Political theorists have hardly asked the question of how and why in their studies. They often examine philosophical canons and thoroughly discuss the meaning of particular political ideas such as power, emancipation, or domination, and yet they seem less concerned with the nature of their sources. They hardly address questions of how they decide to examine one set of texts as relevant intellectual sources for their inquiries rather than others; why do they solely focus on the European canon of modern social and political thought while neglecting non-European thought; should they care about the non-textual materials that are omnipresent in contemporary society as additional media of political thought? This thesis addressed these problems in the study of political thought, and began with two basic goals focusing on Japanese animation as an example of non-European and non-textual forms of political expression. The first goal was to explore how anime serve as a philosophical inspiration for political thought in thinking through the philosophical idea of emancipation. The second is to propose new aspects of the idea of emancipation through analysis of the selected anime. As the analyses have demonstrated, science fiction anime engage in two kinds of philosophical exercises: illustration and innovation.

Under the current framework, RC content is essentially banned, and its sale and distribution is prohibited by Commonwealth, state and territory enforcement legislation. The ALRC recommends that, under the Classification of Media Content Act, the RC category should be named ‘Prohibited’ to better reflect the nature of the category. 11.2 The RC category has been criticised for being overly broad in various ways, including by covering content that depicts or describes particular sexual fetishes, which are legal between consenting adults, or instructs in matters of crime or violence. 11.3 The ALRC recommends that the Classification of Media Content Act should frame the ‘Prohibited’ category more narrowly than the current ‘Refused Classification’ category.

RESUMEN El Código Penal español, tras la reforma operada por la Ley Orgánica 1/2015, de 30 de marzo, incorpora en su artículo 189.1 una definición de aquello que entiende el legislador como pornografía infantil. Siguiendo esta definición, podemos distinguir entre la pornografía infantil clásica (representaciones en que han intervenido menores reales, sin manipulación de imagen) y la pornografía alusiva a menores (aquella en cuya elaboración no se utiliza realmente a menores de edad, o estos son utilizados de forma indirecta). La pornografía alusiva a menores puede a su vez subdividirse en dos grupos: pornografía infantil técnica y virtual. Se trata de un nuevo tipo de pornografía infantil surgido a raíz de la evolución tecnológica y de la preocupación de los legisladores de todo el mundo por la necesidad de perseguir y sancionar toda conducta relacionada con la pornografía infantil. No obstante, la dificultad –o imposibilidad en muchas ocasiones− para determinar la edad real de las personas representadas en las imágenes investigadas ha derivado en una presunción iuris tantum que admite prueba en contrario y que en la práctica se materializa en una inversión de la carga de la prueba. ABSTRACT The Spanish Criminal Code, after the reform operated by the Organic Law 1/2015, of March 30th, incorporates in its article 189.1 a definition of what the legislator means by child pornography.
