destiny as the rest of UK in case of complete withdrawal from the EU, without any accession to the European Economic Area (Hard Brexit). The purpose of this paper is to present the concept of Condominium as a federal political system based on joint-sovereignty and, by presenting the existing case of Condominiums (i.e. Andorra). The paper will assess if there are margins for applying a Condominium solution to Gibraltar. Condominiums and Shared Sovereignty | 2 Condominium in History and Political Theory The Latin word condominium comes from the union of the Latin prefix con (from cum, with) and the word dominium (rule). Watts (2008: 11) mentioned condominiums among one of the forms of federal political systems. As the word suggests, it is a form of shared sovereignty involving two or more external parts exercising a joint form of sovereignty over the same area, sometimes in the form of direct control, and sometimes while conceding or maintaining forms of self-government on the subject area, occasionally in a relationship of suzerainty (Shepheard, 1899). -

Mr Chairman, Thank you once again for giving me the opportunity to address the Special Committee on behalf of the people of Gibraltar. I would like first to take this opportunity to place on record my appreciation for the warmth of the reception I had from your predecessor, His Excellency, Ambassador Renagi Renagi Lohia, on my first appearance before this Committee in 1992 and indeed on my second one in 1993. I can assure the Committee that I was made to feel at home and amongst friends from the first day that I came. That encouraged me to look to this Committee – and it encouraged the people of Gibraltar to look to this Committee – as the forum where we could express our deep seated feelings on having our right as a colonial people recognised and vindicated. I should like to say that I have reported this back in Gibraltar faithfully. Indeed the text of my presentation and my appearance before the Special Committee has been transmitted over Gibraltar television and widely covered by our own press. In doing this, I believe we have been making a small contribution towards the fulfilment of Resolution 43/46 of the 22 November 1988 of the General Assembly on the dissemination of information on decolonisation which called for the widespread and continuous publicity to be given to the work of the United Nations in the field of decolonisation and in particular to the work of the Special Committee. A Resolution, of course, which the administering power voted against, but which the territorial Government in Gibraltar fully supports. -

Each of these entities includes very different territories, with different legal statuses and varying forms of self-administration and constitutional linkages with the UK. However, they also share similarities and challenges that enable an analysis of these territories as a complete set. The incomplete sovereignty of the Crown Dependencies and BOTs has entailed that all these territories (except Gibraltar) have not been allowed to participate in the 2016 Brexit referendum or in the withdrawal negotiations with the EU. Moreover, it is reasonable to assume that Brexit is not an exceptional situation. In the future there will be more and more relevant international issues for these territories which will remain outside of their direct control, but will have a direct impact on them. Thus, if no adjustments are made to their statuses, these territories will have to keep trusting that the UK will be able to represent their interests at the same level as its own interests. Gibraltar, popularly known as “The Rock”, has been a British overseas territory since the Treaty of Utrecht was signed in 1713. The demographics of this unique colony reflect its turbulent past, with most of the population being of Spanish, Portuguese or Italian origin (Garcia 1994). Additionally, there are prominent minorities of Indians, Maltese, Moroccans and Jews, who have also continued to influence both the culture and the languages spoken in Gibraltar (Kellermann 2001). Despite its status as the only English overseas territory in continental Europe, Gibraltar has so far remained relatively neglected by scholars of sociolinguistics, new dialect formation, and World Englishes. The paper provides a summary of the current state of sociolinguistic research in Gibraltar, focusing on such aspects as identity formation, code-switching, language awareness, language attitudes, and norms. It also delineates a plan for further research on code-switching and national identity following the 2016 Brexit referendum. Introduction Gibraltar is located on the southern tip of the Iberian Peninsula and measures just about 6 square kilometres. This small size, however, belies an extraordinarily complex political history and social fabric. In the Brexit referendum of 23rd of June 2016, the inhabitants of Gibraltar overwhelmingly expressed their willingness to continue belonging to the European Union, yet at the moment it appears that they will be forced to follow the decision of the British govern- ment and leave the EU (Garcia 2016). -
Gibraltar's Constitutional Future
RESEARCH PAPER 02/37 Gibraltar’s Constitutional 22 MAY 2002 Future “Our aims remain to agree proposals covering all outstanding issues, including those of co-operation and sovereignty. The guiding principle of those proposals is to build a secure, stable and prosperous future for Gibraltar and a modern sustainable status consistent with British and Spanish membership of the European Union and NATO. The proposals will rest on four important pillars: safeguarding Gibraltar's way of life; measures of practical co-operation underpinned by economic assistance to secure normalisation of relations with Spain and the EU; extended self-government; and sovereignty”. In July 2001 the British and Spanish Governments embarked on a new round of negotiations under the auspices of the Brussels Process to resolve the sovereignty dispute over Gibraltar. They aim to reach agreement on all unresolved issues by the summer of 2002. The results will be put to a referendum in Gibraltar. The Government of Gibraltar has objected to the process and has rejected any arrangement involving shared sovereignty between Britain and Spain. Gibraltar is pressing for the right of self-determination with regard to its constitutional future. The Brussels Process covers a wide range of topics for discussion. This paper looks primarily at the sovereignty debate. It also considers how the Gibraltar issue has been dealt with at the United Nations. Airport Arrival . 1.1 KA arrives at Gibraltar Airport on Thursday at 4 pm on a private jet laid on for her by the Government of Gibraltar. 1.2 KA will be greeted at foot of aircraft steps by CM and Mrs Caruana, Minister & Mrs Reyes, and KA’s parents and close family members. CM will hand KA a bouquet of red and white roses (Gibraltar colours). RGR buglers will play a fanfare as she disembarks the plane. 1.3 Facilities will be available for members of the public to welcome her at airport, from a special enclosure on the tarmac next to the aircraft parking stand. Any member of the public wishing to greet KA at the airport must go to the air terminal early, no later than 3.30 pm, as they will have to be taken by bus to the aircraft parking stand. 1.4 Gibraltar flags will be issued to those members of the public attending at the airport, who wish to have them. Members of the public who attend at the airport will have time to reach Main Street to take part in the KA parade. 1.5 After spending a few minutes greeting dignitaries, family and friends, and members of the public present at the airport, KA will retire into Air Terminal to prepare for parade. -

Result and Eff ect Abstract: Almost complete unanimity of the small Gibraltar community during 2016 referendum on Brexit remained nearly unnoticed because of including this British Overseas Territory into “combined electoral region” with South West England where most of people were in favour of the United Kingdom withdrawing from the European Union. No political diff erences with the UK (i.e. England and Wales) but concern about future possibilities of economic development outside the Single Market stimulated an intense discussion among the Gibraltarians. Th e vision of being non-subject of the EU’s four freedoms (i.e. damage or lost present prosperity basis) would force Gibraltar to re-orientate its economic relations especially by creating and developing new trade links which could gradually replace the existing ones. Despite that Gibraltarians have consequently rejected Spanish proposals of remaining inside the Single Market for the price of sharing sovereignty between the UK and Spain. It is therefore beyond doubt that the people of Gibraltar can be characterised as more British than European. Chief Minister’s Budget Address 2017 THE CHIEF MINISTER’S BUDGET ADDRESS 2017 Her Majesty’s Government of Gibraltar 6 Convent Place Gibraltar Mr Speaker I have the honour to move that the Bill now be read a second time. 2. INTRODUCTION 3. Mr Speaker, this is my sixth budget address as Chief Minister. 4. It is in fact my second budget address since our re-election to Government in November 2015 with a huge vote of confidence from our people, and I now have the honour to present the Government’s revenue and expenditure estimates for the financial year ending 31 st March 2018. 5. During the course of this address, I will also report to the House on the Government’s revenue and expenditure out-turn for the financial year ended 31 st March 2017, which was the fifth full year of a Socialist Liberal Administration since we took office on a warm autumn day in December 2011. 6. Mr Speaker, as has been traditional now for almost thirty years since the first GSLP Chief Minister delivered the first GSLP Budget in 1988, my address will of course be NOT JUST my report to the House on the Public Finances of our nation and the state of the economy generally, but also a Parliamentary ‘State of the Nation’ review of the economic and political future facing Gibraltar. 7. There could be no better way, Mr Speaker for the GSLP to celebrate its fortieth anniversary than with the honour of a second GSLP Chief Minister delivering a Socialist Budget for Gibraltar. -

REGISTER OF INTERESTS OF MEMBERS’ SECRETARIES AND RESEARCH ASSISTANTS (As at 15 October 2020) INTRODUCTION Purpose and Form of the Register In accordance with Resolutions made by the House of Commons on 17 December 1985 and 28 June 1993, holders of photo-identity passes as Members’ secretaries or research assistants are in essence required to register: ‘Any occupation or employment for which you receive over £410 from the same source in the course of a calendar year, if that occupation or employment is in any way advantaged by the privileged access to Parliament afforded by your pass. Any gift (eg jewellery) or benefit (eg hospitality, services) that you receive, if the gift or benefit in any way relates to or arises from your work in Parliament and its value exceeds £410 in the course of a calendar year.’ In Section 1 of the Register entries are listed alphabetically according to the staff member’s surname. Section 2 contains exactly the same information but entries are instead listed according to the sponsoring Member’s name. Administration and Inspection of the Register The Register is compiled and maintained by the Office of the Parliamentary Commissioner for Standards. Anyone whose details are entered on the Register is required to notify that office of any change in their registrable interests within 28 days of such a change arising. An updated edition of the Register is published approximately every 6 weeks when the House is sitting. Changes to the rules governing the Register are determined by the Committee on Standards in the House of Commons, although where such changes are substantial they are put by the Committee to the House for approval before being implemented. -

Differing grand strategies can lead to disagreements about strategic priorities and the value of possible operations. However, poor personal rela- tions can do more to wreck an alliance than differing opinions over strategy. While good personal relations can keep an alliance operating smoothly, it is often military necessity (and the threat of grand strategic failure) that forces important compro- mises. In the case of the Western Mediterranean, it was the urgent situation created by the Allied defeat at Almanza that forced the British and Austrians to create a work- able solution.
