Korean Criminal Law under Controversy after Democratization 49 Korean Criminal Law under Controversy after Democratization Cho Kuk* This Article reviews what democratization has brought and what has remained intact in Korean criminal law, focusing on the change of three Korean criminal special acts under hot debate such as the National Security Act, the Security Surveillance Act, and the Social Protection Act after democ- ratization. Then it examines the newly surfacing issues of Korean criminal law, focusing on the moralist and male-oriented biases. Introduction The nationwide June Struggle of 1987 led to the collapse of Korea’s authori- tarian regime and opened a road toward democratization.1 Under the authoritari- an regime, the Constitution’s Bill of Rights was merely nominal, and criminal law and procedure were no more than instruments for maintaining the regime and suppressing the dissidents. Corrado Research Associate May 23, 2017 Congressional Research Service 7-5700 www.crs.gov R41481 U.S.-South Korea Relations Summary Overview South Korea (officially the Republic of Korea, or ROK) is one of the United States’ most important strategic and economic partners in Asia. Congressional interest in South Korea is driven by both security and trade interests. Since the early 1950s, the U.S.-ROK Mutual Defense Treaty commits the United States to help South Korea defend itself. Approximately 28,500 U.S. troops are based in the ROK, which is included under the U.S. “nuclear umbrella.” Washington and Seoul cooperate in addressing the challenges posed by North Korea. The two countries’ economies are joined by the Korea-U.S. Free Trade Agreement (KORUS FTA). South Korea is the United States’ seventh-largest trading partner and the United States is South Korea’s second- largest trading partner. Between 2009 and the end of 2016, relations between the two countries arguably reached their most robust state in decades. Political changes in both countries in 2017, however, have generated uncertainty about the state of the relationship. Coordination of North Korea Policy Dealing with North Korea is the dominant strategic concern of the relationship. According to world leaders’ discursive construction of South Korea, South Korea is a site of “progress” that proves the superiority of the free market capitalist system for “developing” the so-called “Third World.” Challenging this contention, my dissertation demonstrates how recent South Korean cinema made between 1998 and the first decade of the twenty-first century rearticulates South Korea as a site of economic disaster, ongoing historical trauma and what I call impassible “transmodernity” (compulsory capitalist restructuring alongside, and in conflict with, deep-seated tradition). Made during the first years after the 1997 Asian Financial Crisis and the 2008 Global Financial Crisis, the films under consideration here visualize the various dystopian social and economic changes attendant upon epidemic capitalist restructuring: social alienation, familial fragmentation, and widening economic division. -

Was the current head of government or other chief national authority elected through free and fair elections? 4 / 4 The 1988 constitution vests executive power in a directly elected president, who is limited to a single five-year term. Executive elections in South Korea are largely free and fair. Moon Jae-in of the liberal Minjoo Party won a May 2017 snap presidential election following the impeachment of former president Park. He took 41 percent of the vote, followed by Hong Jun-pyo of the conservative Liberty Korea Party with 24 percent and Ahn Cheol-soo of the centrist People’s Party with 21 percent. About 77 percent of registered voters turned out for the election. In the June 2018 local elections, the Minjoo Party won 14 of 17 metropolitan mayoral and gubernatorial offices, with two of the others going to the Liberty Korea Party and one to an independent. Turnout for the local elections was 60.2 percent, marking the first time the voting rate had surpassed 60 percent for local elections since 1995. A2. Were the current national legislative representatives elected through free and fair elections? 4 / 4 The unicameral National Assembly is composed of 300 members serving four-year terms, with 253 elected in single-member constituencies and 47 through national party lists. The contests are typically free of major irregularities. In the 2016 elections, the Minjoo Party won 123 seats, while the Saenuri Party (which later became the Liberty Korea Party) won 122. -

The nature of this division developed an intense political contestation in South Korea between the political Left who espouse a critical view of top-down national history, and the Right who value the official view of South Korea’s national history. Whether it is a national history or nationalist history, in terms of conceptions of national identity and nationalism in relation to Korean history, disagreement continues. The purpose of this thesis is not to support nor refute the veracity of either political position, which is divided between a sensationalized political Right and a caricaturized Left. The aim of this project is to evaluate a series of developments in Korean history textbooks that can be seen as a recent attempt to build new national identities. ii Acknowledgments There are countless people I am indebted as I completed this Master’s thesis. ABSTRACT This study attempts to explain why ALL of South Korean presidents, without exception and notwithstanding their individual major contributions to the process of Korea’s development, have fallen victim to disgraceful downfalls. For the analysis, I employ S.N. Sangmpam’s middle-range theory that establishes a causal link between society-rooted politics and political outcomes. Building on his analytical frameworks that non-Western countries are characterized by over-politicization in politics as a function of social context, I argue that patterned downfalls of all Korean presidents are an institutional outcome of over-politicization in Korean politics, which is itself a function of not fully entrenched capitalist society. In support of my thesis, I test three hypotheses. Hypotheses one and two posit Korea’s tenacious traditional and cultural traits as an internal modifier of capitalism and the nation’s dependent nature of its relationships with the United States and Japan as an external factor that prevented capitalist entrenchment in Korean society. -

Elite narratives in Japan and South Korea reify the bilateral relationship as a difficulty due to troublesome and insincere neighbour. For the Japanese policy elites, the difficulty is due to troublesome South Koreans unwilling to embrace future-oriented relationship; whereas for the South Korean policy elites, the insincere Japanese unwilling to address past wrong-doing is the source of the problem. The result is a self-fulfilling prophecy of an intractable mutual misapprehension, suggesting that the difficult relationship is here to stay. I analyze pronouncements by both the Japanese- and South Korean policy elites appearing in official documents and media reports for clues into the manner in which the bilateral relationship is reified into a difficulty purportedly due to the recalcitrance of the neighbour. The narratives consistently show that both the Japanese- and South Korean policy elites consider the onus of improvement lies with the troublesome/insincere neighbour. In short, the bilateral relationship is a clash of realities, with the logical conclusion being that the difficult relationship will persist for the foreseeable future. Difficulty underpins the bilateral relationship between Japan and South Korea. The difficulty is normally considered a given, being treated as a starting point for discussions. However, if difficulty is so pervasive, then we need an account exploring the underlying conditions that perpetuate difficulty.
