Degree awarded June 2011 ii © 2011 David Thomas Orique iii DISSERTATION ABSTRACT David Thomas Orique Doctor of Philosophy Department of History June 2011 Title: The Unheard Voice of Law in Bartolomé de Las Casas’s Brevísima relación de la destruición de las Indias Approved: _______________________________________________ Dr. Robert Haskett The organizing principle of this dissertation is that Las Casas’s most famous work, the Brevísima relación, is primarily an intricately reasoned legal argument against the excesses of early Spanish colonialism rather than a fiery polemical diatribe by the “first human rights activist.” Contrary to such anachronistic (though enduringly popular) characterization, this study employs a historical perspective to view this influential text as belonging to the genres of the early modern juridical tradition. Accordingly, this investigation begins by examining the historical matrix of fifteenth-century and early sixteenth-century Spain to properly contextualize Las Casas’s early life and certain initial colonial institutions of the Spanish Indies. Similarly, his juridical expertise is firmly rooted in an explication of his contemporaneous formation in canon law and theology. From these foundational strands of his life and work, his maturing juridical voice spoke most decisively in certain of the major debates among Spanish jurists, theologians, and politicians—as well as in the Brevísima relación—in the wake of the Iberian “discovery” of what was for all concerned a physical as well as philosophical “New World.” iv The combined focus of subsequent chapters elucidates the fundamentally juridical dimensions of the text, beginning with the specific context accompanying its genesis in 1542 until its publication a decade later. The treatise’s legal character as an official publication based on various evidentiary sources is further revealed by the text’s triple function—to inform, to denounce, and to petition, which in turn corresponds to the genres of relaciones, denuncias, and peticiones of the civil juridical tradition. The Brevísima relación’s content unveils far more than this; the epistemological rationale and analytic framework are intimately linked to canonistic, Thomistic, and biblical genres of the ecclesial juridical tradition. Continuing this historical investigation, the concluding chapter demonstrates anew the fundamental grounding of Las Casas’s approach in the vibrant first generations of juristic discourse of the so-called Spanish colonial era. His multifaceted juridical voice was distinctively encoded in a powerful melding of civil and ecclesial legal traditions. INTRODUCTION In 1810 there began in Colombia, as in most Latin American countries, the process leading to independence from Spain.1 Though this process necessarily and permanently altered relations between Spanish rulers and their former subjects in America, the separation did not bring immediate radical changes in relations between the Catholic Church and the emerging republics. Those changes came about gradually as a result of developments within Colombia in particular and throughout Latin America generally. Spain determined in the New World that the Catholic Church was the only recognized and established religion. With independence in the nineteenth century, the new authorities maintained the same state- religion model.

This term designates first of all the act of 'confessing' or professing a par­ ticular faith; secondly, it indicates the content of that which is confessed or professed, as in the Augsburg Confession; finally then it comes to mean the group that confesses this particular content, the church or 'confession'. 2 The New Religious Orders I. The terms 'order' and 'congregation' in this period were not always clear. An order usually meant solemn vows, varying degrees of exemption from the local bishop, acceptance of one of the major rules (Benedictine, Augustinian, Franciscan), and for women cloister.A congregation indicated simple vows and usually subordination to local diocesan authority. A con­ fraternity usually designated an association of lay people, sometimes including clerics, organized under a set of rules , to foster their common religious life and usually to undertake some common apostolic work. In some cases confraternities evolved into congregations, as was the case with many of the third orders, and congregations evolved into orders. 2.     ROBERT BRIAN TATE Robert Brian Tate 1921–2011 Life BRIAN TATE WAS A MAJOR FIGURE IN Hispanic studies, as much at home in Catalan and Latin as in Spanish. He was born in Belfast on 27 December 1921 and died on 21 February 2011. He was educated at the Royal Belfast Academical Institution: the school was unusual in offering Spanish at this period, and produced a number of eminent Hispanists (among them F. W. Pierce). In 1939 he began studies at Queen’s University, and in his second year left for war service in India, Nepal and Burma; while out east he began learning Arabic. In the company of General Slim he was one of the first to enter Rangoon in 1945. On graduation in 1948 with a first in French and Spanish, his teacher Ignasi González i Llubera (1893–1962) encouraged him to go to Barcelona and Girona (in Catalonia) to do research. (This was early in the Franco regime, when Catalan politics and Catalan studies in general were suppressed.) His MA thesis at Queen’s University was ‘The Life, Works and Ideas of Cardinal Margarit’ (1949), and his PhD (also Queen’s University, 1955) was ‘The Influence of Italian Humanism on the Historiography of Castile and Aragon during the Fifteenth Century’. After teaching at Manchester (assistant lecturer, 1949–52) and Queen’s (lecturer, 1952–6) he was appointed reader at Nottingham in 1956 and was professor (indeed, the first professor of Spanish at Nottingham) from 1958 to 1983; dean of the faculty of arts 1976–9; professor emeritus in 1991.

Naipaul To the memory of Richard Shaull (1919-2002), first Henry Winters Luce Professor in Ecumenics When things fall apart In 1566, after more than five decades of immense and exhausting endeavors to influence and shape the policy of the Spanish state and church regarding the Americas, years of drafting countless historical texts, theological treatises, colonization projects, prophetic homilies, juridical complaints, political utopias, and even apocalyptic visions, Bartolomé de las Casas knows very well that the end is at hand: the end of his life and the end of his illusions of crafting a just and Christian empire in the New World. It is a moment of searching for the precise closure, the right culmination and consummation of a human existence that since 1502 had been intimately linked, as no other person of his time, to the drama of the conquest and Christianization of Latin America, a continent, as has been so aptly asserted, “born in blood and fire.” He painfully knows that there will be no time to finish his opus magnum, the History of the Indies.

Portier This dissertation - a postcolonial re-examination of Bartolomé de las Casas, the 16th century Spanish priest often called “The Protector of the Indians” - is a conversation between three primary components: a biography of Las Casas, an interdisciplinary history of the conquest of the Americas and early Latin America, and an analysis of the Spanish debate over the morality of Spanish colonialism. The work adds two new theses to the scholarship of Las Casas: a reassessment of the process of Spanish expansion and the nature of Las Casas’s opposition to it. The first thesis challenges the dominant paradigm of 16th century Spanish colonialism, which tends to explain conquest as the result of perceived religious and racial difference; that is, Spanish conquistadors turned to military force as a means of imposing Spanish civilization and Christianity on heathen Indians.
