MOLD SUPPLEMENT

BACKGROUND In 2001 California Senate Bill 732 was passed which amended the transfer disclosure statement to include a disclosure about mold. It also provides for a revision of the Environmental Hazards Booklet by the California Department of Toxic Substances Control to include a chapter on mold (Chapter 4).

A real estate agent is required to use the new transfer disclosure statement form. An agent should also provide the buyer with a current copy of the above-referenced Environmental Hazards Booklet.

Buyers should be advised that if there is any question as to whether mold exists, they can elect to have a mold inspection performed by a qualified expert.

ABOUT MOLD Mold growth on surfaces can often be seen in the form of discoloration, frequently green, gray, brown, or black, but also white and other colors are possible. Warping floors and discoloration of walls and ceilings can be indications that moisture problems exist. Molds can release tiny spores into the air and often have a musty or earthy odor.

Regarding Registered Sex Offenders

NOTICE: The California Department of Justice, sheriff’s departments, police departments serving jurisdictions of 200,000 or more and many other local law enforcement authorities maintain for public access a database of the locations of person required to register pursuant to paragraph (1) of subdivision (a) of Section 290.4 of the Penal Code. The database is updated quarterly basis and a source of information about the presence of these individuals in any neighborhood. The Department of Justice also maintains a Sex Offender Identification Line through which inquiries about individuals may be made. This is a “900” telephone service. Callers must have specific information about individuals they are checking. Information regarding neighborhoods is not available through the “900” telephone service.

SUMMARY Disclosure Statement will be collectively referred to as a Natural Hazard Disclosure Report (NHDR). The NHDR is based on the research of various databases and maps published by local, state, and federal government agencies for public review. ABW Corp. takes no responsibility and makes no representations concerning the physical condition of the subject property or the accuracy of the maps and databases used for this report. No physical or visual inspections of the subject property were made by any employee or representative of ABW Corp.. Listed but not limited to, ABW Corp. makes no claim concerning and takes no responsibility for: any condition or consequence arising from the hazards disclosed, any zoning and building codes that may additionally effect the subject property, the market value of the subject property, any condition or consequence arising, from information that was withheld, concealed, or undisclosed at the time this report was completed. RECIPIENT'S DUTIES The following NHDR is based solely on the property location provided by recipient. It is the recipient's responsibility to provide the correct location information for the subject property. Reports are for the subject property only and not for other properties within the vicinity of the subject property. It is further the Recipient's duty to disclose any and all information that may alter the outcome of this report. DATE OF ISSUE The data represented on this NHDR is valid as of the date of issue. This statement is completed based on information current as of the date of issue. ABW Corp. will not be responsible for updates, amendments or any alteration of the maps or databases made after the date of issue. INTENTION OF NHDR This NHDR is intended for the recipient (transferor and the listing and/or selling agent), to assist in complying with California Civil Code Sections 1102.6 (b) and 1103. It is not intended to determine the marketability of the subject property, the determination of compliance with other county, state or federal laws, or to be substituted as an insurance policy pertaining to the disclosed hazards. GOVERNING LAW This report shall be governed by and construed in accordance with the laws of the State of California. Any action related directly or indirectly to this Agreement shall be brought in the federal or state courts located in Santa Rosa, CA (Sonoma County) and no other jurisdiction. ERROR AND/OR OMISSION PERTAINING TO THIS AGREEMENT Any error or omission pertaining to this agreement shall be handled according to the terms and conditions of this Agreement. The remainder of this Agreement shall remain in full force regardless of error or omission. ARBITRATION If any dispute arises from or is related to the content of this report and a settlement cannot be reached, both parties agree to first attempt to settle the dispute using the Commercial Dispute Resolution Procedures via mediation administered by the American Arbitration Association. ACCEPTANCE OF TERMS, CONDITIONS AND LIMITATIONS The ordering of the Hazard Disclosure Report and the use of said statement by any recipient constitutes acceptance of all Terms, Conditions and Limitations pertaining to and outlined in this report. LIMITATION OF LIABILITY AND DAMAGES ABW Corp. maintains a minimum $4,000,000 Errors and Omissions insurance policy to cover any and all liabilities that may occur. ABW Corp. will only be liable for actual property damages for losses resulting from the proven erroneous completion of this statement. No other losses either indirect, special, incidental or consequential are the responsibility of ABW Corp.. ABW Corp. shall not be liable for damages in excess of the actual property damage resulting from the proven erroneous completion of this statement or $1,000,000 whichever is less or for amounts covered by Federal Disaster Assistance or another insurance policy. Additionally including but not limiting to, ABW Corp. shall not be liable for inaccuracies or omissions CONDITIONS OF THE NOTICE OF TERMS, CONDITIONS AND LIMITATIONS Unless otherwise agreed upon in writing by ABW Corp. and recipient, This NHDR remains the property of ABW Corp. and as such carries no warranties from ABW Corp. until this report is paid in full. ABW Corp. shall have no further responsibility to any party concerning the notification of future changes to the maps and databases used in this statement which might affect the subject property after the statement issue date unless a statement for the subject property is ordered at a later date. ABW Corp. shall only be liable to the legitimate parties involved as of the date of issue of this statement. Further, no party other than the parties involved as of the date of issue shall be entitled to rely on the findings of this statement. This NHDR is being issued using various Governmental agencies lists, databases and maps. ABW Corp. determines to the best of its ability the location of all hazards within proximity and/or inundation area to the property in question using these sources. The possibility that additional, new or revised information, sites, incomplete information, ordnance, incomplete locations or zones, contaminants and exempt sites may exist. ABW Corp. Assumes no responsibility pertaining to the accuracy of the lists, databases, and maps supplied by the Recipient, Governmental agencies, or other parties to complete this NHDR. Additionally, no further analysis of the referenced information is performed. ABW Corp. assumes that all lists, databases, and maps referenced are complete and accurate. ABW Corp. updates its databases and maps at various intervals based in part, on the Governmental agencies lists, databases, and maps update cycles and release dates. There will be time lapses that exist between the ABW Corp. update cycles and the Governmental agencies release dates. The recipient is made aware of these facts and that changes in one more of the hazards disclosed is a possibility. The possible changes mentioned could change the outcome of the report. No visual inspection of the Subject property was performed. This report does not specify or give assumptions with respect to any defects, existence of toxic or hazardous materials located around or within the Subject property. This report gives no opinion or fact pertaining to the title of the Subject property. The legal description of the Subject property is being supplied to ABW Corp. by the Recipient and is assumed to be correct. No responsibility is assumed by ABW Corp. for any cost associated with the requirement, need or lack of need, for any insurance for the subject property. This includes but is not limited to, flood and/or earthquake insurance. Please contact the proper insurance entity about the availability of insurance. ABW Corp. will not be responsible or be required to give testimony for any deposition or subpoena in any court or hearing due to any information being questioned due to the issuance of the Report. ENTIRE AGREEMENT This Notice of Terms, Limitations and Conditions represents the entire Agreement and represents the entire understanding of all parties involved. No changes to this Agreement will be binding without prior written consent by the parties.
