A RESOLUTION APPROVING AND ACCEPTING THE FINAL (RECORD) PLAT OF NEIGHBORHOOD HEALTH CLINIC, TO REPLAT ALL OF LOT 6, AND PART OF LOTS 5 AND 9 ACCORDING TO THE PLAT OF SEABOARD , RECORDED AT PLAT BOOK 13, PAGE 61, OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, TO CREATE A TWO-TRACT SUBDIVISION IN THE D-DOWNTOWN DISTRICT, ON PROPERTY CONTAINING APPROXIMATELY 2.63 ACRES, OWNED BY NEIGHBORHOOD HEALTH CLINIC, INC., A FLORIDA NOT FOR PROFIT CORPORATION, AND 12TH AND GOODLETTE, LLC, A FLORIDA LIMITED LIABILITY COMPANY, AND LOCATED AT 121, 100 AND 40 GOODLETTE-FRANK , AND 24 12TH STREET NORTH; MORE FULLY DESCRIBED HEREIN; REQUIRING RECORDING; APPROVING SUBDIVISION REPLAT PETITION 17-SD1; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Section 54-31 of the Code of Ordinances details the approval procedures for a subdivision plat petition; and

WHEREAS, Neighborhood Health Clinic, Inc., a Florida not for profit corporation, and 12'^ and Goodlette, LLC, a Florida limited liability^company., owners, have n requested approval of Subdivision/Replat Pe|itr6rc-t7VSp.t^or Final Plat approval to replat all of Lot 6 and parts of LptSvS^andfS, acicoicling to the Plat of Seaboard Downtown Subdivision, to?G^te_a two tra^iSubdivision known as Neighborhood Health Cliifd;:::" onF ~pro'p9rty-contain > approximately 2.63 acres and located at^l3.t, llQ; 'ana' 40:::G|odlette- Frank Road, and 24 12"^ Street North; and /'OS WHEREAS, John M. Passidomo, Esq., Cheffy PassidoniP.vPX";^ has been authorized by the owner to file this petition; and WHEREAS, the Planning Advisoiy Board, following an advertised public hearing, considered the public input, the recommendation of the staff, and recommended by a vote of 7 to 0 that Petition 17-SD1 be granted; and WHEREAS, after considering the recommendation of the Planning Advisory Board and after providing the petitioner, staff and the public an opportunity to present testimony and evidence, the Council finds that the criteria for granting the petition have been met and that the petition should therefore be approved and accepted;

Section 1. That Subdivision/Replat Petition 17-SD1 for Final Plat approval, pursuant to Section 54-31, to replat all of Lot 6 and part of Lots 5 and 9 according to the Plat of Seaboard Downtown Subdivision, recorded at Plat Book 13, Page 61 of the Public Records of Collier County, Florida, to create a two-tract subdivision known as Neighborhood Health Clinic, on property containing approximately 2.63 acres and located at 121, 100, and 40 Goodlette-Frank Road, and 24 12^^ Street North, is hereby approved and accepted, a copy of which is on file in the City Clerk's Office, for property currently described as:

Section 2. That the Final (Record) Plat approval and acceptance is based on the Plat submitted with the petition prepared by John P. Maloney, P.S.M., Stantec Consulting Services, Inc., dated February 7, 2017. An original mylar and copies of the Plat will be kept on file in the City Clerk's Office. Section 3. This acceptance and approval shall expire unless the Plat has been filed for recording with the Collier County Clerk of Circuit Court within 30 business days after the date of filing of this resolution with the City Clerk.
