It can be a political strategy, a genuine reflection of personality, a deep manipulation of core American values, and much more. Political pundits have used it as a descriptive term, and on occasion as an insult. Some have deemed the concept’s flexibility confusing and even counterproductive, which sparked an interest in studying what is meant when analysts and scholars address political speakers as populist. This thesis examines populism in detail, by analyzing the rhetoric of former presidents Ronald Reagan and Bill Clinton. Two questions drove the research: (1) What do people mean when they label a politician as populist? (2) Is this an illuminating descriptor? Although this may seem like a broad brush with which to paint platforms that pride themselves in being in opposition, it is one that has increased in use as the election draws closer. Comparisons of presidential hopefuls as diverse as conservative Republican Mike Huckabee and liberal Independent-Democrat-Socialist Bernie Sanders frequent news stories that claim this type of rhetoric is now necessary to get the increasingly prominent “anti-establishment” vote.2 Some journalists blame not the establishment, but rather international threats, as the cause of this political trend, stating that right-leaning politicians across the world (e.g. Donald J. Trump, Marine Le Pen in France, and Viktor Orban in Hungary) are turning towards populism in response to “a climate of insecurity rivaling the period after the First World War.”3 While trying to determine what causes this rhetoric globally may be a fruitful area for additional research, what is of more interest in this project is the rise of political pundits who are labeling nearly everyone in the American 2016 presidential race as populist. What is this term supposed to convey? What do the journalists and political analysts mean when they designate one person or another as populist? The fact that both Hillary Clinton and Donald Trump fit under this banner may say more about populism as a concept than about either person as a politician. Examining the justifications

The company performed a very lawful, purposeful activity in doing the research and developing the patents of the drugs. I do not see where a nuisance exception has any relevance in this scenario. It is not a nuisance to create this drug, and it is not a nui- sance to operate a drug production plant. I do not want to be trivial about this at all, but it is very easy to give away what you do not own. In my view, this is what happens in a lot of these cases. Some great lofty public good is determined by a state, county, or Federal Government, and any activity that impedes it is au- tomatically declared a nuisance. DAVID GRATZER* He used twenty-two pens to sign the Patient Protection and Affordable Care Act (PPACA)1 into law.2 On March 23, 2010, President Obama finally put the ink on the legislative drive that had stretched for more than a year, and had burned brightly in the imagination and dreams of Democrats since the demise of President Clinton’s efforts in 1994. The journey to the East Room signing ceremony had been long and hard. Not surprisingly, then, the ceremony itself seemed unusually festive. With the final pen stroke, he com- mented: “We are a nation that faces its challenges and accepts its responsibilities. We are a nation that does what is hard. What is necessary. What is right. Here, in this country, we shape our destiny.”3 The rhetoric may have been tall, but the legislation was sweeping. Like it or not, the president has become the most important single player in the legislative juggernaut of Washington, DC. Although the role of the president as an agenda setter has been explored previously, political scientists know very little about the ability of winning presidential candidates to enact campaign promises. We know that presidents have an incentive to follow through with such promises since the public holds them accountable for unmet expectations. But how often are presidents successful in transforming campaign rhetoric into policy realities? How has campaign rhetoric affected the ensuing legislative agenda? Has Congress adopted a president’s campaign program as the basis for its own legislative agenda? In particular, this analysis will compare and contrast the campaign agenda setting strategies of first and second term presidents. I will analyze four recent presidential campaigns and their subsequent legislative sessions. To explore the first versus second term comparison, I chose Ronald Reagan’s 1980 and 1984 campaigns and Bill Clinton’s 1992 and 1996 campaigns. In the paper, I systematically outline the policy proposals each candidate advocated during their campaign. I formulated a list of campaign policy proposals by reading numerous campaign “stump” speeches, the party nomination acceptance speeches, and reviewing the relevant academic literature written on the specific campaign.

RETHINKING PRESIDENTIAL ELIGIBILITY Eugene D. Mazo* Many aspiring American Presidents have had their candidacies challenged for failing to meet the Constitution’s eligibility requirements. Although none of these challenges have ever been successful, they have sapped campaigns of valuable resources and posed a threat to several ambitious men. This Article examines several notable presidential eligibility challenges and explains why they have often been unsuccessful. The literature on presidential eligibility traditionally has focused on the Eligibility Clause, which enumerates the age, residency, and citizenship requirements that a President must satisfy before taking office. By contrast, very little of it examines how a challenge to one’s candidacy impacts a presidential campaign. This Article seeks to fill this gap. It also offers a modest proposal: Congress should pass legislation defining exactly who is eligible to be President and also implement procedural rules that would expedite presidential eligibility cases for review to the Supreme Court.
