The task of the Committee is to advise Her Majesty whether The Hon. Mr Justice Schofield, Chief Justice of Gibraltar, should be removed from office by reason of inability to discharge the functions of his office or for misbehaviour. The independence of the judiciary requires that a judge should never be removed without good cause and that the question of removal be determined by an appropriate independent and impartial tribunal. This principle applies with particular force where the judge in question is a Chief Justice. In this case the latter requirement has been abundantly satisfied both by the composition of the Tribunal that conducted the initial enquiry into the relevant facts and by the composition of this Committee. This is the advice of the majority of the Committee, namely, Lord Phillips, Lord Brown, Lord Judge and Lord Clarke. Security of tenure of judicial office under the Constitution 2. Even when all other protections fail, it provides a bulwark to the public against any encroachments on its rights and freedoms under the law. These observations apply both domestically within the context of each nation State and globally, viewing the global judiciary as one great bastion of the rule of law throughout the world. Ensuring the integrity of the global judiciary is thus a task to which much energy, skill and experience must be devoted. This is precisely what the Judicial Group on Strengthening Judicial Integrity (The Judicial Integrity Group) has sought to do since it set out on this task in 2000. It commenced as an informal group of Chief Justices and Superior Court Judges from around the world who combined their experience and skill with a sense of dedication to this noble task. Since then, its work and achievements have grown to a point where they have made a significant impact on the global judicial scene. The principles tentatively worked out originally have received increasing acceptance over the past few years from the different sectors of the global judiciary and from international agencies interested in the integrity of the judicial process. -

The referendum was authorised and conducted under the European Union Referendum Act 2015. It is advisory because Parliament is sovereign and because the Act contained no enabling legislation. Enabling provisions are ones which explicitly state that Parliament is legally bound to implement the outcome of the referendum. Hence, Parliament was not legally obliged to enact the outcome of the Brexit referendum. In contrast, for countries with codified constitutions, the outcome of a referendum ‘may’, in some instances bind both parliament and the government to implement its result. In Britain, however, with an uncodified constitution, it is possible for the government to promise in advance that it would respect the result, but that promise would be only political and not legally binding as parliament cannot be bound be a previous parliament; it can change its mind. -

InfoGibraltar Servicio de Información de Gibraltar Aviso Ministerio de Defensa El HMS Scimitar efectúa un despliegue en Tánger Gibraltar, 15 de noviembre de 2019 El HMS Scimitar llevó a cabo un breve despliegue en Tánger el fin de semana pasado, donde participó en actos para marcar el Domingo de Conmemoración (Remembrance Sunday) y el Día del Armisticio (Armistice Day). El HMS Scimitar zarpó del Peñón para realizar un corto desplazamiento por el Estrecho de Gibraltar hasta Tánger (Marruecos). A bordo se encontraban efectivos del Escuadrón de Gibraltar de la Royal Navy (Royal Navy Gibraltar Squadron, RNGS), representantes de la Policía del Ministerio de Defensa en Gibraltar (Gibraltar Defence Police, GDP) y del Real Regimiento de Gibraltar (Royal Gibraltar Regiment, RG). El buque forma parte del RNGS y suele dedicar su tiempo a patrullar las Aguas Territoriales Británicas de Gibraltar. Sin embargo, en ocasiones muy contadas, la embarcación se aventura a destinos más lejanos. El Scimitar fue objeto de una cálida bienvenida a su llegada, por parte de miembros de la Marina Real Marroquí. Las actividades del fin de semana comenzaron formalmente cuando el Oficial al Mando del HMS Scimitar, el Teniente James Young, y el Oficial al Mando del HMS Sabre, el Teniente Lloyd Cardy, asistieron a reuniones con el Oficial al Mando de la unidad local de la Fuerzas Armadas Reales Marroquíes y el Comandante del Sector Norte de Marruecos, que contribuyeron a seguir desarrollando las relaciones entre Marruecos y el Reino Unido. Perhaps the most memorable result was the first to be declared – not only because of the enormity of the consensus expressed, but also because, somewhat counter intuitively, the result came from outside the United Kingdom altogether. Voters in the British Overseas Territory of Gibraltar—a rocky Mediterranean promontory, ceded to Great Britain by Spain in 1713— expressed an overwhelming 96% support for remaining within the European Union; the single largest majority of any of the returning areas in the EU referendum (Garcia, 2016). PRESS RELEASE No: 631/2016 Date: 10th November 2016 Chief Minister Meets Armed Forces Minister Rt Hon Mike Penning MP The Minister of State for the Armed Forces, the Rt Hon Mike Penning MP called today on the Chief Minister of Her Majesty’s Government of Gibraltar, the Hon Fabian Picardo QC MP. The visit was part of Mike Penning's extended visit to further familiarise himself with the Ministry of Defence's facilities in Gibraltar. The meeting between the Armed Forces Minister and the Chief Minister was held after the peaceful demonstration to the Convent led by Unite to deliver a letter for the Minister . The Chief Minister said: "I was so happy to see Mike Penning in Gibraltar as Minister for Armed Forces. He has been a good, true and long term friend of Gibraltar and it is fantastic news for all of Gibraltar as a whole that he has now become a Minister in the MoD. At a time when Unite have concerns about the proposed new operating model to be implemented and on which the MoD are consulting with the unions, we can be assured of a decision maker at a ministerial level who is not a fair weather friend but a genuine ally of Gibraltar and its people. I raised with Mike today the concerns which Unite have expressed to me and I can assure Unite members that he was very understanding of those concerns and issues we expressed to him. I also had a chance to discuss with him matters relating to the Royal Gibraltar Regiment and on the transfer to the Gibraltar Government of the Gibraltar Defence Police.
