Closing Statement by Chair RECOMMENDATION 5 Page 29 - 45 That it be recommended to the Board of Directors, the existing Development Variance Permit No. 16-0323-C-DVP issued July 25, 2016 and the existing Development Variance Permit No. 17-0017-C-DVP issued February 28, 2017, be rescinded. RECOMMENDATION 6 That it be recommended to the Board of Directors, the following requirement under Section 5.1.4 (Public Information Meetings and Notice Requirements) of Greater Vernon Water Subdivision and Development Servicing Application Procedures and Administrative Fees Bylaw No. 2658, 2015, as amended, be waived: a) When an application has been approved in principle by the Regional Board, subject to the applicant holding a Public Information Meeting, the applicant shall cause said meeting to be held in accordance with current Board policy on holding Public Information Meetings together with payment of the applicable fee outlined in Schedule “A”. Page 2 of 80 Greater Vernon Advisory Committee Agenda June 7, 2018 RECOMMENDATION 7 That it be recommended to the Board of Directors, upon consideration from adjacent landowners, a Development Variance Permit (DVP) be issued and approved for the Boss Creek “Vernon Hill Ranch” properties, and for the Boss Creek “Bannister/Sissons” properties, legally described as: 1. PID 025-808-117, Strata Lot 2, Section 31, Township 6, Osoyoos Division of Yale District, Strata Plan KAS2590, together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on Form V (located at 1297 Galiano Road); and 2. PID 025-808-125, Strata Lot 3, Section 31, Township 6, Osoyoos Division of Yale District, Strata Plan KAS2590, together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on Form V (located at 1299 Galiano Road); and 3. PID 025-808-109, Strata Lot 1, Section 31, Township 6, Osoyoos Division of Yale District, Strata Plan KAS2590, together with an interest in the common property in proportion to the unit entitlement of the strata lot as shown on Form V (located at 1296 Galiano Road); and 4. PID 011-519-304, District Lot 342, Osoyoos Division of Yale District (no civic address); To vary the following sections of the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, as amended: 1. Defer the requirements contained in Section 110 to provide Waterworks and specifically Schedule B, section B.12.7 to construct a water storage facility and related infrastructure, provided the following conditions are met: - All parcels created must be within Phase 1 of the development, as shown in Figure 1 (attached), and - The Owner/Developer transfers the sum of $15,830.00 per parcel created in Phase 1, shown as Lots 2 to 13, and Lots 15 to 17 on Figure 1, as a security deposit for the future construction of said water storage facility and related infrastructure, and - The Owner/Developer enters into a Servicing Agreement in accordance with Schedule “C” of the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, as amended (or replaced), prior to creation of any parcel within Phase 1, and - Restrictive covenants must be registered on title of both of the remainder properties (Lots 14 and 18) as shown on Figure 1, that state no building permits will be issued and no further subdivision shall be permitted to create any parcel until the water storage facility and related infrastructure have been constructed in accordance with the provisions of Bylaw No. 2650, 2013, as amended, Page 3 of 80 Greater Vernon Advisory Committee Agenda June 7, 2018 2. Defer the requirement contained in Section 112.2 to construct water works including fire hydrants, on a statutory right-of-way registered in favour of the RDNO over the (private) road adjacent to the proposed Lots 15, 16 and 17, as shown on Figure 1, provided that: - the Owner/Developer provides a non-refundable cash deposit or letter of credit acceptable to the RDNO to construct these works in accordance with the Greater Vernon Water Subdivision and Development Servicing Bylaw No. 2650, 2013, section 112.1.c., as amended, and - A restrictive covenant must be registered on title of Lot 14, as shown on Figure 1, stating that any lot(s) created by subdivision within the area designated as Lot 14 shall require the extension of water mains and servicing including fire protection to Lots 15, 16 and 17, shown on Figure 1, in accordance with the provisions of Bylaw No. 2650, 2013, as amended, and - A restrictive covenant must be registered on title of Lots 15, 16 and 17, as shown on Figure 1, stating that the issuance of any building permit on these lots shall require the extension of water mains and servicing including fire protection to Lots 15, 16 and 17, shown on Figure 1, in accordance with the provisions of Bylaw No. 2650, 2013, as amended, and - A restrictive covenant must be registered on title of Lots 15, 16 and 17 as shown on Figure 1 that restricts the property owner from requiring the RDNO to extend the GVW System to service the subject property, and - A private easement, as approved by the RDNO, must be registered over Lot 14 in favour of Lot 15 to provide access to, and for the operation and maintenance of the existing well that supplies the existing house on Lot 15 with potable water, 3. The security deposit collected in Condition 1 above will be released to the developer of the water storage facility and related infrastructure works at time of Substantial Completion of the water storage facility and related infrastructure works. 4. The non-refundable cash deposit or letter of credit collected in Condition 2 above will be released to the developer constructing the water works including fire hydrants on the (private) road frontage adjacent to Lots 15, 16 and 17, as shown on Figure 1, at time of Substantial Completion of these works. 5. The land described herein shall be developed strictly in accordance with the terms and conditions and provisions of this Permit and any plans and specifications attached to this Permit which shall form a part hereof. 6. If the Permittee does not obtain final subdivision approval consistent with Figure 1 within two (2) years of the date of issuance of this Permit, this Permit shall lapse. 2. Water Allocation Purchase Application – 6012 Highway 6, Coldstream, BC • Staff report dated May 14, 2018 RECOMMENDATION 8 Page 46 - 49 That it be recommended to the Board of Directors, the purchase of 2.0 hectares (ha) of water Allocation for the property located at 6012 Highway 6, Coldstream, BC and legally described as Plan B1497, Township 6, Section 25, be authorized; and further, That the property be serviced by the potable main on Highway 6. Greater Vernon Water - Duteau Creek Watershed Technical Advisory Committee Terms of Reference • Staff report dated May 22, 2018 RECOMMENDATION 9 Page 50 - 58 That it be recommended to the Board of Directors, the amended Duteau Creek Watershed Technical Advisory Committee Terms of Reference be endorsed. 4. Greater Vernon Trails and Natural Spaces Advisory Committee • Staff report dated May 23, 2018 • Terms of Reference RECOMMENDATION 10 Page 59 - 67 That the Greater Vernon Trails and Natural Spaces Advisory Committee report dated May 23, 2018 be received as information; and further, That it be recommended by the Board of Directors, the Greater Vernon Trails and Natural Spaces Advisory Committee (GVTNSAC) Terms of Reference be endorsed effective June 30, 2018.
