Probationary/Limited Appt. Release Letter

NX Article 9 - Probationary Period SCOPE: Registered Nurses – California Nurses Association

Summary

Nurses appointed to career positions must serve a 6-month probation period (date to date, not a calendar month). In cases of a maternity leave or extended illness, the ending date may be moved, not to exceed 6 months total).

A Probationary/Limited Appt. Letter of Release normally consists of four (4) sections:

1. Statement that you are releasing the employee. Provide the effective date (2 weeks if possible); 2. Statement that the University actions are not subject to the grievance or arbitration procedures of the Agreement; 3. Statement that the employee must return keys and/or University property; 4. List the attachments (Employee’s Work Performance and General Suitability for University Employment Evaluations, etc.). List the Proof of Service separately as well as the individuals receiving copies of the letter.

RE: Letter of Release (Example)

Section 1: State that you are releasing the employee and the effective date. Normally two weeks notice is given, but advance notice is not required. (See NX Article 9)

This is to inform you that, based on the decision of the University, I am releasing you from employment with the [department name], effective [date].

Section 2: State that the University actions are not subject to the grievance or arbitration procedures of the Agreement.

According to the UC/CNA Agreement effective June 2002, the University may release a nurse at its sole discretion. Additionally, this action is not subject to the grievance and arbitration procedures of this Agreement.

Section 3: Tell the employee to return any University property, including keys.

With this notice of release, you are hereby directed to return all University property immediately, including but not limited to: ID badge, keys, equipment, uniforms, etc.

Section 4: A written performance evaluation may be attached if the Nurse has worked beyond the midpoint of the probationary period. A Proof of Service shall be attached, but listed separately. Individuals receiving copies of the letter should also be listed.
