1 AN ACT

2 RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF

3 SEVERANCE TAX BONDS; AUTHORIZING EXPENDITURES FROM CERTAIN

4 FUNDS AND BALANCES; CLARIFYING CONDITIONS FOR THE ISSUANCE OF

5 BONDS; ESTABLISHING CONDITIONS FOR THE EXPENDITURE OF

6 SEVERANCE TAX BOND PROCEEDS; ESTABLISHING CONDITIONS FOR THE

7 REVERSION OF UNEXPENDED BALANCES; MAKING APPROPRIATIONS;

8 DECLARING AN EMERGENCY.

10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF :

11 SECTION 1. SEVERANCE TAX BONDS--AUTHORIZATIONS--

12 APPROPRIATION OF PROCEEDS.--

13 A. The state board of finance may issue and sell

14 severance tax bonds in compliance with the Severance Tax

15 Bonding Act in an amount not to exceed the total of the

16 amounts authorized for purposes specified in this act. The

17 state board of finance shall schedule the issuance and sale

18 of the bonds in the most expeditious and economical manner

19 possible upon a finding by the board that the project has

20 been developed sufficiently to justify the issuance and that

21 the project can proceed to contract within a reasonable time.

22 The state board of finance shall further take the appropriate

23 steps necessary to comply with the federal Internal Revenue

24 Code of 1986, as amended. Proceeds from the sale of the

25 bonds are appropriated for the purposes specified in this HWMC/HB 219 Page 1 1 act.

2 B. The agencies named in this act shall certify to

3 the state board of finance when the money from the proceeds

4 of the severance tax bonds appropriated in this section is

5 needed for the purposes specified in the applicable section

6 of this act. If an agency has not certified the need for

7 severance tax bond proceeds for a particular project by the

8 end of fiscal year 2018, the authorization for that project

9 is void.

10 C. Before an agency may certify for the need of

11 severance tax bond proceeds, the project must be developed

12 sufficiently so that the agency reasonably expects to:

13 (1) incur within six months after the

14 applicable bond proceeds are available for the project a

15 substantial binding obligation to a third party to expend at

16 least five percent of the bond proceeds for the project; and

17 (2) spend at least eighty-five percent of

18 the bond proceeds within three years after the applicable

19 bond proceeds are available for the project.

20 D. Except as otherwise specifically provided by

21 law:

22 (1) the unexpended balance from the proceeds

23 of severance tax bonds appropriated in this act for a project

24 shall revert to the severance tax bonding fund no later than

25 the following dates: HWMC/HB 219 Page 2 1 (a) for a project for which severance

2 tax bond proceeds were appropriated to match federal grants,

3 six months after completion of the project;

4 (b) for a project for which severance

5 tax bond proceeds were appropriated to purchase vehicles,

6 including emergency vehicles and other vehicles that require

7 special equipment; heavy equipment; books; educational

8 technology; or other equipment or furniture that is not

9 related to a more inclusive construction or renovation

10 project, at the end of the fiscal year two years following

11 the fiscal year in which the severance tax bond proceeds were

12 made available for the purchase; and

13 (c) for any other project for which

14 severance tax bonds were appropriated, within six months of

15 completion of the project, but no later than the end of

16 fiscal year 2020; and

17 (2) all remaining balances from the proceeds

18 of severance tax bonds appropriated for a project in this act

19 shall revert to the severance tax bonding fund three months

20 after the latest reversion date specified for that type of

21 project in Paragraph (1) of this subsection.

22 E. Except for appropriations to the capital

23 program fund, money from severance tax bond proceeds provided

24 pursuant to this act shall not be used to pay indirect

25 project costs. HWMC/HB 219 Page 3 1 F. Except for a project that was originally funded

2 using a tax-exempt loan or bond issue, a project involving

3 repayment of debt previously incurred shall be funded through

4 the issuance of taxable severance tax bonds with a term that

5 does not extend beyond the fiscal year in which they are

6 issued.

7 G. For the purpose of this section, "unexpended

8 balance" means the remainder of an appropriation after

9 reserving for unpaid costs and expenses covered by binding

10 written obligations to third parties.

11 SECTION 2. GENERAL FUND AND OTHER FUND APPROPRIATIONS--

12 LIMITATIONS--REVERSIONS.--

13 A. Except as otherwise specifically provided by

14 law:

15 (1) the unexpended balance of an

16 appropriation made in this act from the general fund or other

17 state funds shall revert no later than the following dates:

18 (a) for a project for which an

19 appropriation was made to match federal grants, six months

20 after completion of the project;

21 (b) for a project for which an

22 appropriation was made to purchase vehicles, including

23 emergency vehicles and other vehicles that require special

24 equipment; heavy equipment; books; educational technology; or

25 other equipment or furniture that is not related to a more HWMC/HB 219 Page 4 1 inclusive construction or renovation project, at the end of

2 the fiscal year two years following the fiscal year in which

3 the appropriation was made for the purchase; and

4 (c) for any other project for which an

5 appropriation was made, within six months of completion of

6 the project, but no later than the end of fiscal year 2020;

7 and

8 (2) all remaining balances from an

9 appropriation made in this act for a project shall revert

10 three months after the latest reversion date specified for

11 that type of project in Paragraph (1) of this subsection.

12 B. Except for appropriations to the capital

13 program fund, money from appropriations made in this act

14 shall not be used to pay indirect project costs.

15 C. Except as provided in Subsection E of this

16 section, the balance of an appropriation made from the

17 general fund shall revert in the time frame set forth in

18 Subsection A of this section to the capital projects fund.

19 D. Except as provided in Subsection E of this

20 section, the balance of an appropriation made from other

21 state funds shall revert in the time frame set forth in

22 Subsection A of this section to the originating fund.

23 E. The balance of an appropriation made from the

24 general fund or other state funds to the Indian affairs

25 department or the aging and long-term services department for HWMC/HB 219 Page 5 1 a project located on lands of an Indian nation, tribe or

2 pueblo shall revert in the time frame set forth in Subsection

3 A of this section to the tribal infrastructure project fund.

4 F. For the purpose of this section, "unexpended

5 balance" means the remainder of an appropriation after

6 reserving for unpaid costs and expenses covered by binding

7 written obligations to third parties.

8 SECTION 3. ADMINISTRATIVE OFFICE OF THE DISTRICT

9 ATTORNEYS PROJECT--SEVERANCE TAX BONDS.--Pursuant to the

10 provisions of Section 1 of this act, upon certification by

11 the administrative office of the district attorneys that the

12 need exists for the issuance of the bonds, twenty thousand

13 dollars ($20,000) is appropriated to the administrative

14 office of the district attorneys to purchase and install

15 information technology, including related equipment,

16 furniture and infrastructure, and to purchase and equip

17 vehicles for district attorney offices statewide.

18 SECTION 4. AGING AND LONG-TERM SERVICES DEPARTMENT

19 PROJECTS--SEVERANCE TAX BONDS.--Pursuant to the provisions of

20 Section 1 of this act, upon certification by the aging and

21 long-term services department that the need exists for the

22 issuance of the bonds, the following amounts are appropriated

23 to the aging and long-term services department for the

24 following purposes:

25 1. thirty thousand dollars ($30,000) to plan, HWMC/HB 219 Page 6 1 design, construct and equip an addition to the Village of

2 Tijeras senior center in Tijeras in Bernalillo county;

3 2. eighty thousand dollars ($80,000) to plan,

4 design, construct, equip, purchase and install improvements

5 to senior centers in Las Cruces in Dona Ana county;

6 3. one hundred eighteen thousand five hundred

7 dollars ($118,500) to plan, design, construct, furnish and

8 equip a senior center in Wagon Mound in Mora county;

9 4. one hundred twenty-four thousand dollars

10 ($124,000) to plan, design, construct, equip and furnish a

11 senior center in the Upper Fruitland chapter of the

12 Nation in San Juan county;

13 5. twenty thousand dollars ($20,000) for

14 improvements to the facility to address code compliance

15 issues at the Picuris senior center in the Pueblo of Picuris

16 in Taos county;

17 6. seventy-five thousand dollars ($75,000) to

18 plan, design and construct a senior center in the Red Rock

19 chapter of the Navajo Nation in McKinley county; and

20 7. five thousand dollars ($5,000) to purchase and

21 install meals equipment at the Bosque Farms senior meal site

22 in Bosque Farms in Valencia county.

23 SECTION 5. BERNALILLO COUNTY METROPOLITAN COURT

24 PROJECT--SEVERANCE TAX BONDS.--Pursuant to the provisions of

25 Section 1 of this act, upon certification by the Bernalillo HWMC/HB 219 Page 7 1 county metropolitan court that the need exists for the

2 issuance of the bonds, thirty thousand dollars ($30,000) is

3 appropriated to the Bernalillo county metropolitan court to

4 purchase and install a video surveillance system and to plan,

5 design, construct, furnish and equip the fourth floor of the

6 Bernalillo county metropolitan courthouse in Albuquerque in

7 Bernalillo county.

8 SECTION 6. BORDER AUTHORITY PROJECTS--SEVERANCE TAX

9 BONDS.--Pursuant to the provisions of Section 1 of this act,

10 upon certification by the border authority that the need

11 exists for the issuance of the bonds, the following amounts

12 are appropriated to the border authority for the following

13 purposes:

14 1. five hundred thousand dollars ($500,000) for

15 site improvements and to plan, design, construct, expand and

16 renovate a conference room at the border authority building

17 in Santa Teresa in Dona Ana county; and

18 2. two hundred fifty thousand dollars ($250,000)

19 to plan, design, construct, equip and furnish a visitor's

20 center at the border authority building in Santa Teresa in

21 Dona Ana county.

22 SECTION 7. CAPITAL PROGRAM FUND PROJECTS--SEVERANCE TAX

23 BONDS.--Pursuant to the provisions of Section 1 of this act,

24 upon certification by the facilities management division of

25 the general services department that the need exists for the HWMC/HB 219 Page 8 1 issuance of the bonds, the following amounts are appropriated

2 to the capital program fund for the following purposes:

3 1. five hundred thousand dollars ($500,000) to

4 purchase and install furnishings, fixtures, equipment and

5 related infrastructure for a child wellness center in

6 Albuquerque in Bernalillo county;

7 2. two hundred eighty thousand dollars ($280,000)

8 to plan, design, construct and renovate facilities, including

9 the purchase and installation of security improvements, at

10 the Camino Nuevo youth center at the youth diagnostic and

11 development center in Albuquerque in Bernalillo county;

12 3. seven hundred fifty thousand dollars ($750,000)

13 to plan, design, purchase and install security and code

14 compliance improvements and to convert the existing swimming

15 pool into a multi-use facility at the youth diagnostic and

16 development center in Albuquerque in Bernalillo county;

17 4. one hundred ninety thousand dollars ($190,000)

18 to plan, design, construct, purchase and install new domestic

19 hot water boilers and to improve the Manzano and Sandia

20 cottages at the youth diagnostic and development center in

21 Albuquerque in Bernalillo county;

22 5. one million five hundred thousand dollars

23 ($1,500,000) to plan, design, construct, renovate, furnish

24 and equip the state police district office in Roswell in

25 Chaves county; HWMC/HB 219 Page 9 1 6. eighty-five thousand dollars ($85,000) to plan,

2 design, purchase and install a fire alarm system at the

3 reintegration center in Eagle Nest in Colfax county;

4 7. four hundred thousand dollars ($400,000) for

5 site improvements and to plan, design, purchase and install

6 heating, ventilation and air conditioning units, electrical

7 system improvements, roofs and curbs at the J. Paul Taylor

8 center in Las Cruces in Dona Ana county;

9 8. five million dollars ($5,000,000) to plan,

10 design, construct, furnish and equip phase 3 of the new

11 Meadows building and for infrastructure improvements at the

12 New Mexico behavioral health institute in Las Vegas in San

13 Miguel county;

14 9. one million five hundred thousand dollars

15 ($1,500,000) to plan, design, demolish, construct, renovate,

16 improve, furnish and equip department of health facilities

17 statewide, including the purchase and installation of

18 equipment for the scientific laboratory division in

19 Albuquerque in Bernalillo county and for repairs to the

20 therapeutic pool at the Los Lunas campus in Valencia county;

21 10. five hundred thousand dollars ($500,000) to

22 plan and design a new evidence and records facility and crime

23 laboratory, including expansion of the existing crime

24 laboratory, at the department of public safety headquarters

25 in Santa Fe in Santa Fe county; HWMC/HB 219 Page 10 1 11. seven million dollars ($7,000,000) to plan,

2 design, construct, renovate, repair, purchase, install, equip

3 and make other infrastructure improvements, including

4 security upgrades and the design and replacement of heating,

5 ventilation and air conditioning systems, at correctional

6 facilities statewide;

7 12. two million dollars ($2,000,000) to purchase

8 easements and to plan, design, construct, equip and furnish

9 the relocation of the Texico port of entry in Texico in Curry

10 county;

11 13. four million dollars ($4,000,000) to plan,

12 design, construct, renovate, furnish and equip facilities,

13 including infrastructure upgrades, demolition and abatement,

14 at state-owned facilities statewide; and

15 14. eighty-five thousand dollars ($85,000) to

16 plan, design and construct improvements to the medical

17 examination room at the Henry Perea building in Los Lunas in

18 Valencia county.

19 SECTION 8. CULTURAL AFFAIRS DEPARTMENT PROJECTS--

20 SEVERANCE TAX BONDS.--Pursuant to the provisions of Section 1

21 of this act, upon certification by the cultural affairs

22 department that the need exists for the issuance of the

23 bonds, the following amounts are appropriated to the cultural

24 affairs department for the following purposes:

25 1. two hundred twenty-nine thousand dollars HWMC/HB 219 Page 11 1 ($229,000) to plan, design, construct and install a memorial

2 to gun violence victims in Albuquerque in Bernalillo county;

3 2. six hundred thirty-nine thousand five hundred

4 dollars ($639,500) to plan, design, construct, renovate,

5 furnish and equip the national Hispanic cultural center annex

6 and site, including parking lot improvements, in Albuquerque

7 in Bernalillo county;

8 3. two hundred seventy-seven thousand five hundred

9 dollars ($277,500) to plan, design, construct, equip, improve

10 and renovate the facilities, exhibits and site at the New

11 Mexico museum of natural history and science in Albuquerque

12 in Bernalillo county;

13 4. fifty thousand dollars ($50,000) to plan,

14 design, construct, landscape and improve the Bosque Redondo

15 memorial at the Fort Sumner historic site in De Baca county;

16 5. twenty-five thousand dollars ($25,000) to plan,

17 design and construct improvements to the Taylor-Barela-

18 Reynolds-Mesilla historic site, including the purchase and

19 installation of security upgrades and a heating, ventilation

20 and air conditioning system, in Mesilla in Dona Ana county;

21 6. fifty thousand dollars ($50,000) to plan,

22 design, construct, renovate and preserve the post ruins at

23 the Fort Selden historic site in Radium Springs in Dona Ana

24 county;

25 7. one hundred seventy-five thousand dollars HWMC/HB 219 Page 12 1 ($175,000) to plan, design and renovate the restrooms,

2 including accessibility improvements, at the New Mexico

3 museum of space history in Alamogordo in Otero county;

4 8. seventy thousand dollars ($70,000) to plan,

5 design and construct the ruins footprint at the Coronado

6 historic site in Sandoval county;

7 9. fifty thousand dollars ($50,000) to plan,

8 design, construct, renovate and improve the exhibits and

9 facility at the museum of Indian arts and culture in Santa Fe

10 in Santa Fe county;

11 10. one hundred ninety-five thousand dollars

12 ($195,000) to plan, design, construct and renovate the

13 facilities and courtyard at the New Mexico museum of art,

14 including fire protection system improvements, information

15 technology and related equipment, furniture and

16 infrastructure, in Santa Fe in Santa Fe county;

17 11. forty thousand dollars ($40,000) to restore

18 the mural on the records center building in Santa Fe in Santa

19 Fe county;

20 12. four hundred seventeen thousand one hundred

21 seventy-five dollars ($417,175) to plan, design, construct,

22 renovate, furnish, equip and improve the palace of the

23 governors state history museum facility, exhibits and site in

24 Santa Fe in Santa Fe county;

25 13. thirteen thousand dollars ($13,000) to HWMC/HB 219 Page 13 1 purchase equipment for preserving and digitizing films,

2 photographs and collections at the palace of the governors

3 photo archives at the New Mexico history museum in Santa Fe

4 in Santa Fe county;

5 14. sixty-two thousand dollars ($62,000) to

6 purchase and install furniture, equipment, fixtures and

7 related infrastructure and to plan, design and construct

8 sidewalks at the children's museum in Santa Fe in Santa Fe

9 county;

10 15. one hundred eleven thousand dollars ($111,000)

11 to plan, design, equip and construct improvements, including

12 a fire suppression system, a security system, drainage and

13 accessibility, for the center for contemporary arts in Santa

14 Fe in Santa Fe county;

15 16. sixty thousand dollars ($60,000) to plan,

16 design and construct improvements to the museum hill campus

17 in Santa Fe in Santa Fe county; and

18 17. two million dollars ($2,000,000) to plan,

19 design, construct, renovate, purchase, install, furnish,

20 equip and upgrade exhibits, facilities, sites and

21 infrastructure at museums, historic sites and cultural

22 facilities statewide.

23 SECTION 9. CUMBRES AND TOLTEC SCENIC RAILROAD

24 COMMISSION PROJECTS--SEVERANCE TAX BONDS.--Pursuant to the

25 provisions of Section 1 of this act, upon certification by HWMC/HB 219 Page 14 1 the Cumbres and Toltec scenic railroad commission that the

2 need exists for the issuance of the bonds, the following

3 amounts are appropriated to the Cumbres and Toltec scenic

4 railroad commission for the following purposes:

5 1. three hundred thousand dollars ($300,000) for

6 locomotive and boiler upgrades and rehabilitation to comply

7 with federal railroad administration standards for the

8 Cumbres and Toltec scenic railroad operating between New

9 Mexico and Colorado; and

10 2. three hundred fifteen thousand dollars

11 ($315,000) for track rehabilitation and for related

12 infrastructure improvements to the Cumbres and Toltec scenic

13 railroad operating between New Mexico and Colorado.

14 SECTION 10. FIRST JUDICIAL DISTRICT COURT PROJECTS--

15 SEVERANCE TAX BONDS.--Pursuant to the provisions of Section 1

16 of this act, upon certification by the first judicial

17 district court that the need exists for the issuance of the

18 bonds, the following amounts are appropriated to the first

19 judicial district court for the following purposes:

20 1. sixty-seven thousand two hundred dollars

21 ($67,200) to purchase and install an integrated electronic

22 docket display system, including information technology and

23 related equipment, furniture and infrastructure, for the

24 first judicial district court in Santa Fe, Los Alamos and Rio

25 Arriba counties; and HWMC/HB 219 Page 15 1 2. seventy thousand dollars ($70,000) to purchase

2 and equip vehicles for the first judicial district court in

3 Santa Fe in Santa Fe county.

4 SECTION 11. SECOND JUDICIAL DISTRICT COURT PROJECT--

5 SEVERANCE TAX BONDS.--Pursuant to the provisions of Section 1

6 of this act, upon certification by the second judicial

7 district court that the need exists for the issuance of the

8 bonds, eighty-two thousand five hundred dollars ($82,500) is

9 appropriated to the second judicial district court to

10 purchase and install video cameras in public and inmate

11 transport elevators at the second judicial district court in

12 Albuquerque in Bernalillo county.

13 SECTION 12. FOURTH JUDICIAL DISTRICT COURT PROJECT--

14 SEVERANCE TAX BONDS.--Pursuant to the provisions of Section 1

15 of this act, upon certification by the fourth judicial

16 district court that the need exists for the issuance of the

17 bonds, eight thousand dollars ($8,000) is appropriated to the

18 fourth judicial district court to purchase furniture for the

19 fourth judicial district courthouse in Santa Rosa in

20 Guadalupe county.

21 SECTION 13. ECONOMIC DEVELOPMENT DEPARTMENT PROJECTS--

22 SEVERANCE TAX BONDS.--Pursuant to the provisions of Section 1

23 of this act, upon certification by the economic development

24 department that the need exists for the issuance of the

25 bonds, the following amounts are appropriated to the economic HWMC/HB 219 Page 16 1 development department for the following purposes:

2 1. two hundred ten thousand dollars ($210,000) to

3 plan, design, construct and renovate a former church building

4 as a multipurpose events center for a cooperative economic

5 development project between Innovate ABQ, incorporated, and

6 the university of New Mexico in Albuquerque in Bernalillo

7 county;

8 2. six million dollars ($6,000,000) for economic

9 development projects statewide pursuant to the Local Economic

10 Development Act; and

11 3. five hundred thousand dollars ($500,000) to

12 plan, design and construct infrastructure improvements in

13 mainstreet and local arts and cultural districts statewide.

14 SECTION 14. PUBLIC EDUCATION DEPARTMENT PROJECTS--

15 SEVERANCE TAX BONDS.--Pursuant to the provisions of Section 1

16 of this act, upon certification by the public education

17 department that the need exists for the issuance of the

18 bonds, the following amounts are appropriated to the public

19 education department for the following purposes:

20 1. two hundred ten thousand dollars ($210,000) to

21 plan, design and construct a facility for the Albuquerque

22 sign language academy in Albuquerque in Bernalillo county;

23 2. twenty-two thousand dollars ($22,000) for

24 asbestos and lead paint abatement and to plan, design,

25 construct and renovate the basement at Amy Biehl high school HWMC/HB 219 Page 17 1 in Albuquerque in Bernalillo county;

2 3. thirty-seven thousand two hundred fifty dollars

3 ($37,250) to plan, design, construct and replace an elevator

4 at Amy Biehl high school in Albuquerque in Bernalillo county;

5 4. thirty-five thousand dollars ($35,000) to

6 purchase and install information technology, including

7 related equipment, furniture and infrastructure, at Amy Biehl

8 high school in Albuquerque in Bernalillo county;

9 5. sixty thousand two hundred fifty dollars

10 ($60,250) to plan, design, construct, purchase and install

11 landscaping, facilities, electrical and security

12 improvements, including the purchase and installation of

13 storage, information technology and related equipment,

14 furniture and infrastructure, at Cesar Chavez community

15 school in Albuquerque in Bernalillo county;

16 6. twenty-six thousand two hundred fifty dollars

17 ($26,250) to purchase and install information technology,

18 including related equipment, furniture and infrastructure, at

19 Cien Aguas international school in Albuquerque in Bernalillo

20 county;

21 7. one hundred thirty thousand dollars ($130,000)

22 to plan, design and construct phase 1 of a multipurpose

23 sports and performance center for Cottonwood classical

24 preparatory school in Albuquerque in Bernalillo county;

25 8. eighty-seven thousand five hundred dollars HWMC/HB 219 Page 18 1 ($87,500) to plan, design, construct, purchase and install

2 grounds, facilities, electrical and security improvements,

3 including the purchase and installation of storage,

4 information technology and related equipment, furniture and

5 infrastructure, at Gilbert L. Sena charter high school in

6 Albuquerque in Bernalillo county;

7 9. sixty thousand dollars ($60,000) to plan,

8 design, construct, renovate, furnish and equip the buildings

9 and grounds, including the purchase and installation of

10 fencing, information technology and related equipment,

11 furniture and infrastructure, at La Promesa early learning

12 center in Albuquerque in Bernalillo county;

13 10. sixty thousand dollars ($60,000) to complete a

14 lease-to-purchase agreement for a building for the Media Arts

15 collaborative charter school in Albuquerque in Bernalillo

16 county;

17 11. seventy-six thousand two hundred fifty dollars

18 ($76,250) to purchase and install information technology,

19 including related equipment, furniture and infrastructure, at

20 Media Arts collaborative charter school in Albuquerque in

21 Bernalillo county;

22 12. forty-five thousand dollars ($45,000) to

23 purchase and install information technology, including

24 related equipment, furniture and infrastructure, at Mission

25 Achievement and Success charter school in Albuquerque in HWMC/HB 219 Page 19 1 Bernalillo county;

2 13. fifty thousand dollars ($50,000) to purchase

3 and install library resources for the Mission Achievement and

4 Success charter school in Albuquerque in Bernalillo county;

5 14. seventy-two thousand five hundred dollars

6 ($72,500) to purchase and equip a bus for the Montessori

7 elementary school in Albuquerque in Bernalillo county;

8 15. nineteen thousand dollars ($19,000) to

24 the issuance of the bonds, two hundred twenty thousand

25 dollars ($220,000) is appropriated to the board of regents of HWMC/HB 219 Page 139 1 the New Mexico military institute to plan, design, construct,

2 renovate and improve the stoops and walkways at the Hagerman

3 and Saunders barracks and barracks area for the New Mexico

4 military institute in Roswell in Chaves county.

5 SECTION 29. NEW MEXICO INSTITUTE OF MINING AND

6 TECHNOLOGY PROJECT--SEVERANCE TAX BONDS.--Pursuant to the

7 provisions of Section 1 of this act, upon certification by

8 the board of regents of the New Mexico institute of mining

9 and technology that the need exists for the issuance of the

10 bonds, ninety thousand dollars ($90,000) is appropriated to

11 the board of regents of the New Mexico institute of mining

12 and technology to purchase and install equipment and

13 furnishings in Jones hall at the New Mexico institute of

14 mining and technology in Socorro in Socorro county.

15 SECTION 30. NEW MEXICO STATE UNIVERSITY PROJECTS--

16 SEVERANCE TAX BONDS.--Pursuant to the provisions of Section 1

17 of this act, upon certification by the board of regents of

18 New Mexico state university that the need exists for the

19 issuance of the bonds, the following amounts are appropriated

20 to the board of regents of New Mexico state university for

21 the following purposes:

22 1. one hundred thousand dollars ($100,000) to

23 plan, design, construct, renovate, equip and install the fire

24 sprinkler system at the weight-training facility at New

25 Mexico state university in Las Cruces in Dona Ana county; HWMC/HB 219 Page 140 1 2. forty-five thousand dollars ($45,000) to plan,

2 design and construct a storage building for the east Rio

3 Arriba soil and water conservation district in Hernandez in

4 Rio Arriba county;

5 3. fifty thousand dollars ($50,000) to plan,

6 design, renovate and construct improvements to reservoirs in

7 the Coronado soil and water conservation district in Sandoval

8 county; and

9 4. ten thousand dollars ($10,000) to purchase and

10 equip a vehicle for the McKinley soil and water conservation

11 district in McKinley county.

12 SECTION 31. UNIVERSITY OF NEW MEXICO PROJECTS--

13 SEVERANCE TAX BONDS.--Pursuant to the provisions of Section 1

14 of this act, upon certification by the board of regents of

15 the university of New Mexico that the need exists for the

16 issuance of the bonds, the following amounts are appropriated

17 to the board of regents of the university of New Mexico for

18 the following purposes:

19 1. one hundred thousand dollars ($100,000) to

20 purchase and install equipment for the athletic training room

21 at the university of New Mexico in Albuquerque in Bernalillo

22 county;

23 2. one hundred seventy-five thousand dollars

24 ($175,000) to plan, design, construct, purchase, install and

25 equip improvements to the baseball facility at the university HWMC/HB 219 Page 141 1 of New Mexico in Albuquerque in Bernalillo county;

2 3. five hundred thirty-one thousand dollars

3 ($531,000) to plan, design, construct, purchase, equip and

4 improve communications equipment and infrastructure at the

5 basketball arena for the university of New Mexico in

6 Albuquerque in Bernalillo county;

7 4. eighty-five thousand dollars ($85,000) to plan,

8 design, construct and expand the Charlie Morrisey research

9 hall and to purchase and install information technology,

10 including related equipment, furniture and infrastructure, at

11 the university of New Mexico in Albuquerque in Bernalillo

12 county;

13 5. one hundred thousand dollars ($100,000) to

14 purchase and install equipment at the Craig Robertson soccer

15 complex at the university of New Mexico in Albuquerque in

16 Bernalillo county;

17 6. three hundred forty-five thousand dollars

18 ($345,000) to plan, design, construct, renovate and equip

19 lighting improvements at the football and soccer stadium at

20 the university of New Mexico in Albuquerque in Bernalillo

21 county;

22 7. seventy thousand five hundred dollars ($70,500)

23 to purchase and install advanced simulated patients for the

24 health professionals pipeline program for the university of

25 New Mexico in Albuquerque in Bernalillo county; HWMC/HB 219 Page 142 1 8. one hundred thousand dollars ($100,000) to

2 plan, design, construct, equip and furnish the lesbian, gay,

3 bisexual, transgender and questioning resource center at the

4 university of New Mexico in Albuquerque in Bernalillo county;

5 9. one hundred thirty-five thousand dollars

6 ($135,000) to plan, design, construct, renovate, furnish and

7 equip the linguistics laboratory at the university of New

8 Mexico in Albuquerque in Bernalillo county;

9 10. eighty-eight thousand dollars ($88,000) to

10 purchase and install a dicer for the manufacturing

11 engineering program at the university of New Mexico in

12 Albuquerque in Bernalillo county;

13 11. three hundred twenty thousand dollars

14 ($320,000) to plan, design, restore, construct, equip,

15 install and furnish phase 3 improvements, including erosion

16 and storm water damage control and remediation measures,

17 restoration of historical structures and the purchase and

18 installation of signage and benches, to the university of New

19 Mexico north golf course urban open space area in Albuquerque

20 in Bernalillo county;

21 12. four hundred five thousand four hundred

22 dollars ($405,400) to plan, design, construct, renovate and

23 improve the restroom facilities at Popejoy hall for the

24 university of New Mexico in Albuquerque in Bernalillo county;

25 13. forty thousand dollars ($40,000) to purchase HWMC/HB 219 Page 143 1 and install equipment for the rugby team at the university of

2 New Mexico in Albuquerque in Bernalillo county;

3 14. one hundred twenty thousand dollars ($120,000)

4 to purchase and install safety lighting at the university of

5 New Mexico in Albuquerque in Bernalillo county;

6 15. one hundred thirty-five thousand dollars

7 ($135,000) to plan, design and construct improvements,

8 including purchase and installation of furnishings and

9 equipment, at the school of law at the university of New

10 Mexico in Albuquerque in Bernalillo county;

11 16. thirty thousand dollars ($30,000) to plan,

12 design, construct, purchase and install improvements,

13 including replacing the sound system, at University stadium

14 at the university of New Mexico in Albuquerque in Bernalillo

15 county;

16 17. forty thousand dollars ($40,000) to plan,

17 design, construct, renovate and equip lighting at the stadium

18 for the university of New Mexico in Albuquerque in Bernalillo

19 county; and

20 18. ninety-five thousand dollars ($95,000) to

21 plan, design, construct, renovate and repair the Harwood

22 museum, including purchase and installation of equipment and

23 fixtures, at the Taos branch campus of the university of New

24 Mexico in Taos in Taos county.

25 SECTION 32. NEW MEXICO UNIVERSITY PROJECTS-- HWMC/HB 219 Page 144 1 SEVERANCE TAX BONDS.--Pursuant to the provisions of Section 1

2 of this act, upon certification by the board of regents of

3 western New Mexico university that the need exists for the

4 issuance of the bonds, the following amounts are appropriated

5 to the board of regents of western New Mexico university for

6 the following purposes:

7 1. one hundred ninety-five thousand dollars

8 ($195,000) to plan, design, construct, purchase and install

9 emergency telephone poles campuswide, including related

10 information technology, equipment, furniture and

11 infrastructure, at western New Mexico university in Silver

12 City in Grant county; and

13 2. eighty-five thousand dollars ($85,000) to

14 acquire property on west 12th street for western New Mexico

15 university in Silver City in Grant county.

16 SECTION 33. BORDER AUTHORITY PROJECT--APPROPRIATION

17 FROM THE FIRE PROTECTION GRANT FUND.--Notwithstanding the

18 provisions of the Fire Protection Fund Law to the contrary,

19 one million one hundred thousand dollars ($1,100,000) is

20 appropriated from the fire protection grant fund for

21 expenditure in fiscal years 2016 through 2020, unless

22 otherwise provided in Section 2 of this act, to acquire land

23 for and to plan, design, construct, equip and furnish a fire

24 station at the Santa Teresa airport in Dona Ana county.

25 SECTION 34. DEPARTMENT OF GAME AND FISH PROJECTS-- HWMC/HB 219 Page 145 1 APPROPRIATIONS FROM THE GAME PROTECTION FUND.--The following

2 amounts are appropriated from the game protection fund to the

3 department of game and fish for expenditure in fiscal years

4 2016 through 2020, unless otherwise provided in Section 2 of

5 this act, for the following purposes:

6 1. seven million dollars ($7,000,000) to acquire

7 land and to plan, design, construct, furnish and equip area

8 offices in Albuquerque in Bernalillo county and in Roswell in

9 Chaves county;

10 2. five million five hundred thousand dollars

11 ($5,500,000) to plan, design and construct improvements

12 related to safety compliance at state-game-commission-owned

13 dams and lakes and associated dams and spillways statewide;

14 and

15 3. one million dollars ($1,000,000) to plan,

16 design, construct and improve new and existing shooting

17 ranges statewide.

18 SECTION 35. DEPARTMENT OF GAME AND FISH PROJECT--

19 APPROPRIATION FROM THE BIG GAME ENHANCEMENT FUND OF THE GAME

20 PROTECTION FUND.--Five hundred thousand dollars ($500,000) is

21 appropriated from the big game enhancement account of the

22 game protection fund to the department of game and fish for

23 expenditure in fiscal years 2016 through 2020, unless

24 otherwise provided in Section 2 of this act, for fisheries

25 renovation and wildlife and riparian habitat restoration HWMC/HB 219 Page 146 1 statewide.

2 SECTION 36. DEPARTMENT OF GAME AND FISH PROJECT--

3 APPROPRIATION FROM THE SIKES ACT ACCOUNT OF THE GAME

4 PROTECTION FUND.--One million dollars ($1,000,000) is

5 appropriated from the Sikes Act account of the game

6 protection fund to the department of game and fish for

7 expenditure in fiscal years 2016 through 2020, unless

8 otherwise provided in Section 2 of this act, for fisheries

9 renovation and wildlife and riparian habitat restoration

10 statewide.

11 SECTION 37. DEPARTMENT OF GAME AND FISH PROJECT--

12 APPROPRIATION FROM THE HABITAT MANAGEMENT FUND.--Five hundred

13 thousand dollars ($500,000) is appropriated from the habitat

14 management fund to the department of game and fish for

15 expenditure in fiscal years 2016 through 2020, unless

16 otherwise provided in Section 2 of this act, for fisheries

17 renovation and wildlife and riparian habitat restoration

18 statewide.

19 SECTION 38. DEPARTMENT OF GAME AND FISH PROJECT--

20 APPROPRIATION FROM THE TRAIL SAFETY FUND.--Six hundred

21 thousand dollars ($600,000) is appropriated from the trail

22 safety fund to the department of game and fish for

23 expenditure in fiscal years 2016 through 2020, unless

24 otherwise provided in Section 2 of this act, to construct

25 off-highway vehicle recreation parks statewide. HWMC/HB 219 Page 147 1 SECTION 39. MINERS' COLFAX MEDICAL CENTER PROJECTS--

2 APPROPRIATIONS FROM THE MINERS' TRUST FUND.--The following

3 amounts are appropriated from the miners' trust fund to the

4 miners' Colfax medical center for expenditure in fiscal years

5 2016 through 2020, unless otherwise provided in Section 2 of

6 this act, for the following purposes:

7 1. two hundred fifty thousand dollars ($250,000)

8 to plan, design, construct, equip, upgrade and expand the

9 Alzheimer's unit courtyard at the miners' Colfax medical

10 center long-term care facility in Colfax county;

11 2. seven hundred fifty thousand dollars ($750,000)

12 to purchase, install and equip a cardiac monitoring system at

13 the miners' Colfax medical center in Colfax county; and

14 3. one million dollars ($1,000,000) to plan,

15 design, construct, renovate, equip and furnish mechanical and

16 electrical system upgrades and improvements at the miners'

17 Colfax medical center long-term care facility in Colfax

18 county.

19 SECTION 40. PUBLIC EDUCATION DEPARTMENT PROJECTS--

20 APPROPRIATIONS FROM THE PUBLIC SCHOOL CAPITAL OUTLAY FUND.--

21 The following amounts are appropriated from the public school

22 capital outlay fund, contingent upon approval by the public

23 school capital outlay council, to the public education

24 department for expenditure in fiscal years 2016 through 2020,

25 unless otherwise provided in Section 2 of this act, for the HWMC/HB 219 Page 148 1 following purposes:

2 1. five million dollars ($5,000,000) to plan,

3 design, renovate and construct public school pre-kindergarten

4 classrooms statewide; and

5 2. seven million dollars ($7,000,000) to purchase

6 and equip school buses statewide.

7 SECTION 41. STATE LAND OFFICE PROJECT--APPROPRIATION

8 FROM THE STATE LANDS MAINTENANCE FUND.--One hundred fifty

9 thousand dollars ($150,000) is appropriated from the state

10 lands maintenance fund to the state land office for

11 expenditure in fiscal years 2016 through 2020, unless

12 otherwise provided in Section 2 of this act, to plan, design,

13 purchase and install space saver storage systems at the state

14 land office in Santa Fe in Santa Fe county.

15 SECTION 42. DEPARTMENT OF TRANSPORTATION PROJECTS--

16 APPROPRIATIONS FROM THE STATE ROAD FUND.--The following

17 amounts are appropriated from the state road fund to the

18 department of transportation for expenditure in fiscal years

19 2016 through 2020, unless otherwise provided in Section 2 of

20 this act, for the following purposes:

21 1. four hundred fifty thousand dollars ($450,000)

22 to construct, equip and furnish a salt dome for the district

23 3 south urban patrol yard in Bernalillo county;

24 2. one million five hundred thousand dollars

25 ($1,500,000) to construct, equip and furnish a patrol HWMC/HB 219 Page 149 1 building at the Gallina maintenance patrol yard in district 5

2 in Rio Arriba county;

3 3. two hundred fifty-five thousand dollars

4 ($255,000) to plan, design, construct, renovate, equip and

5 furnish restrooms at the general office complex to comply

6 with the Americans with Disabilities Act of 1990 in Santa Fe

7 in Santa Fe county;

8 4. two hundred ninety-one thousand dollars

9 ($291,000) for electrical upgrades in the materials

10 laboratory at the general office complex in Santa Fe in Santa

11 Fe county; and

12 5. two million four hundred thousand dollars

13 ($2,400,000) to plan, design, construct and furnish district

14 2 patrol facilities in Capitan, Carrizozo, Hondo and Fort

15 Sumner in Lincoln and De Baca counties.

16 SECTION 43. ENERGY, MINERALS AND NATURAL RESOURCES

17 DEPARTMENT PROJECT--APPROPRIATION FROM THE WATER PROJECT

18 FUND.--Notwithstanding the provisions of the Water Project

19 Finance Act to the contrary, two million five hundred

20 thousand dollars ($2,500,000) is appropriated from the water

21 project fund to the energy, minerals and natural resources

22 department for expenditure in fiscal years 2016 through 2020,

23 unless otherwise provided in Section 2 of this act, to plan,

24 design and construct watershed restoration improvements,

25 including forest thinning, statewide. HWMC/HB 219 Page 150 1 SECTION 44. DEPARTMENT OF ENVIRONMENT PROJECT--

2 APPROPRIATION FROM THE WATER PROJECT FUND.--Notwithstanding

3 the provisions of the Water Project Finance Act to the

4 contrary, one million five hundred thousand dollars

5 ($1,500,000) is appropriated from the water project fund to

6 the department of environment for expenditure in fiscal years

7 2016 through 2020, unless otherwise provided in Section 2 of

8 this act, to plan, design and construct projects to improve

9 surface water quality and river habitat statewide.

10 SECTION 45. HOMELAND SECURITY AND EMERGENCY MANAGEMENT

11 DEPARTMENT PROJECT--APPROPRIATION FROM THE WATER PROJECT

12 FUND.--Notwithstanding the provisions of the Water Project

13 Finance Act to the contrary, seven hundred fifty thousand

14 dollars ($750,000) is appropriated from the water project

15 fund to the homeland security and emergency management

16 department for expenditure in fiscal years 2016 through 2020,

17 unless otherwise provided in Section 2 of this act, for

18 natural hazard mitigation community projects statewide and to

19 match federal emergency management agency funds.

20 SECTION 46. OFFICE OF THE STATE ENGINEER PROJECT--

21 APPROPRIATION FROM THE WATER PROJECT FUND.--Notwithstanding

22 the provisions of the Water Project Finance Act to the

23 contrary, two million dollars ($2,000,000) is appropriated

24 from the water project fund to the office of the state

25 engineer for expenditure in fiscal years 2016 through 2020, HWMC/HB 219 Page 151 1 unless otherwise provided in Section 2 of this act, to plan,

2 design and construct an engineered levee in the San Acacia

3 reach in Socorro county.

4 SECTION 47. PROJECT SCOPE--EXPENDITURES.--If an

5 appropriation for a project authorized in this act is not

6 sufficient to complete all the purposes specified, the

7 appropriation may be expended for any portion of the purposes

8 specified in the appropriation. Expenditures shall not be

9 made for purposes other than those specified in the

10 appropriation.

11 SECTION 48. ART IN PUBLIC PLACES.--Pursuant to Section

12 13-4A-4 NMSA 1978 and where applicable, the appropriations

13 authorized in this act include one percent for the art in

14 public places fund.

15 SECTION 49. EMERGENCY.--It is necessary for the public

16 peace, health and safety that this act take effect
