The BBB is comprised of sixteen seasoned pros on the LA studio scene. Populated by LA’s finest players, The BBB takes the big band tradition into the new millennium with a contemporary, highly original sound featuring the witty, intricate, and hard‐ swinging compositions of established and up‐and‐coming composers and arrangers. And like those other famous road bands such as Buddy Rich’s, Count Basie’s, Woody Herman’s, Stan Kenton’s, Thad Jones/Mel Lewis’, the music and delivery of The BBB’s music is nothing less than astonishing when experienced live. The sound has a contemporary, dynamic and hard swinging energy with a focused edge to it that is like no other jazz orchestra, though reminiscent of Buddy Rich’s ensembles. The band make‐up is unique in that there is no piano but jazz/rockin’ guitar instead, in addition to four trumpets, four trombones, five saxophones and upright acoustic bass and drums. This case is a dispute between two members of a band over the use of the band’s name. The two members are Geoffrey Deane and Andros Kyriakou; the band is called MODERN ROMANCE. 2. On 4 July 2017, Geoffrey Deane1 (“the holder”) applied for the word mark Modern Romance, for the following services: Class 41: Live performances by a musical band; musical group entertainment services. 3. The application achieved registration on 29 September 2017. On 12 March 2018, Andros Kyriakou (“the cancellation applicant”) applied for a declaration that the mark is invalid. The single ground of invalidation is that the registration offends under Section 5(4)(a) of the Trade Marks Act 1994 (“the Act”) due to the goodwill Mr Kyriakou had acquired in the earlier non-registered mark MODERN ROMANCE since 13 May 1999 in respect of live performances by a musical band and musical group entertainment services. DICK HYMAN ...pure straight ahead heaven... doesn’t miss a beat or drop a false note... CHRIS SPECTOR, MIDWEST RECORD ANY DAY IS A GOOD DAY FOR SOME SONGS Many recording sessions are tense affairs, because the musicians feel the pressure of trying to make each note and phrase a little jewel. But at a Rossano Sportiello session, his delight in being allowed to make music, his easy assurance that there is no need to rush, makes everyone feel relaxed and joyous. No one could feel tense when his directions to the other musicians are so gentle, “You watch me. Maybe something nice will come out.” During playbacks, the control room was atypically quiet, because everyone (including visitors Harry Allen and Rebecca Kilgore) was busy listening and smiling. This trio is a friendly supportive community. Each voice is equal yet the three players come together from the first notes in a lovely synergy. Hear Ed Metz’s beautiful touch, his light-hearted rhythms that recall Jake Hanna so well: feathery brushwork or explosive accents. (Ed provides wonderfully apt incidental percus- sion, too.) Hear Nicki Parrott’s swinging pulse, the rich sonorities of her bass. Dur- ing this session, I would have sworn I heard a rhythm guitar because her sound is so ripe and full. As a singer, Nicki is one with the song. Her subtle, understated delivery is always convincing, whether she’s being perky or rueful.
