Conkey, Chair The following chapters are a dissertation submitted in partial satisfaction of the requirements for the degree of Doctor of Philosophy in Anthropology in the Graduate Division of the University of California, Berkeley. This dissertation is a project that attempts to develop a template for implementing an “Indigenous archaeological” research paradigm for the Navajo Nation. The first chapter is a reflexive narrative, which is intended to situate the project within the field and within the wider socio-economic politics of becoming an “indigenous archaeologist.” In the next chapter, a description and analysis of Indigenous archaeological concepts and practices that can be used to create a Navajo approach to archaeology are discussed. Following this chapter is a presentation of a case study on the anthropological and archaeological historical legacy that has created and perpetuated the displacement of Navajo people in the prehistory of the Southwestern US; which will include examples of influential projects that has shaped Navajo displacement from the past. The fourth chapter will present a research design adopted by the Navajo Nation Council that will guide research on Navajo prehistory and history, and one which will allow for a uniquely Navajo perspective and history.     jurisdiction. Specifically, section 1451 (b) (1) (B) of the SDWA provides that a Tribe may exercise regulatory functions under the Act provided that such functions "are within the area of the Tribal Government's jurisdiction." However, the SDWA does not provide further specific guidance regarding the types of land that may be considered to be within the area of a Tribal Government's jurisdiction. The federal regulations implementing this section of the SDWA, reiterating the broad statutory language, do not adopt a specific definition of what constitutes the "area of the Tribal Government's jurisdiction." The preamble to these regulations indicates that the extent of tribal jurisdiction must be examined on a case-by-case basis.~ As indicated Above, much of the discussion in the Attorney General's statement relates to the Navajo Nation's assertion of authority over land within the Eastern Navajo Agency. The Attorney General argues that in accordance with well-established principles of federal Indian law, the Navajo Nation possesses both civil regulatory authority and criminal authority over the Eastern Navajo Agency lands because this land constitutes "Indian country." As a result, he concludes that the Navajo Nation has; sufficient jurisdiction over the Eastern Navajo Agency to support an EPA determination to treat the Navajo Nation as a State with respect to all of those lands pursuant to section 1451 of the SDWA. In making the argument that the Navajo Nation's jurisdiction extends over all of Navajo Indian country, Attorney General Yazzie cites several instances in which EPA has previously adopted or - utilized the Indian country definition to outline either the extent of federal authority or the limits of state jurisdiction with respect to environmental regulation.

    OCTOBER 2, 2015 BEGAYE REQUESTS FEMA PRELIMINARY DAMAGE ASSESSMENT Window Rock – President Russell Begaye yesterday formally requested a Preliminary Damage Assessment (PDA) from the Federal Emergency Management Agency (FEMA) in response to the Gold King Mine spill. A Preliminary Damage Assessment is the first step in the application process for public assistance for recovery from a disaster for eligible applicants. “The spill caused damage to the water quality of the San Juan River to such a massive extent that a state of emergency was declared by the Navajo Nation,” wrote President Begaye in a letter to EPA Associate Administrator Elizabeth Zimmerman. “All of the economic, health, cultural and other impacts to the Navajo people are not yet known. Given the significance of the San Juan River to the health, welfare economy, and culture of our Nation and people, the Navajo Nation, as a federally recognized Indian tribe, officially and specifically requests a mission assignment for Technical Assistance to complete a Preliminary Damage Assessment for damages as sustained as a result of the Gold King Mine spill.” Last month, FEMA rejected the Navajo Nation’s request for the appointment of a disaster- recovery coordinator to direct the federal government’s response to the crisis. During his testimony before Congress following the decision, President Begaye called on the federal government, and specially FEMA, to provide greater support to address the disaster caused by the Environmental Protection Agency (EPA) spill.     FORUM COURAGE AND THOUGHTFUL SCHOLARSHIP = INDIGENOUS ARCHAEOLOGY PARTNERSHIPS Dale R. eroes Robert McGhee's recent lead-in American Antiquity article entitled Aboriginalism and Problems of Indigenous archaeology seems to emphasize the pitfalls that can occur in "indige nolls archaeology." Though the effort is l1ever easy, I would empha­ size an approach based on a 50/50 partnership between the archaeological scientist and the native people whose past we are attempting to study through our field alld research techniques. In northwestern North America, we have found this approach important in sharillg ownership of the scientist/tribal effort, and, equally important, in adding highly significant (scientif­ ically) cullUral knowledge ofTribal members through their ongoing cultural transmission-a concept basic to our explana­ tion in the field of archaeology and anthropology. Our work with ancient basketry and other wood and fiber artifacts from waterlogged Northwest Coast sites demonstrates millennia ofcultl/ral cOlltinuity, often including reg ionally distinctive, highly guarded cultural styles or techniques that tribal members continue to use. A 50/50 partnership means, and allows, joint ownership that can only expand the scientific description and the cultural explanation through an Indigenous archaeology approach. Exploring the Concept of Home at Hunter-Gatherer Sites in Upper Paleolithic Europe and Epipaleolithic Southwest Asia by Lisa A. Maher and Margaret Conkey In both Southwest Asia and Europe, only a handful of known Upper Paleolithic and Epipaleolithic sites attest to aggregation or gatherings of hunter-gatherer groups, sometimes including evidence of hut structures and highly structured use of space. Interpretation of these structures ranges greatly, from mere ephemeral shelters to places “built” into a landscape with meanings beyond refuge from the elements. One might argue that this ambiguity stems from a largely functional interpretation of shelters that is embodied in the very terminology we use to describe them in comparison to the homes of later farming communities: mobile hunter-gatherers build and occupy huts that can form campsites, whereas sedentary farmers occupy houses or homes that form communities. Here we examine some of the evidence for Upper Paleolithic and Epipaleolithic structures in Europe and Southwest Asia, offering insights into their complex “functions” and examining perceptions of space among hunter-gatherer communities. We do this through examination of two contemporary, yet geographically and culturally distinct, examples: Upper Paleolithic (especially Magdalenian) evidence in Western Europe and the Epipaleolithic record (especially Early and Middle phases) in Southwest Asia. A comparison of recent evidence for hut structures from these regions suggests several similarities in the nature of these structures, their association with activities related to hunter-gatherer aggregation, and their being “homes” imbued with quotidian and symbolic meaning. Its primary goal as an organization is to assure the survival of Indian people. The NIYC's priority areas include freedom of religion, Indian political participation, the protection of Indian voting rights, public education, international initiatives (including the position taken in this letter), and job training and placement. The second group is The Forgotten People. It is an ad hoc organization located in the Navajo Nation, formerly known as "The Forgotten People of the Bennett Freeze Community," made up of and representing the interests of individuals who were relocated from the former Hopi Partitioned Lands and Navajo Partitioned Lands when the United States violated the human rights of Navajos and Hopis by relocating them. There are also individuals who continue to live in partitioned lands whose interests are represented by this organization.

It is argued that a more inclusive archaeology is necessary, one that encourages partnerships with Indigenous groups in the interpretation oftheir own past. This study has implications for how we perceive Indigenous peoples from an archaeological perspective. Introduction Smith and Jackson remind us of the contextual nature of interpretation as well as the importance of the past: The shards of the past insinuate themselves into what we see, and don't see, value, and don't value, subtly informing every gaze, every movement, every decision. The privileges we enjoy, or don't enjoy, the inequities we fail to notice, or rail against, are the individual legacies of our shared pasts.

Locating the discipline in the age of insecurity Shannon Lee Dawdy Abstract This discussion article responds to a forum question posed by the editors of Archaeological dialogues: ‘is archaeology useful?’ My response initially moves backward from the question, considering whether archaeology ought to be useful, how it has been useful in the past, and the millennial overtones of the question in our present climate of crisis. I critique the primary way in which archaeology attempts to be useful, as a dowsing rod for heritage through ‘public archaeology’. While European archaeology has long been aware of the dangers of nationalism, in the Americas this danger is cloaked by a focus on indigenous and minority histories. I then move forward through the question and urge colleagues to embrace an archaeological agenda geared towards the future rather than the past.
