ORIGIN

On April 22, 2014, Muskoka District Council adopted Resolution No. 63/2014 that referred Report No. 6(2014)-3 - OPP Billing Model Reform Update to the Corporate and Emergency Services (CES) Committee for discussion and possible next steps, and delegated authority for investigative and advocacy purposes only.

ANALYSIS

On April 24, 2014, CES Committee held a lengthy discussion on policing costs which included efforts that had been made to date regarding the proposed OPP billing model; the disproportionate share amongst municipalities; the new model which may result in the redeployment of services where needed; and the possibility of individual municipal contracts for policing. There was general consensus that the District needs guidance on its requirements to provide police services and advice on how these services could be delivered differently in order to better manage costs.

Actions items arising from the CES Committee meeting include the following:

1) Draft a letter to the Minister of Community Safety and Correctional Services outlining the burden to the District and the need for mitigation and transitional funding; the issue of excluding commercial, industrial and institutional properties from the allocation methodology; and opposition of the OPP Steering Committee’s suggestion of using weighted assessment as an allocation tool. This letter is expected to be completed by the end of this week.

2) Request a meeting with the Minister of Community Safety and Correctional Services so that Councillors from various municipalities, who will experience significant increases in OPP policing costs, can advocate for mitigation and transitional funding. Mr. Duben has requested a meeting with the Minister, but given the election in June, staff is expecting that the meeting will be deferred.

3) Provide a listing by municipality of the impact of the OPP Billing Model. The intent of the CES Committee was to use this information to invite other municipalities to join the advocacy for transitional and mitigation funding at the meeting with the Minister.

a) has completed an analysis using the 2012 FIR data which forecasts the “winner and losers” under the proposed OPP Billing Model (attached as Schedule “A”). This report shows the current cost for OPP policing for all upper-tier municipalities (column labelled “Contract Policing Costs”), the proposed costs and the increase or decrease. It should be noted that the column labelled “Proposed Costs” is the 2012 households multiplied by $369 and is the OPP cost under the proposed model. This cost per household was the amount that the OPP informed municipalities was the average cost per household (including the fixed and variable portions). Due to the fact that the variable portion of the OPP costs will differ between municipalities, these figures are estimates only, based on available information. b) Haliburton County also prepared a report for their February 12th meeting that shows the impact of the OPP billing model on all municipalities (attached as Schedule “B”). The column labelled “Contract Policing Cost” is the current cost of OPP policing, the column labelled “Proposed Costs” is the OPP costs under the new model, and the last column shows the increase or decrease.

4) Hire a policing consultant to assist the CES Committee with next steps regarding the OPP Billing Model Reform currently underway, to a maximum cost of $10,000. This is a resolution that was approved by CES Committee and is before Council for consideration on May 20, 2014.

Councillor Doughty provided the resume of Mike Armstrong who has recently retired from the OPP as a Bureau Commander for the Organized Crime Enforcement Bureau. Mr. Armstrong was with the OPP from 1984 and held various positions including Detachment Commander in and Regional Commander for the North West and Central Regions, prior to his last position as Bureau Commander. If Council approves the resolution noted above, staff will proceed with hiring Mr. Armstrong, since the maximum cost is within allowable limits for a non-competitive purchase as set out in the District’s Procurement policy AD:47.

Staff met with Mr. Armstrong last week as an introductory meeting, to scope out the work to be completed and consider scheduling. Mr. Armstrong has other commitments in June, but would be available to provide reports to CES Committee in July. If Council approves the resolution, Mr. Armstrong will focus on three key areas: a) Explaining the requirements under the Police Services Act to provide adequate and effective police services. There are 5 core police services identified in section 4(2): crime prevention, law enforcement, assistance to victims of crime, public order maintenance and emergency response. Mr. Armstrong will provide information to assist in understanding how the adequacy and effectiveness of services in these categories is determined. b) Explaining how policing would function at the regional government level (District), if one municipality chose to manage police services on its own. c) Explaining whether a municipality can adjust service levels or make other changes in an effort to reduce the cost of policing.

FINANCIAL CONSIDERATIONS

The maximum cost for the consulting work is $10,000. The Corporate Services department has a budget of $12,000 for consulting. Although a certain portion of this budget is committed already, the amount that this account may be over budget will likely be offset within other Finance or Corporate Services accounts.

COMMUNICATION

As noted above, staff will prepare a letter to the Minister of Community Safety and Correctional Services and request a meeting with the Minister. If the resolution noted above is approved by Council, staff will communicate with Mr. Armstrong to ensure that reporting to CES Committee will

proceed in a timely manner. Staff will continue to pursue opportunities with other municipalities and provide updates to Committee and Council.

STRATEGIC PRIORITIES

2.5 Continually investigate means of controlling or reducing expenditures through alternative methods of service delivery. Build strategic alliances or enter into shared services agreements with other agencies, the private sector and the Area Municipalities that result in reduced or avoided costs.
