vi THE ALLEGAN AREA EDUCATIONAL SERVICE AGENCY

Programs relating to the Allegan Area Educational Service Agency’s (AAESA) goals shall be implemented on the basis of those directed by Michigan State Law and Michigan Department of Education’s Rules and Regulations, as well as those representing the expressed need of the majority of the constituent school districts as recommended by the Superintendent’s Association and the AAESA’s Board of Education. The major goals are:

1. To assist in the improvement of learning opportunities of all students in the AAESA.

2. To perform direct educational and clinical services to and for children.

3. To perform non-instructional service functions for constituent districts.

4. To perform administrative functions as directed by Michigan School Law and Michigan Department of Education Administrative Rules and Regulations.

SOME BASIC FACTS

Michigan has 56 Educational Service Agencies/Districts (ESA/ESD) and Intermediate School Districts (ISDs). Each ESA/ESD/ISD includes one or more local school districts and every local school district is in an ESA/ESD/ ISD. The AAESA has eight local school districts, one charter school, and Academy.

FINANCE

The AAESA receives allocated millage on property within its boundaries. The millage allocated for 2019 is 0.1138 for the general fund. Extra-voted millage may be levied for special education and vocational education. The total millage allocated for 2019 is 4.8728.

State aid is received monthly from the Michigan State Legislature.

Michigan, in common with a majority of the 50 states, has a three-echelon administrative structure.

1. The Michigan State Department of Education oversees the entire educational program of the state.

vii 2. ISDs/ESAs assist the state in relationships with local districts and serve local districts with information and educational services.

3. The local school district administers elementary and secondary education programs for a specific locale.

Thus, ISD/ESAs are the middle echelon in the three-echelon administrative structure. As such, they are involved in collecting, checking and reporting a vast amount of educational data from local districts to the State Department.

AAESA BOARD MEETINGS

Regular meetings of the AAESA Board of Education (Board) are held on the third Tuesday of each month in the Board conference room at 310 Thomas Street, Allegan, Michigan. October – April meetings begin at 5:00 p.m. and May – September meetings begin at 8:30 a.m.

The Board is responsible for the formulation and adoption of policies consistent with state laws governing public education, with the rules prescribed by the Michigan State Board of Education, and with the considered interest of the local constituent school districts and communities. These policies serve as a basis for action and execution by the superintendent and his/her staff.

The Board is composed of five members. They are chosen by voting delegates, one from each constituent school district on the first Monday in June. The six-year terms of the members overlap.

The Board elects its own officers at the organizational meeting, which occurs at the July meeting.

So that each member of this community may have an opportunity to voice their opinion, a special section of each meeting is devoted to comments, proposals, and inquiries from the audience. This provides an opportunity to take an active part in the meeting.

Citizens in the audience are permitted to speak at the place on the agenda entitled “Hearings and Correspondence” or at the place entitled “Future Items for Consideration.” When these points are reached, the president or presiding officer will ask if any member of the audience wishes to be heard.

viii CITIZEN PARTICIPATION AT BOARD OF EDUCATION MEETINGS

Any citizen in the audience may request permission to speak. Prior to making any remarks, please provide a name and address and if a group or another individual is being represented.

It is the practice of the Board to allow such speakers a maximum of five (5) minutes to state their proposals or to make comments. More time may be made available at the next regular meeting.

It should be understood that the Board will listen to speakers, but will not attempt to comment or to give answers, or expect the administration to give answers at that particular meeting. It is the practice to refer the inquiry to the superintendent, who will investigate or give consideration to the matter and report to the citizen or group making inquiry to the Board. If Board action is necessary, it will usually be taken up at the next regular meeting.

Keep in mind that the Board meeting is a meeting of the Board in public. It is not a public meeting as such and citizens in the audience may participate only within the framework provided by the Board.

If you intend to make a presentation which may require more than five (5) minutes, you are requested to notify the superintendent in writing so that ample time may be arranged, and a place may be provided in the formal agenda. Items that are to be included in the agenda should be received by the superintendent on Wednesday, one week prior to the Board meeting.

PREPARATION FOR BOARD MEETINGS

Advance preparation for each Board meeting is important. Therefore, on Monday, seven days before each meeting, the agenda, listing all items to be covered is prepared in the superintendent’s office. The agenda is duplicated and sent to members of the Board by Thursday of the week prior to the Board meeting. It is accompanied by carefully-prepared background materials which will assist the Board in reaching necessary decisions. All communications regarding information items or future action items are also included for the Board. This makes it possible for the members to study the matters in detail that are to come before the Board. The deadline for all communications to the Board of Education for listing in the agenda is the close of the day Monday, seven days prior to the Board meeting. ix PARTICIPANTS AT BOARD MEETINGS

A quorum of three (3) is necessary to conduct any official business. The superintendent and administration also attend Board meetings. All regular and special meetings are open to the public. Media representatives are also invited to attend meetings.

ALLEGAN AREA EDUCATIONAL SERVICE AGENCY BOARD OF EDUCATION NONDISCRIMINATION GRIEVANCE PROCEDURE

The Civil Rights Coordinator(s) are designated to receive and resolve complaints from any person who believes that he/she may have been discriminated against in violation of this policy. Any person who believes he/she has been discriminated against in violation of this policy should file a written complaint with the appropriate Civil Rights Coordinator within 10 calendar days of the alleged violation. The Civil Rights Coordinator will take, then, the following action:

First, cause an investigation of the complaint to be commenced. Second, arrange for a meeting to occur with the complainant that may include Agency staff who are knowledgeable of the facts and circumstances of the particular complaint or who have particular expertise that will assist in resolving the complaint. Third, complete the investigation of the complaint and provide, in writing, a reply to the complainant. If the Civil Rights Coordinator determines that a violation has occurred, he/she shall propose a fair resolution of the complaint and deliver the determination to the complainant and the Superintendent.

In the event the complaint is against the Superintendent, a copy of the determination shall be delivered to the President of the Board of Education. The complainant may appeal the Civil Rights Coordinator’s determination to the Superintendent, or, in the case of a complaint against the Superintendent, to the President of the Board, by so notifying the Superintendent or Board President in writing within the 10 calendar days of the Civil Rights Coordinator’s determination. The Superintendent or Board President may conduct additional investigation of the facts and circumstances surrounding the complaint.

The Board Vice-President or President may elect to secure the services of an outside party to investigate the facts and circumstances surrounding any complaint against the Superintendent.

The Superintendent, or Board President in the case of a complaint against the Superintendent, shall affirm or reverse the Civil Rights Coordinator’s decision and, if warranted, implement the Civil Rights Coordinator’s proposed resolution or a modification thereof. The Superintendent or Board President's decision shall be final.

Complainants have the right to file a complaint at any time with the Office for Civil Rights, US Department of Education. The complainant should first be directed to the following address:
