Garrett** James Madison is considered the "Fatherof the Constitution," but his progeny disappointed him. It had no effective defense against self-govern- ment's "mortal disease"--the oppression of minorities by local majorities. This Article explores Madison's writings in an effort to reclaim the deep con- ception of equal protection at the core of his constitutional aspirations. At the Convention, Madison passionately advocated a radical structural ap- proach to equal protection under which the "extended republic's" broadlyfo- cused legislaturewould have monitored local laws and vetoed those that were parochialand "unjust." Rejecting this proposal to structure equal protection into the "interior"operation of government, the Framers instead adopted "ex- terior" admonitions againststate ex post facto laws, impairment of contracts, and the like. Expanding this strategy, the Fourteenth Amendment admon- ished states against all denials of "the equal protection of the laws." Exactly as Madison predicted, however, protection of local minorities cannot be en- trusted to "dim and doubtful" words enforced after the fact by courts that are inaccessible to minorities and too distantfrom the people at large to have the knowledge and confidence to resist powerful local majorities. This is particu- larly so of late, as the courts have placed vast spheres of activity off limits to the extended republic and denied it the power to enlist state officials in imple- menting nationalpolicy. By rediscoveringMadison's neglected thinking on equal protection, and his elaborate design for a constitution that was never enacted, this Article sheds new light on seemingly intractableproblems of federalism and equal protection and paves the way for a modern revival of Madisonian Equal Protection. Indeed, a vision of equal protection deeply motivated the actions of James Madison, the "Father of the Constitution,"' at the time of the framing. As Madison wrote to George Washington before the Con- stitutional Convention, one of the main innovations he sought in the newly constituted government was a national negative or veto of state law 1. COLUMBIA LAW REVIEW [Vol. 104:837 by Congress to curtail state-level "aggressions of interested majorities on 2 the rights of minorities." The constitution Madison envisioned, however, is not the one the Framers wrote. To his great disappointment, the nation's first constitu- tion omitted any explicit equal protection constraint on the states, and it excluded the national negative he had fervently promoted. Nor, as we will see, did Madison's constitution emerge eighty years later with the Equal Protection Clause and the other postbellum amendments. This Article recalls the constitution Madison wanted in order to en- rich our understanding of Madison's thinking and to credit his prescient belief that the constitution the nation originally framed was-and the one that replaced it in 1868 remains-gravely defective for lack of an effective equal protection constraint. A political club composed of 25 to 30 men, meeting once a week to debate specified subjects. What is so unusual or fascinating about that? Schools, colleges, life in the great wide world, are full of myriad just such groups--investment clubs, debating clubs, clubs with a politi- cal connotation--we, today, are constantly hearing about them, going to them, reading about them. What sets this particular club apart, makes it worth investigating, and gives it an aura all its own? First of all, there is the work this club did. The importance of The Political Club of Danville lay in the training of its members for the role they played in the creation of the state of Kentucky.

In his interesting "Sketches of North Cai-olina," it is stated by Rev. W. H. Foote, that the political principle asserted by the Scotch-Irish settlers in that State, in what is known as the "Mecklenburg Declaration of Independence," of the right to choose their own civil rulers, was the legitimate outgrowth of the religious principle for which their ancestors had fought in both Ireland and Scotland—that of their right to choose their own re- ligious teachers. After affirming that "The famous book, Lex Rex, by Rev. Samuel Rutherford, was full of principles that lead to Republican action," and that the Protestant emigrants to America from the North of Ireland had learned the rudiments of republicanism in the latter country, the same author empha- sizes the assertion that "these great principles they brought with them to America." Chapmani ABSTRACT Events in 2015 surrounding Rowan County Clerk Kim Davis showed how removing county clerks from office is not a simple task in Kentucky. At present, removal can be accomplished only by the same dfficult means required to remove a state-wide executive offlcer, meaning the county clerk has the same tenure as the governor and attorney general. Historically, however, the county clerk was removable by other, lesser means, as were all other county officers. Today, the other county offcers are stillremovable by those lessermeans, but the county clerk is not, resultingin a removal gap. That gap first appearedin 1976 and, based on a review of the available historical materials, was the result of mere oversight when the Kentucky Constitution was revised substantially to implement a new judicial branch.

KENZER The Virginia War Office was a critical component of the Virginia government duringthe American Revolution. Its duties encompassed every aspect of planning, ," supplying, and waging war in the state. The Commissioner of War gathered strategic information, superintended the state's military factories, and provided continuity between the administrations of GovernorsJefferson, Nelson and Harrison. The ability of the War Officeto execute its duties depended largely on the diligence of the Commissioner of War and his ability to cope with problems beyond his control. Unfortunately, the trials and tribulations of the War Officehave been overlooked by historians focusingon the luminary figures involved in Virginia's Revolutionary War efforts. This thesis examines the effectivenessof the Virginia War Office. It faced many problems that were beyond its control, including Virginia's economy, the constant invasions by the British, the autonomy of local officials, and the interference of the Continental Army.
