The Board of Directors of the FVRD has resolved to establish a sub-regional transit service to be known as the "Fraser Valley Express Sub-Regional Transit System". The proposed participants of said service will include the City of Chilliwack and the City of Abbotsford. In accordance with the relevant provisions of the Local Government Act, this will be achieved by way of enacting an establishing bylaw.

" Fraser Valley Regional District Fraser Valley Express Sub-Regional Transit System Service Area Establishment Bylaw No. 1236, 2013" was given 3 readings by the FVRD board of Directors on September 25,2013 and a copy is enclosed for your reference_ Also enclosed is a background memorandum dated August 30, 2013 which will provide your council with further information. The next steps in the process are: • To seek the necessary statutory consents from the participants in the service in accordance with S. 801.4 of the Local Government Act; • Approval of Bylaw No. 1236,2013 by the Inspector of Municipalities; and • Consideration of the adoption of Bylaw No. 1236,2013 by the FVRD Board.

A Bylaw to Establish a Sub-Regional Service Area for Transit Services within a portion of the Fraser Valley Regional District

WHEREAS pursuant to Section 796 of the Local Government Act, R.S.B.C. Chapter 323 (the "Act'), a Regional District may, by bylaw, operate any service that the Board considers necessary or desirable for all or part of the Regional District;

AND WHEREAS the Fraser Valley Regional District Board, deems it desirable to operate and establish a service for public transit in portions of the Fraser Valley Regional District to be known as the Fraser Valley Express;

AND WHEREAS the City of Abbotsford and the City of Chilliwack have expressed a desire to participate in such a sub-regional transit system service;

AND WHEREAS consent on behalf of municipal participating areas of the Fraser Valley Regional District has been obtained in accordance with Section 801.4 of the Act;

NOW THEREFORE, Fraser Valley Regional District Board enacts as follows:

1. OFFICIAL CITATION

This bylaw may be officially cited as the "Fraser Valley Regional District Fraser Valley Express Sub-Regional Transit System Service Area Establishment Bylaw No. 1236,2013".

2. TERMS a) The Fraser Valley Regional District hereby establishes the "Fraser Valley Express Sub­ Regional Transit System Service Area" for the purpose of providing transit services. b) The boundaries of the "Fraser Valley Express Sub-Regional Transit System Service Area" shall be the boundaries of the City of Abbotsford and the City of Chilliwack. c) The service area shall include the following participating areas: the City of Abbotsford and the City of Chilliwack. d) In accordance with Section 803 of the Act, the annual costs for the service established by this bylaw shall be recovered by one or more of the following: i) The requisition of money to be collected by a property value tax levied and collected in accordance with Division 4.3 [Requisition and Tax Collection] of the Act on the basis of assessed value of land and improvements in the service area; and/or; ii) The imposition of fees and other charges pursuant to section 363 of the Act that may be fixed by separate bylaw for the purpose of recovering these costs.

e) The maximum amount that may be requisitioned annually for the entire service established by this bylaw shall be $922,000. RECOMMENDATION

THAT the Fraser Valley Regional District Board give three readings to the Bylaw cited as "Fraser Valley Regional District Fraser Valley Express Sub-Regional Transit Service Area Establishment Bylaw No. 1236, 2013";

THAT Bylaw 1236, 2013 be submitted to City of Abbotsford and City of Chilliwack Councils to gain consent on behalf of municipal participating areas of the Fraser Valley Regional District in accordance with Section 801.4 of the Local Government Act;

AND THAT upon receipt of municipal consent, Bylaw 1236, 2013 be submitted to the Inspector of Municipalities for approval.

SUMMARY OF ISSUES The Fraser Valley Regional District has been approached by the City of Abbotsford and City of Chilliwack to assess the feasibility of establishing a Sub-regional Transit Service that will connect the City of Chilliwack, City of Abbotsford and the Carvolth transit exchange in the Township of Langley. This connection will fulfill some of the key recommendations of the FVRD's Strategic Review of Transit and the two recently completed Transit Future Plans, endorsed by the Board on March 26, 2013.

BACKGROUND

In 2010, the Be Ministry of Transportation and Infrastructure released the "Strategic Review of Transit in the Fraser Valley" summary report and four background papers. The Strategic Review provided the basis for BC Transit's two recently completed Transit Future Plans (TFP) in the FVRD: Chilliwack and Abbotsford-Mission.

A key component of both TFPs was the creation of transit links between Chilliwack and Abbotsford and between Abbotsford and Metro . Based on the results of public consultation during the development of the TFPs, Regional Growth Strategy consultation and additional survey work there is a high level of public interest in creating intra/inter-regional transit connections.

103 DISCUSSION

In the last few months, discussions have taken place between the cities of Chilliwack and Abbotsford about the feasibility of developing these inter-and intra-regional transit connections. Both communities have expressed interest in connecting Chilliwack to Langley through the City of Abbotsford and have asked the FVRD to consider creating a Sub-regional Service Area to enable such a service.

BC Transit was asked to assess the feasibility of a service between the three communities. The attached discussion document provides conceptual level detail on routing, service levels and estimated costs to guide the implementation process.

Senior municipal and regional district staff have reviewed the report and see the value of a single express service between Chilliwack, Abbotsford and the adjacent to the 200th St and Highway 1 interchange in Langely. The attached Bylaw reflects a single express route, tentatively called the Fraser Valley Express.

The proposed service will connect Chilliwack and Abbotsford to Langley Township via Highway 1. The service will connect with TransLink at the Carvolth transit exchange where BC Transit will need to secure space. The Carvolth exchange provides a number of destination options for FVRD commuters with transit links to Maple Ridge/ via the , the City and Township of Langley, City of Surrey and , via express service over the Port Mann Bridge, to the Braid Sky train station in . Not only will this service give FVRD commuters improved transit connections to Metro Vancouver destinations north and south of the , but because of the 2-way flow, it will provide Metro Vancouver residents who work in the FVRD a viable transit option.

In order to create a Sub-Regional Fraser Valley Express Transit Service for the City of Chilliwack, and City of Abbotsford, an Establishing Bylaw must be prepared and read three times by the Board . It is also a requirement of the Local Government Act that the bylaw be given Statutory Consent by affected local governments before being sent to the Inspector of Municipalities for approval and followed by Regional Board adoption.

All costs in the attached BC Transit discussion document are based on 2013/14 Chilliwack and Central Fraser Valley Annual Operating Agreements. BC Transit ridership estimates are primarily based on minimum performance standards in order to conservatively project revenue. Service hours are estimated at the conceptual level, meaning that detailed route timing and scheduling have not been conducted to determine other factors such as deadhead and interlining implications.

Given the uncertainties related to finalizing the system, BC Transit has used conservative assumptions in terms of ridership and revenues. The Bylaw as presented reflects a gross budget and does not incorporate potential revenues. The Bylaw also represents the maximum amount that can be requisitioned, not necessarily the amount that will be requisitioned in a given year.

The proposed transit service will be funded by BC Transit and local government partners pursuant to the British Columbia Transit Act. The current funding formula consists of approximately 47% coming from BC Transit and 53% from local government. The local government share of the cost will be offset by revenues generated by fares. Further discussion between the partners will be required to determine fares, schedules and final routes.

The two parties have agreed to share costs based on the percentage of the total combined Actual Assessed property values for each respective municipality. As of 2013 Actual Assessed Values, the share equates to 36.2% for Chilliwack and 63.8% for Abbotsford. This approach will be used as the basis for determining future cost allocations between the two partners, taking into account shifting balances over time as the share of total Actual Assessed Values increases (or decreases) in one or other of the communities over time.

Some (longer) trips will operate between Chilliwack and langley on Highway 1, and some shorter trips will terminate at Abbotsford. These additional trips between Chilliwack and Abbotsford are designed to support medica!, school and personal business trips that primarily occur mid-day and in the evening.

The vision for the regional service is as the name describes, an express service. It will have a limited number of stops to shorten the trip duration, and it will be easy to understand with only two route patterns. The precise routing within Chilliwack and Abbotsford has not been finalized, as more detailed work requires completion on the following topics:

Other than planned facilities at McCallum and Carvolth interchanges and the High street development, the need for additional transfer facilities (park and rides, bus stops, etc.) in close proximity to Hwy 1 will need to be investigated. The local transit system in Abbotsford is undergoing a restructuring that may impact the location that the Fraser Valley Express connects. Two options are under consideration: Abbotsford downtown exchange and the McCallum interchange.

The Fraser Valley Express will connect four independent transit systems: Agassiz- Harrison. Chilliwack, Central Fraser Valley and Transiink. Developing simple regional fares may be rather complex given the existence of 4 other local transit systems - each with its own fare structure.

Be Transit and the FVRD, in consultation with local governments, will collaboratively develop a fare structure that allows passengers to travel throughout the Fraser Valley seamlessly.
