RECOMMENDATION 5 Page 29 - 45 That it be recommended to the Board of Directors, the existing Development Variance Permit No. 16-0323-C-DVP issued July 25, 2016 and the existing Development Variance Permit No. 17-0017-C-DVP issued February 28, 2017, be rescinded.

RECOMMENDATION 7 That it be recommended to the Board of Directors, upon consideration from adjacent landowners, a Development Variance Permit (DVP) be issued and approved for the Boss Creek “Vernon Hill Ranch” properties, and for the Boss Creek “Bannister/Sissons” properties, legally described as: 1. PID 025-808-117, Strata Lot 2, Section 31, Township 6, Osoyoos Division of Yale District, Strata Plan KAS2590, together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on Form V (located at 1297 Galiano Road); and 2. PID 025-808-125, Strata Lot 3, Section 31, Township 6, Osoyoos Division of Yale District, Strata Plan KAS2590, together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on Form V (located at 1299 Galiano Road); and 3. To vary the following sections of the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, as amended:

1. Defer the requirements contained in Section 110 to provide Waterworks and specifically Schedule B, section B.12.7 to construct a water storage facility and related infrastructure, provided the following conditions are met: - All parcels created must be within Phase 1 of the development, as shown in Figure 1 (attached), and - The Owner/Developer transfers the sum of $15,830.00 per parcel created in Phase 1, shown as Lots 2 to 13, and Lots 15 to 17 on Figure 1, as a security deposit for the future construction of said water storage facility and related infrastructure, and - The Owner/Developer enters into a Servicing Agreement in accordance with Schedule “C” of the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, as amended (or replaced), prior to creation of any parcel within Phase 1, and - Restrictive covenants must be registered on title of both of the remainder properties (Lots 14 and 18) as shown on Figure 1, that state no building permits will be issued and no further subdivision shall be permitted to create any parcel until the water storage facility and related infrastructure have been constructed in accordance with the provisions of Bylaw No. 2650, 2013, as amended,

2. Defer the requirement contained in Section 112.2 to construct water works including fire hydrants, on a statutory right-of-way registered in favour of the RDNO over the (private) road adjacent to the proposed Lots 15, 16 and 17, as shown on Figure 1, provided that: - the Owner/Developer provides a non-refundable cash deposit or letter of credit acceptable to the RDNO to construct these works in accordance with the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, section 112.1.c., as amended, and - A restrictive covenant must be registered on title of Lot 14, as shown on Figure 1, stating that any lot(s) created by subdivision within the area designated as Lot 14 shall require the extension of water mains and servicing including fire protection to Lots 15, 16 and 17, shown on Figure 1, in accordance with the provisions of Bylaw No. 2650, 2013, as amended, and - A restrictive covenant must be registered on title of Lots 15, 16 and 17, as shown on Figure 1, stating that the issuance of any building permit on these lots shall require the extension of water mains and servicing including fire protection to Lots 15, 16 and 17, shown on Figure 1, in accordance with the provisions of Bylaw No. 2650, 2013, as amended, and - A restrictive covenant must be registered on title of Lots 15, 16 and 17 as shown on Figure 1 that restricts the property owner from requiring the RDNO to extend the GVW System to service the subject property, and - A private easement, as approved by the RDNO, must be registered over Lot 14 in favour of Lot 15 to provide access to, and for the operation and maintenance of the existing well that supplies the existing house on Lot 15 with potable water, 3. The security deposit collected in Condition 1 above will be released to the developer of the water storage facility and related infrastructure works at time of Substantial Completion of the water storage facility and related infrastructure works. 4. The non-refundable cash deposit or letter of credit collected in Condition 2 above will be released to the developer constructing the water works including fire hydrants on the (private) road frontage adjacent to Lots 15, 16 and 17, as shown on Figure 1, at time of Substantial Completion of these works. 5. The land described herein shall be developed strictly in accordance with the terms and conditions and provisions of this Permit and any plans and specifications attached to this Permit which shall form a part hereof. 6. If the Permittee does not obtain final subdivision approval consistent with Figure 1 within two (2) years of the date of issuance of this Permit, this Permit shall lapse.

2. Water Allocation Purchase Application – 6012 Highway 6, Coldstream, BC • Staff report dated May 14, 2018

RECOMMENDATION 8 Page 46 - 49 That it be recommended to the Board of Directors, the purchase of 2.0 hectares (ha) of water Allocation for the property located at 6012 Highway 6, Coldstream, BC and legally described as Plan B1497, Township 6, Section 25, be authorized; and further,

That the property be serviced by the potable main on Highway 6.

That it be recommended by the Board of Directors, the Greater Vernon Trails and Natural Spaces Advisory Committee (GVTNSAC) Terms of Reference be endorsed effective June 30, 2018.

5. Commemorative Dedication Policy • Staff report dated May 28, 2018

RECOMMENDATION 11 Page 68 - 75 That it be recommended to the Board of Directors, the Regional District of North Okanagan Commemorative Dedication Policy No. BPOL-PRK-002 and the associated Greater Vernon Parks, Recreation and Culture Service Schedule “B”, as included in the staff report dated May 28, 2018, be endorsed.

6. Greater Vernon Water - Rates for Commercial Cannabis Growers • Staff report dated May 24, 2018

RECOMMENDATION 12 Page 76 - 80 That it be recommended to the Board of Directors, properties used for Commercial Cannabis Growing Operations not be eligible for Greater Vernon Water Agricultural Water Rates; and further,

That the Criteria to Receive Greater Vernon Water Agricultural Water Rates be updated to reflect the position that Commercial Cannabis Growing Operations not be eligible for Greater Vernon Water Agricultural Water Rates.

Doug Ross, Director of Recreation Services, City of Vernon provided a verbal update on the Kal Tire Place Arena Expansion Progress.

Okanagan Rail Trail Governance and Interjurisdictional Committee Terms of Reference

Moved and seconded by Director Mund and Alternate Director Garlick That it be recommended to the Board of Directors, the Rail Trail Governance and Committee Terms of Reference report dated April 18, 2018 be received as information with respect to the proposed governance model for the Okanagan Rail Trail, including the establishment and operation of an interjurisdictional committee for the use, operation and further development of the Okanagan Rail Trail; and further,

That the participation of the Regional District of North Okanagan in the Okanagan Rail Trail Committee, in accordance with the Terms of Reference attached to the document entitled "Interjurisdictional Arrangement For The Future Development and Management of the Okanagan Rail Corridor" dated for reference April 20, 2018 and effective June 30, 2018, be endorsed; and further,

That the cessation of the Interjurisdictional Development Team (IDT) effective June 30, 2018, be endorsed; and further,

That the Chief Administrative Officer be authorized to appoint staff representatives to the Okanagan Rail Trail Committee as required to represent Regional District of North Okanagan interests, and report back to the Board for consultation and approvals as required. CARRIED

Ribbons of Green - Okanagan Rail Trail Workshop

Moved and seconded by Alternate Director Garlick and Director Mund That the Ribbons of Green Okanagan Rail Trail Workshop Summary dated April 29, 2108 be received for information. CARRIED

2018 Greater Vernon Arts, Culture and Youth Project Grant - Caetani Cultural Centre Society Application

Moved and seconded by Directors Dirk and Fleming That it be recommended to the Board of Directors, $30,000 from the Greater Vernon Arts, Culture and Youth project grant program be awarded to the Caetani Cultural Centre Society for their Open House project, as outlined in the report titled 2018 Greater Vernon Arts, Culture and Youth Project Grant – Caetani Cultural Centre Society Application, and dated April 18, 2018. CARRIED

North Valley Gymnastics Society

Discussion ensued regarding the request received from the North Valley Gymnastics Society for financial support in the amount of $225,000. The Chief Administrative Officer will forward the request to the individual jurisdictions for consideration consistent with the recreation agreement.

Water Stewardship - Forest Stewardship Plans

Moved and seconded by Agricultural Representative Osborn and Director Fleming That it be recommended to the Board of Directors, a letter be sent to the Ministry of Forests, Lands, Natural Resource Operations and Rural Development (MFLNRO-RD) requesting that major stakeholders be provided the opportunity to review and comment on Forest Stewardship Plans prior to the Plans being accepted by the Ministry. CARRIED

Moved and seconded by Directors Macnabb and Fleming That it be recommended to the Board of Directors, staff be authorized to execute the Water Supply and Works Agreement with the Township of Spallumcheen substantially as presented.

A motion to Call the Question was moved and seconded by Director Dirk and Alternate Director Spiers. CARRIED Opposed: Directors Macnabb, Fleming and Cunningham

The motion was Carried and the Chair called for a vote on the main motion:

That it be recommended to the Board of Directors, staff be authorized to execute the Water Supply and Works Agreement with the Township of Spallumcheen substantially as presented. DEFEATED Opposed: Directors Dirk, Mund, Cunningham and Alternate Directors Garlick and Spiers

Moved and seconded by Director Dirk and Alternate Director Garlick That it be recommended to the Board of Directors, staff be directed to develop a policy requiring all future additions to the Greater Vernon Water Service Area be subject to an asset buy in; and further,

That a moratorium be placed on all Greater Vernon Water Service Area amendments until such a policy is developed. CARRIED Opposed: Directors Macnabb and Fleming

Okanagan Rail Trail - Mile 88

Moved and seconded by Directors Dirk and Mund That it be recommended to the Board of Directors, the Regional District of North Okanagan be authorized to acquire the Mille 88 to Mile 87.65 (Lumby Junction) corridor at price of $870,000 plus closing costs, to be funded from the Land Acquisition Reserve (060); and further,

That Regional District staff work with Coldstream Administration to complete the Purchase and Sale Agreement. CARRIED Opposed: Director Macnabb

PROPOSAL: Phase 1: Proposed 18 lot subdivision that includes: • twelve (12) Country Residential parcels in Boss Creek “Vernon Hill Ranch” • three (3) Country Residential parcels in Boss Creek “Bannister/Sissons” • one (1) parcel designated as private road, and • two (2) remainder parcels: one (1) on the “Vernon Hill Ranch” parcel and one (1) on the “Bannister/Sissons” parcel.

PROPOSED Request to vary Sections 110 and 112.2 of the Regional District of VARIANCE(S): North Okanagan (RDNO) Greater Vernon Water (GVW) Subdivision and Development Servicing Bylaw No. 2650, 2013, as amended (or replaced), with respect to construction of water works and in particular to delay the requirement to construct a water storage facility and related infrastructure as per Schedule B - Section B.12.7. This Development Variance Permit (DVP) will allow subdivision and development of Phase 1 of the Boss Creek Development as shown on Figure 1 to proceed without the requirement to construct a water main, a water storage facility and related infrastructure. These works must be constructed however, before further subdivision of the remainder Lots 14 and/or 18, or before issuance of building permits on any of the proposed Lots 14 to 18.

UTILITIES DEPARTMENT RECOMMENDATIONS:

RECOMMENDATION 1

That it be recommended to the Board of Directors the existing Development Variance Permit No. 16-0323-C-DVP issued July 25, 2016 and the existing Development Variance Permit No. 17- 0017-C-DVP issued February 28, 2017, be rescinded.

RECOMMENDATION 2

That it be recommended to the Board of Directors the following requirement under Section 5.1.4 (Public Information Meetings and Notice Requirements) of Greater Vernon Water Subdivision and Development Servicing Application Procedures and Administrative Fees Bylaw No. 2658, 2015, as amended, be waived: a) When an application has been approved in principle by the Regional Board, subject to the applicant holding a Public Information Meeting, the applicant shall cause said meeting to be held in accordance with current Board policy on holding Public Information Meetings together

RECOMMENDATION 3

That it be recommended to the Board of Directors, upon consideration from adjacent landowners, a Development Variance Permit (DVP) be issued and approved for the Boss Creek “Vernon Hill Ranch” properties, and for the Boss Creek “Bannister/Sissons” properties, legally described as: 1. PID 025-808-117, Strata Lot 2, Section 31, Township 6, Osoyoos Division of Yale District, Strata Plan KAS2590, together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on Form V (located at 1297 Galiano Road); and 2. 2. Defer the requirement contained in Section 112.2 to construct water works including fire hydrants, on a statutory right-of-way registered in favour of the RDNO over the (private) road adjacent to the proposed Lots 15, 16 and 17, as shown on Figure 1, provided that: - the Owner/Developer provides a non-refundable cash deposit or letter of credit acceptable to the RDNO to construct these works in accordance with the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, section 112.1.c., as amended, and - A restrictive covenant must be registered on title of Lot 14, as shown on Figure 1, stating that any lot(s) created by subdivision within the area designated as Lot 14 shall require the extension of water mains and servicing including fire protection to Lots 15, 16 and 17, shown on Figure 1, in accordance with the provisions of Bylaw No. 2650, 2013, as amended, and - A restrictive covenant must be registered on title of Lots 15, 16 and 17, as shown on Figure 1, stating that the issuance of any building permit on these lots shall require the extension of water mains and servicing including fire protection to Lots 15, 16 and 17, shown on Figure 1, in accordance with the provisions of Bylaw No. 2650, 2013, as amended, and - A restrictive covenant must be registered on title of Lots 15, 16 and 17 as shown on Figure 1 that restricts the property owner from requiring the RDNO to extend the GVW System to service the subject property, and - A private easement, as approved by the RDNO, must be registered over Lot 14 in favour of Lot 15 to provide access to, and for the operation and maintenance of the existing well that supplies the existing house on Lot 15 with potable water, 3. The security deposit collected in Condition 1 above will be released to the developer of the water storage facility and related infrastructure works at time of Substantial Completion of the water storage facility and related infrastructure works. 4. The non-refundable cash deposit or letter of credit collected in Condition 2 above will be released to the developer constructing the water works including fire hydrants on the (private) road frontage adjacent to Lots 15, 16 and 17, as shown on Figure 1, at time of Substantial Completion of these works. 5. The land described herein shall be developed strictly in accordance with the terms and conditions and provisions of this Permit and any plans and specifications attached to this Permit which shall form a part hereof. 6. If the Permittee does not obtain final subdivision approval consistent with Figure 1 within two (2) years of the date of issuance of this Permit, this Permit shall lapse.

SUMMARY:

1. The Boss Creek Development located at 1301 Galiano Road, Electoral Area “C” applied for and received two (2) prior Development Variance Permits (DVPs): DVP No. 17-0017-C-DVP and 16-0323-C-DVP (Attachment “A” and Attachment “B”).

2. In 2018, the Boss Creek Development applied for DVP No. 18-0332-C-DVP as outlined in this report.

3. In approving DVP No. 18-0332-C-DVP, the two existing DVPs No. 16-0323-C-DVP and 17- 0017-C-DVP will be rescinded and no longer valid.

4. All three (3) water related DVPs for the Boss Creek Development have been to delay the construction of the water storage facility and related infrastructure for Phase 1 of the

development with conditions that this infrastructure will be constructed at Phase 2 of the development.

5. The main difference between the current application (18-0332-C-DVP) and the previous approved DVPs (16-0323-C-DVP and 17-0017-C-DVP) are changes to the number of lots in Phase 1 and the lot configuration. Additional covenants to ensure the construction of the required infrastructure are also required in 18-0332-C-DVP.

6. The lot configuration proposed in 18-0332-C-DVP and outlined in Figure 1 will align the number of approved lots and the subdivision configuration with the current Preliminary Layout Approval (PLA) registered with the Ministry of Transportation and Infrastructure.

7. The Utilities Department recommends that the DVP No. 18-0332-C-DVP application be approved.

DISCUSSION:

The Boss Creek Development (applicant) plans to subdivide and develop a residential neighbourhood comprised of Country Residential lots at the property located at 1301 Galiano Road, Electoral Area “C”.

The following ortho-photo of the subject and surrounding properties was taken in 2016:

The proposed subdivision area is at the lower elevations of the Subject Property within the GVW boundary and the applicant is proposing to develop in two (2) Phases. Phase 1 includes the development of lowest elevation sites, whereas the upper elevation sites will be subdivided and developed in Phase 2. The proposal to service the development with water supplied from GVW includes the construction of two (2) pump houses and watermain that will service most of the lots in Phase 1, and funds will be collected to assist funding the water storage facility. In Phase 2, the remaining lots in Phase 1 (three lots created on the Bannister/Sissons area) will be connected as well as the construction of water main and water storage facility.

This water servicing plan does not conform to sections 110 and 112.2, and Schedule B - section B.12.7 of the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650,

2013, as amended. Two (2) previous DVPs (16-0323-C-DVP and 17-0017-C-DVP) were approved that allowed subdivision and development of lots in Phase 1 with the delay of building the water storage facility in Phase 2. These DVPs included a requirement to collect non- refundable deposits for each residential lot created in Phase 1 to help fund construction of the future water storage facility.

In 2018, the applicant submitted another DVP request as outlined in this report (No. 18-0332-C- DVP). The applicant is proposing to change the currently approved DVPs (16-0323-C-DVP and 17-0017-C-DVP) by creating three (3) fee simple properties on the “Bannister/Sissons” property, instead of the two (2) already approved; and to remove four (4) previously approved Country Residential lots from Phase 1 on the “Vernon Hill Ranch” property.

The final layout within 18-0332-C-DVP as shown on Figure 1 includes the Boss Creek properties (“Vernon Hill Ranch” and “Bannister/Sissons”) to be subdivided into 18 lots in Phase 1 as follows: 12 parcels in the Boss Creek “Vernon Hill Ranch” development and three (3) parcels in Boss Creek “Bannister/Sissons” development as Country Residential, one (1) parcel as private road, and two (2) remainder parcels.

The proposal within DVP No. 18-0332-C-DVP aligns with the lot layout of the DVP with the Preliminary Layout Approval (PLA) registered with the Ministry of Transportation and Infrastructure.

UTILITIES ANALYSIS:

The Utilities Department recommends approving DVP No. 18-0332-C-DVP with the following criteria: • That the requirement under section 5.1.4 (Public Information Meetings and Notice Requirements) of Greater Vernon Water Subdivision and Development Servicing Application Procedures and Administrative Fees Bylaw No. 2658, 2015, as amended, be waived as the current development meets current zoning requirements and when completed, the development will fully comply with the standards of the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, as amended, and • Rescind the two prior DVPs (16-0323-C-DVP and 17-0017-C-DVP) to avoid conflicts and confusion.

The Utilities Department supports the DVP No. 18-0332-C-DVP application for the following reasons: • DVP No. 18-0332-C-DVP does not change the original intent of the two (2) prior DVPs and aligns the layout of the DVP with the Preliminary Layout Approval (PLA) registered with the Ministry of Transportation and Infrastructure. • Water for fire fighting purposes will be provided in the interim via an existing fire hydrant located at the McLeish Road and Phillips Road intersection (entrance to the development). The applicant provided the funding to install this fire hydrant. It is intended to utilize this hydrant to fill fire tender trucks (tankers) as required in the event of a fire. • Upon completion of Phase 2, all works and services required in Bylaw No. 2650, 2013, as amended, will be completed, including construction of the water storage facility. • The three (3) existing single family homes located on the proposed Lots 15, 16 and 17 are currently serviced with potable water from existing on-site wells and on-site wastewater disposal systems but will be connected to GVW in Phase 2.

3. Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013 is hereby varied as follows:

1. Defer the requirements contained in Section 11 Oto provide Waterworks and specifically Schedule "B", section B.12.7 to construct a water storage facility and related infrastructure, provided the following conditions are met: - Any lot(s) to be created within the area designated as Lot 14 on Figure 1 "Proposed Water System Staging Concept" plan will require the completion of the proposed reservoir and extension of water service to Regional District of North Okanagan (RDNO) standards including fire protection, - The Owner/Developer transfers, prior to subdivision, the sum in the amount of $15,830.00 for each of Lots 15 & 16 as shown on Figure 2 as a security deposit for the future construction of water reservoir and related infrastructure, and - The Owner/Developer provides a non-refundable cash deposit or letter of credit acceptable to the RDNO to construct the Waterworks including fire hydrants adjacent to proposed Lots 15 and 16 as shown on Figure 2 in accordance with the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, Section 112.1.c. - A restrictive covenant on the remainder property (Lot 14) as shown on Figure 2, that states no building permits will be issued and no further subdivision to create any parcel by subdivision until the water storage facility, water mains and related infrastructure have been constructed in accordance with the provisions of the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, - An easement be registered over the Remainder (Lot 14) for access to, operation and maintenance of the existing well that supplies the existing house on Lot 15 with potable water. - A restrictive covenant is placed on title of Lot 15 and Lot 16 as shown on Figure 2 that restricts the property owner from requiring the RDNO to extend the GVW System to service the subject property, and - The Owner enters into a Servicing Agreement in accordance with Schedule "C" of Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, prior to creation of any parcel within the remainder (shown as Lot 14), and

2. Prior to creation of any parcel by further subdivision of land within the area designated as Lot 14 as shown on Figure 2, the water storage facility and related infrastructure shall be constructed in accordance with the provisions of the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, 3. The security deposit(s) collected in Condition 1 for future construction of the reservoir will be released to Boss Creek Development Ltd. at time of Substantial Completion of the water storage facility and related infrastructure works, 4. The proposed access roads (Common Lot 1) up to and including proposed Lot 15 and Lot 16 are constructed to emergency access standards including fire protection in accordance with the design prepared by Kerr, Wood Leida!: Project No. 2329.003, Drawing No. C-501, rev. 1 to the satisfaction of the Ministry of Transportation and Infrastructure.

5. The land described herein shall be developed strictly in accordance with the terms and conditions and provisions of this Permit and any plans and specifications attached to this Permit which shall form a part hereof, 6. If the Permittee does not commence the development permitted by this Permit within two (2) years of the date of issuance of this Permit, this Permit shall lapse. 7. This Permit is not a Building Permit.

3. Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013 is hereby varied as follows: 1. Defer the requirements contained in Section 11 O to provide Waterworks and specifically Schedule "B", section B.12.7 to construct a water storage facility and related infrastructure provided the following conditions are met: All parcels created must be within the Phase 1 (below the dotted blue line to be created by subdivision) boundary as shown in Schedule "A", A new fire hydrant shall be constructed at the Mcleish Road and Phillips Road intersection, The Owner transfers the sum of $15,830.00 per parcel created in Phase 1 as a security deposit for the future construction of said water storage facility and related infrastructure, and The Owner enters into a Servicing Agreement in accordance with Schedule "C" of the Subdivision and Development Servicing Bylaw No. 2650, 2013 prior to creation of any parcel within Phase 1. and, 2. RECOMMENDATION:

That it be recommended to the Board of Directors, the purchase of 2.0 hectares (ha) of water Allocation for the property located at 6012 Highway 6, Coldstream, BC and legally described as Plan B1497, Township 6, Section 25, be authorized; and further,

That the property be serviced by the potable main on Highway 6.

SUMMARY:

Mr. Thorlakson has applied to purchase 2.0 hectares of Allocation for the property at 6012 Highway 6, Coldstream, BC (Attachment “A”). The existing potable water supply system has the capacity to supply the proposed Allocation purchase for farm irrigation water to the subject property and the application meets the conditions of the Greater Vernon Water Purchase of Agricultural Water Allocation Policy No.ENG-WTR-005. Accordingly, staff recommends that the purchase of 2.0 hectares of farm irrigation water Allocation for the property located at 6012 Highway 6, Coldstream, BC, be authorized.

BACKGROUND:

At the January 20, 2016 Board of Directors meeting, the following resolution was carried:

“That the Greater Vernon Water Purchase of Agricultural Water Allocation Policy No. ENG-WTR-005 be endorsed.”

DISCUSSION:

Greater Vernon Water (GVW) has received an application from Harold Thorlakson (owner) to purchase 2.0 ha of water Allocation to irrigate the property for field crops. The property has farm status through BC Assessment but does not have any water Allocation at this time.

The applicant has indicated that they require water Allocation to facilitate an expansion of their farming business.

The parcel currently has 0.0 hectares of Allocation assigned to it. The applicant is requesting the purchase of 2.0 ha of water Allocation for the parcel. This Allocation purchase, if approved, will provide irrigation water for the applicant’s farm expansion.

The current status of the subject property is as follows: 1. The subject property has an area of 8.296 ha; 2. The property currently has 0.0 hectares of assigned Allocation; 3. The applicant has requested to purchase 2.0 ha of Allocation for a total of 2.0 ha of Allocation which is less than the property size; 4. The cost to purchase Allocation is $6,000.00 per hectare; therefore, the cost to the applicants to purchase 2.0 ha of Allocation would be $12,000.00; 5. The property is located within the Agricultural Land Reserve (ALR) and is zoned RU2 Rural Two Zone in the District of Coldstream Zoning Bylaw No. 1382; 6. The applicant will be required to install a meter and appropriate backflow protection within a pit at the property line as per the conditions of the Greater Vernon Water Metering Bylaw No. 2678, 2015, as amended; 7. The water main fronting the subject property is a potable main supplied by treated water from Duteau Creek Water Treatment Plant (DCWTP). This property does not have immediate access to a separate non treated irrigation connection however there is a 50 mm non potable main approximately 130 m from the property boundary (depicted as the dotted line on Hwy 6 on Attachment “A”). Further study (flow and pressure) would be required to assess if this main could be extended to the property boundary to service with non potable water as it is a small main with other irrigation customers connected. The cost to extend this main would be approximately $27,000.00 as long as the main can be constructed outside of the pavement of the highway; 8. In the Lavington Separation and Improvement Plan study completed for GVW in 2014, separated mains will service this property as part of the East Buchanan Service Area. In the GVW Long-Term Capital Plan, the East Buchanan separation project is scheduled to be completed in approximately 2030; and, 9. Currently there is no precedence or policy on requiring a property to complete a main extension or upgrades to access non potable water. Hence, staff is recommending that the Allocation purchase be approved and allow the applicant to connect to the treated water main currently available. The property will be serviced with non potable water as part of the separation project in the future as planned. The potable main on Highway 6 has sufficient capacity to service 2.0 hectares of Allocation and not impact other properties. However, the Board could require that if the 50 mm main has the capacity to service the property, the applicant extend the main to service the property.

That it be recommended to the Board of Directors, the amended Duteau Creek Watershed Technical Advisory Committee Terms of Reference be endorsed.

DISCUSSION:

The Duteau Creek Watershed Technical Advisory Committee (TAC) had its first meeting in February 2009. The Terms of Reference were established in August 2010 (Attachment “A”) to provide guidance to the TAC on its role, composition, meetings and reporting.

In February 2018, the Help Our Watersheds Society (the society) requested to be included in the TAC. The society was asked to provide the purpose for their inclusion and they stated “first and foremost the society seeks to be an advocate for community stakeholders in the Region in ensuring that local watersheds are protected. Pursuant to their constitution, the society aims to: 1) Preserve our provincial watershed for future generations; 2) Promote awareness of environmental impacts of logging in BC watersheds amongst members of the public 3) Promote watersheds in BC from further environmental impacts arising from logging activities; and 4) Advocate for enforcement of legislative watershed protection in BC.” After a review, it was identified that the TAC Terms of Reference (TOR) did not provide for representation from the society, as the composition is currently comprised of stakeholder agencies that have decision making authority within the watershed including staff representatives from Provincial and Federal Ministries and tenure holders.

It is important to note that Greater Vernon Water (GVW) does not have authority related to land use practices on Crown land. GVW relies on Federal and Provincial Acts, Regulations, Stewardship Plans, Best Management Practices and Local Government bylaws and policies to protect the water resource from the impacts of land use in the watershed. The purpose of the TAC is to work with agencies to advance the protection of drinking water in a collaborative fashion rather than be involved in conflict resolution. The TAC also supports the RDNO conformance of the GVW permit to operate. To date, the TAC has achieved many successes by working collaboratively and cooperatively. TAC members have expressed a concern that the collaborative working environment would be hampered and membership may decline if groups or individuals without any decision making authority that are focused on stopping/changing policy regarding any particular Provincially mandated activity are allowed to join the TAC.

Terms of Reference Duteau Creek Watershed Technical Advisory Committee

The Regional District of North Okanagan / Greater Vernon Water received the final report for the Duteau Creek Watershed and Recommendations for Source Protection in December 2008 (Kerr Wood Leidal Consulting Engineers and Dobson Engineering Ltd.) The implementation stage is the key to a successful source water protection program. The first stakeholder meeting was held on February 19, 2009. It was agreed that the goal was to protect the quality and quantity of Duteau Creek with the understanding that Duteau Creek is a Multi-use Community Watershed, that the stakeholder meetings are to be collaborative planning rather than conflict resolution, to increase knowledge of all stakeholders and to find creative yet sound ways to move forward with the recommendations in the Assessment.

1. Role of the Technical Advisory Committee (TAC)

1.1 The role of the TAC is to provide the Regional District of North Okanagan/ Greater Vernon Water staff with comments and recommendations on objectives, strategies, policies, and land use legislation that may be considered to protect water quantity and quality and the implementation of the protection plan. The TAC will also work collaboratively with the GVW manager and staff on:

1.1.1 Provide advice (i.e. bulletins, posters, signage, website links and presentations) aimed at raising awareness of source water protection and the effects of land use on water quality and quantity. 1.1.2 Acting as a resource for RDNO/GVW management and staff for integrated resource management as well as a liaison to the ministry or licensee they represent. 1.1.3 Identifying opportunities that may be available through other agencies or programs to implement strategies to protect source water. 1.1.4 Identifying threats that may delay or impair the implementation of the protection plan. 1.1.5 Developing collaborative solutions that follow SMART (Specific, Measurable, Achievable, Realistic, Time- Bound) principles.

2. Composition of Committee

2.1 The TAC for this protection plan should include representation from most stakeholder agencies that will be responsible for implementation of the plan. TAC meetings are held to facilitate collaborative planning between the participants. SCOPE: The scope of the TAC is defined by the Duteau Creek Watershed Assessment Response Plan (“Response Plan”). The Response Plan is based on the 2008 Duteau Creek Watershed Assessment Final Report (the Report) and the subsequent Action Plans developed in consultation with the TAC participants. The Action Plans and implantation of the actions are the key to a successful source water protection program. The first TAC meeting was held on February 19, 2009. It was agreed that the goal was to protect the water quality and quantity of Duteau Creek with the following objectives:

If a request to attend a TAC meeting is received, the request shall be circulated to members to ascertain whether or not the delegation would be of value to assist the TAC in moving forward in accordance with its purpose, scope and defined responsibilities. Invited delegations will be provided the opportunity to present and answer questions at the beginning of a TAC meeting and may only attend the full TAC meeting if invited by the Chair. CHAIR : Meetings shall be chaired by an RDNO staff person.

MEETINGS: The TAC will meet a minimum of two (2) times per year. The first meeting of the year (February/ March) is to review the previous year’s report, develop actions for the coming year, and possible grant applications (members to provide grant information to Chairperson). The second meeting in the early fall (Sept/ Oct) will be a field day.

Meeting records are outlined below: • Order of business will be set out in the meeting agenda. • Agendas will be prepared by RDNO staff and provided to the members fourteen (14) days in advance of the meeting date. • RDNO staff will be responsible to record minutes of TAC meetings.

BACKGROUND/HISTORY:

The Regional District of North Okanagan currently relies on Ribbons of Green for advice and guidance in order to comment on the development of Greater Vernon trails. It was recently determined that there is a requirement for an advisory committee to be established and led by the RDNO Manager of Parks who would be dedicated to the coordination of trails and natural spaces initiatives, and provide facilitative and administrative support for the committee.

At the Greater Vernon Advisory Committee meeting held on May 3, 2018 it was resolved:

That staff be directed to bring back a report outlining the mandate, process and broad scope of a potential public trails stakeholder advisory group.

Committee Composition The committee will be made up of at least 12 voting members, but not more than 20 voting members, led by the Manager of Parks. This staff coordinator role is dedicated to the coordination of trail and natural space initiatives, and will provide facilitative and administrative support for the committee work. SUMMARY:

The Regional District of North Okanagan administers parks functions for the following services: • 060 – Greater Vernon Parks, Recreation and Culture • 065 – White Valley Parks, Recreation and Culture

Each of these services includes the administration of parks, trails and/or natural areas which may be appropriate for donations of funds to provide park amenities, such as benches, picnic tables or other features.

As such, this policy has been developed to provide guidelines and direction for approving, maintaining and replacing commemorative dedications in Regional District of North Okanagan operated and managed parks, trails and open spaces. Other functions requiring commemorative dedications can be added as required.

DISCUSSION:

In order to provide autonomy of location, selection and price determination for the commemorative features of each service, the details of available locations and commemorative features available have been included as separate schedules to the policy, by service.

The separate schedules provide the ability to easily add a service, a park or trail, or change the types or costs associated with commemorative features through a policy amendment.

The proposed Greater Vernon Parks, Recreation and Culture schedule has been completed, and included for the Committee’s review and endorsement. Once endorsed this draft policy will be brought forward to the Board for ratification.

Commemorative Dedication Program Approval Date: Amendment Date(s):

PURPOSE

To provide guidelines and direction for approving, maintaining and replacing Commemorative Dedications in Regional District of North Okanagan (Regional District) operated and managed parks, trails and open spaces.

DEFINITIONS

Commemorative Dedications: means fixtures or amenities that are installed as a result of a public request accompanied by the donation of all associated costs, to celebrate a special occasion or honour someone’s legacy. Commemorative Dedications are approved by Service, and may include benches, picnic tables, trees, or other items as approved through this policy and listed in associated Schedules.

Donor: means a person or group that donates money to the Regional District for the purposes of purchasing and installing a Commemorative Dedication.

Service: means a service established through bylaw by the Regional District for service provision within a local area as provided under the Local Services Act.

SCOPE

This policy applies to all Regional District Services listed in column 1 of Schedule “A” to this policy as amended from time to time. It does not apply to Regional District lands leased to others, for whatever purpose.

POLICY

1. General Guidelines

1.1. The Regional District accepts donations for costs associated with the purchase and installation of Commemorative Dedications in Regional District operated and managed parks, trails and open spaces subject to this policy and the procedures contained within. Where direction provided in a Service Schedule is not consistent with the terms of this policy, the direction in the Service Schedule will be applied.

1.2. Donations for a Commemorative Dedication are accepted, provided that: a. the park, trail or open space in question has space for a commemorative dedication item; b. payment in full of the current minimum donation for the selected commemorative dedication is received; c. the Regional District has the capacity to administer the installation; and, d. the wording on the commemorative dedication plaque conforms to current inscription guidelines for plaques on commemorative dedications outlined in Section 1.3.

1.3. Commemorative Dedications are not intended as memorials. Donations do not give the right to scatter or dispose of cremated remains on site, nor to place or attach objects on or adjacent to the Commemorative Dedication. The wording on the plaques must not constitute a memorial message. The Regional District shall work with the Donor to establish wording appropriate to a recreational setting, and the Regional District reserves the final approval of all plaque wording.

1.4. All Commemorative Dedications installed under this policy become the property of the Regional District.

2. Commemorative Dedication Options and Costs

2.1. The Donor shall pay the full costs of the purchase, supply, delivery and installation of the Commemorative Dedication. The list of available Commemorative Dedication options and schedule of associated costs shall be established by Service, and included in Schedule “B” to this policy as amended from time to time.

2.2. While the Donor is free to suggest the proposed location, the Regional District reserves the right to final site selection and placement.

3. Maintenance

3.1. Unless otherwise stated in the attached schedules, it shall be the responsibility of the Regional District to maintain the Commemorative Dedications supplied under this policy for a period of ten (10) years. Before the end of the ten year period, the Donor or Donor’s representative is required to contact the Regional District to either renew the term or relinquish the rights to the Commemorative Dedication. At the discretion of the Regional District, a Commemorative Dedication may be removed at the end of the ten year term.

3.2. Should Regional District property containing Commemorative Dedications be redeveloped, the Regional District shall make its best efforts to relocate the items within the redeveloped property. Where property is no longer under the management and operation of the Regional District, the Regional District shall seek to make arrangements with the new manager to retain the Commemorative Dedications in situ for the duration of the term. Where this is not possible, the Regional District shall make its best effort to relocate the Commemorative Dedication to an alternate Regional District park, trail or open space.

3.3. Should a Commemorative Dedication be damaged or vandalized, the Regional District shall make its best efforts to repair or replace the item, subject to capacity and funding availability. Following a second incident of damage or vandalism, the item will be removed and the Regional District will suggest alternate locations.

That the Criteria to Receive Greater Vernon Water Agricultural Water Rates be updated to reflect the position that Commercial Cannabis Growing Operations are not eligible for Greater Vernon Water Agricultural Water Rates.

SUMMARY:

Greater Vernon Water (GVW) provides a rate for agricultural uses that is less than domestic rates. GVW determines if a property is eligible for the agricultural rate by using a number of Criteria. One of those Criteria is if the property has BC Assessment Farm Classification.

BC Assessment excludes medical cannabis production as a farm use for property tax purposes.

DISCUSSION:

The Federal government has been moving forward with the legalization of cannabis. As a result, the Regional District of North Okanagan (RDNO) Planning Department has indicated that there are a number of development/building applications that have been submitted to grow cannabis. As this is a new and evolving industry, staff is seeking direction from the Board regarding water rates for cannabis growing and processing operations.

The proposed legislation indicates two classes; personal use where up to four plants may be grown and Commercial Cannabis Growing Operations (Grow-ops) where plants are grown for commercial sale. This report is in reference to Grow-ops only.

The BC Land Commission has classified the growing of medical cannabis as a farm use. BC Assessment has indicated that they will classify growing cannabis as a farm use but these operations will be excluded from the farm use tax status, so essentially they will be able to get BC Farm Classification without receiving farm tax status.

Upon discussions with the RDNO Planning Department, the Grow-ops are grown in industrial buildings due to security reasons. Under the BC Building Code, the building classification for occupancy for these operations is F3: Low Hazard Industrial. Some of the proposed buildings are extremely large, with one application in the RDNO area proposing to have a footprint of 11 acres. In staff’s view, these operations are dissimilar to other agricultural uses that grow product on the land or in small scale greenhouses that rely on natural soils and weather patterns. These operations grow their product in an industrial building in a controlled environment that are designed to have high production rates all year around.

GVW currently uses the Board endorsed “Criteria to Receive Greater Vernon Water Agricultural Water Rates” (“Criteria”) on the back of the “Application for RDNO Farm Classification” (Attachment “A”). Currently as growing cannabis has always been illegal, there is no clear direction on whether Grow-ops would receive Farm Classification. However, some the Criteria could lead to Grow-ops being approved for GVW Agricultural Water Rates which may not be the intention of the Board, for example:

• The note on the first page of the application indicates that if the Grow-op receives BC Assessment Farm Classification, the property is eligible to receive Agricultural Water Rates, and • Criteria 5. b. has herb production and medicinal plant culture listed as acceptable uses.

Staff is recommending that the Criteria be updated to clearly reflect the direction of the Board.

As stated above, staff is recommending that Grow-ops not receive Agricultural Water Rates and if the Board approves this direction, the Criteria would be updated as follows:

• The following line will be added as Criteria No. 1 and all following Criteria will be renumbered:

1. Properties with BC Assessment Farm Classification will automatically receive Agricultural Water Rates, with the exception of Commercial Cannabis Growing Operations which are not eligible to receive Agricultural Water Rates.

• The following will be added to the exclusion clause of Criteria 5. b.:

The following activities are NOT considered agricultural for the purposes of water billing: - Commercial Cannabis Growing Operations.

The Board may choose the alternative and endorse Grow-ops to receive GVW Agricultural Water Rates, in which case the following motions should be endorsed: That it be recommended to the Board of Directors, that properties used for Commercial Cannabis Growing Operations are eligible for Greater Vernon Water Agricultural Water Rates on properties with the appropriate agricultural zoning; and further, That the Criteria to Receive Greater Vernon Water Agricultural Water Rates be updated to reflect the position that commercial cannabis growing operations are eligible for Greater Vernon Water Agricultural Rates. If these motions are endorsed, then the list of acceptable agricultural purposes in Criteria b. would be updated to include “growing cannabis”.

ATTACHMENT "A" CRITERIA TO RECEIVE GREATER VERNON WATER AGRICULTURAL WATER RATES

The following criteria must be met in order for landowners to receive irrigation water at the agricultural rate:

1. An annual application for Regional District of North Okanagan (RDNO) Farm Classification must be applied for no later than February 15. Applications submitted after this date will be subject to a non-refundable late fee in addition to the appeal application fee.

2. Properties without BC Assessment Farm Classification with an existing irrigation allocation greater than 0.41 ha (1 acre) can apply annually to receive irrigation water at the agricultural water rate.

3. Properties with an existing irrigation allocation less than or equal to 0.41 ha (1 acre) will not be eligible for an appeal, and will be invoiced at the domestic rate.

4. Properties without BC Assessment Farm Classification or without a RDNO Farm Classification will be considered domestic. Domestic water use is required to be metered and is charged at the domestic water rate.

5. A successful application must meet the following conditions: a. Agricultural use of the property is permitted pursuant to the appropriate zoning regulations; b. The property is used for agricultural purposes, comprising at least one of the following uses:

- Apiculture; - Herb production; - Poultry and egg - Aquaculture; - Horse rearing; production; - Christmas tree culture; - Horse Boarding; - Seed production; - Dairying; - Horticulture; - Turf production; - Floriculture; - Populous species and salix - Wool, hide, feather or fur - Forage production; species intensively cultivated production; and - Forest seedling and in plantations; - The raising of crops or seed production; - Insects raised for biological animals for human - Fruit and vegetable pest control; consumption production; - Livestock raising; - Medicinal plant culture;

The following activities are NOT considered agricultural for the purposes of water billing: - Production of manufactured derivatives from agricultural raw materials; - Production for the occupants’ own domestic consumption, - Irrigation of lawns, gardens and landscaping; - Agricultural support services; and - Breeding and rearing of pets, except horses.

6. The property owner must purchase a second water meter from Greater Vernon Water (GVW) and install it inside the property line to capture all water use. The cost to purchase and install the meter, pit and appurtenances will be borne by the property owner. The meter must be inspected by GVW before eligibility for the agricultural water rate is instated.

7. Landowners with water allocations less than or equal to 0.82 hectares (2 acres) will be required to meet the income threshold of $1,000 per year. Landowners with water allocations greater than 0.82 hectares will be required to meet the income threshold of $2,500 per year. Proof of income is required with ALL appeal applications made.

8. New farms may apply for an interim approval process as follows:

a. Complete a “New Farm – SUPPLEMENTAL APPLICATION FOR GVW FARM CLASSIFICATION”. b. Provide receipts for purchases relating to new farm development. c. Provide receipts for gross farm income for previous year (if available), and estimated annual income projections that can be reasonably expected for the proposed farming operation (will be referenced in future applications). d. New farms will be required to meet and sustain the minimum income threshold (see item 7. above) following two years of operation. The Manager - Greater Vernon Water may approve an extended interim approval period providing the new farm activity meets the BC Assessment criteria for the classification of land under development as a farm. Receipts will be required annually to demonstrate the income threshold has been met prior to approval of RDNO Farm Classification for the third year of new farm operation.

9. All properties must be assessed for backflow prevention and meet the Cross Connection Control Bylaw including installation of required backflow prevention devices and / or assemblies.

10. Notification regarding approved or rejected appeals will be mailed to the address provided. Rejected appeals will be informed of the reasons.
