Cyngor Sir Powys County Council 1 Powys LDP 2011-2026 Schedule of Further Focussed Changes, October 2016 1.0 Introduction 1.1 The Powys Deposit Local Development Plan (LDP) was made available for public consultation from 8th June to 20th July 2015. Following consultation, the Council received a total of 882 representations/comments from 254 different individuals or organisations. The representations related to the written statement of the LDP, the proposals and inset maps and a small number to the informing assessments. Having considered these representations, the Council decided that a small number of Focussed Changes should be proposed to the LDP. Having considered the comments made on the Deposit Plan and further evidence, the Council consulted on the proposed Focussed Changes to the LDP. This consultation closed on March 11th 2016. 1.2 What is a Further Focussed Change? 1.3 The LDP was submitted to the Welsh Government / Planning Inspectorate (WG/PINS) on 29th January 2016. However, upon preliminary consideration of the submitted documents, the LDP Inspector held an Exploratory Meeting on 10th May 2016 as she had several concerns mainly regarding the housing requirement and supply, the provision of affordable housing and Gypsy and Travellers Accommodation need. As a result of these issues the LDP Inspector, in her letter of 25th May 2016, decided that the most appropriate course of action would be to suspend the Examination for a period of six months with immediate effect in order to enable the Council to prepare additional evidence. 1.4 As a result of undertaking the additional work, further changes have been made to the Plan. These proposed changes are referred to as Further Focussed Changes, and have been published in this document for public consultation. Representations at this stage must only relate to the Further Focussed Changes. Following the completion of the public consultation the examination process will continue. 1.5 Advice on Focussed Changes is provided by Welsh Government’s LDP Manual, 2015. The Manual advices that changes to the LDP after deposit should be avoided wherever possible, but exceptionally it may prove necessary to consider proposing changes to ensure the plan is sound, for example where there has been a sudden, major change in local circumstances, new national planning policy has been introduced or deposit plan representations identify an unforeseen soundness issue. Further, it advises that this should be one set of an extremely limited number of further focussed changes that reflect key pieces of evidence but do not go to the heart of the plan. It advises that consultation on these proposed changes should take place at the earliest opportunity to avoid delaying the examination process. It advises that immediately preceding submission of its LDP for examination, the LPA should commence advertising through public consultation (6 week period) an addendum to the deposit plan. This addendum should set out the further focussed changes it wishes to be made, showing the new / revised policies and text, and supported by reasoning and Cyngor Sir Powys County Council 2 Powys LDP 2011-2026 Schedule of Further Focussed Changes, October 2016 robust evidence for the changes. It is clear that representations may only be made on the Further Focussed Changes. 1.6 The purpose of the consultation is to enable: The general public and interested parties to submit comments to the proposed Further Focussed Changes; and The Planning Inspector appointed to conduct the Examination of the LDP to be confident that everyone affected has had the opportunity to comment before he/she makes any recommended change to the LDP. 1.7 The Further Focussed Changes have been informed by the following supporting assessments: Strategic Environmental Assessment (Environmental Report). Sustainability Appraisal. Habitats Regulatory Assessment. 1.8 How to Comment Important: Please read before making comments on this consultation document. 1.9 When making a comment or representation, it is important you tell us which part of the document you are commenting on. Please ensure that you quote the relevant Further Focussed Changed (FFC) number, and relevant site reference number if applicable. It is important to note that comments made at this stage can only address and relate to the proposed Further Focussed Changes. This consultation is not an opportunity to add to previous representations or to make new comments on parts of the original Deposit LDP not subject to change. 1.10 The Deadline for Comments: 5.00pm, Monday 21st November 2016. Comments received after the deadline will not be accepted. Comments received during the consultation period will be collated and forwarded to the Planning Inspector appointed to conduct an Examination into the soundness of the Plan. Making comments in writing or by e-mail: Please complete and return the standard comments form which can be downloaded from the Council’s LDP webpages. This can be returned via email or by post. It should be noted that comments received cannot be treated as confidential. All comments will be made available for public inspection and placed on the Council’s website. Cyngor Sir Powys County Council 3 Powys LDP 2011-2026 Schedule of Further Focussed Changes, October 2016 1.11 Explanation of Further Focussed Changes 1.12 Section 2 of this report presents the proposed Further Focussed Changes in page order of the Deposit Local Development Plan. The Further Focussed Changes have been shown in the following two ways: New text: Where there is new text to be included this is shown highlighted as yellow. Deleted text: Where there has been a change to the wording of a paragraph or policy, a deletion is shown by a strike-through. 1.13 For each Further Focussed Change, the document sets out the following: Focussed Change (FC) Reference: a unique reference number for the Further Focussed Change; Section: a reference to the Policy, Paragraph or Section of the Deposit Plan where the proposed change is to occur; and Reason: providing a reasoned justification for the proposed change and identifying which representation(s) or new evidence the change addresses. 1.14 In addition to the Further Focussed Changes, a number of minor editing changes have been included. These are included for information purposes only, not for consultation. 1.15 What happens next? 1.16 All comments received during the Further Focussed Changes consultation period will be submitted to the Planning Inspector.
