Craig, Ph.D. Interim Dean, College of Liberal Arts and Social Sciences Department of Economics ii “IF YOU DO NOT LIKE THE PAST, CHANGE IT”: THE REEL CIVIL RIGHTS REVOLUTION, HISTORICAL MEMORY, AND THE MAKING OF UTOPIAN PASTS _______________ An Abstract of A Dissertation Presented to The Faculty of the Department of History University of Houston _______________ In Partial Fulfillment Of the Requirements for the Degree of Doctor of Philosophy _______________ By Andrew Joseph Pegoda December, 2016 ABSTRACT Historians have continued to expand the available literature on the Civil Rights Revolution, an unprecedented social movement during the 1940s, 1950s, and 1960s that aimed to codify basic human and civil rights for individuals racialized as Black, by further developing its cast of characters, challenging its geographical and temporal boundaries, and by comparing it to other social movements both inside and outside of the United States. Thus far, they have barely scratched the surface when it comes to either historical memory or filmic texts. This dissertation, then, provides an in-depth examination of both how Hollywood films from the 1990s to the present represent the Civil Rights Revolution and how individuals evaluate these films. Given that movies mirror a society’s hopes and fears and tell more about the time in which they were made than the time portrayed, they prove to be important cultural and social barometers of society at large. Selected films, along with almost 3,500 reviews from Amazon, are the focus of this examination. This dissertation argues that Hollywood manifests and perpetuates the on-going struggle of coming to terms with the past. Films ignore evidence and consistently minimize and delete the activism of Black people, while maximizing the generosity, forethought, and understanding of White people. Additionally, everyday people accept filmic representations of the past as epitomizing undisputed, utopian truths. Studying historical memory reminds academics that there is always a gap, sometimes quite large, between the past, how the past is documented, how trained historians study the past, and how society understands the past. iv ACKNOWLEDGMENTS What a wonderful journey graduate school has been, especially the three years working on this dissertation. I have learned an incredible amount and have drastically changed for the better. The past eight years at the University of Houston have been academically challenging and rewarding. The past eight years have also been medically challenging, undergoing major surgery in 2009 and another somewhat less major surgery in 2015, starting many new medications, and facing new medical challenges.     Performative Citizenship in the Civil Rights and Immigrant Rights Movements Kathryn Abrams In August 2013, Maria Teresa Kumar, the executive director of Voto Lat mo, spoke aJongside civil rights leaders at the fiftieth anniversary of the March on Washington. A month earlier, immigrant activists invited the Reverend Al Sharpton to join a press conference outside the federal court building as they celebrated a legal victory over joe Arpaio, the anti-immigrant sheriff of Maricopa County. Undocumented youth orga­ nizing for immigration reform explained their persistence with Marlin Luther King's statement that "the arc of the moral universe is long, but it bends towardjustice." 1 The civil rights movement remains a potent reminder that politically marginalized groups can shape the Jaw through mobilization and col­ lective action. This has made the movement a crucial source of sym­ bolism for those activists who have come after. But it has also been a source of what sociologist Doug McAdam has called "cultural innova­ uons"2: transformative strategies and tactics that can be embraced and modified by later movements. This chapter examines the legacy of the Civil Rights Act by revisiting the social movement that produced it and comparing that movement to a recent and galvanizing successor, the movement for immigrant rights.3 This movement has not simply used the storied tactics of the civil rights movement; it has modified them 2 A Nation of Widening Opportunities in ways that render them more performative: undocumented activists implement the familiar tactics that enact, in daring and surprising ways, the public belonging to which they aspire.4 This performative dimen­ sion would seem to distinguish the immigrant rights movement, at the level of organizational strategy, from its civil rights counterpart, whose participants were constitutionally acknowledged as citizens.

    TOOLKIT ALWAYS DO THE RIGHT THING, EVEN WHEN THE RIGHT THING IS THE HARD THING HARD THE IS THING RIGHT THE WHEN EVEN ABOUT JUST MERCY The film Just Mercy is based on an award-winning book of the same name by attorney Bryan Stevenson, played by Michael B. Jordan. Raised in rural Delaware, Stevenson regularly attended the African Methodist Episcopal Church, where he developed a strong sense of justice and compassion. He earned a law degree and a Masters in Public Policy from Harvard, and in 1989 he launched the Equal Justice Initiative (EJI) in Montgomery, Alabama, which is committed to ending mass incarceration and excessive punishment in the United States, along with challenging racial and economic injustice, and protecting basic human rights for the most vulnerable people in American society. EJI has won reversals, relief, or release from prison for over 140 wrongly condemned prisoners on death row. One of those stories is at the center of Just Mercy. Walter McMillian, played by Jamie Foxx, was convicted and sentenced to death for a murder he did not commit. For more than four years, Bryan Stevenson fought for justice and mercy against a system stacked against him and his client at every turn. Stevenson has gained international recognition for his work defending the poor and un- fairly incarcerated, and has said, “The opposite of poverty is not wealth...the opposite of poverty is justice.” JUST MERCY embodies the mission of forgiveness and redemption for people who have been incarcerated, and demands a fair legal system, free of extreme sentences.

    SUTTELL, BRIAN WILLIAM, Ph.D. Campus to Counter: Civil Rights Activism in Raleigh and Durham, North Carolina, 1960-1963. (2017) Directed by Dr. Charles C. Bolton. 296 pp. This work investigates civil rights activism in Raleigh and Durham, North Carolina, in the early 1960s, especially among students at Shaw University, Saint Augustine’s College (Saint Augustine’s University today), and North Carolina College at Durham (North Carolina Central University today). Their significance in challenging traditional practices in regard to race relations has been underrepresented in the historiography of the civil rights movement. Students from these three historically black schools played a crucial role in bringing about the end of segregation in public accommodations and the reduction of discriminatory hiring practices. While student activists often proceeded from campus to the lunch counters to participate in sit-in demonstrations, their actions also represented a counter to businesspersons and politicians who sought to preserve a segregationist view of Tar Heel hospitality. The research presented in this dissertation demonstrates the ways in which ideas of academic freedom gave additional ideological force to the civil rights movement and helped garner support from students and faculty from the “Research Triangle” schools comprised of North Carolina State College (North Carolina State University today), Duke University, and the University of North Carolina at Chapel Hill. Many students from both the “Protest Triangle” (my term for the activists at the three historically black schools) and “Research Triangle” schools viewed efforts by local and state politicians to thwart student participation in sit-ins and other forms of protest as a restriction of their academic freedom.

    Overview CHAPTER 1 of Race and Crime Because skin color is socially constructed, it can also be reconstructed. Thus, when the descendants of the European immigrants began to move up economically and socially, their skins apparently began to look lighter to the whites who had come to America before them. When enough of these descendants became visibly middle class, their skin was seen as fully white. The biological skin color of the second and third generations had not changed, but it was socially blanched or whitened. —Herbert J. Gans (2005) t a time when the United States is more diverse than ever, with the minority popula- tion topping 100 million (one in every three U.S. residents; U.S. Census Bureau, 2010), the notion of race seems to permeate almost every facet of American life. A Certainly, one of the more highly charged aspects of the race dialogue relates to crime. Before embarking on an overview of race and crime, we must first set the parameters of the discussion, which include relevant definitions and the scope of our review. When speaking of race, it is always important to remind readers of the history of the concept and some current definitions. The idea of race originated 5,000 years ago in India, but it was also prevalent among the Chinese, Egyptians, and Jews (Gossett, 1963). Although François Bernier (1625–1688) is usually credited with first classifying humans into distinct races, Carolus Linnaeus (1707–1778) invented the first system of categorizing plants and humans. It was, however, Johan Frederich Blumenbach (1752–1840) who developed the first taxonomy of race.

Now and then they made lofty artistic pronouncements, but they showed a more sincere interest in anecdotes about scenarios that were written on a cuff during a gay supper.... This might well be a description of Hollywood during any period of its cultivated silence on the matter of film-making. Actually, it is Leningrad in 1924, described by Grigori Kozintsev in his memoirs.1 It is so seldom that we are allowed to study the disclosures of a Hollywood film-maker about his medium that I cannot recall the last instance that preceded John Howard Lawson's book. There is no dearth of books about Hollywood, but when did any other book come from there that takes such articulate pride in the art that is-or was-made there? I have never understood exactly why the makers of American films felt it necessary to hide their methods and aims under blankets of coyness and anecdotes, the one as impenetrable as the other.

Chimps, Obama and Racial Stereotype We are decidedly not in a ‘post-racial’ America, whatever that may look like; indeed, many have been made more uneasy by the election of a black president and the accompanying euphoria, evoking a concomitant racial backlash in the form of allegedly satirical visual imagery. Such imagery attempts to dispel anxieties about race and ‘blackness’ by reifying the old racial stereotypes that suggest African Americans are really culturally and intellectually inferior and therefore not to be feared, that the threat of blackness can be neutralized or subverted through caricature and mockery. When the perpetrators and promulgators of such imagery are caught in the light of national media and accused of racial bias, whether blatant or implied, they always resort to the same ideological escape hatch: it was only ‘a joke’.

Welcome to this course in the Civil Rights Movement (CRM). I adore this course, as has almost every student who’s taken it when I’ve taught it before. I have four goals for the course: to increase and make more sophisticated our understanding of what actually happened during the CRM, to consider the various roles played by lawyers and the law in promoting (and hindering) significant social change, to see what lessons the era of the CRM suggests for apparently similar problems we face today, and to promote consideration of ways in which each of us can contribute to humane social change.
