I know that it is under quite distressing circumstances, but still, it's wonderful to have such a congregation!” Steve, Tasha, Thor, Bruce, Carol, Reed, Susan, Johnny, Ben and Herbie were all in one of the hangars on board the Valiant. JAZZ WRITING? I am one of Mr. Turley's "few people" who follow The New Yorker and are jazz lovers, and I find in Whitney Bal- liett's writing some of the sharpest and best jazz criticism in the field. He has not been duped with "funk" in its pseudo-gospel hard-boppish world, or- with the banal playing and writing of some of the "cool school" Californians. He does believe, and rightly so, that a fine jazz performance erases the bound• aries of jazz "movements" or fads. He seems to be able to spot insincerity in any phalanx of jazz musicians. And he has yet to be blinded by the name of a "great"; his recent column on Bil- lie Holiday is the most clear-headed analysis I have seen, free of the fan- magazine hero-worship which seems to have been the order of the day in the trade. It is true that a great singer has passed away, but it does the late Miss Holiday's reputation no good not to ad• LETTERS mit that some of her later efforts were (dare I say it?) not up to her earlier work in quality. But I digress. In Mr. Balliett's case, his ability as a critic is added to his admitted "skill with words" (Turley). He is making a sincere effort to write rather than play jazz; to improvise with words,, rather than notes. A jazz fan, in order to "dig" a given solo, unwittingly knows a little about the equipment: the tune being improvised to, the chord struc• ture, the mechanics of the instrument, etc. -

I Years ago I went with my son Will, a high school cellist, to check out various music schools. We found ourselves in a famous teacher’s stu- dio, invited in to observe a lesson. A young player was running through one of the cello’s beloved standards, Tchaikovsky’s “Rococo Variations,” a wandering fierce torment lifted skyward, pure semiconsciousness brought to dear life. That kid sounded good, maybe great. How could I tell? I sat there pretty much transfixed. The piece wasn’t long, at least it didn’t seem very long, and came to an end perfectly triumphant. There was a long pause. Either the room got larger or smaller, I couldn’t tell. Nice, said the famous teacher finally, very nice. I see you’ve worked hard. You cut the notes, you had energy, stayed with it. Do you know what was missing? What? whispered the poor boy. Will and I could barely hear him. Charm, said the famous cellist, leaning forward and smiling. Charm? And I thought: what a blow. Devastating! I mean, how do you learn that? You might need a head transplant, a whole character, take-on- reality-your-entire-life transplant. u Okay, charm means irresistible, surprising, often read as good for you, designed to win over, a sweet nature shrewdly projecting confidence and concern, engineered to put the world and self at ease. So many books claim to teach this sort of charm — of course the veneer of manners and etiquette but behind that, a view governed by the often sensible, like what I found in The Woman You Want to Be: Margey Wilson’s Complete Book of Charm, from the early 1940s (and registered, by the way, with the Library of Congress the same year as works by E. -

PRIVILEGED ATTORNEY-CLIENT COMMUNICATION EXECUTIVE SUMMARY SECOND AMENDED AND RESTATED LICENSE AGREEMENT (“SPIDER-MAN”) CREATIVE ISSUES This memo summarizes certain terms of the Second Amended and Restated License Agreement (“Spider-Man”) between SPE and Marvel, effective September 15, 2011 (the “Agreement”). 1. CHARACTERS AND OTHER CREATIVE ELEMENTS: a. Exclusive to SPE: . The “Spider-Man” character, “Peter Parker” and essentially all existing and future alternate versions, iterations, and alter egos of the “Spider- Man” character. All fictional characters, places structures, businesses, groups, or other entities or elements (collectively, “Creative Elements”) that are listed on the attached Schedule 6. All existing (as of 9/15/11) characters and other Creative Elements that are “Primarily Associated With” Spider-Man but were “Inadvertently Omitted” from Schedule 6. The Agreement contains detailed definitions of these terms, but they basically conform to common-sense meanings. If SPE and Marvel cannot agree as to whether a character or other creative element is Primarily Associated With Spider-Man and/or were Inadvertently Omitted, the matter will be determined by expedited arbitration. All newly created (after 9/15/11) characters and other Creative Elements that first appear in a work that is titled or branded with “Spider-Man” or in which “Spider-Man” is the main protagonist (but not including any team- up work featuring both Spider-Man and another major Marvel character that isn’t part of the Spider-Man Property). The origin story, secret identities, alter egos, powers, costumes, equipment, and other elements of, or associated with, Spider-Man and the other Creative Elements covered above. The story lines of individual Marvel comic books and other works in which Spider-Man or other characters granted to SPE appear, subject to Marvel confirming ownership. -

Battle Resolution: The very end of a Battle Instance; some effects trigger during this part of a Battle Instance. Cancel: Cards which are subject to Cancel do not resolve or enter play and are put in their respective discard pile. Counter/Token: An object used to represent a number associated with an ability, Token Unit, Stat or effect. Friendly Units: Units under your control. Nullify: Cards which are subject to Nullify do not resolve or enter play and are put back in their respective deck. Opposing Units: Units under your Opponents control. OPT: Stands for “Once Per Turn”. Cover design by Jeff Belizaire ABOUT THIS BOOK Why does earlier Greek painting (Archaic/Classical) seem so clear and—deceptively— simple while the latest painting (Hellenistic/Graeco-Roman) is so much more complex but also familiar to us? Is there a single, coherent explanation that will cover this remarkable range? What can we recover from ancient documents and practices that can objectively be called “Greek color theory”? Present day historians of ancient art consistently conceive of color in terms of triads: red, yellow, blue or, less often, red, green, blue. This habitude derives ultimately from the color wheel invented by J.W. Goethe some two centuries ago. So familiar and useful is his system that it is only natural to judge the color orientation of the Greeks on its basis. To do so, however, assumes, consciously or not, that the color understanding of our age is the definitive paradigm for that subject.
